A refugee is an alien outside the United States whois unable or unwilling to return to his or her

country of nationality because of persecution or a well-founded fear of persecution. (See Appendix 2, p. A.2-9.)Claims of persecution must be based on race, religion,nationality, membership in a particular social group, orpolitical opinion. Persons within their country ofnationality may be treated as refugees, provided that thePresident, after consultation with Congress, declares thatthey are of special humanitarian concern to the UnitedStates. The definition of refugee set forth in theImmigration and Nationality Act, as amended by theRefugee Act of 1980, conforms to the 1967 United NationsProtocol on Refugees.

U.S. Refugee ProgramThe United States first recognized refugees for entry intothe country in fiscal year 1946. After that time manydifferent refugee programs were enacted on an ad hocbasis, including the Displaced Persons Act and the Cubanand Indochinese Refugee Adjustment Acts. During thefirst decade of refugee programs, virtually all refugeesentered the United States as immigrants. Since 1957, mostrefugees either have been paroled into the United Statesunder special authority granted to the Attorney General bythe Immigration and Nationality Act, or have entered in astatutory refugee status. Each of these refugees may beadjusted to lawful permanent resident status at a later date.

Chart C depicts initial refugee admissions and adjustmentsto lawful permanent resident status for the period 1946-99.This graph demonstrates the time lag between initialadmission and adjustment to immigrant status. At theonset of parole programs there generally were nomechanisms for adjustment to permanent status, thuscreating a recurring need for special legislation. TheRefugee Act of 1980 addressed this situation by allowingrefugees to adjust status one year after arrival. Somerefugees do not adjust status for several years and somerefugees never adjust status.

Admission ceilingsAt the beginning of each fiscal year, the President, afterconsultation with Congress to review the worldwiderefugee situation, determines the number of refugees inneed of resettlement who are of special humanitarianconcern to the United States. The President thenestablishes the authorized number of admissions for thatfiscal year. During the year, changes in the need forresettlement may require revisions in the overall limit onrefugee admissions or reallocation among areas of theworld. The admission ceiling of 78,000 for 1999 wasestablished and later raised and reallocated amonggeographic regions as follows:

The authorized admission levels set the maximum numberof refugees allowed to enter the United States in a fiscalyear from each of the geographic areas of chargeability.The authorized ceiling was decreased from 83,000 in 1998to 78,000 in 1999, resuming a downward trend since thepeak of 142,000 in 1992. An unallocated funded reserveof 2,000 was placed in the 1999 ceiling to allow for smallincreases in one or more areas as needed withoutsubtracting refugee authorized admissions from otherareas. However, the need to resettle more Kosovarrefugees during 1999 caused the President to raise thelimit for Europe to 61,000 and the overall limit to 91,000.

This section presents information on persons who are admitted to the United Statesbecause of persecution abroad, including the number and characteristics of persons applying, approved, arriving, and adjusting to lawful permanent resident status.

The ceiling for East Asia includes certain VietnameseAmerasians, who enter the United States with immigrantvisas. Although these aliens are immigrants rather thanrefugees, they are included in the refugee ceiling since theyare eligible for refugee benefits in the United States. Only241 Amerasians, including their family members, enteredthe United States in 1999. They are included in theimmigrant rather than the refugee tables in the StatisticalYearbook. The Amerasian program is ending, since mostof the eligible persons have already been identified andentered the United States.

Criteria for refugee statusDuring 1999, refugees were interviewed and approved foradmission to the United States by officers in 15 of theService’s 39 overseas offices. To qualify for admission tothe United States as a refugee, each applicant must meet all

of the following criteria: be a refugee as set forth in theRefugee Act of 1980; be among the types of refugeesdetermined to be of special humanitarian concern to theUnited States; be admissible under the Immigration andNationality Act; and not be firmly resettled in any foreigncountry. Spouses and minor children of qualifyingrefugees also enter the United States as refugees, eitheraccompanying or following to join the principal refugee.Occasionally these family members gain refugee statusafter arriving in the United States; this was the case with109 people in 1999.

Special program for applicants from the formerSoviet Union Beginning in 1990, the administrative processing ofrefugee applicants residing in the Soviet Union was shiftedto the United States. Applicants from the former Soviet

Union are now required to submit an initial questionnaireto the State Department’s Washington Processing Center(WPC) in Rosslyn, Virginia. The WPC establishesinterview priority for applications based on informationsupplied on the initial questionnaires and schedulesinterviews in Moscow. On the day of their interview,applicants submit completed refugee applications toService officers in Moscow. Since 1990, those applicationshave been counted as filed on the interview date.

Applicants from the former Soviet Union who were inother countries at the start of fiscal year 1990 are stillallowed to submit applications for refugee status directly toother INS refugee processing posts. Only 10 Sovietapplications were filed outside of Moscow in 1999,including 4 spouses and children who received refugeestatus in the United States.

Data Overview

Applications (Tables B, 21-22)The number of applications for refugee status filed with theINS decreased from 1998 (124,777) to 1999 (111,576)(Table 21). The leading countries of chargeability of theapplicants were Bosnia-Herzegovina with 27 percent of the

applications, Yugoslavia (17—principally Kosovars), theformer Soviet Union (15), Vietnam (8), Cuba (7), andSomalia (6) (Table B and Table 22). Among those countriesof chargeability from which at least 1,000 applications werefiled in 1999, the largest percentage increases over 1998were in applications filed by nationals from Yugoslavia(from 3 to 18,415), Somalia (from 2,638 to 6,722, 154.8percent), Iran (1,691 to 3,696, 118.6 percent), and Liberia(4,228 to 4,640, 9.7 percent); the largest percentagedecreases were in applications filed by nationals of theformer Soviet Union (from 35,008 to 16,882, -51.8 percent),Vietnam (17,240 to 8,856, -48.6 percent), and Croatia(3,111 to 1,681, -46.0 percent). Overall, among the fivegeographic regions of chargeability from which applicationsfor refugee status were filed in 1999, applications filed bynationals from the Near East/South Asia and Africaincreased about 53 and 34 percent, respectively, while thosefiled by nationals from the East Asia, Europe, and LatinAmerica/Caribbean geographic regions decreased 46, 15,and 8 percent, respectively, over 1998.

Approvals (Tables B, 21-23)The total number of refugees approved for admission to theUnited States was 17 percent higher in 1999 (85,592) thanin 1998 (73,198) (Table 23). The leading countries of

chargeability were Bosnia-Herzegovina with 24,766approvals, Yugoslavia (17,970—principally Kosovars), theformer Soviet Union (11,696), Vietnam (6,253), Somalia(5,668), Sudan (2,858), Cuba (2,701), and Ethiopia (2,581)(Table B and Table 22). These eight countries accountedfor 87 percent of all approvals in 1999. The numberapproved from the former Soviet Union decreased 38percent from 1998, reflecting a downward trend inapplications in the past seven years. The numbers ofrefugees approved from the Latin America, Africa, theNear East, and Europe regions increased by 131, 84, 20,and 19 percent, respectively, in 1999. The significantincrease in the Latin America geographic region wasattributed to a large increase (131 percent) in the numberof refugees approved from Cuba. Refugee approvals forVietnam decreased more than 50 percent. All Vietnameserefugee processing centers outside Vietnam were closed bythe end of 1997. Residents of former refugee camps wereasked to return to Vietnam. Their cases are processedthrough a special program called the ResettlementOpportunity for Vietnamese Returnees (ROVR) inVietnam. The ROVR program adjudicated 4,073 cases andapproved 3,684 cases in 1999.

DependentsRefugee figures include spouses and children who arecleared to join principal refugees already in the UnitedStates, and they count against the annual ceiling. Becauseof these family reunification cases, the data continue toshow refugees being approved and arriving for some timeafter active refugee processing has ended for nationals ofcertain countries. Most of the refugee flow from Europe infiscal year 1999, other than from the former Soviet Unionand Yugoslavia, was family reunification cases. Overall,2.0 percent of the applications and 2.1 percent of theapprovals were family reunification cases. In comparisonwith the number of applications filed and refugeesapproved within each geographic region, the Africa regionhad the highest percentage of family reunification casesamong applications, 4.8 percent. The Near East region hadthe highest percentage among approvals, 5.3 percent.

Arrivals (Tables 23, 24)Refugee arrivals into the United States increased to 85,076in 1999 from 76,181 in 1998 (Tables B, 23, and 24). 1 The

increase was largely attributed to the increase in refugeearrivals from Yugoslavia, Croatia, Ethiopia, Somalia,Sudan, and Liberia. Bosnia-Herzegovina (22,699),Yugoslavia (14,280), Vietnam (9,622), Ukraine (8,649),Somalia (4,320), and Russia (4,386) were the leadingcountries for refugee arrivals in 1999, comprising 75percent of the total. The time lag between approval of arefugee application and the refugee’s arrival in the UnitedStates may be several months or more. After approval,refugees must undergo health and security clearances, havesponsorship and placement arranged, and in some cases gothrough orientation and English language training. Thistime lag accounts for the discrepancies between approvaland arrival figures in any given year.

Understanding the Data

Data CollectionThe Immigration and Naturalization Service collects dataon refugees at three points during processing: when theyapply for refugee status abroad; when they are admitted tothe United States; and when they adjust to lawfulpermanent resident status. The INS overseas officescollect data on applicants for refugee status. Each officecompletes INS Form G-319, Report of Applicants forRefugee Status under Section 207, which reports refugeecasework by the country to which each applicant ischargeable.

Both the Bureau for Refugee Programs (Department ofState) and the Office of Refugee Resettlement (Departmentof Health and Human Services) collect data on refugeesadmitted to the United States. The Bureau for RefugeePrograms collects data through the IntergovernmentalOrganization for Migration, which is a nongovernmentalorganization that arranges the transportation of refugees tothe United States. The Office of Refugee Resettlement,responsible for the disbursement of funds for refugeebenefits, collects detailed data on the characteristics ofrefugees at the time they are initially admitted to the UnitedStates.

The Immigration and Naturalization Service collects dataon refugees adjusting to lawful permanent resident statusas part of its immigrant data series gathered by theComputer Linked Application Information ManagementSystems (CLAIMS). The data collected includedemographic variables as well as immigration-orientedvariables (see Immigrants section). This is the only stagein the refugee process where the INS collects detailedinformation about the characteristics of refugees.

Limitations of DataAfter careful consideration of the reporting requirementsand limitations of data collected by the INS, it was decidedthat the Statistical Yearbook would present refugee arrivalstatistics from the Bureau for Refugee Programs,Department of State. This source counts the actualnumber of refugees arriving in the United States in eachfiscal year. Comparison of refugee arrival data fromeditions of the Yearbook prior to 1996 with the present

edition must be made with caution. From 1987 to 1995refugee arrival data presented in the Yearbook were derivedfrom the INS’s Nonimmigrant Information System (NIIS).This system compiled refugee arrival data by country ofcitizenship on a monthly basis from INS Form I-94,Arrival/Departure Record (see Nonimmigrants section).However, since this system records each entry of a personwith nonimmigrant status, a refugee traveling abroad andreturning to the United States may be counted more thanonce during a fiscal year.

An asylee is an alien in the United States who isunable or unwilling to return to his or her country of

nationality because of persecution or a well-founded fearof persecution. (See Appendix 2, p. A.2-2.) An asyleemust meet the same criteria as a refugee; the only differenceis the location of the person upon application—the potentialasylee is in the United States or applying for admission at aport of entry, and the potential refugee is outside the UnitedStates. The Immigration and Nationality Act, as amendedby the Refugee Act of 1980, regulates U.S. asylum policy aswell as governing refugee procedures. The Act, for the firsttime, established a statutory basis for granting asylum in theUnited States consistent with the 1967 United NationsProtocol on Refugees.

U.S. Asylum ProgramFiling of claimsAny alien physically present in the United States or at aport of entry may request asylum in the United States.According to the Refugee Act, current immigration status,whether legal or illegal, is not relevant to an applicant’sasylum claim. Aliens may apply for asylum in one of twoways: with an INS asylum officer; or, if apprehended, withan immigration judge as part of a removal hearing.Traditionally, aliens who appeared at ports of entry withoutproper documents and requested asylum were referred forexclusion hearings; however, the Illegal ImmigrationReform and Immigrant Responsibility Act (IIRIRA) of1996 made major revisions to the procedure, effective onApril 1, 1997. Under the new law, such aliens are referredto asylum officers for credible fear interviews. Theseinterviews are not formal asylum hearings. The purpose ofthe interviews is to determine whether aliens have crediblefear of persecution and are thus eligible to apply forasylum before an immigration judge. In credible fearinterviews, aliens only need to show that there is asignificant possibility that they might qualify for asylum.To be granted asylum, aliens must show they have beenpersecuted in the past or have a well-founded fear ofpersecution. An alien may request that an immigrationjudge review a negative determination by the INS on acredible fear claim. The data reported in this sectionpertain only to asylum cases filed with INS asylum

officers. Aliens denied asylum by the INS may renewasylum claims with an immigration judge.

Adjudication of claimsOn April 2, 1991, the Asylum Officer Corps (AOC)assumed responsibility within INS for the adjudication ofasylum claims that were filed with the INS. Before thatdate, such claims had been heard by examiners in INSdistrict offices. During fiscal year 1999, asylum officersworked from eight sites in the United States—Arlington,VA, Chicago, Houston, Los Angeles, Miami, New YorkCity, Newark, NJ, and San Francisco. Applicants who didnot live near these locations were interviewed by asylumofficers who traveled to other INS offices.

In March 1994, the INS published proposed regulationsdesigned to streamline the asylum decision process,discourage the filing of frivolous claims, and in cases ofclaims that do not appear to meet the standards forgranting asylum, integrate the work of asylum officerswith the work of the immigration judges in the ExecutiveOffice for Immigration Review (EOIR), an independentJustice Department agency. The final asylum reformregulations were published in December 1994, and tookeffect on January 4, 1995.

Under asylum reform, the INS standard is to conduct theasylum interview within 43 days after the claim is filed, andto identify and grant those cases that have merit (generallyin 60 days from the date of filing the application). If theINS asylum officer does not find the claim to be grantable,the applicant is referred immediately for removalproceedings before EOIR (unless the alien is still in a legalstatus). The immigration judge may grant the claim or mayissue a denial and an order of removal. Under this system,INS asylum officers issue relatively few denials, but aninterview followed by a referral to EOIR represents theasylum officer’s judgment that the application is not readilygrantable. The INS will issue a denial (and cannot refer thecase) when the applicant is still in a legal status. Anapplicant who fails without good cause to keep a scheduledappointment for an asylum interview is referredimmediately to EOIR for removal proceedings; this isconsidered to be one type of case closure.

III. ASYLEES

This section presents information on persons who come to the United States to seekasylum from persecution abroad, including the number and characteristics of persons who filed, were granted asylum, and adjusted to lawful permanent resident status.

Beginning in 1997, the AOC also began conductingcredible fear interviews as required by IIRIRA andinterviewing applicants for refugee status at INS overseaslocations.

Data Overview Applications filed (Chart D, Tables 25, 27)The annual number of asylum applications filed with theINS has fluctuated greatly since the effective date of theRefugee Act of 1980, as shown in Chart D. In fiscal year1999, 42,207 asylum cases were filed or reopened. Thesecases involved 60,781 individuals. The number of casesdeclined 18 percent from the 51,176 cases filed in 1998(Table 25). The decline in 1999 was largely due todecreases in claims filed or reopened by nationals ofGuatemala, El Salvador, India, and Mexico. However,there were large increases in claims by nationals ofIndonesia and Somalia.

In 1999, 32,711 new claims for asylum were filed with theINS. The People’s Republic of China, with 4,209 newclaims, ranked first, followed by Somalia (3,125), Haiti(2,492), Indonesia (2,330), Mexico (2,251), and ElSalvador (2,008) (Table 27). Individuals from therepublics of the former Soviet Union filed 2,343 newclaims; two-thirds were from Russia and Armenia. A malewas the principal applicant in 62 percent (20,172) of thenew claims filed. About 56 percent of all individualsinvolved in new claims are male.

Nearly 9,500 asylum cases were reopened in 1999, whichaccounted for 22 percent of the applications received(Table 27). The leading countries of nationality of thereopened cases were Guatemala (1,681), El Salvador(1,046), the People’s Republic of China (1,027), and Haiti(548). The republics of the former Soviet Union had 730cases.

The number of reopened cases in 1999 was less than one-half of the cases reopened in 1998. An automatic functiontriggers the reopening of cases that were administrativelyclosed when aliens apply for renewal of their employmentauthorization. Those cases were administratively closeddue to a failure to appear for the asylum interview or aninvalid mailing address. This function also automaticallyreschedules an interview. Some of these reopened casesmay qualify under the terms of the American BaptistChurches (ABC) vs. Thornburgh settlement.

Trends in asylum applications filed by nationalsfrom Central America (Tables C, 27)For over a decade, nationals from Central Americadominated the annual number of asylum applications filedin the United States. From 1986 to 1992, about half of allasylum applications were filed by Central Americans. By1993 and 1994, that percentage had fallen somewhat, but itremained at about 40 percent of the total applications filed.Then, the number of applicants from Central Americasurged to a new height in the next two years, well over halfof all asylum applicants. A sharp decline in cases filed byNicaraguans was later offset by a sharp increase in casesfiled by Guatemalans and Salvadorans. Beginning in 1997,the numbers started a sharp decline largely due to thetermination of the filing period under the terms of theAmerican Baptist Churches (ABC) vs. Thornburghsettlement. As a result, Central Americans accounted forabout 10 percent of the new claims and 16 percent of thetotal filed and reopened in 1999. The trend in claims fromCentral America is shown in Table C.

During the 1990s, the trend in asylum claims filed orreopened by nationals from Central America has beendriven in large part by ABC cases. Under the terms of this

1991 class action lawsuit settlement, many nationals of ElSalvador and Guatemala were allowed to file or renew theirclaims for asylum. Nationals of Guatemala had a filingdeadline of March 31, 1992, which was the peak year forclaims from this country. The 187,000 Salvadorans whohad registered for Temporary Protected Status (TPS) in1991 became eligible to file for asylum at the expiration oftheir TPS period in 1992. They were later grantedadditional time under deferred enforced departure periodswhich extended until December 1994, and they ultimatelyhad until January 31, 1996 to apply for asylum under theABC agreement. The number of ABC claims filed bySalvadorans surged during fiscal year 1996 before thefiling deadline. These claims are heard under the pre-reform regulations. Applications filed after the ABC filingdeadline were processed as reform filings, except thoseABC cases that were closed by the EOIR or federal courtsand were not previously filed with the INS. Under thesettlement, once the latter cases are identified by the INS,they are treated as ABC filings instead of reform filings.During 1999, 2,498 cases were identified as either filed orreopened as ABC cases.

On November 19, 1997, the Nicaraguan Adjustment andCentral American Relief Act (NACARA) was signed intolaw. Section 203 of the NACARA permits certainGuatemalans, Salvadorans and nationals of former Sovietbloc countries to apply for suspension of deportation orspecial rule cancellation of removal under the moregenerous standards in effect before the 1996 immigrationlaw. Individuals granted relief under NACARA arepermitted to remain in the United States as lawfulpermanent resident aliens. All ABC class members, whoare eligible for ABC benefits and have asylumapplications pending with the INS, also are eligible toapply for the NACARA benefits with the INS AsylumProgram.

Cases completed (Tables 25, 27, 28)During fiscal year 1999, the Asylum Officer Corpscompleted work on 55,196 claims and adjudicated about 63percent (34,544) of them (Table 25). The number of casesgranted in 1999 was 13,241, representing 38.3 percent ofthe cases adjudicated compared to the 23.3 percentapproval rate in fiscal year 1998. The 13,241 granted casesincluded 17,800 individuals—principals, spouses, andchildren (Tables 27 and 28). The leading countries ofnationality were Somalia with 2,108 granted cases,Indonesia (1,120), the People’s Republic of China (940),and Ethiopia (914) (Table 27).

There are special procedures for adjudicating cases basedon coercive population control. Section 601 of the IIRIRAstipulates that a person qualifies as a refugee or asyleepersecuted for political opinion if forced to undergo, has awell founded fear of being compelled to undergo, or resistsa coercive population-control procedure. It sets acombined annual ceiling of 1,000 persons who may begranted refugee or asylee status under this provision. Boththe INS and the Executive Office for Immigration Review(EOIR) grant conditional asylee status to qualifiedapplicants each year under this provision—status that is notsubject to the 1,000 annual ceiling (currently, there aremore than 1,000 conditional grants in a year). At thebeginning of a new fiscal year, the INS Asylum Officeissues 1,000 final grants—counted toward the annualceiling of the previous year—to those who have received aconditional asylee status from either agency in previousfiscal years. The selection criterion for final grants is thedate of the conditional grants. Those who received theirconditional grants earlier would receive their final grantsfirst. At the beginning of fiscal year 2000, the INS issuedthe 1,000 fiscal year 1999 final grants for asylum status to168 individuals who received their conditional grants fromthe INS, 810 whose conditional grants were made by

immigration judges, and 22 whose conditional grants weremade by the Board of Immigration Appeals. China was thecountry of origin of all grants. No one was granted refugeestatus in fiscal year 1999 based on coercive population-control measures.

Cases pending (Tables 27, 28)The number of asylum cases pending for adjudicationdecreased about 4 percent, from 358,255 in 1998 to342,485 in 1999. Cases filed by nationals of El Salvador(178,868), Guatemala (100,379), Haiti (15,180), andNicaragua (13,708), accounted for about 90 percent of thepending cases. The ABC cases, which also can be handledunder the NACARA provisions, comprised 90 percent ofthe Salvadoran and Guatemalan cases filed, and 79 percentof all pending cases. A large number of Nicaraguan andHaitian pending cases also will be eligible for theNACARA benefits.

Credible fear interviewsDuring fiscal year 1999, about 6,503 aliens appeared atports of entry without proper documents and requestedasylum. Most of these aliens were subsequently referred toasylum officers for credible fear interviews. Nationals ofthe People’s Republic of China submitted the mostapplications (2,150), followed by Haiti (1,004) and SriLanka (728). These three countries accounted for almost60 percent of all applications in 1999. Some applicantschange their mind and decide to withdraw their asylumapplications before a credible fear interview takes place.The Asylum Officer Corps made 5,829 credible feardeterminations in 1999. The total approval rate for thecases not withdrawn was 97.9 percent.

Understanding the DataData CollectionPrior to April 1, 1991, data on asylum applicants reflectcases filed with INS district directors and, subsequently,cases filed with INS asylum officers on Form I-589(Request for Asylum in the United States). A centralized,automated data system (Refugee, Asylum, and ParoleSystem—RAPS) supports the processing of the existingcaseload and new asylum applications. The systemsupports case tracking, schedules and controls interviews,and generates management and statistical reports. Thesystem reports asylum casework by nationality and othercharacteristics of asylum applicants. Data can be reportedby case or by the number of persons covered, since a casemay include more than one person. Data on asylumapplicants have been collected by the INS for selectednationalities since July 1980, and for all nationalities sinceJune 1983.

As with refugees, the Immigration and NaturalizationService collects data on asylees adjusting to lawfulpermanent resident status in the Computer LinkedApplication Information Management Systems (CLAIMS)(see Immigrants section). Adjustment to immigrant statuswas the only point at which detailed characteristics ofasylees were collected prior to 1992. The RAPS systemprovides data on selected characteristics of asylum seekersand asylees at an earlier time.

The number of asylum applications filed is defined here asthe sum of new applications received and applicationsreopened during the year. Tables 27 and 28 show thenumber of applications that were reopened during the year.Most of these are cases that had been closed earlier withouta decision. The tabulations also show the number of casesreferred to immigration judges, with and without aninterview. A referral due to failure to keep an appointmentfor an interview without good cause is consideredcomparable, for statistical purposes, to a closed case. Theapproval rate is calculated as the number of casesgranted/approved divided by the number of casesadjudicated, which is defined as the casesgranted/approved, denied, and referred to EOIR followingan interview.

Limitations of DataThe figures shown here for fiscal year 1999 differ slightlyfrom preliminary statistics released by the Asylum Divisionin November 1999. The data presented here were tabulatedfrom the RAPS system three months after the close of thefiscal year and incorporate late additions and corrections tothe database. Cases entered into the RAPS system duringfiscal year 1999 with filing dates in previous fiscal yearswere treated as new cases in these tabulations. Othercorrections resulted in a decrease from 360,247 to 358,255in the pending caseload as reported in the 1998 StatisticalYearbook and at the beginning of fiscal year 1999 in thisedition. Another change between 1998 and 1999 concernsthe identification of applicants from the former SovietUnion. Due to improvements in data collection, only 1new filing in 1999 was assigned to an unspecified republic.

It is possible for an asylum case to have more than oneaction during a year, particularly if the claimant fails topursue a claim and later reopens it. Therefore, some claimsmay be double-counted as received and reopened, or closedand denied or granted. For this reason, and due to recentgrowth in the number of reopened claims, the pendingcaseload at the end of the year can no longer be calculatedby taking the pending caseload at the beginning of the year,adding claims filed, and subtracting claims completed.

Data on applicants for asylum collected by the Immigrationand Naturalization Service historically have covered onlycases filed with the INS. Information has not beenavailable on cases filed by aliens after the INS has placedthe alien in removal proceedings before an immigrationjudge in the Executive Office for Immigration Review. Thetwo agencies are working to integrate their data systems toprovide these data in the future. Asylum was granted byEOIR to approximately 8,400 individuals in 1999;therefore, the total number of individuals granted asylum byboth agencies was more than 26,000.

Principal applicants whose asylum applications aresuccessful can apply for their spouses and minor children,whether they are in the United States or abroad, and these

relatives also receive status as asylees. The RAPS systemcollects information on the spouses and children of asylumapplicants only if they are included on the principal’sapplication. Information regarding relatives whoseprincipals petition for them after receiving asylum iscollected by the CLAIMS and is not included in any table inthis publication. The total number of relatives approved forasylum after the initial appeal of their sponsors is unknown;however, approximately 1,850 relatives in the United Stateswere granted asylee status in 1999. The data collected bythe INS at the time asylees adjust to permanent residentstatus include all aliens who adjust regardless of whetherthey were granted asylum by the INS, immigration judges,or the Board of Immigration Appeals. Adjustment data alsoinclude all spouses and children of persons granted asylum.
