FORWARD
It is my pleasure to present to you this Service Charter for the Ministry of Statefor Immigration and Registration of Persons.
This Service Charter has been prepared in tandem with the Government sreform agenda and in the spirit of being responsive to customer needs,transparency and accountability.
The Charter spells out the role of this Ministry, highlights the services offeredand the requirements therein, lists the service centers at which our services canbe accessed and the guiding legal instruments.
The development of this Charter signifies our commitment to serve our clientelewith a view to creating a better understanding and enhancing our servicedelivery.

1. INTRODUCTION
The Ministry of State for Immigration and Registration of Persons in the Office of the President wascreated through Presidential Circular Number 1 of February 2005 on the Organization of Government.It derives its mandate from this circular and the following legal instruments:
(a) Kenya Citizenship Act Cap. 170(b) Immigration Act Cap. 172(c) Aliens Restrictions Act Cap 173(d) Constitution of Kenya Chapter 6(e) Registration of persons Act Cap. 107(f) Birth and Death registration Act Cap. 149
The Ministry is also guided by the 1951 Geneva Convention on Refugees and OAU Convention onRefugees of 1969.
Immigration Services
The control of entry and residence of foreigners into this country dates back to the introduction ofwhat was called the Immigration Restriction Ordinance of 1906. The Immigration Ordinances wererevised in 1962 and 1964, when the latter was renamed the Immigration Act. The Immigration Act of1964 was revised and a new immigration Act of 1967, Cap. 172 Laws of Kenya became operationalon December 1, 1967.
National Registration Bureau Services
Identification in Kenya is traced from 1915 when the British colonial government passed the NativeRegistration Ordinance in which, it was mandatory for all adult male Africans to register and carryidentification papers. The Registration of Persons Ordinance Cap 50 of 1947 made mandatory for allmale persons of 16 years and above to register.
This Ordinance became the Registration of Persons Act Cap 107 of the Laws of Kenya in 1963. ThisAct was amended in 1978 to provide for the registration of both male and female and create theDepartment of National Registration Bureau. An amendment of the Act in 1980 changed theregistration age to eighteen (18) years.
Civil Registration Services
Registration of births and deaths was introduced for the first time in Kenya in 1904 and applied onlyto Europeans and Americans.
In 1928 the current Act CAP. 149 was enacted. This Act only provided for the compulsory registrationof the deaths of Africans but not for their births.
After independence in 1963 compulsory registration of all births and deaths was extended in phasesto other areas beginning with Nairobi and Nyeri on 1st March 1963. On 1st September 1971 itbecame compulsory to register all births and deaths occurring in Kenya.
Refugee Services
The influx of refugees into Kenya can be traced back before independence but no formal recognitionor registration was done. After independence, the Government set up a secretariat to handlerefugees’ documentation, registration and settling programme(s). The refugees were spread invarious camps and reception centers across the country but the number soared up to about 500,000people thereby necessitating the Government to open Dadaab and Kakuma camps.

Since early 1990’s the country has been host to a big population of refugees from the horn of Africaand the great lakes region. The current population of the refugees is around 610,000 of whom260,000 reside in major urban centers around the country. The majority of the refugees are fromSomalia, Ethiopia and Sudan. The three constitutes 90% of the refugee’s population in Kenya whilethe rest come from Burundi, DRC – Congo, Rwanda and Uganda.

6. SERVICES OFFERED BY THE MINISTRY
A. Services by Department of Immigration
I. Issuance of Kenyan Passports and other travel documents
(a) Issuance of Passports to New Applicants
This service is offered to Kenyan applicants intending to travel abroad
i. Persons who qualify for this service
Applicants who:-
• Are bona fide Kenya Citizens in accordance with the Constitution of Kenya.• Must demonstrate a genuine reason for travel.
NB: The onus of proof of citizenship rests with the applicant.
ii. Requirements for issuance of passport to new applicants
The applicant must appear in person before an Immigration officer with the followingdocuments: -
• Application form PP1 (PP2 for children 0- 16 years) duly filled and personally signed bythe applicant/legal guardian. Children below below 16 yrs are given their own passportsand require consent letters from parent/guardian.
• Security bond form A 43 duly executed.• Applicant’s Birth Certificate (original and photocopy). In some instances we may require
applicant’s parent(s) or grandparents’ birth certificate to establish parentage/citizenship• New generation identity card (original and two photocopies)• Three coloured passport studio size photographs of applicants with one of them duly
certified as true likeliness of applicant (‘photo me’ not accepted)• For students, the following additional information are required: a letter of admission to
school (original copy), a clearance letter from Ministry of Education, parent’s/guardian’saffidavit in support of passport application/ travel, and form 1-20 (for US colleges)
• For employees, an introductory letter from the employer is necessary• For religious officials, a letter from the local registered religious organization stating the
purpose of the visit is required. A certificate of registration of the religious organizationmay also be required
• For business persons, a certificate of business registration from the Registrar ofCompanies at Sheria House (original & photocopy)
• Registered or naturalized citizens should submit a Kenyan Citizenship certificate (original& photocopy), and a Renunciation certificate
iii. Fee
• Kenya Passport A Series (32 pages) - Kshs. 2,040.00• Kenya Passport B Series (48 pages) - Kshs. 3,040.00• East African Passport - Kshs. 640.00• Diplomatic Passport - Kshs. 4,040.00

(b) Renewal of Passports after five (5) years
i. Requirements for renewal
• Application form PP3 duly filled and personally signed by the applicant.• Passport to be endorsed for renewal
ii. Fee
• Kenya Passport A Series (32 pages) - Kshs. 1,040.00• Kenya Passport B Series (48 pages) - Kshs. 1,540.00• East African Passport - Kshs. 340.00• Diplomatic Passport - Kshs. 2,040.00
(c) Replacement of passport after ten (10) years
i. Requirements for replacement
• Application form PP1 (PP2 for children 0- 16 years) duly filled and personally signed bythe applicant.
• Security bond form A 43 duly executed.• Three coloured passport studio size photographs of applicants duly certified as true
likeliness of applicant (‘photo me’ not accepted)• Expired passport
ii. Fee

NB: Filled up passports will be treated similarly as replacement after ten (10) years
(d) Replacement of a Mutilated or Lost Passport
The applicant must appear in person before an Immigration officer with the followingdocuments: -
• Application form PP1 (PP2 for children 0 - 16 years) duly filled and personally signed bythe applicant.
• Security bond form A 43 duly executed.• Three coloured passport studio size photographs of applicants with one of them duly
certified as true likeliness of applicant (‘photo me’ not accepted)• Mutilated passport• An affidavit detailing the circumstances under which the mutilation occurred.• Police abstract (for lost passports)
i. Fee
Mutilated passports - Kshs. 8,040.00Lost passports - Kshs. 10,040.00
NB1. All charges are inclusive of Kshs. 40.00 application fee. All payments above

reference number (R.NO), to facilitate any future communication with thePassport Control Office
(e) Waiting Time
Upon application and payment of the required fee:• A new passport will be issued within 30 working days (For students, 2 weeks)• Renewals of passports after 5 years will be done within 30 minutes• Replacement of passports after 10 years will be done within 14 working days• Replacement of Mutilated passports will be done within 14 working days• Replacement of Lost passports will be done within 14 working days• For emergencies, e.g. medical, as soon as possible
(f) Issuance of other travel documents
• Temporary Permit
This document is issued to Kenya Citizen wishing to travel to Uganda and Tanzania. It has avalidity of one year. Issued over in Nairobi (Immigration headquarters), Regional offices inMombasa and Kisumu and in gazetted border points. The document is issued within a day oras you wait. The fee is Kshs 800.
• Certificate of Identity (CIN)
It is primarily issued to Kenya Residents who for one reason or another are unable to obtaintravel documents from the authorities of whom they are nationals. The document has avalidity of two years. The processing time is equivalent to a new passport. The fee is Kshs2040.
• United Nations Convention Travel Documents (UNCTD)
The document is issued free of charge to recognized and registered refugees in accordancewith the 1951 Geneva Convention of which Kenya is a signatory. It has a validity of twoyears and is renewable. UNCTD are issued at Immigration headquarters in Nairobi.
NB:1. All customers are advised not to send 3rd parties to follow up on their applications
but to consult directly with the Immigration Officers dealing with the servicebeing sought

II. Registration of Aliens
The Aliens Restriction Act Cap 173 of the Laws of Kenya requires that all aliens staying in the countryfor whatever purpose for a period exceeding 90 days must register. It is an offence for an alien to bein the country without any valid registration. Upon registration, an alien certificate is issued.Registration can be done in the following stations: - Nairobi, Mombasa, Kisumu, Eldoret and Malindi.
i. Persons who qualify for this service• Visitors• Residents (non-Kenyan)• Students (non-Kenyan)• Government of Kenya recognized refugees• Mandate refuges (registered in camps)
ii. Requirements for Alien Registration :
• Be over 18 years of age• Have a valid passport/travel document• Have a valid immigration status e.g. a valid entry permit• Be resident in the country for more than 90 days from date of entry into Kenya• Self presentation to an immigration officer for registration• Applicants must be fingerprinted
Alien Registration forms are available at Alien registration counters at Nairobi Nyayo House southern wing ground floor, Mombasa, Kisumu, Eldoret and Malindioffices.
iii. Fee
Initial application Kshs 2,000Renewals Kshs 1,000 per year
The validity of an alien certificate cannot exceed two years.
iv. Waiting time
Upon application and payment of the required fee an Aliens Card will be issued within 5weeks
III. Issuance of Entry Permits
i. Persons who qualify for this service
All non-Kenyans wishing to work, engage in business or reside in Kenya must obtain theappropriate entry permits. It is an offence for any non-Kenyan to work, reside or do businessin the country without a pass or permit or exemption.
Entry Permits range from A M for various categories of people as stipulatedbelow: -
Class A Issued to a person who is offered specific employment by a specificemployer. Fee Kshs. 50,000.00. Validity - 2 years.
Class B A person being the holder of a dependant pass who is offered specificemployment by the Government of Kenya, the East African Community or

any other person or authority under the control of the Government or theCommunity, and whose engagement will be of benefit to Kenya.
Class D Issued to a holder of a dependant’s pass who is offered specific employmentby specific employer, whose engagement will be of benefit of Kenya.Fee Kshs. 50,000.00
Requirements for issuance of New & Renewal for Classes - Permits
• Application form 3 duly filled• An application letter from the employer• Copies of the certificates – both academic and professional/copy of C.V.• Evidence that the organization failed to secure a person from the local market• Two passport size photographs (for New)• Copies of the passport. (for New)
Class E Issued to Missionaries, Fees is Kshs. 6,000.00 for three years.
Requirements for issuance of New & Renewal for Class Permits
• Application form 3 duly filled• A copy of certificate of registration(for New)• Copies of certificate both for educational and professional qualifications (for New)• 2 passport size photographs(for New)• Copies of the passport(for New)• An application letter from the employer• Evidence of membership of missionary organization of source country
Class F A Person who intends to engage in the business or agriculture or animal husbandry.Fee is Kshs. 60,000.00 for two years.
Requirements for issuance of New & Renewal for Class Permits
• Application form 3 duly filled• An application letter• Proof of land ownership for the purpose. (for New)• Proof of capital available for the purpose. (for New)• 2 passport size photographs. Class G A person who intends to engage in prospecting for minerals or mining in Kenya. Feeis Kshs. 60,000.00 for two years.

Class H A person who intends to engage in a specific trade, business or profession (otherthan prescribed profession). Fee is Kshs. 60,000.00 for two years.

occurred.(Renewal)• A copy of certified audited accounts for the previous two years.
Class I For a person wishing to engage in specific manufacturing. Fee is Kshs. 60,000.00 fortwo years.
Requirements for issuance of New & Renewal for Class Permits
• Application form (form 3) duly filled.• An application letter• A copy of license held• A copy of certificate of Registration for the Company• Proof of funds available for the purpose (New)• 2 passport size photographs (New)• Copies of passports (New)• Copies of personal and company’s Pin number (Renewal)• Audited accounts of the previous year (Renewal)
Class J A member of a prescribed profession. Fee is Kshs. 60,000.00 for two years.
Requirements for issuance of New & Renewal for Class Permits
• Applicant form (form 3) duly completed• An application letter from the applicant• Proof of membership to a prescribed profession (New)• 2 passport size photographs (New)• Copies of the passport (New)• A copy of balance sheet of the previous year (Renewal)• Copy of personal pin number (Renewal)• Letter from the local professional body confirming suitability
Class K Residence permit for a person who intends to stay in Kenya without working (mainlyas a retiree) Fee is Kshs. 15,000.00 for three years.
Requirements for issuance of New & Renewal for Class Permits
• Application form (form 3) duly completed• An application letter• Documentary proof of assured annual income that is sufficient to live on (New)• Two passport size photographs (New)• Copies of the passport (New)
Class L A person who is not in employment and has been lawfully present in Kenya (and aresidence certificate issued under repealed Acts) for a period of not less than 10years.

Class M Issued free-of-charge to conventional refugees who intend to engage in business oremployment.

ii. Waiting Time
Upon application and payment of the required fee:
• An entry permit will be issued within (2) months• Renewal for an entry permit will be done within (1) month
NB:i. Application for renewal of entry permit should be done three months prior to
expiry date
ii. ‘Prescribed’ professionals include: - Medical, Legal, Surveyors, pharmacists,veterinary surgeons, engineers, nursing, physiotherapists, accountants,architects or quantity surveyors and chartered secretaries.
iii. After rejection of an application the department is not obliged to givereasons.
The above services and application forms are obtainable from all immigration offices while entrypermits are processed and issued centrally at the Department of Immigration Headquarters, NyayoHouse.
IV. Issuance of Visas
(a) Types of Visas
i. Ordinary/Single Entry Visa – These are visas required by certain categories offoreigners as per the visa regulation who intend to enter Kenya for visits orresidence. The current standard visa fee for an ordinary or a Single Journeyentry visa is US $50 or the equivalent of other currencies.
ii. Transit Visa – required by foreigners intending to transit through Kenya forperiod’s not exceeding seven days. The transit visa fee shall be US $20 or theequivalent of other currencies.
iii. Diplomatic Visas- diplomatic whether ordinary or transit is issued gratis to aholder of a Diplomatic Passport on official visits.
iv. Multiple Journey Visa: Foreigners who by nature of their business orcircumstances frequently travel in and out of Kenya may be issued with MultipleJourney Visas for Kenya within six (6) or twelve (12) months as the case may be.The standard fee for a multiple journey visa is US$100 or the equivalent for allnationalities.
v. Official/Service Visa – Official, Service, Ordinary/Transit Visas are issued gratisto holders of Official or Service passports on official visits.

vi. Courtesy Visas- Courtesy, Ordinary or Transit visas maybe issued gratis wherethe applicant is not entitled to a diplomatic visa but where it is considereddesirable on grounds of international courtesy.
Note: Diplomats and government officials on private visits to Kenya and who are nationalsof countries that require referred visas, shall have their visa application referred tothe Principal Immigration Officer, Nairobi.
(b) Requirements for issuance of Visas
• Visa form V1 duly filled and signed• Two (2) photographs – passport size• Copies of passports• Letter of introduction• Proof of need to travel to Kenya
(c) VISA EXEMPTIONS: All accredited diplomats, their immediate families, person’scovered under the Privileges and Immunities Act Cap. 179, and members of UN bodiesin the country and other international agencies with headquarters agreement withGovernment.

Important Notice: It should be noted that the possession of a visa for Kenya is not thefinal authority to enter Kenya.
Referred visa cases - Nationals of the following countries will require prior clearance from thePrincipal Immigration Officer in Nairobi to enter Kenya:- Afghanistan, Azerbaijan, Armenia,Cameroon, Iraq, Jordan, Lebanon, Mali, North Korea, Nigeria (Resident out side Nigeria), Senegal,Somalia, Syria, Tajikistan
V. Issuance of passes (visitors, special, pupils, dependants and re-entry pass)
(a) Visitor s Pass Issued at ports of entry whose period may vary from time to timedepending with the needs and is renewable on application for a further period of 3months maximum at a fee of Kshs. 200.00 upon registration as an Alien for anyoneover 18 years.
This pass does not allow the holder to engage in employment whether paid or unpaid.
(b) Special Pass issued to persons who come to the country for a specific assignmentsfor a period not exceeding 90 days at a fee of Kshs. 12,500.00.
The applicant is required to provide the following information/documents• Application form 10 duly completed• An application letter• 2 passport size photographs
(c) Kenya Pupil s Pass Issued to a foreigner who has been enrolled to take up studiesin registered training institutions at a fee of Kshs. 2,000.00 per year. The applicant isrequired to provide the following information/documents: -
• An application letter from an established educational institution• Application form 8 duly completed• Proof of sponsorship

• 2 passport size photographs• Copy of passport• The applying educational institution must be registered
It is an offence to take up studies without being in possession of a Pupils Pass. Citizens ofEAC Partner states are issued with gratis.
(d) Dependant s Pass Issued to the dependants of holders of entry permits ordependants of Kenyan citizens or exempted persons at a fee of Kshs. 1,000 per yearfor immediate family (spouse & children) and Kshs. 5,000 for any other person i.e.parents.
The applicant is required to provide the following information/documents• Application form 6 duly completed• Copies of either prove of marriage or birth certificate or death certificate• 2 passport size photographs• Copy of passport
(e) PASS EXEMPTIONS - All persons exempted by the Minister for state for Immigrationand Registration of Persons from immigration requirements of section 4, sub section3(h) of the Immigration Act
(f) Waiting time
Upon application and payment of the required fee:
• A visitor pass, extensions and re-entry pass will be issued as you wait• Kenya Pupils pass will be issued within two (2) months• Renewal Kenya pupils passes will be issued within one (1) month• Dependant pass to adults will be issued within two (2) months• Dependant pass to minors will be issued within one (1) month• Special pass for applicants with referral visa will be issued within one (1) month• Special pass for applicants with non-referral visa will be issued within one (1) month
VI. Granting of Citizenship to non-Kenyans
This service is offered to foreign nationals who have been lawfully resident in the country and wouldlike to acquire Kenyan citizenship.
i. Persons who qualify for this service
The issuance of Kenya Citizenship is governed by the Constitution of Kenya chapter VI andthe Kenya Citizenship Act Chapter 170. The Constitution also empowers the Ministerresponsible for Immigration to grant or refuse citizenship to a person who applies forregistration under section 88, 91, 92 or Naturalization under section 93.
ii. Requirements for issuance of Kenya Citizenship
• Strictly in accordance with the Constitution of Kenya and Kenya Citizenship Act• Applicants above 21 years of age may be subjected to a security clearance from certain
security agents of Government by the Department
iii. Prescribed Fee
• Adults Kshs 50,000• Minors Kshs 18,000• Woman married to a Kenyan who is a citizen by birth Kshs 15,000

• Woman married to a Kenyan who is a citizen by registration or naturalization Kshs 30,000• Naturalization Kshs 60,000• A duplicate certificate Kshs 5,000• Registration of child born abroad of a single Kenyan mother – Gratis• Certificate of Renunciation of Kenyan citizenship Kshs 2,000
VII. Clearance for entry and exit at gazetted Border points, Airports and Seaports
We control entry and exit of persons into and out of the country through:• Examination of all travel documents presented to us by persons wishing to enter or leave
the country• Issuance of visitors passes and other kinds of passes, various kinds of visas and
prohibited immigrants passes• Issuance of travel permits to Kenyans wishing to visit Uganda and Tanzania (only in
certain border controls)VIII. Offering consular services at Kenyan Missions Abroad
Consular functions are those duties which are connected with the welfare of Kenya Citizens who areresident, working, visiting or studying in a foreign country. The functions are spelled out underArticle 5 of the Vienna Convention on Consular Regulations, Privilege and Immunities Act Cap 179 ofthe laws of Kenya and in Kenya Foreign Service Regulations.

VI. Issuance of Civil Servants ID cards
For all Civil Servants i.e. newly employed, changing status, require staff badges and haveeither mutilated or lost ID card.

• For new employees- Letter of appointment, National ID card, letter ofintroduction from applicant’s ministry and current pay slip
• For change of status – the old card, current pay slip and letter ofpromotion(original and copy)
• For replacement of mutilated or lost ID card– a letter from employer. In additiona police abstract for lost card
• For all cases present yourself for a photo• Registration form 135 duly completed. (No form is required for change of

V. Birth re-registration upon Legitimacy
(a) Persons qualify for this service
Parents who marry after the birth of their child and they want the name of thefather inserted in the register of birth.
(b) Requirements for re-registration upon legitimacy• Parents Identification cards/Entry permit/Passport• Birth Certificates without the father’s name• Marriage certificate/Joint affidavit by both parents (LO2)• Application for Re-Registration sworn jointly by the parents (LO1)• Application form duly completed• Physical presentation by both parents
(c) Fee• Birth Certificate with no amendments - Kshs 50.00• Birth Certificate with amendments on either parents or child’s names -
Kshs 90.00• New Birth Certificate with amendments on the fathers names - Kshs 90.00
VI. Birth re-registration upon recognition
(a) Persons who qualify for this service
Parents who are not married but want the name of the father inserted in theregister of birth of the child.
(b) Requirements for re-registration upon recognition• Parents Identification cards/passport• Birth Certificates without the father’s name• Application for Re-Registration sworn jointly by the parents• Written consent from the father• Physical presentation by both parents

Relatives, owners of house where the death has occurred or any person with fullinformation on the occurrence of a death.
(b) Requirements for reporting of current death and issuance of burial permit
• Name, age and occupation of the deceased, cause, place and date ofdeath
• Residential area and district of the deceased• Name of informant (person giving the information)• Register of death form D1/A2 for deaths occurring in health institutions
duly completed, or• Register of death form D2/A3 for a death that occurs at home duly
completed• Post mortem report for death from unnatural course

All these forms are available in all registered health institutions, all assistant chiefsoffices except in Nairobi and all births and deaths registries
