TERMS OF PAYMENTAll rates are net cash with order unless credit has been approved by the Publisher. Where credit has been extended invoices are payable on terms stipulated on the invoice statement. Publisher will invoice advertiser on a monthly or cash basis depending on financial conditions and known credit data. All charges that are over 30 days or more past due will be assessed a delinquent charge of 1.5% per month. The delinquent charges will con-tinue monthly until account becomes current.

PERSONNEL

2010 Rate Card

A. All Rates contained herein are net as shown. No Agency commissions or further discounts are allowed unless otherwise noted.

B. All display advertising takes the “run of the paper,” unless otherwise specifically requested in each case. Every effort will be made to comply with the request, but position is not sold or guaranteed. Advertising orders are not accepted on a “position or omit” basis.

C. A yearly contract, signed in advance, is required to earn other than the open rate and to qualify for discounts.

D. Publisher reserves the right to revise advertising rates upon 30 days notice and all contracts are accepted subject to this condi-tion.

E. Publisher reserves the right to refuse or cancel any advertisement.

F. Advertiser represents and warrants that all statements contained in copy submitted by advertiser are true, and Advertiser agrees that it

will indemnify and hold harmless Publisher from liability, including reasonable attorney’s fees and other costs of defense, arising from any actions or claims for libel, slander, disparage-ment, trade libel, invasion of privacy, or other causes of action resulting from publication of Advertiser’s copy.

G. The St. Augustine Record will not be li-able for any error in advertisements to a greater extent than the cost of the space occupied by the error. The publisher will not incur any liability for errors after the first day the ad appears. Any errors should be reported immediately to the advertising department for corrections as soon as possible. Publisher is not responsible for errors on copy received after deadline.

H. All advertising space will be credited once as dollars toward contract fulfillment, except as otherwise noted.

I. Advertising set to resemble news matter must carry the word “Advertisement” at the top of the advertisement.

J. Some advertisers may be temporarily extended a $500 courtesy credit limit pending the final credit extension decision, providing a completed credit application has been submit-ted for review.

K. Application of Retail Rates: Retail display rates apply to advertisers who sell a product or service to the public through one or more local retail outlets owned and operated by the advertiser and do not apply to other types of advertising. All rates and discounts apply to individual advertisers.

L. All rates subject to any applicable tax.

M. Customers receive a maximum of two proofs per ad. Any proofs thereafter will be billed at $25/per proof for changes.

N. Ads cancelled after deadline will be billed at 50% of agreed upon rate.

O. By submitting an order to run advertise-ment in The St. Augustine Record you are agreeing to all terms and conditions presented in this rate card.
