Introduction

The Dallas Independent School District (“District”) operates a grievance

system through the Human Resources Department, also known as Human Capital

Management, which should operate in accordance with federal law, state law, and

the DGBA series of District policies established by the Board of Trustees. From

the broadest legal perspective an efficient, neutral, and unbiased grievance

system effectively required by the First and Fourteenth Amendments to the U.S.

Constitution.

“Congress shall make no law respecting an establishment of religion, or

prohibiting the free exercise thereof; or abridging the freedom of speech, or

of the press; or the right of the people peaceably to assemble, and to petition

the government for a redress of grievances.” (1st Amendment, 1791)

“All persons born or naturalized in the United States, and subject to the

jurisdiction thereof, are citizens of the United States and of the state wherein

they reside. No state shall make or enforce any law which shall abridge the

privileges or immunities of citizens of the United States; nor shall any state

deprive any person of life, liberty, or property, without due process of law;

nor deny to any person within its jurisdiction the equal protection of the

laws.” (14th Amendment, Section 1, 1868)

While specific references are made to the 1st and 14th Amendments to the

U.S. Constitution, this paper does not seek to discuss the full legal applicability of

Constitutional, federal, state, and case law issues as they apply to the District’s

grievance system. It should be noted, however, that an inefficient and/or biased

grievance system has significant legal implications including violation of the

Constitutional rights afforded to District employees.

During my ten years of employment and eight months post-employment I

have had the opportunity to directly observe the District’s grievance system from

almost every angle – serving as a grievant, witness, hearing officer, and

representative at all three levels of hearings over the course of over a dozen

grievances. During said observations I developed testable hypotheses which I

believed required research and analysis:

Hypothesis 1: District policy mandates that a “Level I hearing shall be held

within ten days of the date the grievant requests a Level I hearing” and a “Level II

hearing shall be held within ten days after the date a Level II hearing request is

received” (DGBA Local, 2015). The District has established a pattern and practice

of failing to hold Level I and Level II hearings within policy required time frames.

Hypothesis 2: Grievances are typically heard at Level I by the grievant’s

immediate supervisor and at Level II by a hearing officer selected by Employee

Relations from a pool of administrators approved by the Superintendent of

Schools or designee (DGBA Local, 2015). Grievance decisions at both Level I and

Level II show a strong internal bias favoring the administration.

Hypothesis 3: The Board of Trustees requires that “[on] a semiannual

basis, the Human Resources Department shall submit a report to the Board

outlining the status of employee grievances in the District” (DGBA Local, 2015).

The Human Resources Department, also known as Human Capital Management,

has failed to submit any such reports for at least the three years that Mike Miles

has served as the Superintendent of Schools.

Method

On April 13, 2015, a request pursuant to the Public Information Act was

filed requesting 1) all reports from the past 5 years related to Hypothesis 3 and

13 data points for each grievance filed which would tend to relate to Hypothesis

1 and Hypothesis 2 (Liebbe, 2015). School attorney Leticia McGowan

acknowledged receipt of the request on April 14th (McGowan 1, 2015). On April

27th, Leticia McGowan provided the District’s response to the Public Information

Act request via a letter transmitted via e-mail and a Microsoft Excel spreadsheet

provided on a CD-R (McGowan 2, 2015; Dallas ISD, 2015).

A multivariate empirical analysis was conducted on the sequential series

of grievance data provided by the District on April 27th. The series included only

grievances files after July 1, 2015, and therefore are representative of all

grievances filed after Tonya Sadler Grayson, Executive Director of HR Operations,

conducted a reorganization that impacted several divisions within human

resources. I would be happy to conduct the same analysis and review for the

preceding time period for comparison should the requisite data be provided to

me.

It should be noted that I have removed the names of employee grievants

and employee respondents from the attached copy of the data used for the

empirical analysis 1) as those names are not relevant to the analysis and 2) to

maintain privacy for those employees who filed grievances.

The District provided no semi-annual reports from the Human Resources

Department to the Board of Trustees for the past five years. The substantive

response included “Please note, per the Board Services Office, there have been no

semi-annual report received. Therefore, there is no information responsive to this

portion of your request.” (McGowan 2, 2015). This lack of informational response

is sufficient to validate Hypothesis 3 as true.

The District provided a 13 column spreadsheet containing requested data

points for 161 discrete grievances filed between July 7, 2014, and April 16, 2015.

The responsive data was sufficient to fully analyze the time frames of Level I

hearings but was insufficient to fully analyze the time frames of Level II and Level

III hearings. A review of the original request found that the request did not specify

the need for the dates that the Level II hearing requests and Level III hearing

requests were received, which may have contributed to the insufficient data

points (Liebbe, 2015). As such, calculations for Level II and Level III time frames

assume that 1) the lower level decision letter was provided to the grievant on the

last day allowed pursuant to policy (10 days) and 2) the subsequent hearing

request was filed by the grievant on the last day allowed pursuant to policy (10

days). These assumptions tend to favor the District – and it should be noted that

the violations of required time frames at Level II and Level III may thus be more

prevalent than herein reported.

Results

The 161 grievances analyzed represented principals, assistant principals,

teachers, teacher assistants, assorted support personnel, and a handful of central

staff supervisors. Six grievances were filed by central staff employees holding

positions of Manager or higher. Of the 161 grievances filed, 20 (12.4%) involved

a waiver of the Level I hearing moving directly to a Level II hearing.

The subjects of grievances represented 9 core categories of complaints: 1)

Appraisals (e.g. 3R, TEI, etc.), 2) Compensation, 3) Discipline (e.g. Letter of

Concern, Written Reprimand, Individual Improvement Plan, Suspension, etc.), 4)

Discrimination & Harassment (e.g. DIA policy violations, harassment, retaliation,

etc.), 5) Family Medical Leave Act (FMLA) violations, 6) Demotions &

Reassignments, 7) Termination of At-Will Employees, 8) Termination of Contract

Employees, and 9) Other (e.g. all other grievances). The largest categories were

1) Termination of At-Will Employees, 2) Discrimination & Harassment, and 3)

Discipline.

The number of grievances held and the number of working days between

the filing of those grievances and their hearings was analyzed with respect to

Hypothesis 1. The results show that grievance hearings are held within

appropriate time frames 5.0% of the time at Level I, 0.0% of the time at Level II,

and 50.0% of the time at Level III. The results do not include the 105 grievances

filed that have not yet received a Level I hearing.

Calculations were made to ascertain the minimum, mean, median, mode,

maximum, range, and 1st standard deviation for the number of working days that

transpired between the filing date and the hearing date. Additional calculations

were made to evaluate grievances filed which have not yet received a Level I

hearing calculated through April 29th, 2015.

Calculations were made with regards to the decisions of the hearing

officers or Board subcommittee at each level. Decisions were grouped into

categories of 1) Granted, 2) Granted in Part, 3) Denied, 4) Withdrawn by Grievant,

and 5) Settled without Hearing. In all, only 7.1% of grievance decisions resulted

in the grievant’s requested relief being fully granted. Please note that these

calculations do not include the 105 grievances that are awaiting a Level I hearing.

Findings & Discussion

Hypothesis 1: District policy mandates that a “Level I hearing shall be held

within ten days of the date the grievant requests a Level I hearing” and a “Level II

hearing shall be held within ten days after the date a Level II hearing request is

received” (DGBA Local, 2015). The District has established a pattern and practice of

failing to hold Level I and Level II hearings within policy required time frames.

Hypothesis 1 was found to be true in 96.3% of the cases analyzed. The data

and analysis for the time period researched clearly shows an overwhelming

pattern and practice of failing to hold Level I and Level II hearings within policy

required time frames. It is my opinion that this violates the due process clause of

the 14th Amendment, inhibits employee rights established under the 1st

Amendment, clearly violates Board policy, and potentially violates a host of other

statutes and rulings at the state and federal level. The data and analysis would

support employee grievants filing for Mandamus Writs from a state District Court

ordering the day, time, and place for grievance hearings to be held.

Hypothesis 2: Grievances are typically heard at Level I by the grievant’s

immediate supervisor and at Level II by a hearing officer selected by Employee

Relations from a pool of administrators approved by the Superintendent of Schools

or designee (DGBA Local, 2015). Grievance decisions at both Level I and Level II

show a strong internal bias favoring the administration.

Hypothesis 2 was found to be true in 59.4%, partially true in 30.4%, and

false in 10.1% of the cases analyzed. The data and analysis for the time period

researched shows a weak to moderate internal bias of the hearing officers at both

Level I and Level II in favor of the administration and to the detriment of

employees. I suspect that the internal bias would report stronger were 105

grievances not holding an average of 114 working days for a Level I hearing as it

is more likely that administratively weaker cases are more likely to be delayed

than administratively strong cases. It is my opinion that this potentially violates

the due process clause of the 14th Amendment, potentially inhibits employee

rights established under the 1st Amendment, potentially violates the spirit of

Board policy, and thus creates a potential for liability to the District.

Hypothesis 3: The Board of Trustees requires that “[on] a semiannual basis,

the Human Resources Department shall submit a report to the Board outlining the

status of employee grievances in the District” (DGBA Local, 2015). The Human

Resources Department, also known as Human Capital Management, has failed to

submit any such reports for at least the three years that Mike Miles has served as the

Hypothesis 3 was found to be true 100% of the time for the past five years.

This could be interpreted as a series of intentional omissions that would tend to

cover up inherent problems in the administration and management of the

grievance system, such as those posed in Hypothesis 1 and Hypothesis 2 or, at

best, a systematic concern of gross negligence.

Limitations of Analysis and Findings

The presented analysis and findings are limited by the amount and quality

of the data obtained from the District via the Public Information Act. Direct

acquisition of data from the actual grievance files for the time period analyzed and

previous time period(s) may generate different statistical findings.

Recommendations

I recommend that the Board of Trustees consider and take swift action to

bring this issue under control to mitigate current liability and minimize future

liability to the District. Additional research would likely show how long the

deficiencies in the administration and management of the grievance system have

existed as well as trend data that would likely help isolate and identify events that

had significant impact on the development and growth of the deficiencies. A

complete overhaul of the District’s grievance system with significant focus on due

process is highly indicated. Post-overhaul research and analysis would tend to

show systematic improvements.
