I hope this message finds you well. A little more time left for family vacation and seeing how busy we've been, I hope you have set some time aside. Year over year number of single family home sales for the month of June increased 60% for Indian River. Pending sales are up almost 20% year over year and we could see an interesting end of our summer for closed sales. According to Nielsen consumer confidence is cur-rently at it's highest level since October 2007 (95.2). Even though our inventory levels have gained year over year for the past 9 months, currently 21% higher than last June, our months supply has reduced from 7% to 6% year-over-year simply because of our rate of sales in-crease. Hello to All the REALTORS® and Affiliates for Indian River County. First, please allow me to Thank the RAIRC for their gracious request on being in the Affiliate Spotlight.

Just a little about myself, I have been in the Financial Industry for over 30 years. Starting out in the medical world and realizing the Financial world held a special place for me I made the switch soon after graduating from college. Since starting my business career, I have worked in Property Management for large apartment complexes, then transitioning to Real Estate and finally into the Banking World. I love the Real Estate side as much as the Financial side and have a deep passion for helping customers and understand that a REALTOR® does not have a 9 – 5 job. That is why when you need help with pre-qualifying a customer, you can call me seven days a week, night or day. Unless I am in the middle of the Atlantic Ocean fishing, another great hobby of mine, time will be made to help your customer.

Since starting within the Banking World many years ago, the experiences that I have had the pleasure and sometimes the frustration of being involved with has helped me to provide your customer with the level of knowledge that one needs in this ever changing environment. From the First Time Home-buyer to the more seasoned Jumbo customer with complex Tax Returns or to the investor, they cannot be in better hands. My philosophy is to treat your customer as I want to be treated.

With the changing times, there is so much to learn and a need to stay on top of the Mortgage World that there is

definitely a need to be with an organization such as Chase where it allows me the time to focus on helping the customer, not worrying about the compliance aspect of things. That is where I can contribute the most in the commitment to a customer and providing superior customer service thru the many layers of the mortgage business.

The yearning to live in Florida and close to the ocean has been a quest for many years, but being a Mother and certain life situations, it escaped me longer than anticipated. Finally the opportunity to re-locate to the Florida market a few years ago could not be passed up. My two younger sons are here with me and we have a very active life style from being involved with the community in volunteer organizations such as The Hibiscus Children’s Center to a Moto-Cross world as well as boating and deep sea fishing or anything on the water when-ever possible. My oldest son still lives in Illinois along with my three beautiful Grandchildren, but the visits are fantastic.

In closing if you are looking for a Mortgage Banker that has the knowledge and experience from sales to the underwriting side, please share my information. In addition if you need a resource for questions in general for Mortgage, please pick up the phone and call. I am here to help as no one wants surprises at any point in a transaction.

Case #1-18: REALTOR® Not Responsible for Legal Advice (Originally Case #2-4. Revised and transferred to Article 7 as Case #7-22 June, 1988. Transferred to Article 1 November, 1994.)

Client A listed a commercial property with REALTOR® B who sold it. Following the sale, Client A learned that his total tax position would have been more favorable if he had disposed of the property in a trade. He complained to the Board of REALTORS® against REALTOR® B stating that in connection with his listing of the property he had discussed his total tax position with REALTOR® B, and that REALTOR® B, in spite of his obligation under Article 1 of the Code of Ethics to “be informed regarding laws” had failed to advise him that a trade would be more to his advantage than a sale.

At the hearing, REALTOR® B defended his actions by stating that it was true that Client A had briefly outlined his total tax situation at the time he listed the property for sale. REALTOR® B advised that he had told Client A the sale of the listed property might result in unfavorable tax consequences and suggested that Client A consult an attorney. The client had not taken this advice.

After several weeks of advertising and showing the property, in the absence of a change of instructions from the client, the property was sold in accordance with the terms of the listing contract.

The Hearing Panel concluded that advising the client to consult an attorney had demonstrated REALTOR® B’s attempt to protect the best interest of his client; that in giving this advice REALTOR® B had fully discharged his obligation under Article 1; that a REALTOR® is not responsible for rendering legal advice beyond the advice that legal advice be sought when the client’s interest requires it; and that REALTOR® B was not in violation of Article 1. MLS Statistics

Statistics developed by the REALTORS Association of Indian River County through its Multiple Listing Service reflects the following for June 2013 and 2014.

The Residential closed sales of single family detached homes totaled 369 units for June 2014. This compares to a total of 230 units in June 2013. The median price of single family detached homes sold by members of the REALTORS Association of Indian River County MLS for June 2014 was $162,000. This compares to a median price of $173,865 for June 2013. Current active inventory of residential single family detached homes total 1,782 for June 2014. This compares to the active inventory of 1,470 for June 2013.

The Residential closed sales of condominium homes totaled 98 units for June 2014. This compares to a total of 80 units in June 2013. The median price of condominium homes sold by members of the REALTORS Association of Indian River County MLS for June 2014 was $136,500. This compares to a median price of $99,450 for June 2013. Current active inventory of condominium homes total 511 for June 2014. This compares to the active inventory of 575 for June 2013.

Government Affairs Update ‘Hurricane Tax’ on Policies to End 18 Months Early

An extra charge on property-insurance and auto-insurance policies to cover claims paid for the 2004 and 2005 hurricane seasons will end Jan. 1.

The Office of Insurance Regulation formally issued orders July 23rd for insurance companies to move up by 18 months the end of a 1.3 percent "emergency assessment" for the state-run Florida Hurricane Catastrophe Fund, which provides backup coverage to insurers. The orders make official a decision Gov. Rick Scott and the Cabinet made in June to end the assessment, Amy Bogner, a spokeswoman for the Office of Insurance Regulation, said in an email.

The charge is imposed on most property and casualty policies other than medical malpractice and workers compensation. It first appeared at 1 percent in 2007 and was raised to the current rate in 2011. The assessment has collectively hit policyholders for $350 to $500 million a year and has now reached $2.9 billion. The collected amount has gone to reimburse insurance companies for claims from the eight hurricanes that hit Florida in 2004 and 2005, the last time a hurricane made landfall in Florida.

In addition to the state's near-decade luck at avoiding hurricanes, the early termination is due to claims for Hurricane Wilma coming in $498 million less than what had initially been thought. Wilma hit South Florida in October 2005. Also, the fund received more money than expected due to an increase in policies statewide.

The catastrophe fund, better known as the Cat Fund, currently has about $13 billion on hand and is expected to be able to raise an additional $4 billion, which is considered solid ground for covering most post-storm claims. In addition to the Cat Fund assessment, the state-backed Citizens Property Insurance Corp. adds an extra 1 percent charge on most policies to cover losses from the 2005 storms. First imposed in 2007, the state expects that charge to be paid off in June 2017.

Sec. 203 (k) Loans OK for Flood-risk Moves

FHA confirms in a letter to NAR and other groups that the Sec. 203 (k) rehabilitation loan program can be used by home owners in flood-risk areas to move or raise their home to avoid flood damage.

NAR: Base Wetlands Rule on Analysis

NAR in a statement to a House committee in July stressed that federal wetlands permits must be based on data and analysis and not turned into a burden on property owners.

NAR Challenges EPA Lead-Rule Framework

A framework proposed by EPA for regulating lead-paint hazards from remodeling and other work conducted on commercial and public buildings appears to circumvent a regulatory process the federal government set forth in the Toxic Substance Control Act, NAR and its partners in a coalition say. FEMA Releases Refund Guidance

FEMA has released information on providing refunds to property owners who overpaid for flood insurance. Refund amounts will be determined using rates made available in Bulletin W-14026 issued on May 29, 2014. The Homeowner Flood Insurance Affordability Act requires FEMA to restore Pre-Flood Insurance Rate Map (FIRM) subsidized rates and issue refunds of excess premiums collected for: pre-FIRM properties not insured when the Biggert-Waters Flood Insurance Act of 2012 was enacted; pre-FIRM properties purchased after Biggert-Waters was enacted; and policies for Pre-FIRM properties that were rated full-risk under Biggert-Waters due to a lapse in coverage, but only for policies where the lapse was due to a property owner no longer being required to purchase flood insurance. The issuance of refunds will begin on Oct. 1 and must be completed by Dec. 31, 2014.

Castro Confirmed as HUD Secretary

The US Senate confirmed Julian Castro in a roll-call vote last month as the secretary of the Department of Housing and Urban Development (HUD). The 39-year-old, three-term mayor of San Antonio replaces Shaun Donovan, who will head the Office of Management and Budget. In a statement, NAR President Steve Brown supports the selection: "Mayor Castro's vision for strong communities and affordable housing is the right fit for HUD, which has helped make the dream of homeownership a reality for millions of Americans. We are encouraged by his record of achievements to revitalize the city center in San Antonio and his commitment to public engagement and collaboration."

“What is Required to Extend a Contingent or Pending Listing from Expiring in MLS?”

If the expiration date is not extended to the closing date on a Pending or Contingent listing, (refer to Exclusive Right of Sale Listing Agreement 1. Authority to Sell Property) wilsonsu the listing will expire. If this happens, and you receive an extension, or need to extend to the closing date, the listing can be copied by using the copy function and the system will generate a new ml #. Be sure to use the original listing date from the original listing agreement on your new entry.

“Fusion Experience Service Notice” Please be advised, that CoreLogic will no longer offer or support Fusion Experience, now that the mobile solution ‘MLSofIRC’ is available. Users who want to continue using a virtualization solution to access Fusion can download the Puffin Browser from the App Store. Once Puffin Browser is installed, user can navigate to the MLS login page.

“How Do I Get ‘MLSofIRC’ the GoMLS Mobile App?” The Android tablets or phones go to the Google Play Store, iPad and iPhones go to App Store. Search 'MLSofIRC or CoreLogic and look for the RAIRC logo and download the app ‘MLSofIRC’. To access the App as a REALTOR®, press Agent Login and use the same User ID and Password that you use in MLS. To access as a consumer you will need to create an account using an email address and password. There will be 3 ways to view listings: map view, list view and gallery view. There is improved mapping functionality showing groups of listings on the map, which will now appear bundled with a circle icon. You can zoom in to see individual listings. New search results will automatically appear as the map is moved. Landscape view users will have a choice to view in landscape or portrait mode on both iPhone and Android devices. Clients and customers can search for listings. The next ‘MLSofIRC’ training will be October 6th.

“Where Do I Find the Member Roster in the App?” The agent roster is found under “Directory”. The Agent Directory provides a searchable interface for Agents/Consumers to look up agents and their contact information.

“Where Can I Find Support or Help Using the App?” Users can find Help under FeedBack. FeedBack allows users to view the support site featuring user guide/submit feedback. http://doapprealestate.rivr.us for help the document. Help will provide 4 help screens to get you started using the app.

“What is Required by MLS When the Owner Does Not Wish to Participate in MLS?”

When a broker’s obligations and authority on the Listing Agreement indicates that the sellers/builders authorize broker NOT to report to the MLS the listing information on any resulting sale for use by MLS members, the listing agreement needs to be sent to the MLS. MLS will keep it on file, if asked why this property is not placed in MLS. Listing agreement is also sent if the sellers/builders request to not place in MLS until a certain date.

”Looking for MLS Rules and Regulations Online?” Go to the Association website www.rairc.com and click on Member Login – enter your user name and password. Go to the tab box called Files and Documents, under Intranet, to MLS forms. All the sections of the MLS Rules and Regulations will be listed on the right side of the page.

What is a 1 Day Code?  

1 day codes allow anyone access to a lockbox key com‐partment without using a SentriCard. 1 day codes are NOT static—they change on a daily basis.  

You can use 1 day codes provide the security of giving time limited access to the lockbox key compartment with‐out the hassle of having to visit your lockbox to chance the access code.  

A 1 day code can be generated for a lockbox up to two weeks prior to when the code is actually needed. 1 day codes are valid for one day and they expire at midnight on the day they have been created for.  

There are 3 different ways to create a 1 day code… 1)  By using the SentriLock Web Site 2)  By using the SentriLock Mobile Web Site 3)  By calling SentriLock Technical Support

REGISTRATION: We appreciate your cooperation in your timely arrival as the course will begin promptly as scheduled. Due to DBPR requirements, Registration Sign-In will begin 30 minutes PRIOR to the start of ALL scheduled courses.

REGISTRY DEADLINE: *1 Calendar Day PRIOR to the scheduled course or event, by (midnight) 11:59PM. Anyone registered after the deadline will be considered a LATE registry and will be REQUIRED to pay FULL PRICE prior to attending the course or event.

REGISTRATION CONFIRMATION: Anyone who registers for a course using the website, www.RAIRC.com, will receive a registration confirmation number. All students registered for an RAIRC CEU course will receive an email confirmation 2 days prior to the scheduled course.
