REGULATION FOR THE ORGANIZATION AND

CONDUCT OF DOCTORAL STUDIES

GENERAL PROVISIONS

Art.1.  Bucharest University of Economic Studies (BUES) is classified as an advanced research and

education university and is accredited by the Ministry of National Education (MNE) as an

Institution Organising Doctoral Studies (IODS) in accordance with the National Education

Law no. 1/2011, modified and completed, the Government Ordinance no. 681/2011 on the

Code of doctoral studies, Law no. 288/2004 on the organization of university studies,

modified and completed, and the BUES Charter.

Art.2. 

 Rules of organization and conduct of doctoral studies shall be updated at least once a year or

whenever it is necessary and enter into force on the date of approval by the BUES Senate.

Art.3.   Doctoral studies is the third cycle of university studies focused on learning through research

and whose purpose is to develop research skills.

Art.4.  Doctoral studies are held on the full time basis only.

Art.5.  Describing  IODS –  BUES : 

(1) Within BUES, Ph.D. is of scientific type and represents an advanced form of learning

through research, through the acquisition and production of knowledge, thuscontributing to the development of professional skills in specialty areas, as well as

transversal competences.

(2) Scientific doctorate is a prerequisite for careers in higher education and research.

(3) BUES organises doctorate in two branches of science and ten areas for doctoral studies:

 Economic Sciences: Business Administration, Cybernetics and Statistics, Accounting,

Economics, International Business and Economics, Finance,

Economics, Management, Marketing. Legal Sciences: Law

Art.6.  IODS  –   BUES promote interdisciplinarity in doctoral studies. Doctoral studies allow the

acquisition of an 8 level qualification of the European Qualifications Framework (EQF) and

the National Qualifications Framework (NQF).

Organisation and conduct of doctoral studies

Art.7.  Organisation and conduct doctoral studies in BUES are done by doctoral schools. Doctoral

Schools are organized by subject or disciplinary and interdisciplinary topics.

Art.8.  Organisation structure of IODS –  BUES is approved by BUES Senate.

Art.9.  Coordination of BUES doctoral studies is performed by the Council for Doctoral Studies

(CDS) that operate under the law of this Regulation Code doctoral studies and the University

Charter.

Art.10. 

(1) 

CDS  –  BUES is composed of 17 members, respectively, a director, eight supervisors in

BUES, four Ph.D. students and four members from outside BUES.

(2) 

CDS Members, academics or researchers must meet minimum standards, mandatory for

granting the certificate of entitlement in force on the date of their appointment as members

of CDS.

(3) 

CDS members, academics or researchers, are:

a)  elected by universal, direct, equal and secret ballot by heads of doctoral

schools (at least one);

 b)  named by BUES rector (at least 50%)

Ph.D. students, who apply to become members of CDS are elected by universal suffrage,

direct, equal and secret of all doctoral students in the doctoral schools.

(4) 

CDS members mandate is 4 years. Doctoral Students, CDS members, who complete their

doctoral studies during the council's mandate lose this quality at the completion of

doctoral studies. Also CSUD members end their mandate and those who cease to be Ph.D.

students.

(5) To fill any vacancy in the CSUD-elections are held according to Art. 13, 14 and 15, and

the mandate of the new member ends when CSUD term expires, or the completion of

doctoral studies, namely, the loss of Ph.D. students position.

(6) 

CSUD is assisted in its work by the Office of Doctoral Studies.

Art.11. 

CSUD meets quarterly and whenever needed, if the CSUD Director or at least a third of itsmembers require. 

Art.12. 

(1) CSUD director is appointed following a public competition organized by the Rector

 based on a methodology proposed by the Board of Directors and approved by the BUES

Senate. 

(2) 

The position of CSUD director is assimilated to the position of vice rector.

Art.13. 

Based on the decision of the competition, BUES Rector closes with CSUD director amanagement contract for a period of four years.

Art.14.  CSUD has, mainly, the following responsibilities:

a)  establishes IOSUD –  BUES strategy;

 b)   proposes to the Board Rules of organization and development of doctoral studies for

approval by the Senate of BUES;

c)  validates elections of board members and appoint the directors of doctoral schools.

Director of the Doctoral School is member of the board of that doctoral school;

d) 

approves the Council's proposals on the doctoral supervisors of doctoral schools that

are part of a newly established PhD School;

e)  approves proposals on the establishment of doctoral schools councils and abolition of

doctoral schools in BUES;

f)  approves regulations of doctoral schools;

g) 

develops, periodically, a strategy for attracting and selecting candidates for doctoral

study programs, providing correct information to those concerned about the

conditions and criteria for admission;

h)  develops minimum criteria concerning the organization and functioning of doctoral

study programs, including those concerning admission to doctoral studies, curricula,

assessment of doctoral students, establishing selection criteria and evaluation

committees of doctoral theses;

i) 

establishes minimum criteria for completion, evaluation and exploitation of the results

of doctoral study programs, including doctoral thesis;

 j)  develops methodologies for monitoring the progress of scientific professional

doctoral students;

k)  advances their own proposals and approves proposals of doctoral schools of

agreements and partnerships / consortia to conduct doctoral study programs and joint

degrees doctorates;

l) 

 proposes registration of doctoral students and manages, on behalf of schools and

doctoral programs, doctoral studies;

m) develops criteria and indicators for assessing the thesis, according to the European

Qualifications Framework and associated skills and qualifications listed in RNCIS on

 proposals of doctoral schools, according to the specific areas of academic

specialization organizes and conducts doctoral studies;

n) 

establishes the criteria for internal assessment of doctoral study programs;

o)   provides information on research centers and doctoral schools in the country and

abroad in which students can conduct research internships;

p)  performs other tasks that ensure a high quality of doctoral studies. 

Doctoral school

Art.15. 

(1) A doctoral school may be established only if it has at least 3 supervisors.

(2) The general organization and functioning of doctoral schools established by law, the

 provisions of the Code of doctoral studies by this Regulation may be filled with the

regulations of doctoral schools.

Art.16. 

(1) Doctoral School is headed by a director of the doctoral school and doctoral school board.

Director of the Doctoral School is assimilated to the department director. DoctoralSchool Council is assimilated to the council department.

(2) Share of doctoral school in doctoral school board is determined by CSUD.

Art.17. 

(1) Regulation of doctoral school establishes the way programs of doctoral studies in the

doctoral school are organized and conducted and the cooperation with departments,

faculty councils and CSUD.

(2) Regulation is approved by the doctoral school CSUD.

(3) Regulation applies in the case of doctoral study programs conducted in co-tutoring, if the

 partnership agreement is thus decided.

Art.18.  BUES ensures transparency of the organization and conduct of doctoral study programs in all

doctoral schools.

Art.19.  BUES, by its the doctoral schools, subject to availability and in accordance with legal

 provisions, can offer financial support for doctoral students conducting research internships in

the country or abroad, with the agreement of the doctoral school.

The doctoral supervisor and guidance committee

Art.20. 

(1) 

Academics and researchers can be supervisors, those who have obtained the right of

supervising doctoral studies before the entry into force of the National Education Law no.

1/2011, and persons who have obtained the certificate of entitlement, having at least the

 position of lecturer, scientific researcher 3rd degree, and those who acquire this rightaccording to art. 166 of the National Education Law no. 1/2011.

(2) 

To supervise doctorates, teachers and researchers that have acquired this right must have

an employment contract with BUES and be a member of a Doctoral School of BUES.

(3) The right to conduct doctoral theses can only be achieved in the field for which was

awarded this quality in only one IOSUD.

(4) If the doctorate supervisor wishes to pursue doctoral supervising work in another IOSUD

organizing activity only in the field, this can be done with the approval of the university

senate. The request must be addressed to the Rector of the university and approved by the

Director of the Council for doctoral studies (CSUD). The agreement of the two

institutions (IOSUD) is expressed on the application submitted by the doctoral supervisor,

the Director CSUD opinion and approval by the university rector.

(5) Approval of the carrying on of doctorate supervisors in another IOSUD than that in which

he was awarded the position of a PhD requires clarification of the PhD students between

the two institutions involved (IOSUD) and conclusion of the individual employment

contract with IOSUD where he will work.

Art.21. 

(1) Doctoral studies can be organized in co-tutoring, doctoral student working under the

guidance of a doctorate supervisor from BUES and doctoral supervisor of a foreign

country or under a written agreement between institutions involved or under two BUES

supervisors.

(2) If the doctoral supervisors are from BUES, the doctorate can be held jointly only in

different fields of study.

(3) In the case of joint doctorate is determined mainly a doctoral supervisor. Doctoral student

is registered at the main doctoral supervisor including his full time teaching and research;

Art.22.  A doctoral supervisor may conduct simultaneously 10 Ph.D. students, in various stages of

doctoral studies.

Art.23. 

(1) Upon motivated request of the student- PhD, Doctoral School Council (SSC) proposes

change if there is any breach of contractual obligations, or for other legitimate reasons.

(2) 

The CSD shall, within 30 days, appoint another doctoral supervisor in the case above, and

if it finds the unavailability of the doctoral supervisor.

(3) The new doctoral supervisor of the doctoral committee may maintain existing guidance

committee or propose another committee.

Art.24. 

(1) In the program of doctoral studies, doctoral student is guided by a committee of the

doctoral school and three other members of the team can be part of the doctoral school

 personnel, other persons affiliated to the doctoral school and non-affiliated researchers

with a PhD;

(2) CSD may propose criteria that the guiding committee members must meet;

(3) 

Composition of the guidance is determined by the doctoral supervisor, in consultation

with the Ph. D student and is approved by the Council of the doctoral school.

Art.25.  Activity of doctoral supervisors, of guidance committee members and members of the doctoral

committee are standardized according to a methodology approved by the BUES Senate.

 Admission at the doctoral studies programs

Art.26. 

(1) The entrance examination is held for admission based on a methodology to be approved

 by the Senate BUES.

(2) 

The competition consists of two parts: language proficiency test and evaluation of the

doctoral student by a committee composed of the director of the doctoral school and

doctoral supervisor who have taken research topics in the contest.

(3)  CSUD displays the methodology admissions on the website: www.ase.ro/admitere with

at least six months before the competition for admission.

Art.27.  Only graduates with master's degree or its equivalent in the country or abroad are entitled to

 participate in the competition for admission to doctoral studies.

Registration of Ph.D. students

Art.28.  After the completion of the admission and registration decision is issued, the person admitted

is PhD student throughout the period of his presence in the doctoral program, the registration

and the public to support the thesis or expulsion, except during periods of interruption of

studies.

Art.29.  Ph.D. students are employed by IOSUD-BUES as research assistants or assistant professor,

during the period. PhD student teaching can take place according to the contract for doctoral

studies, within 4-6 hours per week of conventional teaching. Educational activities that

exceed this level will be paid in accordance with the law, falling within the Labour Code, the

rights and obligations of the employee and pay the contributions to the state, according to the

law, to social security, unemployment insurance, health insurance for work accidents and

occupational diseases.

Art.30.  Registration of doctoral students from BUES decision is made by the Rector and doctoral

school board after fulfilling all the requirements in the proposal submitted by the PhD, a

member of the doctoral school. After registration approval, doctoral students are enrolled in

the school register, as unique, valid for the entire school in the same field of doctorate.

Art.31. 

(1) When registering as Ph.D. students the personal file will contain 1:

a)  the master diploma and the supplement in original;

 b)  the graduation diploma and the diploma supplement in original;

c) 

the baccalaureate diploma or its equivalent in original;

d)  copy of the identity card;

e)  the original certificate issued by first IOSUD stating the form of funding for

Ph.D. students following the second course of doctoral studies;

f)  authenticated copy of their birth certificate;

(2) In the second year of study, the student's file is completed with master's diploma in

original.

Art.32.  Records of doctoral students completed each year with any contracts or amendments to

contracts for studies and any documents and decisions regarding academic and social

situation (interruption of studies, transfers, social, financial obligations, etc.).

Art.33.  After registration, the student-PhD student receives a card on which he is legitimate for all

services and activities of the university. If the student loses the card it may be issued

duplicate for a fee after the publication in the press, by the student, the notice of its loss. 

Structure and period of doctoral studies

Art.34.  Program of doctoral studies comprises:

(1) 

a training program based on advanced university studies.

(2) an individual program of scientific research.

Art.35. 

(1) The training program based on advanced university specified in the Individual PhD Plan

(PID).

Art.36. 

(1) Scientific Research Program (PCS) involves doctoral student's participation in one or

more scientific projects established by the doctoral school;

(2) PCS is based on a PID under the guidance of the doctoral supervisor supported by the

guidance committee;

Art.37.  The duration of the Ph.D. program is usually 3 years and covers the period from the date of

registration until the public presentation of the thesis; it can be extended to 1-2 years, the

reasons set out at the proposal of the doctoral supervisor, with BUES Senate approval, with

the availability of funds.

Art.38. 

(1)  If the Ph.D. student fails to deliver the thesis within the period specified under the

contract of doctoral studies (3 years) and any addenda thereto, it is provided a grace

 period of up to 2 years after completing their studies to finish the doctoral thesis and to

overcome this period automatically leads to expulsion.

(2) 

During the grace period specified in the preceding paragraph, the PhD student cannot

receive doctorates or other financial support from doctoral grants.

(3) During the grace period there are not allocated hours of the doctoral and guidance

committee members.

(4) During the grace period it cannot be awarded the Ph.D. interruptions or extensions of the

duration of the PhD program.

Art.39.  PhD Student must devote significant time to doctoral program that requires his effective

 presence in the BUES or the research and development units that have agreements or

institutional partnerships with BUES, outside periods related to mobility. The actual presence

of the student's PhD is decided by the doctoral supervisor depending on the specific doctoral

 program and in compliance with Regulation of doctoral school.Art.40.  After delivering the thesis, BUES issued at the request of the graduate, a certificate of

completion of doctoral studies and the student-doctoral studies followed, whether they were

 promoted or not.

Art.41. 

(1) The responsibility of the structure, content, conduct and organization of doctoral study

 program belongs to doctoral supervisor.

(2) 

The head of the PhD course is directly responsible for the PhD student knowledge and is

obliged to do everything possible to ensure the conditions, knowledge and information to

maximize his chances to successfully complete the doctoral program.

(3) Ensuring resources necessary to conduct doctoral training is a requirement of the BUES,

for the doctoral school and doctoral supervisor.

(4) BUES, by its doctoral schools, ensure access to resources and logistics of doctoral

research and encourages the participation of doctoral students in research projects with

national and international relevance.

Art.42. 

(1) The PhD student must spend 40 hours per week for doctoral program, conducted under

BUES hours (study programs, research centers, research teams, etc.)

(2) Activities related to the doctoral program and the number of hours allocated to each of

these are set by the doctoral school in compliance with the regulation.

Art.43.  By 20 October of the first year of study it completes doctoral individual plan (SIP) by the

doctoral supervisor, in consultation with the student-student. Its structure is shown in Annex

1 of this Regulation.

Art.44.  Individual plan of doctorate is displayed online on CSUD platform and is submitted to the

CSUD secretariat in writing, approved in advance by the Board of guidance and the doctoral

school board.

Training program based on advanced academic studies

Art.45.  Training program based on advanced university is a support tool for knowledge enrichment of

student-and serves to the proper course of a scientific research program and to acquire

advanced skills specific to doctoral studies.

Art.46. 

(1) The training program based on advanced university studies must be relevant to the topic

of the research thesis.

(2) Participation of a student to doctoral training program based on advanced university

study and choosing elements of this program to be followed by the student are

determined solely and independently by the doctoral supervisor.

(3) PhD student can opt independently for completing advanced courses within the

university doctoral school provided by its own or other doctoral schools.

(4) The cumulative duration of the training program based on advanced university may not

exceed three months, according to the Code of doctoral studies. 

Art.47.  Advanced academic studies can be accomplished by:

a)  special programs for advanced university organized by doctoral schools;

 b) 

attendance of 3-5 subjects in research programs Master BUES;

c)  other activities determined by the doctoral supervisor.

Program of scientific research

Art.48.  The main objective of the research program is to develop the thesis and include in the job

skills training doctoral qualification RNCIS.

Art.49.  Scientific research program requires doctoral student's participation in one or more scientific

 projects established by the doctoral supervisor at doctoral research centers or departments.

Art.50.  Scientific research program is carried out under the guidance of the doctoral committee.

Art.51.  Scientific research program can be conducted BUES, research institutions or international

recognised partners in a consortium with BUES.

Art.52.  BUES research centers will provide research infrastructure necessary to doctoral studies.

Art.53.  Minimum requirements for the completion of scientific research programs into account:

a) preparation in the late studies, progress reports must include the results of their scientific research;

 b) participation in scientific discussions organized within the doctoral school, resulting in the

 publication of working papers;

c) the minimum criteria for public support of the thesis. These are set by CSUD, pending admission to

doctoral training session. Minimum criteria set out in Annex 2 to this Regulation.

Art.54.  Research in the third year of studies assessing the mentoring committee on dissemination of

research results through participation in scientific conferences and by publishing articles in

international databases journals.

Interruptions and extensions

Art.55.  Doctoral study program may be interrupted at the request of the PhD student, on reasonable

grounds upon submission of supporting documentation.

(1) Interruption is approved by CSUD following the opinion of the doctoral supervisor and doctoral

school board approval. Periods together may not exceed two semesters, excluding breaks provided by

law.

(2) The duration of the PhD is extended in case of interruption, corresponding to periods of

interruption approved by CSUD. 

Art.56.  The extension or interruption is established by contract addenda to doctoral studies.

Art.57.  Interruption of schooling is made as of the date of filing to the Office of Doctoral Studies and

the date of commencement of the academic semester subsequent to the period of interruption.

Art.58.  Interruption of doctoral studies is only possible before the session evaluation of research

 progress reports according to the schedule of activities.

Art.59. 

Tuition paid for the semester in which the interrupt request was approved is not returned.

Art.60.  Resumption after interruption of studies is under funding from the budget or charge, subject to

availability, in accordance with the law. Tuition will be the effect in the academic year in

which the student - doctoral returns after interruption.

Art.61.  Resumption after interruption of studies is based on an addendum of doctoral school.

Art.62.  Receiving doctoral student interruption of studies, transfer or withdrawal from the study, will

submit to the Office of Doctoral Studies the PhD Student ID card, and if necessary the travel

ticket.

Expulsions

Art.63.  PhD student will be expelled if he:

a) does not submit, in time, progress reports of scientific research or does not present in

 public his research results ;

 b ) is rejected or failed to pass one of the progress reports of scientific research even after

reassessment session. Following the expulsion proposal by the doctoral committee and

supervisor, obtaining "rejected" to the progress report, CSUD issues expulsion decision for

the PhD student.

c) has not defended his doctoral thesis at the end of doctoral program, or, if applicable, upon

completion of the grace period, according to law;

d) at the public thesis delivery, the doctoral committee give "unsatisfactory ";

e) violate ethical academic or scientific research, including plagiarism;

f) does not pay the tuition fee for the first three weeks of the beginning of the semester.  

Art.64.  Ph.D. students who have been expelled from BUES doctoral studies can enrol in a new

competition for admission to the university, except those who have been expelled on grounds

of plagiarism.

Art.65.  PhD students who have been expelled are issued the original documents from the personnel

file on liquidation note signed by all responsible persons. 

 Assessment of academic doctoral programs

Art.66. 

External evaluation of doctoral schools is based on their performance and institutional

capacity of BUES.

Art.67.  External evaluation of doctoral schools is done by ARACIS or by another agency of quality

assurance at home and abroad, based on their methodologies.

Art.68.  (1) The doctoral study programs will be subject to internal review process coordinated by

CSUD based on its own methodology.

(2) The internal quality evaluation of doctoral study programs is done by the school board and

CSUD every five years.

(3) Procedures for internal evaluation of doctoral study programs shall be based on the

minimum criteria established by the Code of doctoral studies CSUD endorsed by the Senate

 Assessment of Ph.D. students

Art.69.  Evaluation of doctoral students is focused on valorisation research results, i.e., publications,

 participation in conferences, according to their quality, estimated by integrating publications,

citations, awards to the international flow, etc.

Art.70.  Procedures and evaluation criteria should allow:

a) the correct measurement of the performance of doctoral students and reflect the

 performance differences between them;

 b) review progress in acquiring knowledge doctoral students and skills associated with

vocational qualification concerned;

c) academic and administrative check to ensure fairness of the proceedings;

d) transparency and information on evaluation criteria for doctoral students;

e) inform doctoral students methods, assessment criteria and expected performance.

Art.71. 

(1) continuous assessment and final activity-doctoral student will observe professional ethics,

scientific and academic ethics.

(2) In the event of academic fraud, violations or deviations from good practice in scientific

research, including plagiarism, Ph.D. student and the doctoral supervisor are responsible

according to the law.

Art.72. 

(1) Each graduate student is evaluated based on the annual progress reports.

(2) The Council may establish, in each graduate school, other specific tools for monitoring

the activity of PhD students during the academic year.Art.73. 

1 ) PhD student assessment is conducted by the doctoral committee and guidance. After facing

the progress report, the doctoral supervisor and guidance committee granted one of two

grades: passed or rejected. Granting rejected entails improving progress report and submitting

it in a second session on a schedule approved annually.

2) The doctoral student may appeal the grade obtained within 48 hours of the date of

assessment / announcement of results by an application to the Director of the Doctoral School.

In this case, the director of the doctoral school makes a commission consisting of three

scientific supervisors, who will conduct a new evaluation of the progress report. The result

given by the commission shall notify the Office of Doctoral Studies in writing within 7 days

after the final grade appeal. The PhD student will be communicated to the personal page.

3) Following the qualifier rejected at the second annual assessment of the progress of scientific

research, the doctoral guidance committee propose expulsion.

Internal assessment of doctoral supervisors

Art.74.  Internal assessment of doctoral supervisors will consider the quality of the results obtained by

them in research and doctoral guidance, such as:

a) the results of their scientific research and doctoral supervisors, measured by publications

and / or other ways to exploit the research;

 b) other indicators of scientific activity of doctoral and doctoral supervisors, such as

 participation in research projects, participation in national and international conferences,

membership in professional organizations.

Art.75.  Assessment of doctoral supervisors is done every five years, according to the law. Evaluation

 procedures are established by Order of the Minister of National Education, at CNATDCU

 proposal. The evaluation results are public.

Financing the doctoral studies program

Art.76.  Doctoral study programs are organized with funding from the state budget, for a fee or other

legal sources.

Art.77.  Ph.D. students receive grants for doctoral studies, according to national methodology.

Art.78.  Schools may finance doctoral programs, doctoral studies and research and development

 projects funded from other sources, public or private.

Art.79. 

People who have adequate financial resources, either from their own resources or from grants

awarded by the natural or legal persons, may be allowed, at their request, the Ph.D. students

in tuition under the law. Tuition in doctoral study programs are set by the BUES Senate.

Art.80. 

(1) The financing of the budget shall be retained as long as the doctoral and guidance

committee notes progress in preparing the PhD student.

(2) Otherwise, the budget place remains vacant and is available for the contest organized by

the doctoral committee and doctoral supervisor for Ph.D. students that pay tuition fee,

changing the terms of a doctoral school.

(3) In special circumstances when a Doctoral School cannot occupy the vacancies, they are

redistributed to other doctoral schools, based on a decision CSUD.

Doctoral thesis and completion of doctoral studies

Art.81.  PhD thesis must be the result of your own research under the guidance of the doctoral

supervisor and contain original results in scientific knowledge.

Art.82. 

(1) In order to standardize institutionally, each doctoral school develops a guide for writing a

thesis on areas of academic specialization, adding elements such as the visual identity of the

doctoral school and BUES, the formal structure of the sentence, minimum and maximum

number of pages, standard wording of references, formal requirements for editing etc.

(2) The doctoral thesis can be written in Romanian language or in a foreign language.

(3) The author of the thesis, the Ph.D. student and scientific coordinator will be specified on

the cover of the thesis. Members of the doctoral committee will be mentioned on the inside

cover of the thesis.

Art.83. 

(1) The content of the thesis is set by Ph.D. student in consultation with the doctoral

supervisor and meet the guide frame structure of the thesis writing.

(2) Title of the thesis can be modified at the discretion of the student's PhD until its

completion, to public delivery. The new title of the thesis must be consistent with scientific

research conducted by PhD student throughout the doctoral program.

(3) The doctoral thesis must be an original work, having to mention the source for any

material taken.

Art.84. 

(1) The Ph.D. student is the author of doctoral thesis and assumes the correctness of the dataand information presented in the thesis, and the opinions expressed in the paper and

demonstrations.

(2) The supervisor of the doctoral thesis and the author are responsible for compliance with

quality standards and professional ethics, including ensuring the originality of content,

according to legal provisions.

Art.85. 

(1) The thesis together with its annexes are public documents.

(2) The protection of intellectual property rights on the thesis is provided in accordance with

the law.

(3) Recovery of the copyright and / or industrial property rights to the product or original

creation made in the doctoral study program is carried out in accordance with legislation.

 Assessment and delivery of doctoral thesis

Art.86.  The delivery of the doctoral thesis is done according to the procedure of thesis delivery from

www.doctorat.ase.ro displayed on site.

Art.87.  Criteria for assessing the quality of a thesis follow the research results presented in the thesis,

obtained in the doctoral study program. Necessarily there shall be taken into account the

results of doctoral student publications in professional journals and scientific conferences

volumes under the minimum criteria in Annex 2 to this Regulation.

Art.88.  At least some of the original scientific results included in the paper must have been published

as outstanding professional achievements in the interval between enrolment in the program of

doctoral studies and public dissertation in journals included in the international databases.

Art.89. 

(1) Delivery of the thesis takes place in front of the committee of public thesis delivery, the

PhD committee.

( 2 ) The public delivery can take place only after the doctoral and guidance committee gave

consent.

( 3) Following the identification of violations of good conduct in research and development,

including plagiarism and publishing the results of other authors, making replacement results

or outcomes with fictitious data in the assessment by the doctoral thesis and guidance

committee, the student - PhD will not get the agreement for public delivery of the thesis.

( 4) The thesis is proposed by the doctoral supervisor, approved by the Director of doctoral

school and the board of doctoral school.

( 5) The thesis is composed of at least five members: the president, as a member of the Senate

or the Board of Directors of BUES, Ph.D. supervisor and at least 3 reviewers or foreign

officials, experts in the field and at least two outside BUES. Referees outside BUES should

 be part of universities and prestigious research institutes nationally and internationally. At

least one of the two referees outside BUES must be of university consortia.

( 6 ) The members of the doctoral committee are Ph.D. and at least associate professors or

researcher degree or doctorate supervisors from the country or from abroad.

( 7) For the co-tutoring doctorate from the committee of public delivery of the thesis, both

supervisors shall participate.

(8 ) CSUD and doctoral schools impose minimum performance standards that scientific

members of the doctoral committee must meet to be part of that committee.

(9 ) Delivery the thesis can take place only after assessment by all members of the doctoral

committee in the presence of at least four of them, with the involvement of the president and

of the doctoral committee.Art.90. 

(1) For the public delivery of the thesis, the PhD student will draw up the thesis abstract,

keywords and content in Romanian, English or French.

(2) PhD thesis, dissertation abstract, keywords, list of publications and his own statement and

the one of the doctoral supervisor shall be deposited at CSUD together with favourable papers

of doctoral committee members;

(3) In the case of co-tutoring doctorate, doctoral thesis is submitted to IOSUD which has the

main PhD supervisor.

Art.91. 

(1) The proposal to grant the title of doctor includes:

a) the rating proposed to be granted;

 b) the special committee of the CNATDCU that best fits the thesis subject, hereinafter

referred to as the main board, where theses on subjects of interdisciplinary or

multidisciplinary can be given up to two other specialized committees of the corresponding

CNATDCU thesis topic;

c) the date of public presentation of the thesis.

(2) Thesis and its annexes contained in the file shall be submitted in PDF format, the main

text is represented as such, and not images. An exception to this rule is the audio material,

video or graphic illustrations.

Art.92.  PhD folder content shall to be submitted to MEN by CSUD procedure is set and displayed on

its website.

Art.93. 

(1) CSUD submits to BUES Central Library the PhD thesis and summary of the thesis, at

least 18 days prior to the public delivery, on paper and electronic format, for the consultation

ensuring the regime for unpublished materials.

(2) Notices of public defence of the thesis and its summary is published on the notice board

and the Office of Doctoral Studies at www.doctorat.ase.ro.

(3) Date and place of delivering the thesis is established within less than 15 days and not

more than three months from the date of the Commission's decision appointed by the rector

and posted on the website CSUD at least 15 days before the date fixed by the chairman

doctoral committee.

Art.94.  Public delivery of the thesis necessarily includes a series of questions from members of the

doctoral committee and the public.

Art.95. 

( 1) Based on public defence of the thesis and official reports, doctoral committee evaluate

and decide on the rating that is assigned to the thesis. Ratings are attributable to “Excellent”, 

“Very good", “Good", “Satisfactory" and “Unsatisfactory ".

( 2 ) the minimum qualifications for the award are set out in Annex 2 to this Regulation and

shall be included in the contract for doctoral studies and remain valid for the duration of the

PhD program.

( 3 ) the marks for public support of the thesis is given to fulfil the minimum standards

approved by CSUD.

( 4 ) Where a member of the doctoral thesis identifies the evaluation and public support,

serious violations of the conduct in scientific research and academic activities, including

 plagiarism and publishing the results of other authors, making replacement results or

outcomes to fictitious member of the doctoral committee must:

a) notify the other members of the doctoral committee deviations and propose granting

"unsatisfactory " ;

 b ) refer the matter to the Ethics Committee of BUES to analyse and resolve the case,

including the expulsion of the student.

( 5 ) If the PhD student has met all requirements of the program of scientific research and

assessments on the thesis allow the assignment of the rating "Excellent ", "Very good ",

"Good " or " Satisfactory" doctoral committee proposes to grant doctorate. The proposal is

submitted CNATDCU for validation. CNATDCU, after file evaluation, proposes to the

Minister of National Education whether or not to grant the title of doctor.

( 6) if the mark is "unsatisfactory ", the doctoral committee specifies content elements to be

restored or completed and calls for a new public thesis delivery. A second public delivery of

the thesis takes place before the same doctoral committee, as in the case of the first

submission. If at the second public delivery the "unsatisfactory” mark is awarded, the PhD

student is expelled.

Art.96. 

(1) If CNATDCU invalidate the thesis, doctoral student, can remake it in 9 months for the thesis

to be again sent to CNATDCU in one year from the date of the first rejection.

(2) Throughout this process the guidance committee and doctoral supervisors are kept.

(3) If the thesis will be invalidated the second time, Ph.D. title will not be granted and the

doctoral student will be expelled.

Art.97.  PhD title is awarded by the Minister of Education, after validating the thesis by CNATDCU.

Art.98.  Diploma conferred after promoting a program of doctoral studies is called doctorate degree.

The diploma mentions expressly, the disciplinary or interdisciplinary doctorate field.

Rights and obligations of Ph.D. student  

Art.99.  The rights and obligations of doctoral students, doctoral supervisors and BUES, through

doctoral schools are established by doctoral studies contracts.

Art.100. During the program of doctoral studies, doctoral student has the right to:

a) receive the support and coordination of the doctoral guidance committee;

 b ) attend seminars or meetings of research centers in BUES when there are discussion topics

relevant for doctoral studies;

c ) be represented in decision-making bodies of the doctoral school under the provisions of

this Regulation;

d ) access documentation centers, libraries and school equipment of BUES for the

development of doctoral research reports and thesis;

e) attend courses and seminars organized by other doctoral schools;

f ) work with teams of researchers from the university or in the research and development

units that have agreements or institutional partnerships with BUES;

g ) receive national and international mobility, if there are funds available;

h ) receive institutional support to attend scientific conferences or congresses, workshops,

summer or winter schools, national and international seminars in the field of thesis

specialization, if there are funds available;

i) attend the scientific sessions organized by doctoral school and / or BUES;

 j ) be informed about the curriculum of doctoral studies in the doctoral school;

k ) other legal rights.

Art.101. PhD Student has the following obligations:

a) pay the tuition fee, if the doctoral student attends the funding form of education;

 b) comply with the program agreed with the doctoral supervisor and fulfil his obligations and

sustain the presentation of research results;

c) submit annually to doctoral supervisor and committee guidance, the progress reports of

scientific research and any other elements of monitoring laid down in this Regulation;

d) be in permanent contact with the doctoral guidance committee;

e) on each article or participation in conference only to be passed the affiliation at the

Academy of Economic Studies (English language version shall be "The Bucharest University

of Economics Studies");

f) comply with institutional discipline;

g) other legal obligations.

Rights and obligations of doctoral supervisor 

Art.102. 

( 1) The rights and obligations of the doctoral supervisor arise from the National Education

Law no. 1/2011, modified and completed, of these Regulation, Regulations of doctoral

schools and the employment contract.

( 2 ) the doctoral supervisor has, among others, the following rights:

a) to be paid for the coordination of Ph.D. activities;

 b ) to participate in competitions for doctoral grants;

c ) to direct and evaluate the work of PhD student in the doctoral study program according to

 professional autonomy and academic demands pursuing doctoral studies program and

respecting the doctoral student's professional interests;

d ) to propose doctoral committee;

e) to receive internal and external impartial assessment, consistent with the specific

methodology of the evaluation process;

f ) to know the results of internal and external evaluation of his own activities;

g ) to propose research topics;

h ) to refuse the guidance of a PhD student in the conditions in which there is a conflict of

interests;

i) to ask the interruption of doctoral school tutoring with a PhD student;

 j ) to select doctoral candidates for a vacant position under his guidance and to propose

registration of doctoral student;

k )to require the doctoral school an admission competition for every vacant position of PhD

student under his direction;

l ) to decide the study elements of the training program based on advanced university studies-

where doctoral student must attend by respecting the provisions of this Regulation.

m ) to require the expulsion of the doctoral student if he does not fulfil the obligations of the

doctoral studies program.Art.103. Doctoral supervisor has the following obligations:

a) to provide scientific guidance, professional conduct of each PhD student;

 b) to ensure the conditions and to stimulate research progress of doctoral students;

c) to carry out objective and rigorous monitoring and evaluation of each PhD student;

d) to support the mobility of doctoral students;

e) to avoid conflicts of interest in guiding doctoral students;

f) to meet internal and external assessment methodology.

Incompatibilities

Art.104. Doctoral school director cannot simultaneously have executive management position (head of

department, vice dean, dean, vice rector, rector).

Art.105. In the Commission guidance, in the doctoral school board and CSUD may not be members

those who are related as spouses, in-laws and relatives up to the third degree.

Art.106. A doctoral supervisor cannot coordinate the student's doctoral program of the doctoral student

who is in family relationship up to the third degree.

Art.107. The Commission guidance may not include members who are with-doctoral student in

relation of spouses, in-laws and relatives up to the third degree.

TRANSITIONAL AND FINAL RULES

Art.108. 

(1) A doctoral supervisor may coordinate not more than 15 doctoral students in various

stages; not more than 10 doctoral students are in the program of doctoral studies.

(2) 

Teachers or researchers that coordinate doctoral students can receive new students until

retirement, when the work contract ends.

(3) The decision of admission seats allocation belongs to Doctoral School of the doctoral

supervisor and CSUD.

(4) 

Teachers or researchers who retire can continue coordinating PhD students until the

 public delivery of the thesis.

(5) If a doctoral supervisor does not wish to continue working after retirement, the doctoral

school is responsible for reallocation of PhD students to other doctoral supervisors.

Art.109. Ph.D. students who began doctoral studies program before the entry into force of the National

Education Law no. 1/2011, in the form of no attendance education, may continue their studies

in this type of education, until completion.

Art.110. 

For doctoral students whose theses were not preliminary analysed inside specialized

department or research team until October 1, 2011, the provisions of the Code for doctoral

taking into account the procedural stage they are, respectively advanced academic training

 program or research program.

Observations on writing the Individual Plan for PhD Studies

1. The document, filled in and signed by the PhD Supervisor, by the members of the guidance committee and by the PhD

Student shall be submitted to the Doctoral School Director by 20 October 2014. The document shall be subsequently sent to

CSUD by 30 October 2014.

2. The Individual Plan for PhD Studies shall be written by the PhD student under direct guidance of the PhD Supervisor.

3. The title of the PhD thesis shall be established by the PhD student after consultation with the PhD supervisor, taking into

account the research domain open to competition during the admission session. Pursuant to Art. 65 par. (4) of the Code of

Doctoral Studies, "the title of the PhD thesis can be modified by the PhD student at any time before its completion with a

view to its public defence."

Minimal criteria for allowing the public defence of the PhD Thesis

I.  Minimal criteria for awarding the ”Good” mark: 

a. 

At least 4 articles in ISI indexed journals, or in law journals of scientific prestige, or in journals

indexed in recognised international databases; at least 1 of these articles shall be published as sole

author in the proposed field of research.

 b. 

At least 4 articles in law journals of scientific prestige or indexed in at least two international

databases; at least 1 of these articles shall be published as sole author in the proposed field of

research.

c. 

At least two participations in national or international conferences, out of which at least one as sole

author, in the proposed field of research.
