No. 56/2013(II)/PPS-II.— In pursuance of sub-paragraph (2) of paragraph 17 of the ElectionSymbols (Reservation & Allotment) Order, 1968, the Election Commission of India hereby makesthe following amendments to its Notification No. 56/2013/PPS-II, dated 18-1-2013, as amendedfrom time to time, namely:—

1. In Table II (State Parties), appended to the said Notification,—

(i) Against Sl. No. 9 in respect of the State of Karnataka, the following entries shall be insertedunder Columns No. 3, 4 and 5, respectively:—

In exercise of the powers conferred bysections 26, 32, 41, 42, 51 and 76 of the IndianForest Act, 1927 (16 of 1927), and all otherpowers enabling it in this behalf, theGovernment of Goa hereby makes thefollowing rules so as to further amend the Goa,Daman and Diu Forest Rules, 1964, namely:—

1. Short title and commencement.— Theserules may be called the Goa Forest(Amendment) Rules, 2013.

(2) They shall come into force at once.

2. Insertion of new rule 38A.— After rule 38of the Goa, Daman and Diu Forest Rules, 1964,the following rule shall be inserted, namely:—

“38A. Transit pass for imported timber.—(1) Notwithstanding anything contained in

these Rules, the timber as also other woodimported into India in a closed container, atMormugao Port or Panaji Port, Goa shall beissued transit pass on payment of such sum,based on the volume of such container, asmay be specified by the Conservator ofForests, with the previous sanction of theGovernment. There shall be no need foraffixing of transit hammer mark on suchtimber contained in container.

(2) Such closed container shall be sealedon payment. The transit pass shall be validfor a period of twelve (12) hours from thetime of its issue. The transit pass shall beverified at the border of the State of Goa.

(3) Such closed containers shall move onthe road, only during night time so as toprevent traffic congestion.”.

In exercise of the powers conferred byArticles 233 and 234 of the Constitution ofIndia read with section 20 of the Goa, Damanand Diu Reorganisation Act, 1987 (Central Act18 of 1987) and after consultation with the GoaPublic Service Commission and the High Courtof Bombay, as required by the said Articles 233and 234 of the Constitution of India, theGovernor of Goa is pleased to make thefollowing Rules, namely:—

1. Short title and commencement.— (1)These rules may be called the Goa JudicialService (Seniority) Rules, 2013.

(2) They shall be deemed to have come intoforce from the date of their publication in theOfficial Gazette.

2. Seniority.— (1) An officer appointed inaccordance with the rules of recruitment onregular basis shall be senior to personsappointed temporarily.

(2) Where more than one officer is promotedto a cadre at the same time, the inter-se--seniority of persons so promoted shall bedetermined in order in which their names arearranged in select list of promotees.

(3) Where direct recruitment is made to acadre, the inter-se-seniority of persons sorecruited shall be in the order in which theirnames are arranged in the select list:

Provided that in case of doubt, or wherethese Rules are silent, the order issued by theGovernment of India and/or Government ofGoa from time to time pertaining to regulationof seniority, shall apply so as to fix seniority ofJudicial Officers.

3. Seniority of District Judges to beappointed after these rules come into force.—Officers who are appointed under entries 1(a),1(b) or 1(c) in the Schedule to the Goa JudicialService Rules, 2013, their seniority shallbe regulated by a forty point roster inAppendix-I to these Rules.

4. Publication of Seniority List.— Every yearin the month of January, seniority lists ofofficers in all cadres shall be prepared andpublished by the High Court and the lists sopublished shall be used for the purpose ofmaking promotions to the next higher cadre.

CHAPTER-I

Preliminary

1. Short title and commencement.— (1)These rules may be called the Goa JudicialService Rules, 2013.

(2) Rule 3 shall be deemed to have come intoforce on 1-7-1996, and the remaining rules shallcome into force from the date of theirpublication in the Official Gazette.

2. Definitions.— In these rules, unless thecontext requires otherwise,—

(a) “Commission” means the Goa PublicService Commission;

(b) “Degree in Law” means a degreequalifying the holder for enrollment as anAdvocate under the Advocates Act, 1961(Central Act 25 of 1961);

(c) “Government” means the Governmentof Goa;

(d) “Government Advocate” includesGovernment Pleader, AdditionalGovernment Pleader, Assistant GovernmentPleader, Sub-Government Pleader and alsoAdvocate appointed by local bodies;

(e) “Governor” means the Governor ofGoa;

(f) “High Court” means the High Court ofBombay;

(g) “Official Gazette” means the GoaGovernment Gazette;

(h) “Public Prosecutor” means Additionaland Assistant Public Prosecutor, but doesnot include the full time and salaried PublicProsecutor;

(i) “Recruiting Authority” means the HighCourt;

(j) “Schedule” means the Scheduleappended to these Rules;

(k) “Service” means the Goa JudicialService;

(l) “State” means the State of Goa.

CHAPTER-II

Constitution of the Service

3. Constitution of the Scrvice.— (1) On andfrom the 1st day of July, 1996, there shall beconstituted a State Service known as the GoaJudicial Service.

(2) The service shall consist of the cadresspecified in column (2) of the Table belowsub-rule (3).

(3) The existing cadres specified in column(2) below shall be designated as the cadresspecified in the corresponding entries incolumn (1) of the said Table below and initiallythey shall constitute the service and theholders of the posts in said column (2) shallhold posts in said column (1) and theircondition of service shall be governed by theserules.

(5) Assured Career Progression Scales.— (i)A Civil Judge, Junior Division or a Senior CivilJudge shall be entitled to be considered forconferment of the First Assured CareerProgression Scale on completion of five yearsof service as Civil Judge, Junior Division ora Senior Civil Judge, as the case may be,if,—

(a) he has not been promoted;

(b) the High Court finds him fit to beconferred with First Assured CareerProgression Scale and his performance asreflected in annual confidential reports isnot less than average;

(ii) A Civil Judge, Junior Division or a SeniorCivil Judge shall be entitled to be consideredfor Second Assured Career Progression Scaleon completion of ten years of service as CivilJudge, Junior Division or a Senior Civil Judge,as the case may be, if,-----

(a) he has not been promoted;

(b) the High Court finds him fit to beconferred with Second Assured CareerProgression Scale and his performance asreflected in annual confidential reports isnot less than “Good”, for a continuous periodof five years commencing from any yearafter he gets the First Assured CareerProgression Scale:

Provided that no Judicial Officer shall beentitled to get the benefits of First AssuredCareer Progression Scale or Second AssuredCareer Progression Scale, if—

(a) his integrity is doubtful;

(b) more than once warning or cautionis issued to him;

Note:- Mere “advice” would not amount to

“warning” or “caution”.

(c) any of the minor penalties asmentioned in rule 11(i) to (iv) of theCentral Civil Services (Classification,Control and Appeal) Rules, 1965 isinflicted against him even on oneoccasion;

(d) his average disposal for more thanone year within the span of five years isfound to be “inadequate”;

(e) he is retired compulsorily or getsretirement voluntarily, even after therelevant span of five years and if his caseis pending for consideration for suchbenefit;

(f) for any other reason the High Courtfinds him unfit to be conferred with FirstAssured Career Progression Scale orSecond Assured Career ProgressionScale:

Provided further that, if the probationperiod of the Judicial Officer is extended,the grant of First Assured CareerProgression Scale or Second AssuredCareer Progression Scale, shall bedeferred proportionately to commen-surate with the extended probationperiod.

CHAPTER-III

Recruitment

4. Appointing Authority.— The AppointingAuthority for the cadre of District Judges andCivil Judges, Junior Division shall be theGovernor and for promotion to the cadre ofSenior Civil Judges shall be the High Court.

5. Method of recruitment, qualifications, agelimit, etc.— In respect of each category of postsspecified in column (2) of the Schedule hereto,the method of recruitment, minimumqualifications, age limit, etc., shall be asspecified in the corresponding entries incolumns (3) (4) and (5) thereof.

6. Recruitment by nomination or directrecruitment.— (1) (a) On or before the 15th dayof January of every year in case of the CivilJudge, Junior Division and on or before the31st day of March of every year in case of

District Judges, the Recruiting Authority shallbe informed of the number of existingvacancies and the vacancies that are likely tooccur within one year for the post of CivilJudge, Junior Division and District Judges.

(b) Every year the Recruiting Authorityshall, invite by advertisement in the OfficialGazette and in at least two newspapers,applications in such form as it may determine,from intending candidates, who possess thequalifications and experience for filling in thevacancies.

(c) For the purpose of shortlisting thecandidates, the Recruiting Authority may, ifnecessary, hold preliminary writtenexamination comprising of multiple choiceobjective type questions, which can bescrutinized by computers and call upon thecandidates obtaining the cut-off marks, as maybe fixed by the Recruiting Authority, to appearfor final written examination, maintaining theratio of 1:10 of the available vacancies to thesuccessful candidates:

Provided that if there are more than onecandidate who have secured identical cut-offmarks as fixed by the Recruiting Authority formaintaining ratio of 1:10, all such candidatesshall be called upon to appear for final writtenexamination.

(d) (i) The Recruiting Authority shall holdwritten examinations in Civil Laws andCriminal Laws, carrying 100 marks each,having duration of 3 hours each respectively,for the post of Civil Judge, Junior Division andfor the post of District Judge to be filled up bynomination.

(ii) The medium of written examination forthe post of Civil Judge, Junior Division shallbe either Konkani or Marathi or English. Thecandidate shall specifically mention in hisapplication form about his choice of medium.Choice once given shall not be allowed to bechanged subsequently in any case.

(iii) The medium of written examination forthe post of District Judge shall be English.

(e) The candidate applying for beingappointed by nomination who secures not less

than 50 marks in each paper shall be eligiblefor viva-voce carrying 50 marks:

Provided that the Scheduled Castes and

Scheduled Tribes candidates who secure not

less than 45% marks in each paper shall be

eligible for the viva-voce:

Provided further that the Recruiting

Authority shall call the candidates for viva-

-voce in the ratio of 1:3 of the available

vacancies to the successful candidates:

Provided also that if there are more than onecandidates who have secured identical cut--off marks as fixed by the Recruiting Authorityfor maintaining the ratio of 1:3, all suchcandidates shall be called upon to appear forviva-voce:

Provided also that only such candidates whohave obtained at least 40% of marks in viva--voce test shall be eligible for selection.

(f) The object of the viva-voce examinationunder these Rules is to assess the suitabilityof the candidate for the cadre by judging themental alertness, knowledge of law, clear andlogical exposition, balance of judgment, skills,attitude, ethics, powers of assimilation, powerof communication, character, intellectualdepth and the like of the candidate.

(2) (a) The mode of evaluating theperformance shall be specified in numericalmarks obtained in written and viva-voceexamination. The scheme of examination ofthe candidates including written and viva--voce shall be framed by the High Court inconsultation with the Commission.

(b) A candidate who has committed anycopying or misconduct during course ofwritten examination, or has been convicted incriminal case or is compulsorily retired,removed or dismissed from judicial service orcould not successfully complete probationperiod of any post in judicial service shall notbe eligible to appear for the competitiveexamination.

(3)(a) The Recruiting Authority shall, on thebasis of cumulative grade value secured by acandidate, prepare in the order of merit, a listof candidates eligible for appointment. Thenumber of names of candidates to be includedin the list shall be equal to the number ofvacancies notified.

(b) Besides the above list, the RecruitingAuthority shall prepare an additional list ofcandidates equal to ten percent of the numberof vacancies notified for recruitment or one,whichever is higher.

4(a) The Recruiting Authority shallrecommend the names of selected candidatesby completing the selection process.

(b) The Government, within two months ofthe names of the selected candidates beingforwarded to it, shall complete the process ofverification of antecedents and medicalexamination and issue appointment orders.

(c) The lists so prepared under clause (a) ofsub-rule (3) above shall be published in theOfficial Gazette and they shall cease to beoperative on the expiry of one year from thedate of such publication.

(d) The High Court may issue the postingorders after the appointment orders are issuedby the Government.

(e) Candidates included in the list preparedunder clause (a) of sub-rule (3) above and aftersuch list is exhausted, candidates from theadditional list prepared under clause (b) ofsub-rule (3), shall be considered forappointment in the order in which their namesappear in such lists and subject to rule 10, theymay be appointed by the Appointing Authorityin the vacancies notified. Inclusion of acandidate in any list prepared under sub-rule(3) shall not confer any right of appointmenton such candidate.

(5) Every candidate applying forappointment by direct recruitment shallfurnish certificates from two respectablepersons unconnected with his College or

(6) The decision of the Recruiting Authorityas to the eligibility or otherwise of a candidatefor admission to the written and viva-voceexamination shall be final.

(7) Candidates whose names are includedin the list prepared under clause (a) ofsub-rule (3) above shall be considered forappointment in the order in which their namesappear in the list and subject to rule 8, theymay be appointed by the Appointing Authorityin the vacancies notified. Candidates whosenames are included in the additional list maybe similarly appointed after the candidateswhose names are included in the list preparedunder sub-clause (a) of sub-rule (3) above havebeen appointed. Inclusion of the name ofa candidate in any list prepared undersub-rule (3) shall not confer any right ofappointment to such candidate.

7. Disqualification for appointment.— Aperson shall not be eligible for appointment tothe service if,—

(a) he is not a citizen of India; or

(b) he is compulsorily retired, removed ordismissed from judicial service or fromservice in Government or Statutory or LocalAuthority or failed to complete probationperiod in judicial service on any post, or inGovernment or Statutory or Local Authority;or

(c) he has been convicted of an offenceinvolving moral turpitude or he is or hasbeen permanently debarred or disqualifiedby the High Court or the Union PublicService Commission or any State PublicService Commission from appearing forexaminations or selections conducted by it;or

(d) he directly or indirectly influences theRecruiting Authority by any means for hiscandidature; or

(e) he is a man has more than one wifeliving and if a woman, has married a manalready having another wife; or

(f) he has more than two children.

Explanation.— For the purpose of thisclause, where a couple has only one child, anynumber of children born out of a singlesubsequent delivery shall be deemed to beone child:

Provided that, a person having more thantwo children on the date of commencementof the Goa Judicial Service Rules, 2005, i.e.30-06-2005, shall not be disqualified forappointment under this clause so longas the number of children he had on thedate of such commencement does notincrease:

Provided further that a child or more thanone child born in a single delivery within theperiod of one year from the date of suchcommencement shall not be taken intoconsideration for the purpose ofdisqualification mentioned in this clause.

8. Conditions relating to Suitability, Fitnessand Character.— No person selected forappointment by direct recruitment shall beappointed,—

(i) unless the Appointing Authority issatisfied that he is of good character and isin all respects suitable for appointment tothe service;

(ii) unless it is certified by the medicalauthority specified by the High Court thathe is medically fit to discharge the duties ofthe post to which he is selected forappointment.

9. Fees.— Every candidate for directrecruitment shall be required to pay such feesas may be specified in the advertisementinviting applications:

Provided that in the case of a candidatebelonging to Scheduled Caste/ScheduledTribe, the fees payable shall be one half of thefees specified in the advertisement for othercandidates.

10. Joining time for Appointment.— (1) Acandidate selected for direct recruitment shallreport for duty before the Authority on thedate specified in the order of appointment.

(2) Notwithstanding anything contained in

sub-rule (1), the Appointing Authority may,

on the application of the candidate, if satisfied

that there are good and sufficient reasons for

doing so, by order in writing, grant such

further time as it may deem necessary.

(3) The name of the candidate who fails toassume charge of the post within the timespecified in the sub-rule (1) or within thefurther time granted under sub-rule (2), shallstand deleted from the list of selectedcandidates and he shall cease to be eligiblefor appointment.

11. Appointment by promotion.— (1) To filla vacancy required to be filled by promotion,the Recruiting Authority shall take allnecessary steps well in advance so as tofinalise the list of persons considered eligiblefor promotion at least fifteen days before theoccurrence of the vacancy. For this purposethe Authority may follow an AnnualProgramme similar to the one specified insub-rule (1) rule 6 above.

(2) (a) Promotion of Civil Judges, JuniorDivision, to the post of Senior Civil Judges shallbe made on the basis of evaluation of theirJudgments carrying 50 marks, evaluation ofannual Confidential Reports carrying 20marks, Vigilance Reports carrying 10 marks,disposal remarks carrying 10 marks andSpecial Reports of the Heads of the Departmentunder whom the Judicial Officer has workedduring three years preceding the year ofselection carrying 10 marks.

(b) The Recruiting Authority shall draw alist of Judicial Officers from the zone ofconsideration out of those Civil Judges, JuniorDivision, who have obtained not less than 60%marks in the evaluation referred to in thepreceding clause, provided the selectioncommittee does not entertain any doubt about

integrity of the concerned Judicial Officer. Ifthe number of Judicial Officers who haveobtained at least 60% marks is more than thenumber of vacancies to be filled in next oneyear, they shall be picked up in the order oftheir seniority in the cadre of Civil Judges,Junior Division and their names in the selectlist shall be arranged in accordance with theirseniority in the cadre of Civil Judge, JuniorDivision. Appointments shall be made from thelist so prepared.

(c) An additional list of Officers equal to tenpercent of the expected number of vacanciesmay also be similarly prepared.

(3) (i) Promotion to 65% of the posts in thecadre of District Judge as specified in Schedulehereto shall be made by suitability test toexamine the legal knowledge, continuedefficiency and adequate knowledge of the caselaw. For promotion of Senior Civil Judges tothe cadre of District Judges, the RecruitingAuthority shall call upon the eligible JudicialOfficers in the ratio of 1:3 of the availablevacancies to submit their judgments forevaluation:

Provided that the Chief Justice may, forreasons to be recorded in writing, relax theratio in which Judicial Officers are called uponto submit their judgments for evaluation. Thesuitability for promotion of Senior Civil Judgesto the cadre of District Judges under this ruleshall be considered on the basis of evaluationof their judgments carrying 50 marks,evaluation of Annual Confidential Reportscarrying 20 marks, Vigilance Reports carrying10 marks, disposal remarks carrying 10 marksand special reports of the Head of theDepartments under whom the Judicial Officerhas worked during three years preceding theyear of selection carrying 10 marks and viva--voce examination carrying 50 marks.

Subject to clause (iii) of this sub-rule (3), theRecruiting Authority shall draw up a list ofofficers from the zone of consideration out ofthose Senior Civil Judges, who have obtainednot less than 60% marks in the evaluationreferred to in the preceding clause, provided

the selection committee does not entertain anydoubt about the integrity of the concernedJudicial Officer. If the number of JudicialOfficers who have obtained 60% marks or moreis more than the number of vacancies to befilled-up in the next one year, they shall bepicked up in the order of their seniority in thecadre of Senior Civil Judges and their namesin the select list shall be arranged inaccordance with their seniority in the cadreof Senior Civil Judges. Appointments shall bemade from the list so prepared.

(3) (ii) (a) For accelerated promotion ofSenior Civil Judges to the 10% of the posts ofDistrict Judges, as specified in the schedulehereto, the Recruiting Authority shall holda limited Departmental CompetitiveExaminations, carrying 200 marks havingduration of 90 minutes comprising of 100multiple choice objective type questions,which can be scrutinized by computers andcall upon the candidates obtaining the cut-offmarks, as may be fixed by the RecruitingAuthority, to appear for viva-voce in the ratioof 1:3 of the available vacancies:

Provided that if there are more than oneJudicial Officer who have secured identicalcut-off marks as fixed by the RecruitingAuthority for maintaining the ratio of 1:3, allsuch candidates shall be called upon to appearfor viva-voce.

(b) The Recruiting Authority shall call upononly those Judicial Officers to submit theirJudgments for evaluation, who would comein the zone of consideration for viva-voce.

(c) The final selection of such Senior CivilJudges for the accelerated promotion shall bemade on the basis of their performance at theabove referred examination carrying 200marks, Evaluation of their Judgments carrying50 marks, Annual Confidential Reportscarrying 20 marks, Vigilance Report carrying10 marks, Disposal Remarks carrying 10 marks,Special Reports of the Heads of the Departmentunder whom the Judicial Officer has workedduring three years preceding the year ofselection carrying 10 marks and viva-vocecarrying 50 marks.

(3) (iii) Only such Judicial Officers whoobtains at least 40% of marks in viva- voce testshall be eligible for being promoted to the 10%of the posts in the cadre of District Judges asspecified in Schedule hereto.

CHAPTER-IV

Probation and Officiation

12. Probation and Officiation.— (1) Allappointments to the service by nominationshall be on probation for a period of two years.

(2) All appointments by promotion shall beon officiating basis for a period of two years.

(3) The period of probation or officiation, asthe case may be, for reasons to be recorded inwriting, may be extended by the AppointingAuthority by such period not exceeding twoyears.

(4) Months before the end of the period ofprobation or officiation or before the extendedperiod of probation or officiation, as the casemay be, the appointing authority shallconsider the suitability of the person soappointed or promoted to hold the post towhich he was appointed or promoted, and—

(i) if found suitable, issue an Orderdeclaring him to have satisfactorilycompleted the period of probation orofficiation, as the case may be, and such anorder shall have effect from the date ofexpiry of the period of probation or officiation,including extended period, if any, as thecase may be;

(ii) if the Appointing Authority finds thatthe person is not suitable to hold the post towhich he was appointed or promoted, as thecase may be, shall by Order,—

(a) if he is a promotee, revert him to thepost which he held prior to his promotion;

(b) if he is a probationer, discharge himfrom service.

(5) A person shall not be considered to havesatisfactorily completed the period of probation

or officiation, as the case may be, unless aspecific order to that effect is passed. Anydelay in passing such an order shall not entitlethe person to be deemed to have satisfactorilycompleted the period of officiation or probation,as the case may be.

13. Discharge of a Probationer during theperiod of Probation.— Notwithstandinganything contained in rule 12, the AppointingAuthority may, at any time during the periodof probation, discharge from services, aprobationer on account of his unsuitability forthe service.

14. Confirmation.— A probationer who hasbeen declared to have satisfactorily completedhis probation and a promotee who has beendeclared to have satisfactorily completed hisperiod of officiation shall be confirmed as amember of the service in the category of postto which he was appointed or as the case maybe promoted, at the earliest opportunity in anysubstantive vacancy which may exist or arise.

15. Increment during the period of Probationor Officiation.— (1) A probationer or promoteemay draw the increments that fall due duringthe period of probation or officiation:

Provided that, he shall not, draw anyincrement after the expiry of the period ofprobation or officiation unless and until he isdeclared to have satisfactorily completed hisprobation or officiation, as the case may be.

(2) When a probationer or promotee isdeclared to have satisfactorily completed hisprobation or officiation, as the case may be,he shall draw, as from the date such ordertakes effect, the pay he would have drawn, hadhe been allowed the increments for the wholeof his service from the date of his appointmenton probation or officiation, as the case may be.

CHAPTER-V

Miscellaneous

16. Age of Superannuation.— Everymember of the Judicial Service shall retire bysuperannuation on attaining the age of 60years, subject to clearance by Special ReviewCommittee constituted by the Chief Justice of

the High Court for the purpose, whichCommittee shall review the cases of all JudicialOfficers by following the procedure prescribedfor compulsory retirement under the ServiceRules applicable to them, on their attaining theage of 58 years:

Provided that the High Court may in suitablecases re-employ District Judges, subject totheir physical fitness, up to the age of 62 yearsaccording to exigencies of situation.

17. Addition of certain service for purposeof pension.— An Advocate appointed as a CivilJudge, Junior Division or a District Judge shallbe entitled to reckon as service qualifyingfor superannuation Pension, the actual periodof practice put in by him at the Bar notexceeding three years or seven yearsrespectively.

18. Retirement in Public Interest.— (1)Notwithstanding anything contained inthese Rules the Governor shall, on therecommendation of the High Court, if he is ofthe opinion that it is in the public interest so todo, have the absolute right to retire anymember of the service when he attains the ageof 50/55/58 years by giving him a notice of notless than three months in writing or threemonths pay and allowances in lieu of suchnotice.

(2) Whether a member of the service shouldbe retired in public interest under sub-rule (1)shall be considered at least three times, thatis, when he is about to attain the age of 50years, 55 years and 58 years:

Provided that nothing in this rule shall beconstrued as preventing consideration of amember of the service at any time afterattaining the age of 50 years or 55 years or58 years, as the case may be, for the purposeof retiring him in the public interest despitesuch member was considered earlier as per thissub-rule (2).

19. Knowledge of Konkani and Marathi.—For appointment by direct recruitment,knowledge of Konkani is essential. Knowledgeof Marathi will be desirable.

20. Residuary Provision.— The Conditionsof Service of the members of the service forwhich no express provision is made in theseRules shall be determined by the rules andOrders for the time being applicable to officersof Goa Civil Service of similar ranks.

21. Training .— (1) (a) Every personappointed by direct recruitment to the serviceshall, before he is given a posting, undergosuch training as may be prescribed by the HighCourt from time to time.

(b) A person may be deemed unsuitable forthe purpose of rule 13 if his performance duringthe training is found to be unsatisfactory.

(2) Every member of the service shall begiven such periodical training as the HighCourt may, from time to time, prescribe.

22. Repeal and Savings.— (1) On and fromthe date of commencement of these Rules, theGoa Judicial Service Rules, 2005 shall standrepealed:

Provided that such repeal shall not affect the

previous operation of the rules so repealed and

anything done or any action taken shall, in so

far as it is not inconsistent with the provision

of these rules, be deemed to have been done

or taken under the corresponding provisions

of these Rules and shall continue to be in force

unless and until specifically invalidated under

the present Rules.

(2) All the rules/regulations/resolutions andpractices, so far as they are inconsistent withthese rules stand repealed.

The Government of Goa is hereby pleasedto amend the Goa (Rules for admission to theSuper-speciality Course, MagistrateChirurgiae (M. Ch.) Degree in Neuro-surgeryof the Goa University at the Goa MedicalCollege) Rules, 2008, as publishedvide Notification No. 1/1/2008-II/PHDdated 21-05-2008, in the Official Gazette,Extraordinary, Series I No. 8 dated22-05-2008, as follows, namely:—

1. Short title and commencement.— (1)These rules may be called The Goa (Rulesfor admission to the Super-speciality Course,Magister Chirurgiae (M. Ch.) Degree in Neuro-

-surgery of the Goa University at the GoaMedical College) (Amendment) Rules, 2013.

(2) They shall come into force from thedate of their publication in the Official Gazette.

2. Amendment of rule 2.— In rule 2 of theGoa (Rules for admission to the Super--speciality Course, Magister Chirurgiae(M. Ch.) Degree in Neuro-surgery of the GoaUniversity at the Goa Medical College) Rules,2008 (hereinafter referred to as the “principalRules”), for the word “one”, the word “two”shall be substituted.

3. Amendment of rule 5.— In rule 5 of the‘principal Rules’, for the sub-rule (3), thefollowing sub-rule shall be substituted,namely:—

“(3) The interview shall be held by aduly constituted Board for the purpose. Afinal merit list will be prepared based onthe candidates’ performance in both, theentrance examination and the interview.The entrance examination shall carry 85%marks and the interview shall carry 15%

marks. The 15% marks shall be for theknowledge of Neuro-surgery and relatedknowledge in medical subjects. Thecandidate holding the highest marks inthe combined merit list after entranceexamination and interview shall beselected for the said degree course. Themerit list will also have three othercandidates in the waiting list who will beoffered admission in order of their positionin the merit list, if the candidate placed
