A. Definitions

1. Premium / Risk Rate The total consideration paid by or on behalf of the insured for a title insurance policy.

2. Simultaneous Issued Policies

a) Loan policy (or combination of two loan policies) issued simultaneously with owner’s policy when liability of owner’s policy exceeds loan policy(ies).

b) Loan policy issued simultaneously with owner’s policy when liability of loan policy exceeds owner’s policy.

c) Second loan policy issued simultaneously with a loan policy.

3. Residential Transaction One-to-four family dwelling to include vacant land when used for residential purposes.

4. Commercial Transaction

Any transaction not meeting the above definition of Residential Transaction.

5. Builder One who constructs a residential structure not for his own occupancy or one who constructs a commercial structure.

6. Subdivider

One who develops a parcel or parcels for resale.

7. Builder’s & Subdivider’s Rate That rate applicable to any builder or subdivider (as defined hereinabove) with respect to any parcel or parcels, lots, tracts or units being developed or built for resale. Both residential and commercial properties are eligible for this Builder/Subdivider Rate.

B. Title Insurance

Unless otherwise provided herein, the rates shown in the Missouri Rate Table shall apply when issuing preliminary commitments or policies of title insurance. Policies insuring deeds of trust issued for foreclosure purposes shall be issued in an amount at least equal to the outstanding principal indebtedness. All other policies shall be issued in an amount at least equal to the full value of the estate insured, without deduction of encumbrances.

C. Title Insurance Rates

1) The rates for the various types of title insurance policies and endorsements offered by WFG National Title Insurance Company (“the Company”) are set forth below. Premiums are for title insurance only and do not include search fees, abstract fees, attorney fees, or escrow or closing fees. Additional charges may be assessed for title insurance policies which involve an unusually large amount of work, but the applicant shall be notified before any additional charges would apply.

2) Homeowner’s Policy/Expanded Coverage Loan Policy

The charge for Homeowner’s and Expanded Coverage Loan policies shall be 115% of the applicable rates in Schedule 1.

D. Endorsements

See Schedule 2 attached for rates. E. Insured Closing Letters - See Schedule 3 attached for rates. F. ALTA Residential Limited Coverage Mortgage Modification Policy

The premium charge for the ALTA Residential Limited Coverage Mortgage Modification Policy will be as follows:

Maximum liability for this policy will be $2,500,000.00.

G. ALTA Residential Limited Coverage Junior Loan Policy

The premium charge for the ALTA Residential Limited Coverage Junior Loan policy shall be a flat fee of $110.00 for up to $250,000.00 coverage. This coverage may be supplemented by including the ALTA Endorsement JR-1(Date Down) at no additional cost and/or the ALTA Endorsement JR-2 (Revolving Credit/Variable Rate) at no additional cost.

H. Flat-Rate, Centralized, Residential, Refinance Rate

The charge for a loan policy issued in connection with loan transactions which meet the criteria set forth below shall be as follows:

The loan is not in excess of $1,500,000.00; 2. The loan is secured by a mortgage or deed of trust encumbering real property improved with a

one-to-four family residential dwelling unit or residential condominium unit; 3. The loan proceeds must be used to refinance an existing loan secured by the same property; 4. Electronic and Paperless order opening and electronic and paperless delivery of the

preliminary report or commitment; and 5. The new policy coverage is ALTA in form (including an ALTA Loan Policy or ALTA Short Form

Residential Loan Policy) with streamlined searching providing for generic exceptions for CC&Rs, easements, minerals, mineral rights or survey matters.

I. WFG Master Home Equity Loan Policy For home equity loan transactions up to $250,000 with centralized order tracking and processing through WFG Lenders Solution or similar unit, pursuant to a written agreement, the rate shall be $45.00. For home equity loan transactions from $250,000 up to $500,000 with centralized order tracking and processing through WFG Lenders Solution or similar unit, pursuant to a written agreement, the rate shall be $75.00. The Master Home Equity Loan Mortgage Report Fee shall be $30.00.

J. Standard and Generic Exceptions filed in Compliance with MO RS 381.085 The following Standard and Generic Exceptions are included in this Rate and Rule Manual in order to comply with Missouri Revised Statute section 381.085.4, which requires that any standard exception to the coverage provided in a title insurance policy must be filed with the Director of the Missouri Department of Insurance. Standard Coverage Exceptions

The following Standard Exceptions will be shown in all Title Commitments and all Title Policies issued by the Company, unless the Company has acquired or has been provided sufficient documentation, in compliance with its underwriting guidelines, to remove said Standard Exceptions.

1. Rights or claims of parties in possession not recorded in the Public Records.

2. Easements or claims of easements not recorded in the Public Records.

3. Any encroachment, encumbrance, violation, variation, or adverse circumstance that would be disclosed by an inspection or an accurate and complete land survey of the Land.

4. Any statutory lien for services, labor, or material arising from construction of an improvement or work related to the Land and not recorded in the Public Records.

5. Liens for real estate taxes, assessments and other charges imposed by a governmental authority that are not shown as existing liens by its records.

6. (a) Unpatented mining claims: (b) reservations or exceptions in patents or in Acts authorizing the issuance thereof; (c) water rights, claims or title to water, whether or not the matters excepted under (a), (b), or (c) are shown by the public records.

7. Any Services, installation or connection charge for sewer, water or electricity.

8. Any right, title, or interest in any minerals, mineral rights, or related matters, including but not limited to oil, gas, coal, and other hydrocarbons.

Generic Exceptions: The following approved Generic Exceptions may be used in lieu of exceptions ascertained from the search or examination of records relating to the title of a specific owner or parcel of real estate when producing a Commitment or Title Policy insuring a Lender only. These Generic Exceptions are NOT ascertained from a search or examination of records relating to the title of a specific owner or parcel of real estate, but are broad descriptions of matters that may affect record title. Generic Exceptions are not approved and will not be used in a Commitment or Title Policy issued in anticipation of issuing Owner’s insurance or any transaction insuring property other than that improved with a one-to-four family residential dwelling.

Generic Exceptions:

1. Covenants, conditions and restrictions, if any, appearing in the public records deleting therefrom any restrictions indicating any preference, limitation or discrimination based on race, color, religion, sex, handicap, familial status or national origin.

2. Easements or servitudes appearing in the public records

3. Leases, grants, exceptions or reservations of minerals or mineral rights appearing in the public records.

4. Loss or damage by reason of any violation, variation, encroachment or adverse circumstances affecting the title that would have been disclosed by an accurate survey.

5. IF APPLICABLE: a) Riparian and littoral rights of others. b) No title is insured to any filled-in land or land lying below the present or any former

mean high water line of any body of water.

1 “Original Title Insurance for Owners and Leasehold Owners Policies” means any owner’s policy insuring fee simple estate for the full value of the premises, or

any owner’s policy insuring a leasehold estate for the present market value of such leasehold estate. 2

“Reissue Title Insurance for Owners and Leasehold Owners Policies” means a title insurance policy issued to a purchaser or lessee of real estate from a person

whose title as owner has previously been insured by any company prior to the application for a new policy. 3

“Title Insurance for Conversion of Contract Purchaser’s and Leasehold Policies” means a title insurance policy issued to a contract purchaser who has previously obtained a policy from an insurer insuring his/her contract, who subsequently obtains a deed given in pursuance of the contract and makes an

application for an owner’s policy from the same insurer and surrenders the previous policy; or a title insurance policy issued to a lessee who has previously

obtained a leasehold policy of an insurer insuring his/her lease and subsequently purchases the property, makes application for an owner’s policy from the same

insurer and surrenders the previous policy. 4

“Original Title Insurance for Loan Policies” means a mortgage title insurance policy issued for an amount equal to or higher than the principal amount of the

mortgage debt. 5

“Reissue Title Insurance for Loan Policies” means a mortgage title insurance policy issued for an owner of property who has had the title to such property

previously insured as owner by any title insurer. 6

“Title Insurance for Owners or Leasehold Owners Policies Upon Acquisition in Satisfaction of Debt” means a title insurance policy issued to an insured under a

mortgage title policy who acquires title by foreclosure or by voluntary conveyance in extinguishment of debt. 7

“Title Insurance for Substitution” means a title insurance policy issued to a borrower who obtains a substitution loan on the same property by the same lender. 8

“Simultaneous Issue Policies” means an owner’s and mortgagee’s policy(ies) covering identical land which are issued simultaneously. 9

“Title Insurance for Builder/Developer (Subdivision Rates)” means a title insurance policy covering premises owned by one owner which have been platted

into multiple lots; a title insurance policy issued to an owner of multiple lots within a platted subdivision; or a title insurance policy issued to an owner who proposes to sell vacant lots to individual purchasers and furnish an owner’s title insurance policy to each purchaser, as evidence of title, in lieu of furnishing an

abstract of title.

10”Title Insurance for U.S. Government Agencies and Departments” means an ALTA U.S. Policy issued to any Agency or Department of the United States

Government that acquires an interest in the insured property.
