BRIEF NOTE ON PLANT QUARANTINE

Plant Quarantine regulatory measures are operative through the ‘DestructiveInsects & Pests Act, 1914 (Act 2 of 1914) in the country. The purpose and intent ofthis Act is to prevent the introduction of any insect, fungus or other pest, which is ormay be destructive to crops. The import of agricultural commodities is presentlyregulated through the Plant Quarantine (Regulation of Import into India) Order, 2003the provisions of New Policy on Seed Development, 1988. Further, the significanceof Plant Quarantine has increased in view of globalization and liberalization inInternational trade of plants and plant material in the wake of Sanitary andPhytosanitary (SPS) Agreement under WTO. The phytosanitary certification ofagricultural commodities being exported is also undertaken as per International PlantProtection Convention (IPPC), 1951.

In line with the New Policy on Seed Development, 1988 and the provisions ofPQ Order, 2003, the specified planting material for propagation (viz., cuttings,saplings, bud woods, etc.) require growing under Post Entry Quarantine (PEQ) for aspecified period. The import of such planting material is granted based on acertificate from Designated Inspection Authorities of the concerned jurisdictionstating that the importer possesses the post entry quarantine facility for the importedplanting material. Such consignments are released with the intimation to theconcerned Inspection Authorities for conducting further PEQ inspections and the finalclearance is granted based on the PEQ Inspection Report. The pest risk analysis ismandatory for all the plants/plant material prior to its import into India as per PQOrder, 2003. The risk of exotic pests and diseases is minimized by identifying thepotential pests which can get into the country with the specified commodity andseeking export certification for their freedom/pest free area status, etc. from theexporting country. The export inspections are carried out to facilitate certification ofexportable plants and plant material as per the requirement of importing country inline with the International Plant Protection Convention (IPPC). The exportinspections involves sampling and detailed laboratory tests in case of seeds andplanting material for propagation whereas visual examination with hand lens andwashing tests, etc are carried out for plant material meant for consumption. Theexport inspections are conducted at exporters’ premises also to facilitate exports foragricultural commodities meant for consumption.

OBJECTIVES

1. Inspection of imported agricultural commodities for preventing the introductionof exotic pests and diseases inimical to Indian fauna and flora throughimplementation of DIP Act, 1914 and the Plant Quarantine (Regulation of Import intoIndia) Order, 2003 issued there under.

2. Inspection of plants and plant material meant for export as per therequirements under International Plant Protection Convention (IPPC) 1951 of FAO tofacilitate pest free trade.

3. Detection of exotic pests and diseases for their containment by adoptingdomestic quarantine regulations, if introduced.

ENTRY POINTS

As per Plant Quarantine (Regulation of Import into India) Order, 2003 a totalof 60 entry points including 44 seaports, 21 airports and 17 land custom stations arenotified points of entry for import of plants and plant material. Besides, 72 InlandContainer Depot/Container Freight Station, 11 Foreign Post Offices have also beennotified for the entry of plants/plant material under the PQ Order, 2003.

DIRECTORATE OF PLANT PROTECTION, QUARANTINE & STORAGE

The Directorate of Plant Protection Quarantine & Storage was established inthe year 1946 on the recommendation of ‘Woodhead Commission’ as an apexorganization for advising the Government of India and state governments on all thematter related to Plant Protection. The Directorate is headed by Plant Protectionadviser. Plant Protection strategy and activities have significant importance in theoverall crop production programmes for sustainable agriculture. Plant protectionactivities encompasses activities aimed to minimizing crop losses due to peststhrough integrated pest management, plant quarantine, regulation of pesticides,locust warning & control and training in desert areas besides training and capacitybuilding in plant protection. It is an attached Office of Ministry of Agriculture andFarmers Welfare. It has various Sub-Offices throughout India.

STRENGTHENING AND MODERNIZATION OF PLANT QUARANTINEFACILITIES IN INDIA (SMPQF)

The scheme has been continuing as a Central Sector Scheme since 1949.The Scheme is implemented by the Government of India, Ministry of Agriculture&Farmers Welfare, Department of Agriculture, Cooperation& Farmers Welfare,Directorate of Plant Protection, Quarantine & Storage in accordance with DIP Act,1914, International Plant Protection Convention (IPPC) of Food and AgricultureOrganization (FAO) 1951.Government’s primary objectives under the scheme are:

Government of India notified Plant Quarantine (Regulation of Import into India)Order, 2003 under which Pest Risk Analysis (PRA) of agricultural commodities ismandatory before import is permitted to safeguard Indian agriculture. There are 57Plant Quarantine stations at major airports, seaports and land frontiers implementingPQ regulations.

The major activities under the scheme include:

Conducting the Pest Risk Analysis (PRA) to finalize phytosanitaryrequirements for import of plant/plant material.

Inspection of imported agricultural commodities for preventing the introductionof exotic pests and diseases inimical to Indian fauna and flora to ensureagricultural bio-security.

Inspection of agricultural commodities meant for export and issue ofphytosanitary certificates as per the requirements of importing countries underInternational Plant Protection Convention (IPPC).

Detection of exotic pests and diseases already introduced forcontaining/controlling them by adopting domestic quarantine regulations.

Undertaking Post Entry Quarantine Inspection (PEQ) in respect of identifiedplanting materials.

DUTIES AND RESPONSIBILITIES OF DPPQ&S

Presently, there are 57 Plant Quarantine Stations (PQS) at differentInternational Airports, Seaports and Land frontiers for implementing the PlantQuarantine regulations with its headquarters at Faridabad. The duties andresponsibilities of DPPQ&S/PQSs are as under:

To issue import permits with additional declarations and special conditions to

facilitate safe imports of agricultural products.

To undertake quarantine inspection and laboratory testing of plants and plant

material to ensure freedom from exotic pests.

To undertake phytosanitary certification (for issuance of Phytosanitary

Certificates (PSCs); 195 Nos. of Officers from Central/ State/ UTGovernments have been authorized for this purpose.

IMPORT & EXPORT PROCEDURE OF AGRICULTURAL PRODUCTS

IMPORT PROCEDURE

An agricultural commodity may be imported into India as per the provisionsgiven in Plant Quarantine Order, 2003. An Import Permit is required only forconsignment of soil in any form for research purpose; growing media (withsoil, peat or other organic materials), peat or sphagnum moss for horticulturalpurposes, germplasm, transgenics or genetically modified organisms, liveinsects and other arthropods/nematodes/microbial cultures includingalgae/bio-control agents.

Inspection of imported agricultural commodities on arrival at the port of entry

for preventing the introduction of exotic pests and diseases inimical to IndianFauna and Flora through implementation of DIP Act, 1914 and PlantQuarantine (Regulation of Import into India) Order, 2003 issued thereunder.

The import clearance involves various steps from receipt of reference from

Customs until recommendation for its release or otherwise to the Customsincluding sampling, detail testing viz., bacteriological, mycological,entomological, nematological, etc., besides the post entry quarantine (PEQ)testing at the importers premises under the PEQ facility. The post entryquarantine inspections which are required in case of cuttings, saplings andbud woods are carried out by the Designated Inspection Authoritiesconstituting mainly the head of the Department of Entomology/PlantPathology of the Sate Agricultural Universities/ICAR Institutions.

Undertaking Post Entry Quarantine Inspection in respect of identified planting

materials: In line with the New Policy on Seed Development, 1988 and theprovisions of PQ Order, 2003, the specified planting material for propagation(viz., cuttings, saplings, budwood, etc.) require growing under Post EntryQuarantine for a specified period. Such consignments are released with theintimation to the concerned Inspection Authorities for conducting further PEQinspections and the final clearance is granted based on the PEQ InspectionReport.

EXPORT PROCEDURE

Inspection of agricultural commodities meant for export as per therequirements of importing countries under International Plant ProtectionConvention (IPPC) 1951 of FAO as per the model certificates prescribedunder IPPC and issue Phytosanitary Certificate.

PLANT QUARANTINE ORDER, 2003

Plant Quarantine (Regulation of Import into India) Order, 2003 regulatesimport and prohibition of import of plants and plant products into India. The Orderwas published in the Gazette of India, vide, S.O.1322 (E), dated 18th November,2003 and has been subsequently amended from time to time.

The Plant Quarantine Order has 15 clauses describing various aspects andconditions of import of agricultural articles (plants and plant products) into India.There are 16 forms for various plant quarantine regulatory functions. The Order hasfollowing Schedules:

HIGHLIGHTS OF‘PLANT QUARANTINE (REGULATION OF IMPORT INTO INDIA)ORDER, 2003’.

In exercise of the powers conferred by sub-section (1) of Section 3 of theDestructive Insects and Pests Act, 1914 (2 of 1914), the Central Government herebymakes the following Order, for the purpose of prohibiting and regulating the importinto India of agricultural articles mentioned herein, namely:-

CHAPTER I

Preliminary

1. Short title and commencement. –

(1) This order may be called the Plant Quarantine (Regulation of Import into India) Order, 2003.

(2) Sub-clause (22) of clause 3 shall come into force on the 1st day of April, 2004 and all other provisions of this Order shall come into force on the 1 st day of January, 2004.

2. Definitions. – In this Order, unless the context otherwise requires. –

(i) “additional declaration” means a statement that is required by an importing country to be entered in a phytosanitary certificate and which provides specific additional information pertinent to the phytosanitary condition of a consignment;

(ii) “bio-control agent” means any biological agent such as parasite, predator, parasitoid, microbial organism or self replicating entity that is used for control of pests;

(iii) “consignment”- means a quantity of seeds, plants and plant products orany regulated article consigned from one party to other at any one timeshipment and covered by a phytosanitary certificate, bill of entry of customs, shipping/airway bill or invoice;

(iv) “cotton” includes ginned cotton, cotton linters and dropping, tripping, flyand other waste products of cotton mill other than yarn waste, but doesnot include cotton seed or un-ginned cotton;

(v) “form” means a form appended to this Order

(vi) “fruit” means any fleshy portion of the plant, that contains seeds, which is used for consumption, including seedless fruit both fresh and dry but does not include preserved or prickled or frozen fruits.

(vii) “grain” means seeds intended for processing or consumption and not for sowing or propagation.

(viii) “germplasm” means plants in whole or in parts and their propagules including seeds, vegetative parts, tissue cultures, cell cultures, genes and DNA based sequences that are held in a repository or collected from wild as the case may be and are utilized in genetic studies or plant breeding programmes for crop improvement;

(ix) “import” means an act of bringing into any part or place of territory of Republic of India any kind of seed, plant or plant product and other regulated article from a place outside India either by sea, land, air or across any customs frontier;

(x) “import permit” means an official document authorizing importation of a consignment in accordance with specified phytosanitary requirements;

(xi) “Inspection Authority” means an authority specified in Part I of Schedule XI or an officer of the Directorate of Plant Protection, Quarantine and Storage duly authorized by the Plant Protection Adviser for the purpose of approval and certification of Post-entry quarantinefacilities and inspection of growing plants in such facilities in accordance with the guidelines issued by the Plant Protection Adviser and for any specified purpose, an authority specified in Part II of the said Schedule.

(xii) “Irradiation” means the treatment of food or agricultural products with any type of processing of ionized radiation such as gamma irradiation or micro-electron acceleration processing.

(xiii) “issuing authority” means an authority as envisaged under Schedule-IVof this order or duly notified by the Central Government from time to time either generally or specifically for issuance of import permit;

(xiv) “notification” means a notification published in the official Gazette and the expression “notifies” shall be construed accordingly;

(xv) “noxious weeds” mean any weed harmful or hazardous or unwholesome to human beings, animal life or parasitic on plant species;

(xvi) “packing material” means any kind of material of plant origin used for packing of goods;

(xvii) “pest” means any species, strain or biotype of plant, animal or pathogenic agent injurious to plants and plant products;

(xviii) “pest risk analysis” means the process of evaluating biological or other scientific and economic evidence to determine whether a pest should be regulated and strength of any phytosanitary measures to be taken against it;

(xix) “phytosanitary certificate” means a certificate issued in the model format prescribed under the International Plant Protection Convention of the Food & Agricultural Organization and isssued by an authorized officer at the country of origin of consignment or re-export;

(xx) “plant” means a living plants and parts thereof including seed and germplasm;

(xxi) “plant product” means an un-manufactured material of plant origin including grain and those manufactured products that, by their nature or that of their processing, may create risk for the introduction and spread of a pest.

(xxii) “Plant Protection Adviser” means the Plant Protection Adviser to the Government of India, Directorate of Plant Protection, Quarantine and Storage;

(xxiii) “point of entry” means any sea port, airport, or land-border check-post or rail station, river port, foreign post office, courier terminal, container freight station or inland container depot notified as specified in Schedule-I or Schedule-II or Schedule-III as the case may be;

(xxiv) “post-entry quarantine” means growing of imported plants in confinement for a specified period of time in a glass house, screen house, poly house or any other facility, or isolated field or an off-shore island that is established in accordance with guidelines/ standards and are duly approved and certified by an inspection authority notified under this order;

(xxv) “quarantine pest” means a pest of potential economic importance to thearea endangered thereby and not yet present there, or present but not widely distributed and being officially controlled;

(xxvi) “regulated article” means any article the import of which is regulated bythis order;

(xxvii) “schedule” means a Schedule to this Order;

(xxviii) “seeds” means seeds intended for sowing or propagating and not for consumption or processing;

(xxix) “soil” means earth, sand, clay, silt, loam, compost, manure, peat or sphagnum moss, litter, leaf waste or any organic media that support plant life and shall include ship ballast or any organic medium used for growing plants.

(xxx) “timber” means a form of dead wood, log and lumber cut from plants, with or without bark or sawn and sized, which is used for manufacturingveneer, plywood, particle or chip board and making building material, furniture, packages, pallets, sports goods and handicrafts;.

(xxxi) “tissue cultured plant” means any part of a plant or plant tissue or plantlet grown under aseptic or sterile conditions in flasks or other suitable container on appropriate media and shall include ex-agar washed plant lets;

(xxxii) “dunnage” means wood packing material used to secure or support a commodity but which does not remain associated with the commodity [FAO, 1009; revised ISPM Pub. No. 15, 2002]

(xxxiii) “wood packing material” means wood or wood products (excluding paper products) used in supporting, protecting or carrying a commodity(includes dunnage) [ISPM Pub. No.15, 2002]

(xxxiv) “article” means any kind of movable property including any goods and stores consigned from one party to another as a shipment and coveredby a bill of entry of customs, shipping or airway bill and/ or invoice in the course of international trade.

(xxxv) Animal Feed- Kibbled-crushed seeds/ pellet/ dried cake form thereby denatured and free from weed seeds, bacterial and fungal pathogens.

CHAPTER II

General conditions for import

3. Permits for Import of plants, plant products etc.

(1) No plants, plant products and other regulated articles (hereinafter referred toas “consignmen”) shall be imported into India without complying thephytosanitary conditions stipulated under this Order. The order shall regulateimport of all plants, plant products and other articles including but not limitedto seeds/grains, pods, nuts, fruits, bulbs, tubers, corms/cormlets, rhizomes,suckers, cuttings, grafts, saplings, bud woods, roots, rootstock, flowers,pollens, dry plant materials, timber, wood, logs, tissue culture plants, soil,earth, clay, sand, peat/moss, live insects, microbial culture, biocontrol agents,transgenic plants and genetically modified organisms etc.,

(2) No categories of plants/plant products in respect of the plant species orvariety mentioned in Schedule-IV shall be allowed to be imported into Indiafrom the countries mentioned against each in column (4) of the said Schedule.

(4) Import of consignments of seeds of coarse cereals, pulses, oil seeds andfodder seeds and seeds/stock material of fruit plant species for propagationshall only be permitted based on the recommendations of EXIM Committee ofDepartment of Agriculture, Cooperation & Farmers Welfare (DAC&FW),‟except the trial material of the same as specified in Schedule-XII of PlantQuarantine Order.

(5) Deleted vide Sixth Amendment of 2016, vide S.O.2453 (E) dated July 5, 2016.

(6) No consignment of regulated articles as referred under Clause 4, 6 & 7 shallbe allowed for import unless accompanied with an import permit issued by theauthority as specified under Schedule X.

(7) The Plant Protection Adviser shall, after obtaining the approval of the CentralGovernment in the Department of Agriculture, Cooperation and FarmersWelfare and based on International Standards established by the InternationalPlant Protection Convention (IPPC) under Food and Agriculture Organization,issue the guidelines for carrying out Pest Risk Analysis (PRA). No import shallbe permitted for the consignment other than those listed in Schedule-V, VI andVII unless the Pest Risk Analysis is carried out in accordance with suchguidelines and subject to such restrictions and conditions as specified in suchpermit. For this purpose the importer or NPPO of exporting country shallsubmit an application for PRA for import of agricultural commodities into Indiain form PQ 23, including the technical information in form PQ 24 forconducting PRA to PPA or Joint Secretary (PP). The technical informationmust be updated, validated and provided by National Plant ProtectionOrganization (NPPO) of the exporting country. The process of PRA involvesthe categorization of pests associated with the commodity into quarantinepests; evaluation of their introduction potential; critical assessment ofeconomic and environmental impact of their introduction; and specification ofrisk mitigating measures against them. The completion of PRA process mayinvolve the visit of phytosanitary experts to the country of export to carry outpre-shipment inspections, evaluate post–harvest treatment technologies andquarantine inspection and certification facilities. In the event of interception ofa quarantine pest in imported consignment, further import of consignmentsshall be suspended until earlier PRA in respect of the consignment isreviewed and the risk mitigating measures are evaluated.

(8) The issue of permit may be refused or withheld by the issuing authority aftergiving reasonable notice to the applicant and for reasons to be recorded inwriting.

(9) The Import Permit issued shall be valid for twelve months from the date ofissue and valid for multiple port access and multiple part shipments inaccordance with Clause 3(14) (i) provided the exporter, importer and countryof origin are the same for the entire consignment. The issuing authority may,on request, extend the period of validity for a further period of twelve monthsafter charging Rs. 500/- provided such request for extension of validity ismade to the issuing authority before the expiry of the permit with adequatereasons to be recorded in writing. Suppression of the facts or any materialinformation while issue of import permit is liable to be cancelled or withdrawn.

(10) The import permit issued shall not be transferable and no amendments to thepermit shall be issued except for change of point of entry subject to reasons tobe recorded in writing.

(12) No consignment of seed or grain shall be permitted to be imported withcontamination of quarantine weeds, which are listed in Schedule-VIII unlessthe said consignment has been devitalized by the exporting country and acertificate to that effect has been endorsed in the phytosanitary certificateissued by the exporting country. Every application for quarantine inspectionand clearance shall be made in Form PQ 15.

(13) All the consignments of plants and plant products and other regulated articlesshall be imported into India only through ports of entry as specified inSchedule-I and Inland Container Depots/Container Freight Stations andforeign post offices falling within the jurisdiction of concerned plant quarantinestation operating here under or those notified by the Government from time totime in this behalf.

(14) Points of entry for all consignments of seeds and plants for propagation andregulated articles

i. All consignments of seeds and plants for propagation and regulated articlessuch as live insects, microbial cultures, bio-control agents, soil, growing media(with soil, peat or other organic materials) and peat or sphagnum moss shallonly be imported into India through National Plant Quarantine Station, NewDelhi or Regional Plant Quarantine Stations, Amritsar, Chennai, Kolkata,Mumbai or Plant Quarantine Station, Bengaluru or through any other points ofentry as may be notified from time to time for this purpose, provided thatimport of germplasm/ transgenic plant material and genetically modifiedorganisms shall be permitted only through New Delhi Airport.

ii. All consignments of sand in any form for non-agricultural purpose shall beimported into India through National Plant Quarantine Station, New Delhi orRegional Plant Quarantine Stations, Amritsar, Chennai, Kolkata, Mumbai orPlant Quarantine Station, Cochin, Mangalore, Tuticorin and Krishnapatnam.

iii. All consignments of other similar materials like inorganic soil additives,leonardite, lignite, pure sand (silica, zircon, quartz etc.), pure clay like kaolinetc., rock aggregates and gravel, volcanic, pumice, chalk, rock salt,diatomaceous earth, all kinds of ore, vermiculite, perlite, gypsum, zeolite etc.,in any form for industrial and non-agricultural purpose and stone(aggregated/dust) for non-agricultural purpose shall be imported into India asper clause 3(13).

(15) On arrival, at the first point of entry the consignment shall be inspected by thePlant Protection Adviser or any other officer duly authorized by him in thisbehalf and appropriate samples shall 8 be drawn for laboratory testing, inaccordance with the guidelines issued by Plant Protection Adviser from timeto time.

(16) The Plant Protection Adviser or the officer authorized by him may, afterinspection and laboratory testing, fumigation, irradiation, disinfection ordisinfestation, as may be considered necessary by him, accord quarantineclearance for the entry of a consignment or grant provisional clearance forgrowing under post-entry quarantine, as the case may be in form PQ 16 andor order deportation or destruction of the consignment in form PQ 17 in theevent of noncompliance with the restrictions and conditions specified in thisOrder.

(17) Where fumigation or disinfestation or disinfection is considered necessary inrespect of a consignment of plants, seeds and fruits the importer shall on hisown and at his cost arrange for the fumigation, disinfection or disinfestation ofthe consignment, through an agency approved by the Plant Protection Adviserunder the supervision of an officer duly authorized by the Plant ProtectionAdviser in that behalf.

“Provided that where irradiation is necessary in respect of any consignment offresh fruits or vegetables or other plant products, the same shall be carriedout by the importer at his own cost, at an irradiation facility, established as perthe regulations of the “Atomic Energy Regulatory Board” and duly approvedby the “Plant Protection Adviser” to the Government of India (PPA) under theInternational Standards established under the “International Plant ProtectionConvention” and at the scheduled dosage approved by the Plant ProtectionAdviser under supervision of an officer authorized by him, where necessary”

(18) It shall be the responsibility of the importer or his authorized agent. –

(i) to file an application for the quarantine inspection of imported seeds, plantsand plant products or other regulated articles in the form PQ 15 along withcopies of relevant documents and fees as prescribed under Schedule-IXpayable by a demand draft to the competent authority

(ii) to provide information on any plant and plant product and other articlescovered under this Order and which are imported by him/her or are in his/herpossession, to Plant Protection Adviser or any officer duly authorised by him;

(iii) to bring the consignments to the concerned plant quarantine station or toplace of inspection, fumigation or treatment as directed by Plant ProtectionAdviser or any officer duly authorised by him;.

(iv) to permit drawing of appropriate samples for inspection and laboratoryinvestigation and extend necessary facilities towards the same;

(v) to open, repack and load into or unload from the fumigation chamber and sealthe consignment;

(vi) to remove them after inspection and treatment according to the directions issued by the Plant Protection Adviser or any officer authorised by him;

(vii) to arrange deportation or destruction of the consignment at the cost ofimporter as may be deemed necessary by Plant Protection Adviser or anofficer authorized by him.

(19) No consignment or container carrying plants and plant products intended forother countries shall be allowed transit through or transhipment at air or seaports or land customs stations, unless they are packed in such a manner soas not to permit spillage of material or contamination with soil or escape ofany pest, and subject to the condition that the package or container shall notbe opened or seals are broken anywhere in India

(20) No consignment shall be permitted import unless accompanied by an originalPhytosanitary Certificate issued by an authorized officer at the country oforigin in PQ Form 21 or at the country of re-export in PQ Form 22; Providedthat cut flowers, garlands, bouquets, dry fruits/nuts etc., weighing not morethan two kilograms imported for personal consumption may be allowed to beimported without a Phytosanitary Certificate or an import permit. Provided thatall consignments of Similar material: Inorganic soil additives, Leonardite,Lignite, Pure sand (Silica, Zircon, Quartz, etc.,) Pure clay like kaolin etc., Rockaggregates and Gravel, Volcanic pumice, Chalk, Rock salt, Diatomaceousearth, All kinds of ore, Vermiculite, Perlite, Gypsum, Zeolite etc., may beallowed to be imported in any form, for industrial and non-agricultural purpose,without a Phytosanitary Certificate or an import permit.

(20A) No article, packed with raw / solid wood packing material shall be released bythe proper officer of Customs unless the wood packaging material has beenappropriately treated and marked as per ISPM-15 or is accompanied by aphytosanitary certificate with the treatment endorsed.

The treatment of raw / solid wood packing material prior to export shall includeeither Methyl bromide (MB) @ 48 g/m3 for 16 hrs at 210C and above or anyequivalent thereof or heat treatment (HT) at 560C for 30 min (coretemperature of wood) or Kiln Drying (KD) or Chemical Pressure Impregnation(CPI) or any other treatments provided that these meet the HT specification ofthe ISPM-15.

Any, article, if found packed with raw / solid wood packaging material withoutspecified treatment and without marking as per ISPM-15 or if notaccompanied by Phytosanitry Certificate with treatment endorsed, as the casemay be, shall be considered untreated and shall be referred by the properofficer of the Customs to Plant Quarantine Officer. The proper officer orCustoms shall grant release of such articles packed with untreated woodpackaging material only after ensuring that the wood packaging material hasbeen appropriately treated at the point of entry under the supervision of PlantQuarantine Officer.

Provided that above conditions shall not be applicable to wood packagingmaterial wholly made of processed wood products such as ply wood, particleboard, oriental strand board or veneer that have been created using glue,heat and pressure or combination thereof. Also the above conditions shall notbe applicable to wood packaging material such as veneer peeler cores, sawdust, wood wool and shavings and thin wood pieces (less than 6 mmthickness), unless they are found to be harboring any regulated pestsspecified in this order.

Provided further that nothing contained in this clause shall be applicable towood packaging materials used for packaging of bona-fide passengerbaggage containing goods other than plant and plant products.

(20 B) No article packed with hay or straw shall be allowed to be imported unlesssuch hay or straw, as the case may be is treated prior to export and the articleshall accompany the treatment certificate. Explanation: In this sub-clause, theword “treated” shall mean treated by Methyl bromide fumigation @ 48 gm/m3for 24 hours at normal atmospheric pressure at 210C or above or equivalentthereof; or steam sterilization under pressure 560C for 30 minutes; or anyother treatment approved by the Plant Protection Adviser.

4. Import of soil, growing media, etc. - No import of soil, growing media(with soil, peat or other organic materials), sand and peat or sphagnum moss,similar material and stone shall be permitted except under the followingconditions, namely:-

i. The consignments of soil in any form for research purpose; sand, similarmaterial and stone for industrial and non-agriculture purpose; growing media(with soil, peat or other organic materials), peat or sphagnum moss forhorticultural purposes, may be permitted through specified air or sea ports orland customs station.

“Provided an import permit shall be required for consignment of soil in any form for research purpose; growing media (with soil, peat or other

organic materials), peat or sphagnum moss for horticultural purposes”

ii. The application or online application for the purpose referred to in (i) aboveshall be made to the Issuing Authority as listed in Schedule-X, at least 10days in advance, in PQ Form 06.

iii. A fee of Rs. 1000/- shall be payable along with the application. The fee shallbe payable online or in the form of Demand Draft payable to the CompetentAuthority having jurisdiction.

iv. The Competent Authority may, after scrutiny of the application, and if satisfiedof the purpose, for which such consignment is being imported, issue specialpermit in Form PQ 07. The import permit shall be issued subject to suchrestrictions and conditions prescribed under Schedule-VI.

5. Fees for inspection, fumigation, etc. -The importer of the consignment orhis agent shall pay to the Plant Protection Adviser or any other officer dulyauthorized by him in this behalf, the fees prescribed in Schedule-IX towardsinspection, fumigation, disinfestation, and disinfection of consignment.

6. Permits required for import of Germplasm, Transgenic or GeneticallyModified Organisms

(1) No consignment of germplasm/transgenics/Genetically Modified Organisms(GMOs) shall be imported into India for the purpose of agricultural research orexperimentation purpose without valid permit issued by the Director, NationalBureau of Plant Genetic Resources, New Delhi -110012. Explanation: In thissub-clause, “purpose of agricultural research or the purpose ofexperimentation” shall not include commercial imports which are governed byseparate 11 guidelines issued by the Genetic Engineering ApprovalCommittee, or as the case may be by the Review Committee on GeneticManipulation (RCGM)”.

(2) Every application for import of plant germplasm/ transgenics/geneticallymodified organisms for research/experimental purpose by the public/privateorganizations will be made to the Director, National Bureau of Plant GeneticResources, New Delhi in form PQ 08 and the permit shall be issued in formPQ 09 in triplicate and a red/green tag in PQ 10 for germplasm and aRed/White tag in PQ 11 for transgenic/Genetically Modified Organisms. Suchpermits for import of transgenic/Genetically Modified Organisms shall beissued subject to the approval of Genetic Engineering Approval Committee(GEAC) or as the case my be, the Review Committee on GeneticManipulation (RCGM) set- up by Department of Biotechnology under theprovisions of sub-rule (2) of rule 4 of the Rules for the manufacture, use,import, export and storage of hazardous micro-organisms, Geneticallyengineered organisms or cells made under Sections 6, 8 and 25 of theEnvironment (Protection) Act, 1986 (29 of 1986) and subject to suchrestrictions and conditions prescribed thereof.

(3) No imported consignments of plant germplasm/ transgenics/ geneticallymodified pests shall be opened at the point of entry and it shall be forwardedto the Director, National Bureau of Plant Genetic Resources, New Delhi.

7. Import of live insects and other arthropods/nematodes/microbialcultures including algae/bio-control agents–

(1) No consignment of live insects and other arthropods/nematodes/microbialcultures including algae/bio-control agents shall be permitted into Indiawithout valid import permit issued by competent authority as specified underSchedule-X.

(2) Every application or online application for permit to import live insects andother arthropods/nematodes/microbial cultures including algae/bio-controlagents, shall be made in the PQ Form 12 at least thirty days in advance toPlant Protection Adviser along with a fee of Rs. 1000/- towards registration inthe form of bank draft issued in favour of the Accounts Officer, Directorate ofPlant Protection Quarantine and Storage, Faridabad121001.

(3) The competent authority shall issue the permit in PQ Form 13 in triplicate, ifsatisfied of the purpose for which import is made and subject to suchconditions imposed thereon.

(4) All the consignments of live insects and other arthropods/nematodes/microbialcultures including algae/bio-control agents shall be permitted only throughpoints of entry specified under Clause 3(14). The consignment of beneficialinsects shall be accompanied by a certificate issued by National PlantProtection Organisation at the country of origin with additional declarations forfreedom from specified parasites and parasitoids and the bio-control agentsfree from hyper-parasites. agents shall be subjected to Post-entry quarantineas may be prescribed bythe Plant Protection Adviser.

(5) Nothing contained in the clause shall apply to import of live insects and otherarthropods/nematodes/microbial cultures including algae/bio-control agentshaving no relevance in agriculture.

8. Permit required for import of plants and plant products –

(1) No consignment of plants and plant products, if found infested or infected witha quarantine pest or contaminated with noxious weed species shall bepermitted to be imported.

(2) Every vessel carrying out bulk shipment of grains shall be inspected on boardby an officer duly authorized by Plant Protection Adviser before the sameaccorded permission to offload the grain at the notified port of entry. Oninspection, if found free from quarantine pests and noxious weed species,permission shall be accorded to off-load the grain at the port or orderfumigation/treatment of grain on board or immediately upon unloading at theport, as the case may be, before such permission is granted for movementoutside the port and subject to such conditions as imposed thereon.

(3) The bulk shipment (s) of transgenic plants or plant products or geneticallymodified organisms shall be dealt as per the provisions of the Rules formanufacture, use, import, export and storage of hazardous micro-organisms,Genetically engineered organisms or cells made under Sections 6, 8 and 25of the Environment (Protection) Act, 1986 (29 of 1986) or under themechanism established as per the provisions of Biosafety Protocol by theMinistry of Environment and Forests.

9. Requirement of Import of Wood and Timber:

(1) No consignment of timber and wood/bamboo products shall be brought into India unless such consignment fulfils the following conditions, namely:-

i. No consignment of timber and wood/bamboo species other than those listedunder Schedule-VI shall be imported into India unless the provisions ofClause 3(7) are fulfilled.

ii. the timber and wood/bamboo with or without bark shall be fumigated prior toexport with Methyl bromide at 48 g/m3 for 24 hrs at 210C or above orequivalent thereof or any other treatment duly approved by the PlantProtection Adviser and the treatment shall be endorsed on the PhytosanitaryCertificate issued thereof at the country of export;

iii. the timber or sawn or sized wood with or without bark prior to export shall beeither fumigated as above or kiln dried at 560C for 30 minutes (core

temperature of wood) or heat treated at 560C for 30 minutes (coretemperature of wood) and the treatment shall be endorsed on thePhytosanitary Certificate issued thereof at the country of export.

iv. Wood/Bamboo based products such as manufactured/ finished/ handicrafts/furniture/ joinery and articles from carpentry (windows/doors/ shutters/photoframes/ curtain rods/boxes/ thatch etc)/ conveyances (row boats, vehicledecks, trailers etc)/ garden items/house hold articles/ musical instruments/sporting equipments/ tools/toys/flower vase/ wood fiber/ woody dry brancheswithout bark/ cones/baskets etc/., shall be fumigated/treated prior tomanufacturing/crafting/ finishing process etc., with Methyl bromide at 48 g/m3for 24 hrs at 210C or above at NAP or kiln dried or heat treated at 560C for 30minutes (core temperature of wood) or Gamma irradiation at 25 kGray orequivalent thereof or any other treatment duly approved by the PlantProtection Adviser and the treatment shall be endorsed on the PhytosanitaryCertificate issued thereof at the country of export.

(2) All the consignments of timber shall be inspected on board prior to unloadingat the port of arrival by an officer duly authorized by Plant Protection Adviserand, if necessary, fumigated or treated on board before unloading: Providedthat no such inspection shall be necessary in case of containerized cargo.

(3) The containerized cargo of timber or sawn/sized wood without bark andwood/bamboo based products shall be inspected by an authorized PlantQuarantine Officer after unloading of the containers from the ship at the portof Container Freight Station or Inland Container Depots under the jurisdictionof concerned Plant Quarantine Station.’

(4) The provision of this Order shall not apply to consignments of processedwood material such as plywood, particleboard, oriental strand board or veneerthat have been manufactured by using glue, heat and pressure orcombination thereof.

CHAPTER III

Special conditions of Import

10. Special conditions for import of plant species –

(1) In addition to the general conditions listed above in Chapter-II, the plantspecies herein after mentioned in Schedule-V, VI and VII shall be permitted tobe imported subject to such restrictions and conditions specified in thisChapter.

(2) Every consignment of plant species herein specified in Schedule-V, VI and VIIshall be accompanied by an original Phytosanitary Certificate issued by theauthorized officer at country of origin or Phytosanitary Certificate for re-exportissued by the country of re-export along with attested copy of phytosanitarycertificate from country of origin, as the case may be, with the additionaldeclarations being free from pests mentioned under Schedule-V and VI of thisorder or that the pests as specified do not occur in the country or state oforigin.

(3) The special conditions relating to treatment and freedom from soil, and/ orweed as specified under Schedule V and VI shall be endorsed on suchPhytosanitary certificate wherever applicable. (4) The consignment of plantsand planting material shall be imported subject to the conditions stipulatedunder Clause 3(4) &11.

CHAPTER IV

Post-entry Quarantine

11. Post-entry quarantine –

(1) Plants and seeds, which require post-entry quarantine as laid down inSchedule V and VI of this order, shall be grown in post-entry quarantinefacilities duly established by importer at his cost, approved and certified by theInspection Authority as per the guidelines prescribed by the Plant ProtectionAdviser.

(2) The period for which, and the conditions under which, the plants and seedsshall be grown in such facilities shall be specified in the permit granted underclause 3.

(3) Nothing contained in Sub-clause (1) shall apply to the import of tissue-cultured plants that are certified virus-free as per Schedule-V and VI, but suchplants, shall be subjected to inspection at the point of entry to ensure that thephytosanitary requirements are met with.

(4) Every application for certification of post-entry quarantine facilities shall besubmitted to the inspection authority in Form PQ 18. The inspection authorityif satisfied after necessary inspection and verification of facilities shall issue acertificate in Form PQ 19.

(5) At the time of arrival of the consignment, the importer shall produce thiscertificate before the Officer-in-Charge of the Quarantine Station at the entrypoint along with an undertaking in form PQ 20.

(6) If the Officer-in-Charge of the Quarantine Station, after inspection of theconsignment is satisfied, shall accord quarantine clearance with Post-entry

quarantine condition on the 14 production, by an importer, of a certificate fromthe inspection authority with the stipulation that the plants shall be grown insuch Post-entry quarantine facility for the period specified in the import permit.

(7) After according quarantine clearance with post-entry quarantine conditions tothe consignments of plants and seeds requiring post-entry quarantine, theOfficer-in-Charge of the Quarantine Station at the entry point shall inform theinspection authority, having jurisdiction over the post-entry quarantine facility,of their arrival at the location where such plants would be grown by theimporter.

(8) It shall be the responsibility of the importer or his agent –

(i) to intimate the inspection authority in advance about the date of planting ofthe imported plant or seed.

(ii) not to transfer or part with or dispose the consignment during the pendency ofpost-entry quarantine except in accordance with a written approval ofinspection authority.

(iii) to permit the inspection authority complete access to the post-entryquarantine facility at all times and abide by the instructions of such inspectionauthority.

(iv) to maintain an inspection kit containing all requisite items to facilitate nurseryinspection and ensure proper plant protection and upkeep of nursery records.

(v) to extend necessary facilities to the inspection authority during his visit to thenursery and arrange destruction of any part or whole of plant population whenordered by him in the event of infection or infestation by a quarantine pest, ina manner specified by him.

(9) The inspection authority of concerned area of jurisdiction or any officerauthorized by the Plant Protection Adviser in this behalf, in association with ateam of experts shall inspect the plants grown in the approved post-entryquarantine facility at such intervals as may be considered necessary inaccordance with the guidelines issued by the Plant Protection Adviser, with aview to detect any pests and advise necessary phytosanitary measures tocontain the pests.

(10) The inspection authority shall permit the release of plants from post-entryquarantine, if they are found to be free from pests and diseases for the periodspecified in the permit for importation.

(11) Where the plants in the post-entry quarantine are found to be affected by pestsand diseases during the specified period the inspection authority shall:-

(i) order the destruction of the affected consignment of whole or a part of theplant population in the post-entry quarantine f the pest or disease is exotic, or

(ii) advise the importer about the curative measures to be taken to the extentnecessary, if the pest or disease is not exotic and permit the release of theaffected population from the post-entry quarantine only after curativemeasures have been observed to be successful. Otherwise, the plants shallbe ordered to be destroyed.

(12) Where destruction of any plant population is ordered by the inspectionauthority, the importer shall destroy the same in the manner as may bedirected by the inspection authority and under his supervision

(13) At the end of final inspection, the inspection authority shall forward a copy ofthe report of post-entry quarantine inspection duly signed by him to the PlantProtection Adviser under intimation to officer-in-charge of concerned plantquarantine station.

(14) The importer shall be liable to pay the prescribed fee for inspection of plantsin the post-entry quarantine facility as laid down in Schedule-IX.

CHAPTER V

Appeal and Revision

12. Appeal –

(1) If an importer is aggrieved by the decision of the inspection authorityregarding the destruction of any plant population, he may appeal to the PlantProtection Adviser within 7 days from the date of communication of thedecision giving the grounds of appeal.

(2) It shall be lawful for the Plant Protection Adviser to rely on the observations ofthe inspection authority and such other expert opinion, as he may deemnecessary, for deciding the appeal.

(3) The memorandum of appeal under sub-clause (1) shall set out the grounds insuccessive paragraphs on which the decision is challenged and shall beaccompanied by a bank draft in favour of the Plant Protection Adviser andpayable at Faridabad, evidencing the payment of fee of Rs. 100/-.

13. Revision –

The Plant Protection Adviser may, at any time, call for the records relating toany case pending before the inspection authority for the purpose of satisfyingitself as to the legality or propriety of any decision passed by that authorityand may pass such order in relation thereto, as it thinks fit:

Provided that no such order shall be passed after the expiry of three monthsfrom the date of the decision;

Provided further that the Plant Protection Adviser shall not pass any orderprejudicial to any person, without giving him a reasonable opportunity of beingheard.

CHAPTER VI

Power of Relaxation

14. Relaxation conditions of Import Permit and Phytosanitary Certificate incertain cases –

(1) The Central Government may, in public interest, relax any of the conditions ofthis Order relating to the import of any consignment. The Joint Secretary in-charge of Plant Protection in the Department of Agriculture & Cooperationshall be the competent authority for according the relaxation. Further thepowers of relaxation has been delegated (vide DAC lt. No. 8-5/2004-PPI(pt)dated 2nd February 2005) to officers in charge of the Plant Quarantine 16Stations for relaxing the conditions of Import permit and phytosanitarycertificate required as per Plant Quarantine (Regulation of Import into India)Order, 2003 as a one-time exception in favour of a single party and not forrepeated violations by that party. All second or subsequent cases of violationof requirement of Import Permit and Phytosanitary certificate by any partyshall be forwarded to Joint Secretary (Plant Protection), Department ofAgriculture &Cooperation

(2) In the event of grant of relaxation by competent authority, the consignmentshall be released after charging the fee for import permit and fee for plantquarantine inspection at five times of normal rates.

(3) The provisions of this Order shall apply without prejudice to the Customs Act,1962 (52 of 1962) or any other Acts or Order related to imports.

Chapter VII

Repeal and Savings

15. Repeals and Savings –

(1) The following orders and notifications are hereby repealed, namely: -

(i) Rules for regulating the import of insects into India notified under F-193/40A dated 3.2.1941

(2) Not withstanding such repeal, an import permit issued by any competentauthority, which is in force immediately before the commencement of thisOrder and shall continue in force till the 31st day of March, 2004 and allappointments made and fees levied under the repealed Rules, Regulationsand Orders, and in force immediately before such commencement shalllikewise continue in force and be deemed to be made or levied in pursuanceof this Order until revoked.

MONITORING OF PESTICIDE RESIDUES AT NATIONAL LEVEL (MPRNL)

The Department of Agriculture and Cooperation, Ministry of Agriculture isregularly monitoring the pesticide residues in food commodities and environmentalsamples under the central sector scheme, “Monitoring of Pesticide Residues atNational Level”. The scheme was initiated during 2005-06 with the participation ofvarious laboratories representing Ministry of Agriculture, Indian Council of AgricultureResearch, Ministry of Health and Family Welfare, Ministry of Environment andForest, Council of Scientific and Industrial Research, Ministry of Chemical andFertilizer, Ministry of Commerce and State Agricultural Universities across thecountry.

The scheme involves monitoring and analysis of pesticide residues inagricultural commodities in different agro-ecological regions of the country toaddress the concerns for food safety and impact of pesticides on India’s food andagricultural trade.

PROGRAM &SCHEME :

The Department of Agriculture & Cooperation, Ministry of Agriculture hasstarted a Central Sector Scheme, “Monitoring of Pesticide Residues at NationalLevel” in food commodities and environmental samples during 2005-06 with theparticipation of various laboratories representing Ministry of Agriculture, IndianCouncil of Agriculture Research, Ministry of Health and Family Welfare, Ministry ofEnvironment and Forest, Council of Scientific and Industrial Research, Ministry ofChemical and Fertilizer, Ministry of Commerce and State Agricultural Universitiesacross the country. The scheme is on-going with the participation of 22 (twenty two)laboratories all over the country. Five of these have been designated as corelaboratories to provide technical guidance and support to the associated laboratoriesin each zone. As per the approved technical programme during the annual workshopof the scheme, the participating laboratories collect the food commodities samplesfrom various Agriculture Produce Marketing Committee (APMC) markets and PublicDistribution System (PDS), irrigated water and soil samples from intensiveagricultural fields across various parts of the country and analyze them for pesticidesresidues. Since October 2006, the participating laboratories have monitoredpesticide residues in various food commodities such as vegetables, fruits, cereals,spices, pulses, milk, animal feed, fish, meat, tea, honey, dry fruits, egg, soil andwater.

The central sector scheme is monitored by two committees, namely, SteeringCommittee and Technical Committee. The policy decisions related to the scheme areunder the preview of the Steering Committee headed by the Joint Secretary (PlantProtection), Department of Agriculture and Cooperation (DAC) while the TechnicalCommittee, headed by the Assistant Director General (Plant Protection), Indian

Council of Agriculture Research (ICAR) takes care of the technical issues related tothe scheme. The Project Coordinating Cell of AINP on Pesticide Residues is thenodal centre for implementation of the scheme. The Network Coordinator, All IndiaNetwork Project on Pesticide Residues, IARI, New Delhi is the Member Secretary ofthe scheme and is the nodal person for the day to day implementation of the schemerelated to financial and technical matters and submission of monthly report, annualreport and need based information to the DAC.

The main objectives of the scheme include:

To test pesticide residues and other contaminants in food commodities andenvironmental samples like soil and water.

To identify crops and regions having preponderance of pesticide residues inorder to focus extension efforts for Integrated Pest Management (IPM) andGood Agriculture Practices (GAP).

To strengthen infrastructure at Quarantine stations to prevent entry of foodand food commodities which have pesticide residues above maximum residuelimit (MRL).

Testing / Certification of pesticide residue in export / import consignments.

For the year 2017-18, the funds were released for the Scheme from theBudgetary head ‘Grants-in-aid-General’ where there was a provision of Rs. 1700lakhs. So far Rs. 1275 lakhs has been released for the Scheme in two instalmentsof Rs. 800 lakhs and Rs. 475 lakhs.
