Beginning at 7:00 p.m. on Tuesday, March 6, 2012, the Board of Trustees,

Kountze Independent School District, will conduct a special meeting for the

purpose of discussing the legal aspects of several personnel issues with its

attorney, and the board will receive an update from GJ-MAR Educational

Consultants. And the first thing it says is that no action will be taken at this

special meeting and on down, if you go down again before it ends, it says that no

action, decision or vote will be taken either in open or closed session. So my

question is – Were you acting on your own or were you getting direction from

somewhere else? When was this action voted on? Because it clearly stated that

no action would be taken yet there was a letter that went out that said – on the

direction of KISD Board of Directors I’m instructed to do this? I also want to

say that if this report is not accurate by GJ Mar you need to ask for your money

back and you need to 86 that thing. I also want to ask you to put faces with

names. You know when you send out a letter to somebody, put a face with it.

There are people in this district that have worked hard all their life. They are

battling cancer, but yet they still keep working. I was up at the school the other

day picking up something for my daughter and a lady came in there, I think she’s

68 years old, works part-time in the cafeteria, and asking to work part-time as a

custodian. I’m here to tell you folks a 70 year old lady shouldn’t have to worry

about an $8 an hour job. It ain’t right. What about these people who have put in

18 years in the district? There are several of them. They do above and beyond

whatever is asked of them. Our band program is exceptional, our basketball

program is exceptional, we’ve got exceptional schools. We’ve got people in

these offices doing exceptional jobs. The woman that works there audits for 9

straight years got a superior rating from the state of Texas. I realize there are

times we all make quick decisions that have caused pain, grief and hardships on

others. Well, I believe that you should carefully review the facts before you

make any decisions. I’m not here to criticize anyone but why would we hire an

outside source to look at numbers when we have a trusted group of people in

place that do this day in and day out. I realize this board for the most part is

inexperienced along with the superintendent who is inexperienced also so that

being said it is very easy to base decisions on personal feelings toward someone.

It is easy to base decisions on the inexperience of board members and the

superintendent. It’s easy to base decisions on being hasty, guided by outside

influences or not knowing all the facts. I also know all of you. I’ve known a lot

of you for years and I know you have good hearts. Sometimes it’s easy for us to

get blinded by things. Don’t forget this is family.

The report prepared by GJ Mar Educational Consultants was discussed in executive session on Tuesday, March 6

th. This report should have been

discussed in open session. If this report had been discussed in open session as required, you may have learned that these consultants who propose major cuts to the band program never had a conversation with the band director, nor the director of technology, the maintenance director the transportation director or the assistant superintendent whose jobs are in jeopardy tonight.

According to the TEA Legal Division and TASB this is a violation of the Open Meetings Act.

There is a possible conflict of interest between GJ Mar and the Kountze ISD.

Per board agenda, no action was taken to accept or decline the recommendations made by GJ Mar at the March 6

th special board meeting.

Therefore, the letter that was sent out on Wednesday, March 7th

to all district employees based on this report should never have gone out.

On Friday, March 9th

, several members of the KISD administration, faculty and staff received letters at the direction of the KISD school board based on this report informing them of the possibility of losing their positions.

This letter should have not gone out, as: 1. No action was taken on the GJ Mar report. 2. How could this be a directive from this board when at least three of

our board members knew nothing about this letter or its contents? The fact of the matter is this seven member board never discussed this issue.

3. Why would such a letter go out when Superintendent Kevin Weldon has never recommended a Reduction in Force due to Financial Exigency or Program Changes?

How did we arrive at this point with the people who received these letters?

Who exactly chose these positions and why? Was it the superintendent? Was it a board member(s)?

A RIF requires the board and superintendent to take preliminary steps before discharging contract employees. These preliminary steps include:

declaring a RIF based on financial exigency or program change, identifying the affected employment areas, Systematically applying preset criteria to identify the individual

employees to be discharged. Example: Certification Performance Seniority Professional background

These guidelines insure that no employee is targeted.

Therefore, I ask you, why haven’t the proper procedures for a RIF been followed?

A RIF has not even been recommended, much less declared. (Step 1) How was the affected employment areas identified? (Step 2) What exactly is the preset criteria used to identify the individual

employees to be discharged? (Step 3) Surely you are not referring to the GJ Mar Report that has not been accepted, as the assistant superintendent’s position or that of the business director was never mentioned in this report. Again, I ask who chose these positions and why are we in the middle of Step 3 when we haven’t even completed Step 1?

It seems to me, that someone(s) has put the cart before the horse. Prior to the implementation of a RIF, TASB suggests districts take the

following steps: Avoid filling positions as they become vacant by attrition – we haven’t

done this… Avoid creating new personnel positions – we have created new

positions… Avoid spending money on optional, non-core projects or programs,

such as making improvements to facilities the same year the district lays off personnel – we have done this…

TASB advises that school boards be prepared for close examination by the staff and community of the district’s recent expenditures.

TASB suggests that districts retain an outside financial consultant to recommend ways to restore financial stability to the district – Please

note GJ Mar Educational Consultants are not financial consultants. It is evident by reading their report that they do not even have working knowledge of the state’s Financial Accounting and Reporting Guide.

Be upfront with staff and the community about the reasons for the financial difficulty and the steps the district is taking to avoid a RIF – If you had been up front, we wouldn’t be here tonight.

Hold brief appropriate district planning committee meetings under the district’s site-based decision making plan – meetings have not been held to discuss the possibility of a RIF.

If this board goes through with a reduction in force at this time, it will result in the termination of several two-year contracts with 1 year left to go on each of these contracts. Therefore, according to TEA and TASB you will cost our district hundreds of thousands of dollars to pay off these contracts and legal fees.

Therefore, Mr. Weldon, I am requesting that you stop; evaluate the improper steps taken thus far, look at the options that are available to you and this school district. If you should decide to recommend a RIF, I suggest that you insure/document that you have followed all TASB guidelines to the letter.

This board does not have the authority to seek a RIF without the recommendation of the superintendent.

Wayland Whisenhant: Next to speak is Ms. Julia Swope.

Julia Swope: Good evening Superintendent Weldon and the Kountze ISD

Trustees. I am Julia Swope, I am the Director of Membership for the Texas

Classroom Teachers Association. So I may not be from you community I have a

job in this tonight because many of you teachers have known me for 20 years or

more. Which is on behalf of the 125 members of the Kountze Classroom

Teachers Association that I address you this evening. TCTA membership

includes a broad category of employees here in your district that work with

students and in the classroom we have teachers, librarians, counselors, coaches,

trainers and paraprofessionals in our association. Our Kountze ISD members are

concerned that the district is currently discussing eliminating jobs and possibly

reducing the amount of support staff for 2012-2013 school year. TCTA and

KCTA urge you to wait until you know for certain – how many people will

resign at the end of this school year. And how you will determine which

positions are expendable. For any non-contract employees, waiting until years

end means the district will have a better idea the effects of retirement and

attrition and the district can more accurately determine what you needs are going

to be and what the financial impact of retirement and attrition will have on this

district. If Kountze ISD intends to give notice of proposed non-renewal to term

contract employees on or before the 45th

calendar day, before the last day of

student instruction. The trustees have several more weeks to work with your

community and to work with your teachers to sort out the districts situation. For

term contact employees, KISD can give notice of proposed non-renewal up to

April 17th

. Which is several, several business days from now. TCTA and KCTA

urge you to create a review committee that includes Teachers. Try to identify

other economic solutions that would allow Kountze ISD to continue to employee

the teacher aides who are so important to classroom instruction and provide so

much needed support to our teachers. TCTA and KCTA urges trustees to

examine very closely the duties that employees actually perform on a daily basis

before the board proposes to eliminate positions that might appear redundant.

The effect of eliminating one employee and shifting that persons duties to one or

more employees can have substantially adverse consequences on the remaining

staff’s ability to do their job with jobs that might appear similar have very

different duties to perform. TCTA and KCTA think this approach would go a

long way towards substantially reducing speculation and fears that are negatively

impacting your community and your staff morale at this time, which I’m here to

witness. I would like to reiterated that we at TCTA in conjunction with our

KCTA members which is about 90% of your employment today wish to work

with the district to resolve this issue in a manner other than a reduction in force

or other than the elimination of jobs. I appreciate that you have given me this

opportunity to speak in a professional manner and address these concerns to you.

We appreciate your support of our employees, our members and your

employees. We thank you for your consideration; we thank you for your time

and commitment to this district. We stand ready and available to work with Mr.

Tanner and Hunt and our legal staff that is ready to work with you in any way we

can to help you through what are undoubtedly trying times. Although I’m hear

speaking to you in KISD, I want you to realize that we represent thousands of

members in Region V. As the state Director of Membership for TCTA for 27

years, I’ve worked with 1150 districts. In which what you are facing here in

Kountze, is not particularly unusual to with any of the other districts are facing.

But how you handle yourself during this time is very important. Thank you.

Wayland Whisenhant: Next to speak will be Ms. Hannah Daniel

Hannah Daniel: Hi..Hi, I’m Hannah and um, I coming from a little bit of a

different angle then most of the people that are will come up here tonight. They

come at you with a lot of facts, a lot of figures which honestly, I do have a lot of

facts and a lot of figures and I’ve put those out on power point and most people

in this room have them and I encourage you to look at them. However, I’m

coming to you as a former student of KISD. I graduated here in 2009. I was a

very active student. I was a member of, I played 4 different varsity sports all the

way through High School and I was a member of the Band all the way from

Middle School to High School. And I cannot tell you the invaluable lessons I

learned and how they have shaped me into the young women that I am today.

Um, I am currently a Music Education Major at Sam Houston State, but I also a

part-time group tennis job, so both athletics and music are very important parts

of my life today. Um, just looking back at the things I have learned in High

School, Music has shaped me into who I am, the career that I choose to pursue.

Making these giants cuts into what is an astounding music program here in

Kountze is not what needs to happen. No one ever spoke to Mr. Fife about what

was going on. He has taken this music program, which honestly, you can find it

on u-tube, if you want to. Kountze High School Band, like I think 1992 and you

can watch that clip and then you can look clips on-line from 07, 08, 09 and that

just the quality is just astounding and how in 14 years Mr. Fife has created a

superior program here in Kountze and not only without that program, I would

not have the career path that I’m doing today. Without having those private

lessons I and the truthful fact is that I probably could not have afford my own

private lessons and I would not be the musician I am today without having those.

I probably would have not been accepted in the band because I wouldn’t have

been a good enough player. And so, just having that background and those

resources to be available to me as a student just has helped me leaps and bounds.

And so, I just want to encourage you to rethink a lot of the cuts that ya’ll are

considering to make today, because I’ve just proven that fact that what he is

doing is working.

Wayland Whisenhant: Dallas Colton

Dallas Colton: Good evening. I also am a former student of Kountze High

School. I played in the band and sang in the choir for all 3 years of High School,

several years in Jr. High and I also am a current music education student.

There’s not much I can say that Hannah didn’t already say. Except, I read the

report that was issued and I found it to be full of falsehood and just silliness

altogether. I got a couple of laughs from reading the report. I would also like to

urge you to reconsider the things that were spoken about like I’d like to

encourage you to actually go and get some real information. That would

probably be helpful. I’m sorry; I’m having a hard time communicating myself.

The band program in Kountze has also helped shape me into the man I am today.

I received a full scholarship to McNeese State University to go and learn to

study music. There are several, several people, countless students that have gone

through this program and also received scholarships. Without which, most of us

would have not been able to attend college. And it was because of the private

lesson program. Thank you.

Wayland Whisenhant: Mr. Joe Penland

Joe Penland: Thank you very much. I hope that what’s driving all these letters

and the actions that are taking place is not dollars and cents alone. I’ve been on

the school board for 3 terms. We had to make some hard decisions back then.

I’ve run my own company for 38 years. I’ve always put a lot more interest, a lot

more stock in my people than the facilities or equipment that surrounded it. You

can have a fine school. You can have the best school as far as campuses in the

state of Texas or the United States but if you don’t have people like you’ve got

working for you today nobody is going to run your school but those people. You

people show up once a month and you attend your meeting; you have a lot of

duty on your shoulders, there’s no doubt, but there’s people out there, a lot of

them have taught you; a lot of them are teaching your kids, they’re teaching my

kids and my grandkids through this district. If all it is, is money look at your

fund balance. You’ve got places to look to cover a shortfall. We all know that’s

maybe to build something. You’re not fixing to spend 2.7 million dollars this

year to build another facility or repair an air conditioner or a bathroom. You

know it and I know it. So if you’ve got some places you’ve got to reach down

and get somebody to make this thing work for a year or so, please do so. Texas

is the leading state in the rig count today. There’s 1900 rigs running the United

States recovering oil and gas. You have 930 rigs running the state of Texas.

Within 2 years, you’ll have a surplus in this state because the revenue is gonna

come out of what we’re doing in this state. Look around you, it’s not just Hardin

County, things are happening in the state that will help the state’s budget to help

you cover your short fall. Last year you added money to your fund balance by a

couple a hundred thousand dollars. We’re talking about cutting peoples job that

amount to basically that after we make some cuts that we can make. There’s no

reason to send those letters out right now, you know it and I know it. Make sure

this is dollars and cents and it ain’t personal cause you’re laying the district on

the line for law suits that we’re gonna have to pay as taxpayers. Don’t do that to

us, don’t do it to this school, don’t do it to these people, don’t do it to this

community. Reach back and take your time. If you’re gonna vote on something

this serious, you better make sure everybody is in attendance. You can do that. I

mean somebody can forget a meeting they had to go to somewhere else or

somebody can fit this in. You took this job, you asked for our votes and now

you got it. Now sit up there and bare it on your shoulders. If you don’t like it,

resign, somebody will take your place.
