THE ADMINISTRATIVE LAW SECTION

At its annual meeting on September 16, 1952, the Section of Administrative Law adopted the following amendments to its By-laws, such amendments to be retroactive to September 16, 1952.

Amendment to Article II, Section 1 of the By-laws.

Section 1. Each member of the Sec- tion shall pay to the American Bar Association annual dues of five dollars. Any member of the Association, upon request to the Secretary of the Asso- ciation and upon payment of dues for the current year, shall be enrolled as a member of this Section. Thereafter said dues shall be paid in advance each year beginning on the July first next succeeding such enrollment. Any mem- ber of this Section whose annual dues shall be more than six months past due shall thereupon cease to be a member of this Section. Members so enrolled and whose dues are so paid shall con- stitute the membership of this Section.

Amendment to Article III, Section 3.

Section 3. The Chairman, Vice- Chairman and Secretary shall be nomi- nated and elected in the manner here- after provided, and shall hold office for a term of two years thereafter, and until their successors shall have been elected and qualified: Provided, That, the Chairman, Vice-Chairman, and Sec- retary nominated and elected at the annual meeting at which this amend- ment to the By-laws of the Section of Administrative Law shall be adopted shall hold office for the term of two years specified in this amendment, in

the event such amendment becomes ef- fective upon approval of the Houe of Delegates in accordance with Article IX of these By-laws.

Amendment to Article IV.

Section 1. Nominations. At the first session of the annual meeting the Chairman shall appoint a Nominating Committee of three members of the Section not members of Council, which Committee shall make and report nom- inations to the Section each even-num- bered year for the offices of Chairman, Vice-Chairman, Secretary and Section Delegate and each year for members of Council, to succeed those whose terms will expire at the close of the then an- nual meeting and to fill vacancies then existing for unexpired terms except in the case of the Section Delegate whose selection is made by. Council in ac- cordance with Article VI, Section 3 of these By-laws. Other nominations for the same officers may be made from the floor.

Amendment to Article VI.

Section 3. If a vacancy occurs in any office after the person has been duly elected and qualified, the Council may fill such vacancy and the person so se- lected to serve until the next annual meeting except in the case of the Sec- tion Delegate who shall serve for the remainder of the term.

The amendments were approved by the Board of Governors on February 23, 1953.

Inadvertently a typographical error was not corrected prior to presentation to the Board of Governors; and in the copy certi- fied by the American Bar Association the amendment to Article VI, Section 3 ap- pears as an amendment to Article IV, Sec-

tion 3. Artide VI, Section 3 appears as it was before amendment. It is the opinion of the Committee that further action by the Section is not necessary to correct the er- ror; and that attention should be called to the appropriate office of the American Bar Association.

In the certified copy of the By-laws, there appears a Proviso to Article III, Section 6 and therein it is noted that this clause ap- pears in the original By-laws as a part of Article III, Section 4. The minutes of the organizational meeting of July 1, 1946, do not reflect that such a Proviso was a part of the By-laws adopted; and, the original By-laws, as published in Volume I, Number 1, of the Bulletin, January 10, 1949, did not contain the Proviso. (If it was adopted, it appears it should follow Section 4 rather than Section 6.) It is recommended that this be brought to the attention of the ap- propriate office of the Association.

REPORT OF SECTION DEVELOPMENT COMMITTEE

This Committee has been charged by the Chairman and Council with two duties:

(1) To increase the membership of the Section ; and

(2) To make recommendations as to how the program of the Section can be made more useful and attractive to the pro- fession.

The Committee reports as follows:

1. Membership Membership has been from 1044 as of

October 15, 1952 to approximately 1100 as of June 15, 1953. A continuing drive for new members is being made, and the Com- mittee expects to report some further in- crease in membership at the August Section meeting in Boston.

2. Suggestions for the Program of the Section

The Committee has solicited and received from several members of the Section sug- gestions with respect to the program of the Section, which are here summarized for consideration by the membership and the Council :

(a) That the Section adopt an aggres- sive program and statement of principles, based upon the improvement of the proc- esses and procedures covered by the Ad- ministrative Procedure Act.

(b) That members be given more infor- mation oh the techniques of presenting fac- tual evidence in administrative cases.

(c) That Section members who cannot attend annual meetings be given greater opportunity to participate in the affairs of the Section.

(d) That the Section Bulletin be pub- lished more often, and contain more data, particularly state court decisions.
