‘complex motor-powered aircraft’ shall mean:(i) an aeroplane:— with a maximum certificated take-off mass exceeding 5 700kg, or— certificated for a maximum passenger seating configurationof more than nineteen, or— certificated for operation with a minimum crew of at leasttwo pilots, or— equipped with (a) turbojet engine(s) or more than oneturboprop engine, or(ii) a helicopter certificated:— for a maximum take-off mass exceeding 3 175 kg, or— for a maximum passenger seating configuration of more thannine, or— for operation with a minimum crew of at least two pilots, or(iii) a tilt rotor aircraft;

Operators of complex motor-powered aeroplanes andhelicopters involved in non-commercial operations shalldeclare their capability and means to discharge theirresponsibilities associated with the operation of aircraftand operate the aircraft in accordance with theprovisions specified in Annex III and Annex VI.
Operators of other-than- complex motor-poweredaeroplanes, and helicopters, as well as balloons andsailplanes, involved in non-commercial operations,including non-commercial specialised operations, shalloperate the aircraft in accordance with the provisionsspecified in Annex VII.

Training organisations having their principal place ofbusiness in a Member State and approved inaccordance with Regulation (EU) No 1178/2011when conducting flight training into, within or out ofthe Union shall operate:(a) complex motor-powered aeroplanes andhelicopters in accordance with the provisionsspecified in Annex VI (NCC);(b) other-than- complex motor-poweredaeroplanes and helicopters as well as balloons andsailplanes in accordance with the provisions specifiedin Annex VII (NCO).

ARO.GEN.120 Means of compliance(a)The Agency shall develop Acceptable Means ofCompliance (AMC) that may be used to establishcompliance with Regulation (EC) No 216/2008 and itsImplementing Rules. When the AMC are compliedwith, the related requirements of the ImplementingRules are met.(b)Alternative means of compliance may be used toestablish compliance with the Implementing Rules.(c)The competent authority shall establish a systemto consistently evaluate that all alternative means ofcompliance used by itself or by organisations andpersons under its oversight allow the establishment ofcompliance with Regulation (EC) No 216/2008 and itsImplementing Rules.

AMC provide legal certainty, contribution to uniformimplementation, and presumption of compliance withthe rules.AltMOC: Propose an alternative to an existing AMC Propose means to establish compliance with BR or
IR if no AMC has been adopted by the AgencyDO NOT presume compliance and evaluation by CAneeded.IF used, compliance MUST be demonstrated andprocess established by operator, CA and Agency toensure no negative effect on safety, transparency andharmonization.Treatment of AltMOC has two different scenarios:a) proposed by operator,b) proposed by authority.

Član 14(6) Vazduhoplov koji se upotrebljava u komercijalnim operacijama i složenivazduhoplov na motorni pogon mora da ima listu minimalne ispravnosti opremevazduhoplova, koju odobrava Agencija.
Član 32(1) Operator u nekomercijalnim operacijama složenim vazduhoplovom namotorni pogon može biti pravno ili fizičko lice, odnosno državni organ koji imaprofesionalnu sposobnost, odobren operativni priručnik od strane Agencije iorganizacionu strukturu koja obezbjeđuje sigurno izvođenje vazdušnih operacijakoje obavlja.(2) Ispunjenost uslova iz stava 1 ovog člana operator vazduhoplova dokazujedavanjem izjave o svojoj profesionalnoj sposobnosti i sredstvima za ispunjenjeobaveza u vezi sa upravljanjem vazduhoplovima iz stava 1 ovog člana.(3) Operator u nekomercijalnim operacijama koje se ne obavljaju složenimvazduhoplovom na motorni pogon može biti pravno ili fizičko lice i nije dužno dadaje izjavu iz stava 2 ovog člana za obavljanje vazdušnih operacija, akovazduhoplov ispunjava propisane uslove za plovidbenost, kao i ako imaodgovarajuće dozvole za posadu i ispunjava druge uslove u skladu sa ovimzakonom.

Države članice mogu da odluče da ne primjenjuju:(a) odredbe Aneksa III na nekomercijalne operacije sasloženim avionima i helikopterima na motorni pogon do25. avgusta 2016. godine; i(b) odredbe Aneksa V, VI i VII na nekomercijalneoperacije sa avionima, helikopterima, jedrilicama ibalonima do 25. avgusta 2016. godine.“;
