INTRODUCTION

The Yorba Linda Town Center Retail Project (Project) is a proposed private retail shopping center

situated within the Town Center Commercial District subarea of the Yorba Linda Town Center

Specific Plan. Over the last two years, the City of Yorba Linda (City) has been working diligently

with the retail center project applicant, Zelman Retail Partners, Inc., to bring forward a high quality

retail/restaurant/entertainment lifestyle shopping center that is intended to serve as the

foundation for overall revitalization of the downtown.

On October 20, 2015, the City of Yorba Linda City Council considered the Project and the

Subsequent Environmental Impact Report (SEIR), and voted unanimously to adopt the resolutions

of approval certifying the SEIR and approving all applicable entitlements. However, construction of

the proposed Project would require the removal of two (2) residences designated with California

Historic Resource Status Code 5S3.

As such, the City is seeking offers from firms, organizations, or individuals that have interest in acquiring a craftsman bungalow, currently located within the Yorba Linda Town Center. The home must be relocated to a property or location that is identified by the bidder. Receiver sites may be located either in the community or anywhere outside of the city boundaries. Bidders will be responsible for all costs associated with the relocation of the structure and will need to demonstrate either ownership or permission to locate the cottage onto a receiver site. Interested parties will have approximately 45 days from release of notice in which persons may contact the City for additional information and submit a formal offer. The deadline for submitting an offer is 12: 00 p.m. on Thursday, December 31, 2015.

DETAILED PROJECT DESCRIPTION

Location

The Town Center Development Project area is located just northeast of the Yorba Linda Boulevard and Imperial Highway intersection and is bordered by Lakeview Avenue to the east, Main Street and School Street to the west, Lemon Drive to the north and Yorba Linda Boulevard and Imperial Highway to the south and southwest. (See Exhibit A)

The two (2) residences, addressed as 4852 and 4871 School Street, are located within the Town Center project boundaries.

Overview

The construction of the Project requires the removal of the two (2) residences located within the Project area. These residences were surveyed as part of a 2009 Citywide Historic Property Survey and were designated with a “5S3” California Historical Resources Status Code (“status code”), meaning that they are eligible for local historic listing, and for the purposes of CEQA are considered “historical resources” (§15064.5).

Since retention of the cottages is not feasible for implementation and development of the Proposed Project, they will first be recorded prior to either relocation or demolition.

Pursuant to Mitigation Measure 2 (M5.2-3) of the adopted SEIR, the City intends to solicit proposals from the public for relocation of the subject residences for a period of 45 days.. The City will make every effort to ensure widespread public notification of the process. If after 45 days it is evident that no party is interested in purchasing one or all of the building(s) then the City would be required to salvage the key character-defining physical features of the residences.

Relocation Conditions

A proposal for relocation shall be undertaken in accordance with a Relocation and Rehabilitation plan prepared by the party taking possession of the structure to be moved. The Relocation and Rehabilitation Plan shall be developed in conjunction with a qualified architectural historian, historic architect, or historic preservation professional who satisfies the Secretary of the Interior’s Professional Qualification Standards for History, Architectural History, or Architecture, pursuant to 36 CFR 61.

Upon relocation of the structure to the new site, any maintenance, repair, stabilization, rehabilitation, preservation, conservation, or reconstruction work performed in conjunction with the relocation the building shall be undertaken in a manner consistent with the Secretary of the Interior’s Standards for the Treatment of Historic Properties with Guidelines for Preserving, Rehabilitating, Restoring, and Reconstructing Historic Properties. In addition, a plaque describing the date of the move and the original location shall be placed in a visible location on each of the buildings.

As the City of Yorba Linda City Council voted unanimously to adopt resolutions approving all applicable entitlements for the Yorba Linda Town Center Retail Project, the City is looking to move forward with removal of the existing structures within the next several months. Proposals should take into account the required timeline and schedule to relocate the residences in a timely manner.

4852 School Street

Located on the east side of School Street, this property was also originally recognized in the 1980-81 survey wherein it was noted that the bungalow was historically used as classrooms and moved to the present location at an unidentified date [pre-1920]. The property was assigned a status code of 5S3 as part of the 2009 Citywide Historic Property Survey. PCR also surveyed this property and as of September 2013, the structure appeared to be in fair to poor condition

Currently the property is vacant land owned by the Yorba Linda Successor Agency. PCR surveyed the property in September 2013 and found the property to be in overall good to fair condition.

SUBMITTAL REQUIREMENTS & EVALUATION CRITERIA

Submittal Requirements

Interested buyers are responsible for preparing an effective, clear, and concise proposal. In order to be considered for evaluation the following mandatory information must be provided: A cover letter with general description of project intent, purpose and proposed offer amount. Relevant background information, including specific qualifications and experience in historic

preservation, if any, and/or residential rehabilitation. Identification of receiver site and proof of ownership or authorization to relocate structure to

the intended site. Detailed proof of financial stability enabling the entity to be capable of meeting the conditions

of sale pursuant to the anticipated Relocation and Rehabilitation Plan. A reasonable time line for project completion, including preparation of a Relocation and

Rehabilitation Plan in accordance with the aforementioned guidelines, required approvals from the City, and physical relocation of the structure.

Evaluation Criteria

Offer amount and schedule of completion Demonstration of adequate financial resources to relocate the structure Adequate insurance and liability coverage acceptable to the City of Yorba Linda. Release of financial responsibility and liability to the City associated with the relocation of the

structure

Selection Process

Access to the homes will be available on a pre-arranged date and time once an interest list is assembled. Each proposal received will be evaluated and reviewed to determine if it meets the stated requirements. Proposals will be evaluated upon offered amount and demonstrated financial ability to carry out the intended project per the criteria stated. Two (2) copies of the proposals must be delivered, or mailed, in a securely sealed envelope to:

General Information The City of Yorba Linda reserves the right to reject any or all proposals and will not be liable for

any costs incurred by respondents relating to the preparation of proposals.

Proposals must be valid for a minimum of 90 days.

The City is not required to select the proposal that may indicate the highest bid. The City may reject all proposals when, in its sole discretion and opinion, none of them meet the requirements or specifications, the benefits derived will be less than anticipated or desired, or the rejection is in the best interest of the City. If all proposals are rejected, the City may or may not request additional proposals.

The successful entity shall defend, indemnify, save and hold harmless the City of Yorba Linda, its officers, agents, and employees, from any demands, claims, suits, damages, or actions that may be brought by third persons on account of bodily injury or death; personal injury; damage to property or personal interest; or violation of any law, regulation or ordinance; where the third person’s loss, demand, claim, suit, damages, or action arises in whole or part out of any negligent or other act or omission of the contracting agency or its officers, employees, and agents, while performing the services agreed to save and except those actions arising out of the sole negligence of the City.
