ASSIGNMENT OF RENTS

As a condition of lease approval, the Owner and Lessee shall agree to the following: in the event the

Unit Owner is delinquent in the payment of any assessment for more than ninety (90) days, the

Association may notify the Lessee of the delinquency and in such event, the Lessee shall be obligated to

commence paying all future rent payments to the Association, until the delinquent assessments and

related charges are paid in full to the Association. At such time, the lessee shall resume paying rent to

the Unit Owner. During the period of time that the Lessee is paying the rent to the Association, the Unit

Owner may not evict the Lessee for non-payment of rent. However, if the Lessee does not pay the rent,

the Association shall have the authority to evict the Lessee. In such an event, the Unit Owner shall be

obligated to reimburse the Association for the eviction cost and attorneys fees incurred by the

Association.

This resolution was passed on May 17, 2011 by the Board of Directors.

PALM CLUB VILLAGE I CONDOMINIUM ASSOCIATION, INC. RULES and REGULATIONS

The following Rules and Regulations were approved by the Board of Directors. Strict enforcement of these Rules and Regulations is required for the benefit of the entire community. Our rules are your rules, and they exist for the safety and consideration of all of us. GENERAL:

1. The Palm Club Association/Property Manager’s Office phone number is 561-471-1094; the fax number is 561-471-1842; the E-mail address is: [email protected]. Please look for on-going community up-dates on your cable TV Channel 063, website (palmclub1.com) and clubhouse bulletin board.

2. Each unit is restricted to residential use only, as a single family by the Owner thereof, his immediate family, guest, tenants and invitees. A single family shall be defined as a married couple, or up to two (2) unmarried persons, living together with their children, parents or grandparents, as a single housekeeping unit. The allowable number of inhabitants per unit is as follows:

a. 1 Bedroom Unit Three (3) persons b. 2 Bedroom Unit Four (4) persons c. 2 Bedroom/Conv. Den Unit Five (5) persons

At no time may the unit be used by more persons for which it was designed.

3. A guest shall be considered any occupant who is not a unit owner. There shall be no time limitation of guest occupancy provided the guest occupies the unit with the owner, or the guest is a member of the owner’s family, as defined above. However, any guest who occupies a unit in excess of thirty (30) days cumulatively in any calendar year, whether with or without the owner in residence, shall be subject to screening. Guest occupancy, in the absence of the unit owner, by persons other than members of the Unit owner’s family shall be limited to a total of thirty (30) days cumulatively per calendar year. Prior to any occupancy of the unit by any guest in the absence of the owner, the owner must provide written notice to the Association of the name, or names, of the intended guest(s), the anticipated date of arrival, and the anticipated date of departure.

4. All Common Areas and Association properties are similarly restricted to use by those

same persons.

5. All potential buyers/renters/residents will be Screened and interviewed, a Background Check shall be conducted by an outside agency before they purchase/rent or become a resident. Pursuant to Florida Statute 718.112 (2) (i) the Transfer Fee/Screening Fee/Background Check Fee/Application Fee shall be $100.00. When submitting application for purchase or a rental a separate check for $100.00 for parking sticker ($50.00) and Transponder ($50.00) must accompany application. If not approved, a

check will be refunded. A Parking Sticker and/or Transponder will be replaced at No Charge if a resident turns in the old Parking Sticker/Transponder (or part thereof) in the event of a windshield replacement or new vehicle purchase.

6. Temporary Transponder: A Temporary Transponder may be issued to a resident only for their personal use when they drive a temporary or rented vehicle for a maximum of 30 days. Temporary Transponders are not to be shared with family members, friends or anyone else. A $50.00 (fifty dollar) deposit must be paid to the Association to guarantee the transponder’s safe return to the office within the 30 days. The deposit will not be refunded if the transponder is not returned within the 30 days. The Temporary Transponder may be disabled if not returned within 30 days. This deposit may remain indefinitely for future use, if agreed upon, or refunded. The owner must fill out and sign a form agreeing to abide by this rule to use the Temporary Transponder. (See Office for the form).

7. All government laws, ordinances and regulations governing the area are to be observed. No immoral, improper, or offensive actions are tolerated. No activity interfering with the peaceful possession and proper use of condo property is permitted.

8. Alterations, additions, or a modification to the interior of any unit requires the prior

written approval of the Association. Modifications or installation of electrical wiring or TV antennas are not allowed, either inside or outside of a unit. No changes are allowed to the exterior of a unit without written permission of the Board.

9. All windows, as seen from the outside, shall have white verticals and/or horizontal blinds.

10. Outside planting of any vegetation is prohibited without Board approval.

11. Sidewalks, entrances, passages and stairways shall not be used for storage. They are for going in or out of the units. (I.E. No shoes, plants, boxes, carriages, bikes, etc.)

12. No owner, lessee, or guest shall create or permit any disturbance that interferes with the right, comforts or convenience of others.

13. No sign, advertisement, notice, or other lettering that is visible from the outside of the unit shall be placed on any unit. No commercial or business activity shall be conducted in any unit or on Association properties. Unit owners actively engaged in soliciting business, or any solicitor of commercial nature, will not be allowed without prior written approval of the Board of Directors.

14. All garbage and trash must be placed in plastic bags, and then deposited in the trash receptacles that are provided. If garbage and trash are left on the ground outside the receptacles, the City will not unload the receptacles. Do not put anything other than

bagged trash into the dumpsters. (I.E. Furniture, appliances, mattresses, plumbing fixtures, etc.) Residents who place anything other than bagged trash into dumpsters will be charged for the removal of the same. Please contact the condo office to make arrangements for the removal of furniture.

15. If you plan to be absent during the hurricane season, remove everything from your balcony or patio before leaving. Leave someone in charge of your unit should damage occur, and let the Association know who that individual is.

16. The Association office should have a spare key to your unit in case of an emergency.

17. Maintenance assessments are due on the first day of each quarter: January 1st / April 1st / July 1st / October 1st. Any payments made after the 10th of the month will incur a late fee equal to 5% (percent) of the Quarterly Assessment.

18. Owners and Residents are not allowed to place, store or use personal BBQ Grills, or any items displaying BBQ Grill like characteristics, in or on any of the Common Areas or Association Property. 19. Association BBQ Grills in the recreational areas are to be used for cooking purposes only. PATIOS and BALCONIES:

1. Patios and balconies are for seating purposes only 2. No cooking is permitted, nor food or beverages be consumed, outside a unit except in

the designated picnic areas. Contact the office for location information.

3. No clothes, towels or similar articles shall be hung on patios or balconies.

4. All personal property shall be placed inside the unit or in the storage spaces provided for such purposes. Storage on balconies and patios is not permitted. This includes hurricane shutters, ladders, mops, boxes, garbage cans, etc.

5. No propane tanks or BBQ grills can be stored or used on Patios or balconies.

6. No gym or exercise equipment is allowed on patios and balconies.

7. No pets are to be left unattended on a balcony or patio. This includes birds/bird cages.

8. Nothing can be hung on railings or Villa fences. 9. No Gazebos or Tents or any items displaying Gazebo or Tent like characteristics are

allowed to be placed in or on Balconies, front or back Patios, Association Properties, the Common Elements, and as well as the Limited Common Elements.

LAKE AREA: 1. NO boating or swimming, or other water activities are allowed in the lakes.

2. No pets are allowed around the lake area.

3. No duck feeding, as they mess up hallways and sidewalks, and can become aggressive.

CLUBHOUSE:

1. Pool key is required for admittance. You may not access the pool through the glass sliding doors in the Clubhouse at any time. You must enter the pool area through the outside gate entrance.

2. Shoes are required in the Clubhouse at all times. 3. No dripping swimsuits are permitted in the Clubhouse. Residents/guests must dry off

before entering.

4. Residents may rent the Clubhouse for private parties, with advance notice and the written permission of the Board of Directors. The cost to rent the Clubhouse is $300.00, with a cash security deposit of $200.00. This security deposit will be returned in full upon determination that the Clubhouse is left in the same condition as when given to the clubhouse renter.

5. No pool parties or use of the pool are allowed when renting the Clubhouse. PETS:

1. One domestic pet or animal, not exceeding twenty-five (25) pounds, is allowed per unit as long as it does not constitute a nuisance, as determined by the Board of Directors.

2. The Association will need a picture of your pet, as well as an up-to-date certificate for vaccines and weight of the pet from a Veterinarian.

3. The State of Florida has a “Leash Law.” Please obey it.

4. While being walked, all pets shall be kept on a leash not to exceed six (6) feet. Pets are to be walked on the street side (Green Pine Blvd.) and on sidewalks granting access to the street. of the property only. Pets are not permitted on the lake side of properties or on the areas around buildings.

5. Owners are to pick up after their animals. Not picking up is a violation of our Condominium Documents. Fines will be imposed if violations are not corrected.

POOL RULES:

1. Pool key is required for entrance. Admittance to the pool is through the outside gate entrance only, not through the Clubhouse.

2. The pool key also grants access to the Clubhouse for use of the restrooms.

3. Each unit is issued one (1) pool key. The cost for a replacement key is $100.00. 4. When using the pool (or tennis courts), ensure that the gate closes firmly after you.

Not only does this keep non-residents out, it is also a safety factor.

5. The Association reserves the right to deny use of the pool to anyone for failure to obey the rules.

6. Pool hours are 8:00 AM until 10:00 PM.

7. There is no Lifeguard on duty. Swim at your own risk.

8. Guests must be accompanied by a Resident with the appropriate key.

9. No child under eighteen (18) years of age is permitted in the pool area or pool without

adult supervision.

10. Children who are not “potty trained” must wear rubber pants or swim diapers. 11. Proper swim attire is required. Please, no thongs.

12. All swimmers must shower each time before entering the pool. 13. There is no reserving of tables or chairs.

14. Towels must be placed on chairs if using sun tan lotion or other oil products.

15. No animals are permitted in the pool or pool area.

16. Persons with contagious or infectious health conditions must not use the pool facilities.

17. No alcoholic beverages are permitted in the pool area.

18. No food in the pool area, use the Clubhouse.

19. No glass bottles or containers allowed in the pool area.

20. No boisterous conduct or loud music permitted in or around pool.

21. No diving or jumping into the pool. No running in the pool area.

22. No throwing of balls or objects in or around the pool.

23. The only floatable objects allowed in the pool are noodles and small ring devices for

children. Rafts and other large floatable items are not permitted at any time.

24. The safety ring and other safety equipment are not to be used for anything other than life saving.

25. Do not hang anything off fences (including towels, clothes, swimsuits, etc.).

26. No fishing off of the pool deck.

PARKING and TOWING of VEHICLES:

1. All resident’s vehicles must be registered at the Association office. Current copies of driver license(s) and vehicle registration(s) must be kept on file in the Association office. Any changes in your resident status and/or vehicle registration must be reported to the Association office.

2. Only two (2) vehicles per unit are allowed. Each unit has only one (1) numbered parking space with an assigned code/number painted on the tire stop. These are for the exclusive use of the unit resident. A unit with only one (1) licensed driver is allowed only one (1) car, a unit with two (2) licensed drivers is allowed two (2) cars. Drivers must be registered residents of Palm Club Village 1. If a unit has more than two cars, the additional car(s) are illegally parked on the property and will be subject to towing.

3. Residents must have a visible parking sticker on the windshield; guests must have a visitor pass from security displayed on the dashboard or vehicle will be towed at owner’s expense.

4. All residents shall park their vehicles in their assigned spaces. Guests shall park in guest spaces only.

5. No vehicle shall be parked on the grass, bike paths, in front of dumpsters, or in the road. Vehicles parked in any area other than the designated assigned and guest spaces at any time will be subject to towing.

6. Guest parking spaces are just that. They are not intended to be used for long-term parking or storage of extra vehicles.

7. Do not park in someone else’s space. Numbers on parking sticker and parking space must coincide and will be periodically checked.

8. Car parked in your space? Do not call the gate house. Leave a friendly note on the car asking the owner to correct the situation. If this continues, take down the offender’s license plate number, make of the vehicle, sticker number (if applicable), location of vehicle, and report it to your Association office.

9. Vehicles must be parked head in. Do not back into a parking space.

10. No overnight parking of vehicles that have advertising on them.

11. Motorcycles, motorbikes, electric bikes, motorized skate boards, scooters, etc. are not permitted on the property at any time.

12. No untagged or unregistered vehicles are permitted at any time. No vehicles with expired tags are permitted.

13. No boat, boat trailer, camper, motor home or like vehicle shall be left or stored on the property.

14. Bicycles shall be kept inside the unit, NOT on Balconies or Patios.

15. Any vehicle that cannot be operated under its own power shall not remain on the property for more than forty eight (48) hours. This includes vehicles with flat tires. Please report this situation to the office to avoid towing.

16. No repairs or maintenance of vehicles may be made on the property. Only the changing of flat tires, windshield wipers, boosting of batteries, and washing and waxing of vehicles is allowed. Washing of vehicles shall only be done on the hard surface of the parking lot, not on the grass areas. Please be sure the water is turned off when you are finished.

17. All vehicles that are not in compliance with the Rules and Regulations, will be subject to towing at the owner’s expense. It is the resident’s responsibility to advise his/her guest(s) of proper parking procedures.

18. Parking spaces in front of the clubhouse are for office and clubhouse parking only. No overnight parking allowed.

19. If additional parking is needed there is an “overflow “parking lot located at the North East corner of the Palm Club Village 1 property.

RENTAL of UNITS: 1. No unit will be rented during the first twelve (12) months of ownership. 2. All unit owners who plan to rent their units on their own, or through a realtor, must

contact the Association for the guidelines and approval of leases.

3. A separate application must be approved for each person on the lease, except for husband and wife, and children under eighteen (18) years of age.

4. All potential Renters will be screened and approved. A background check shall be conducted by an outside agency before they rent or become a Resident. Pursuant to Florida Statute 718.112 (2) (i), the transfer fee/screening fee/background check fee/application fee shall be a non-refundable fee of $100.00. Married couples pay only one application fee ($100.00) Each Resident must purchase a Parking Sticker and Transponder for $100.00 ($50.00 each), a separate check to be submitted with the application. In the event the application is not approved, the $100.00 fee for the Parking Sticker and Transponder will be fully refunded. A Parking Sticker and/or Transponder will be replaced at No Charge if a Resident turns in the old Parking Sticker/Transponder (or part thereof) in the event of a windshield replacement or purchase of a new vehicle. Please make checks payable to "Palm Club Village 1 Condo Association."

5. All assessments must be current or rental approval will be denied.

6. Renewal leases must be submitted to the office thirty (30) days prior to renewal for approval. Screening fees are not required on renewal leases.

7. During the term of the lease, any new or additional occupants or roommates must be screened (even if they are not on the lease).

8. All owners must notify the property manager when a renter concludes his rental period.

9. Owners must have their roommates screened.

10. Renters are not allowed to have pets.

TRI-PALM/SECURITY:

1. Guard house phone number is: 561-686-8163 2. All vehicles entering the premises shall have either a window sticker or a gate pass in

order to enter the property. Non-conforming vehicles are subject to being towed at the owner’s expense. Residents are responsible for notifying the guard house of any driver changes.

3. The gate guard will take down the license plate number of all guests’ vehicles as they enter the gate. The driver of all visitors’ vehicles must show photo identification to the gate guard. All visitors will be issued a visitor pass, good for one (1) day or twenty-four (24) hours, which must be placed on the dash and be visible through the windshield.

4. If a visitor will be staying for more than two (2) days, you must notify your Association office. Guest passes are only issued by the property manager, and are good for two (2) to thirty (30) days. After thirty (30) days cumulatively in a calendar year, this person must be screened and approved by the Association.

5. Expecting a visitor? A visitor is someone who a resident places on their visitor list, and is required to obtain a daily visitor pass at the guard house. After thirty (30) days cumulative in a calendar year, this person will have to obtain screening and clearance from the Association office.

6. If a visitor is not on a resident’s permanent guest list, the resident must call the guard gate with the visitor’s name. The visitor will be issued a visitor’s pass for twenty-four (24) hours.

7. Residents are not allowed to use the visitor’s lane to enter and exit the property. Each resident is issued a transponder for admittance. If you do not have a transponder, you must use the visitor’s lane to enter. You will be stopped and asked for identification by the guard. The guard is instructed to challenge any resident using the visitor’s lane. This will cause a delay in your admittance. If you don’t have a transponder, or it is not working, report to your Association office.

8. Residents must not share their transponders. The transponder must be affixed to the windshield. If it is discovered that a non-resident has a transponder, it will be deactivated. Lost, unattached, or illegally obtained transponders will be deactivated. For non-functioning transponders, residents will have to report to the Association office to gain admittance to the property.

9. The resident entrance lane at the main gate entrance closes at 12:00 AM midnight, and all residents must use the visitor’s entrance lane until 6:00 AM.

10. The rear gate (Village Boulevard) closes at 12:00 AM midnight and reopens at 6:00 AM.

11. Any and all damage to the gates, barrier arms, or equipment will be charged to the

individual responsible for the damage. Owners are responsible for their tenants, visitors and guests.

12. All pedestrians, cyclists, joggers, skaters, etc. must use the pedestrian gates. Palm Club Associations 1, 2 and 3 are not responsible for any injuries incurred by people not in vehicles using the vehicle gates.

13. No visitors or deliveries are allowed through the rear gate (Village Boulevard).

14. Moving in or out is not permitted on Sundays.

15. No deliveries are permitted after 8:00 PM.

16. If any resident witnesses a rules violation, they should call or visit the guard house and ask that an incident report be completed by the guard. The Tri-Palm Committee and appropriate Association may then take any action necessary.

17. The gate guards shall be treated with courtesy and respect as they endeavor to do their job to ensure the security of our property. Patience is required while the guard writes down the license plate numbers of visitors, checks the identification of visitors, and checks the resident’s guest list. Violators of this rule will be reported to the Tri-Palm Committee, who will report to the appropriate Association to take action.
