Under Article 102 of the Charter of the United Nations, every treaty and every international agreement en-tered into by any Member of the United Nations after the coming into force of the Charter shall, as soon as pos-sible, be registered with the Secretariat and published by it. Furthermore, no party to a treaty or international agreement subject to registration which has not been registered may invoke that treaty or agreement before any organ of the United Nations. The General Assembly, by resolution 97 (I), established regulations to give effect to Article 102 of the Charter (see text of the regulations, vol. 859, p. VIII; https://treaties.un.org/doc/source/publications/practice/registration_and_publication.pdf).

The terms "treaty" and "international agreement" have not been defined either in the Charter or in the reg-ulations, and the Secretariat follows the principle that it acts in accordance with the position of the Member State submitting an instrument for registration that, so far as that party is concerned, the instrument is a treaty or an international agreement within the meaning of Article 102. Registration of an instrument submitted by a Member State, therefore, does not imply a judgement by the Secretariat on the nature of the instrument, the sta-tus of a party or any similar question. It is the understanding of the Secretariat that its acceptance for registra-tion of an instrument does not confer on the instrument the status of a treaty or an international agreement if it does not already have that status, and does not confer upon a party a status which it would not otherwise have.

Les termes « traité » et « accord international » n'ont été définis ni dans la Charte ni dans le règlement, et le Secrétariat a pris comme principe de s'en tenir à la position adoptée à cet égard par l'État Membre qui a pré-senté l'instrument à l'enregistrement, à savoir que, en ce qui concerne cette partie, l'instrument constitue un trai-té ou un accord international au sens de l'Article 102. Il s'ensuit que l'enregistrement d'un instrument présenté par un État Membre n'implique, de la part du Secrétariat, aucun jugement sur la nature de l'instrument, le statut d'une partie ou toute autre question similaire. Le Secrétariat considère donc que son acceptation pour enregis-trement d’un instrument ne confère pas audit instrument la qualité de traité ou d'accord international si ce der-nier ne l'a pas déjà, et qu'il ne confère pas à une partie un statut que, par ailleurs, elle ne posséderait pas.

PROTOCOL AMENDING ARTICLE 81 OF THE TREATY INSTITUTING THE BENELUX ECONOMIC UNION

The Government of the Kingdom of Belgium, the Government of the Grand Duchy of Luxembourg, the Government of the Kingdom of the Netherlands,

Considering that article 81 of the Treaty instituting the Benelux Economic Union was drafted under the influence of the Bretton Woods Agreements of July 1944,

Considering that the Member States of the European Economic Community introduced their own monetary system on 13 March 1979 and that since that time currency parities have been realigned by common agreement among Member States,

Considering that there is therefore no longer any unilateral alteration by one of the High Contracting Parties of the parity of its currency, as referred to in article 81,

Having regard to the opinion expressed on 24 November 1989 by the Benelux Interparliamentary Consultative Council,

Have agreed as follows:

Article 1

Article 81 of the Treaty instituting the Benelux Economic Union signed at The Hague on 3 February 1958 shall be replaced by the following provision:

“Article 81 1. Unless previously agreed otherwise, if the equivalence of the specific rates established for

unified duties, taxes, charges and levies of any kind whatsoever is broken following a realignment of currency parities within the European Monetary System, the High Contracting Party or Parties whose currency has decreased in value in relation to that of one or more other High Contracting Parties shall undertake to increase the rates of those tariffs, expressed in its/their own currency so as provisionally to restore the equivalence.

The High Contracting Party or Parties shall take the necessary domestic measures on the national level in order to ensure that this increase becomes effective within a period of two months from the date of the decision to realign parities.

2. As an exception to paragraph 1 above, the High Contracting Parties shall undertake to restore provisionally the equivalence between rates of excise tax on fermented fruit beverages through mutual realignment in respect of the total amount of the excise tax and the supplementary excise tax and with regard to the additional excise tax, each for half of the difference resulting from the alteration of parity, it being understood that the rate of excise tax will be maintained at the level of 600 F/hl.

The High Contracting Parties shall take the necessary steps in order for these adaptations to become effective within a period of two months from the date of the decision to realign parities.

3. The High Contracting Parties shall consult immediately with one another as from the date of the decision to realign parities in the European Monetary System in order to fix definitively in

each of their currencies the new joint rates of the duties, taxes, charges and levies referred to in paragraphs 1 and 2 of this article.”

Article 2

1. This Protocol shall be submitted for ratification. Instruments of ratification shall be deposited with the Secretary-General of the Benelux Economic Union, who will inform the Contracting Parties of the deposit of those instruments.

2. This Protocol shall enter into force on the first day of the month following the date of deposit of the third instrument of ratification.

IN WITNESS WHEREOF, the undersigned, duly authorized to this effect, have signed this Protocol.

PROTOCOL ON THE PRIVILEGES AND IMMUNITIES OF THE BENELUX UNION

Referring to article 29 of the Treaty instituting the Benelux Union (hereinafter referred to as “the Treaty”), the High Contracting Parties have agreed as follows:

Article 1

For the purposes of this Protocol: (a) The “premises of the Benelux Union” are the grounds and buildings used by the Benelux

Union for the exercise of its official activities; (b) The “archives” are all the files, documents, manuscripts, electronic documents, photos,

films and audio and video recordings belonging to or held by the Benelux Union or its personnel in the exercise of their official activities;

(c) The “host country” is the State where the Benelux Union has its headquarters or a State where an entity is established that has been instituted by the Benelux Union and is recognized as such by that State;

(d) “Official activities” are the activities of the Benelux Union which are strictly required for it to discharge its functions as defined in Part 1 of the Treaty.

Article 2

1. The premises of the Benelux Union together with its archives and any document belonging to or held by the Union shall be inviolable.

2. The authorities of the High Contracting Parties in whose territory the Benelux Union has its premises can only enter those premises with the consent of the Secretary-General. Such consent is presumed to have been given in the event of a fire or any other accident requiring immediate measures of protection.

3. The service on the premises of the Benelux Union of any procedural documents necessitated by litigation concerning the Benelux Union shall not constitute an infringement of inviolability.

Article 3

1. In the exercise of its official activities, the Benelux Union shall enjoy immunity from legal process and execution except:

(a) In so far as the Benelux Union has expressly waived such immunity in a particular case; (b) In respect of any civil claim lodged by a third party concerning persons and/or property,

provided that this civil claim is not directly related to the official functioning of the Benelux Union;

(c) In respect of any civil claim lodged by a third party for damage arising from an accident caused by a motor vehicle belonging to, or operated on behalf of, the Benelux Union, or in respect of a motor traffic offence involving such a vehicle.

2. The property, funds and assets of the Benelux Union, wherever located in the territory of the High Contracting Parties, shall enjoy immunity from any form of requisition, confiscation, expropriation and sequestration.

3. The property, funds and assets of the Benelux Union shall also enjoy immunity from any form of administrative or judicial seizure, except in so far as may be temporarily necessary in connection with the prevention of accidents involving motor vehicles belonging to, or operated on behalf of, the Benelux Union and of the investigations to which such accidents may give rise.

Article 4

1. For its official communications and the transfer of all its documents, the Benelux Union shall enjoy, in each High Contracting Party, the most favourable treatment granted to any other international organization by that High Contracting Party.

2. No censorship may be exercised in respect of the official communications of the Benelux Union, whatever the channel of communication is used.

Article 5

1. In the exercise of its official activities, the Benelux Union, its property, assets and income assigned for its official use shall be exempt from direct taxes.

2. When substantial purchases of goods or services are made by the Benelux Union in the exercise of its official activities and the price of such goods and services includes taxes, appropriate steps shall be taken by the High Contracting Parties, wherever possible, and without prejudice to the application of European regulations, to refund to the Benelux Union the amount of such taxes or to grant prior exemption.

3. No exemption shall be granted in respect of taxes and dues that only constitute payment for public utilities.

4. Goods or services exempted from taxes under paragraphs 1 and 2 of this article may not be used for any purpose other than that for which the exemption was granted except in accordance with conditions laid down by the host country that granted the exemption.

Article 6

1. The Benelux Union shall enjoy in the territory of each High Contracting Party the same legal competence required for the discharge of its duties and for attaining its objectives as is accorded to legal persons in civil law; in particular, the Union may acquire and dispose of real and personal property and may appear in a legal capacity. For these purposes the Benelux Union shall be represented by the Secretary-General.

2. If a dispute arises regarding the competence of the courts of the High Contracting Parties in a lawsuit to which the Benelux Union is a party, the court of the State within which the Benelux Union has its headquarters shall be solely competent.

Article 7

The representatives of the High Contracting Parties, their deputies, advisers or experts shall enjoy, on the occasion of meetings of institutions of the Benelux Union, common services and working groups of the administration and in the course of their journeys to and from the place of meetings, the following privileges and immunities:

(a) Immunity from arrest and detention and seizure of their personal effects, except in cases of flagrante delicto;

(b) Immunity from legal process, even after the termination of their mission, in respect of acts, including words spoken or written, carried out by them in the exercise of their functions; this immunity shall not apply, however, in the case of a motor vehicle offence committed by one of the aforementioned persons, or in the case of damage caused by a motor vehicle belonging to or driven by any such person;

(c) Inviolability for all their official papers and documents; (d) The right to use codes and to receive documents or correspondence by special courier or

sealed luggage.

Article 8

The Secretary-General, the Deputies Secretary-General and the officials of the Benelux Union:

(a) Shall enjoy immunity, even after the termination of their functions, from legal process in respect of acts, including words spoken or written, performed by them in the exercise of their functions; this immunity shall not apply, however, in the case of a motor vehicle offence committed by them or in the case of damage caused by a motor vehicle belonging to or driven by them;

(b) Shall be exempt from any military service obligation; (c) Shall enjoy inviolability in respect of all their official papers and documents; (d) Shall enjoy, for themselves and their legal or recognized spouses and their dependent

children living in their home, the same exceptions from immigration restrictions and alien registration formalities as those generally granted to staff members of international organizations;

(e) Shall enjoy, for themselves and for their legal or recognized spouses and their dependent children living in their home, the same repatriation facilities in time of international crisis as diplomatic agents.

Article 9

1. In addition to the privileges and immunities covered by article 8, the Secretary-General and the Deputies Secretary-General shall enjoy respectively the privileges and immunities granted to diplomatic agents under the Vienna Convention on Diplomatic Relations of 18 April 1961.

2. Immunity from legal process shall not apply in the case of civil claims arising from damage caused by the Secretary-General and the Deputies Secretary-General in their private life or from contracts into which they have entered privately.

3. Notwithstanding paragraph 1, the application of income tax and property tax to the income and property of the Secretary-General and the Deputies Secretary-General shall be decided in supplementary agreements within the meaning of article 29 of the Treaty.

Article 10

Experts exercising functions in the name and on behalf of the Benelux Union shall enjoy the following privileges and immunities in so far as is necessary for the exercise of their functions, including during travel undertaken in the exercise of their functions or in the course of such missions:

(a) Immunity from legal process for acts, including words spoken and written, carried out in the exercise of their functions, except in the case of motor traffic offences committed by an expert or damage caused by a motor vehicle belonging to or driven by the expert; experts shall continue to enjoy such immunity after termination of their functions on behalf of the Benelux Union referred to at the beginning of this article;

(b) Inviolability for all their official papers and documents.

Article 11

1. Without prejudice to the obligations of the High Contracting Parties under treaties relating to the European Union, the High Contracting Parties shall take the necessary steps to facilitate the entry into their country of the persons referred to in article 10. Any visa required for such persons shall be issued as soon as possible.

2. The Secretary-General of the Benelux Union shall communicate beforehand the names of the persons referred to in paragraph 1 of this article to the competent authorities.

Article 12

1. The High Contracting Parties shall not be required to grant the privileges and immunities covered by articles 7, 8 (b) and 9, paragraph 1:

(a) To their own citizens; (b) To persons who have permanent residence in their territory at the time when they take up

their duties with the Benelux Union. 2. For the purposes of this article, permanent residence means prior residence in the territory

of one of the High Contracting Parties for a minimum period of time under the provisions in force in that High Contracting Party, not counting the years spent in the service of an international organization or foreign mission.

Article 13

1. The Secretary-General shall be duty-bound to waive the immunity of the officials referred to in article 8 and the experts referred to in article 10 when he or she considers that such immunity impedes the course of justice and that it can be waived without detriment to the interests of the Benelux Union.

2. The Committee of Ministers may, for the same reasons, waive the immunities granted under articles 8 and 9 to the Secretary-General and the Deputies Secretary-General.

3. Each High Contracting Party shall be duty-bound to waive the immunity of its representatives and of their deputies, advisers or experts referred to in article 7 in any case where, in its opinion, immunity would impede the course of justice and can be waived without jeopardizing the purposes for which it was granted.

Article 14

1. The Benelux Union shall cooperate at all times with the competent authorities of the High Contracting Parties in order to facilitate the proper administration of justice, ensure the observance of police regulations and regulations concerning public health and labour inspection or other national laws and prevent any abuse of the privileges, immunities and facilities provided for in this Protocol.

2. The privileges and immunities granted by this Protocol to the persons referred to in articles 7, 8 and 10 are not designed to give personal advantages to those concerned. Their sole purpose is, in all circumstances, to ensure the smooth functioning of the Benelux Union and the full independence of those concerned.

3. The Benelux Union and the persons referred to in articles 7, 8 and 10 shall be required to observe the laws and regulations of the High Contracting Parties.

Article 15

Each High Contracting Party reserves the right to take precautionary measures in the interest of its security.

Article 16

The High Contracting Parties shall not incur, through the activity of the Benelux Union, any international responsibility for acts or omissions of the Benelux Union or its officials acting or refraining from acting in the exercise of their functions.

Article 17

This Protocol shall not apply to the Benelux Interparliamentary Consultative Council or to the Benelux Court of Justice.

Article 18

1. Any difference arising out of the interpretation and application of this Protocol between two or more High Contracting Parties or between the Benelux Union and one or more High Contracting Parties shall be settled by consultation, negotiation or other agreed mode of settlement.

2. If the difference is not settled in accordance with paragraph 1 of this article within the three months following a written request by one of the parties to the dispute, it shall, at the request

of one of the parties, be referred to an arbitral tribunal in accordance with the procedure set out in paragraphs 3 to 7 of this article.

3. The arbitral tribunal shall be composed of an odd number of members. Each party to the dispute shall appoint one member. If the arbitral tribunal is composed of an odd number of members, those members shall appoint from among their number one member to chair the tribunal. If an even number of members is appointed, those members shall choose an additional member to chair the tribunal.

4. If one of the parties to the dispute has failed to appoint its member of the tribunal within three months of the date of the written request referred to in paragraph 2, the other party or one of the other parties may request the President of the International Court of Justice to make such appointment. Should the first members fail to agree on the choice of chairperson of the arbitral tribunal within one month following the appointment of the other members, the other party or one of the other parties may request the President of the International Court of Justice to appoint the chairperson.

5. Unless the parties to the dispute decide otherwise, the arbitral tribunal shall determine its own procedure. The expenses shall be borne by the parties to the dispute, as assessed by the arbitral tribunal.

6. The arbitral tribunal, which shall decide by a majority of votes, shall state its position on the dispute on the basis of the provisions of this Protocol and the applicable rules of international law. Its decision shall be final and binding on the parties to the dispute.

7. The decision of the arbitral tribunal shall be communicated to the parties to the dispute and to the Secretary-General of the Benelux Union.

DECLARATION

Upon signing the Treaty revising the Treaty instituting the Benelux Economic Union of 3 February 1958 (hereinafter referred to as “the Treaty”), the plenipotentiaries of the High Contracting Parties adopted the following declaration:

CONCERNING THE COMMON WORK PROGRAMME

The common work programme, referred to in article 3, paragraph 1, of the Treaty is established for a period of four years. Every two years the Committee of Ministers shall consider the need to adapt the common work programme in accordance with the procedure laid down in article 6, paragraph 2 (b), of the Treaty. The annual plan, referred to in article 6, paragraph 2 (d), of the Treaty, shall ensure the implementation of the common work programme.

Elements for a common work programme, which will take effect from the date of entry into force of this Treaty, are set out in an Annex to this Declaration.

This initial common work programme is intended to ensure continuity between the current Treaty instituting the Benelux Economic Union and the revised Treaty instituting the Benelux Union. It should also ensure a gradual transition towards a more far-reaching and broader mission for the Benelux Union so as to enable it to boost mutual cooperation in a changed international context.

The implementation of this work programme needs to be steered at the political level and by senior officials. The High Contracting Parties shall ensure that this is actually the case, if need be at the ministerial level.

The General Secretariat shall implement the elements of the common work programme. It shall periodically evaluate all cooperation activities and initiate appropriate follow-up action. It shall support cooperation at the diplomatic, logistic and administrative levels and reports on the results achieved.

CONCERNING THE CHAIRING OF THE BENELUX COMMITTEE OF MINISTERS

Upon the entry into force of the Treaty, article 9, paragraph 2, of the Treaty shall be applied as follows:

(a) If the Treaty enters into force before 1 October of any given year, the Committee of Ministers shall be chaired, for the remaining period of the calendar year starting from the date of entry into force, by the High Contracting Party taking the chair at the date of entry into force pursuant to article 20, paragraph 2, of the Treaty instituting the Benelux Economic Union of 3 February 1958.

(b) If the Treaty enters into force on or after 1 October of any given year, the Committee of Ministers shall be chaired, for the remaining period of the calendar year starting from the date of entry into force, by the High Contracting Party that would take the chair at 1 January of the year following the year of entry into force pursuant to article 20, paragraph 2, of the Treaty instituting the Benelux Economic Union of 3 February 1958.

CONCERNING REPRESENTATION IN THE BENELUX COUNCIL

The representative or representatives of each of the High Contracting Parties, referred to in article 13, paragraph 1, of the Treaty, shall exercise within the public services of the High Contracting Parties the functions of Secretary-General, Director-General or a managerial function at a comparable level.

CONCERNING CONTACTS BETWEEN THE HIGH CONTRACTING PARTIES AND THE BENELUX UNION

Each High Contracting Party shall designate a focal point who will act as coordinator in relations between the High Contracting Party concerned and the Benelux Union.

CONCERNING ARTICLE 29, PARAGRAPH 3

Negotiations concerning the conclusion of a supplementary agreement between the Kingdom of Belgium and the Benelux Union shall begin as early as possible following the signing date in order to ensure their short-term completion. One of the purposes of this Agreement will be to achieve eventually a more balanced composition of the Secretariat General.

CONCERNING THE BUDGET

1. The Convention of the 14 January 1964 between the Kingdom of the Netherlands, the Kingdom of Belgium and the Grand Duchy of Luxembourg, concluded in pursuance of article 37, paragraph 2, of the Treaty instituting the Benelux Economic Union, shall be deemed to have been concluded in pursuance of article 22, paragraph 2, of the Treaty.

2. In the three months following the entry into force of the Treaty, the Committee of Ministers shall determine, by a decision in accordance with article 6, paragraph 2 (a), of the Treaty, which representative of which High Contracting Party in the Council shall act as the person referred to in article 26, paragraph 2, of the Treaty instituting the Benelux Economic Union.
