Dziennik Ustaw 03.21.177 REGULATION OF THE MINISTER OF HEALTH of 19 th December 2002 as regards the fixing of maximum levels of pesticide residues used for the purposes of plant cultivation, protection, storage and transport, which may be found in the foodstuffs or on their surface without any harm to human health or life Pursuant to Art. 9 paragraph 5 of the Act on Food and Nutrition Sanitary Conditions of 11 th May 2001, (Dziennik Ustaw No 63, item 634 and No. 128, item 1408, and of 2002: No. 135, item 1145; and No. 166, item 1362), Regulation is hereby issued as follows: § 1. The maximum levels for pesticide residues in or on the surface of foodstuffs of animal origin, excluding grain, are laid down in the Annex No 1 hereto. § 2. The maximum levels of pesticide residues in or on cereals, including also pesticides used for cereals fumigation are laid down in the Annex No 2 hereto. § 3. The maximum levels of pesticide residues in or on foodstuffs of animal origin are laid down in the Annex No 3 hereto. § 4. The maximum levels of pesticide residues in foodstuffs intended for infants (maximum 12 months of age inclusive) and small children (maximum 36 months of age inclusive) are laid down in the Attachment No 4 hereto. § 5. The maximum levels of pesticide residues laid down herein are not applicable to foodstuffs placed on the territory of the Republic of Poland that are traded on the territory of any European Union Member States other than the Republic of Poland. § 6. The Regulation shall enter into force on 30 th day from its publication, with the provisions in § 5 being applicable when the Republic of Poland has become a member of the European Union. REGULATION OF THE MINISTER OF HEALTH

of 19th December 2002

as regards the fixing of maximum levels of pesticide residues used for the purposes of plant cultivat ion, protection, storage and transport, which may be found in the foodstuffs or on their surface without any harm to human health or l ife

Pursuant to Art. 9 paragraph 5 of the Act on Food and Nutrition Sanitary Conditions of 11th May 2001, (Dziennik Ustaw No 63, item 634 and No. 128, item 1408, and of 2002: No. 135, item 1145; and No. 166, item 1362), Regulation is hereby issued as follows:

§ 1. The maximum levels for pesticide residues in or on the surface of foodstuffs of animal origin, excluding grain, are laid down in the Annex No 1 hereto.

§ 2. The maximum levels of pesticide residues in or on cereals, including also pesticides used for cereals fumigation are laid down in the Annex No 2 hereto.

§ 3. The maximum levels of pesticide residues in or on foodstuffs of animal origin are laid down in the Annex No 3 hereto.

§ 4. The maximum levels of pesticide residues in foodstuffs intended for infants (maximum 12 months of age inclusive) and small children (maximum 36 months of age inclusive) are laid down in the Attachment No 4 hereto.

§ 5. The maximum levels of pesticide residues laid down herein are not applicable to foodstuffs placed on the territory of the Republic of Poland that are traded on the territory of any European Union Member States other than the Republic of Poland. § 6. The Regulation shall enter into force on 30th day from its publication, with the provisions in § 5 being applicable when the Republic of Poland has become a member of the European Union.

Comments:

In the event of multi-ingredient foodstuffs for which maximum permissible levels of pesticide residues were not f ixed, the MRLs may not exceed the fixed levels, taking into consideration relat ive concentrations of such ingredients in multi-ingredient food.

Hints:

1. Meat and processed meats

In the event of foodstuffs with the fat content by weight 10% or less, residues refer to the total mass of a foodstuff with bone. In such cases the maximum level of pesticide residues accounts for one tenth of the value of fat content, but it may not be lower than 0.01 mg/kg.

2. Milk and dairy products

Milk: In the event of determining residues in whole milk , 4% fat content by weight was taken as calculation basis.

- with fat content less than 2% by weight ‒ maximum residue level accounts for half of the MRL fixed for whole milk,

- with fat content 2% by weight or more ‒ maximum residue level is expressed in mg/kg of fat; in such cases maximum residue levels are 25 times higher than the MRL fixed for whole milk.

3. Eggs

In the event of eggs and egg products with the fat content higher than 10% by weight, MRLs are expressed in mg/kg of fat . In such case the maximum level of pesticide residues are 10 t imes higher than MRLs for fresh eggs.

MAXIMUM LEVELS OF PESTICIDE RESIDUES IN BABY FOODS (MAXIMUM 12 MONTHS OF AGE INCLUSIVE) AND SMALL CHILDREN (MAXIMUM 36 MONTHS OF AGE INCLUSIVE)

Processed cereal-based foodstuffs and baby and children foods may not contain single pesticides used for cult ivat ion, protection, storage and transportat ion of plants above 0.01 mg/kg of product.

Maximum levels of pesticide residues refer to food ready to eat or prepared in accordance with instructions of use specified on the label .
