This would be similar to legacy approval procedures that currently exist between other telecommunications and video services providers offering services across the City , allowing construction of communications infrastructure (primarily underground, but including above ground pedestals and cabinets) and attachment to existing or relocated poles. This agreement will include the same set of standards of staff approval for typical residential and commercial telecommunications construction. The City of Durham and Town of Cary have both approved similar agreements with Google. This will allow City staff to administratively approve encroachment requests within the parameters set by the agreement, avoiding a need for individual Council action for each submission as Google builds their fiber-to-the-home network. (Council has approved similar encroachment requests at its July 7 th and July 21 st meetings and it is the intent of staff to bring those encroachments under the Master Encroachment Agreement when executed.) The encroachments will have a 20 year term and will include insurance and bonding requirements no less protective than through the current major encroachments process. Recommendation: Authorize the City to enter into a master encroachment agreement with Google Fiber North Carolina, LLC, subject to approval of terms by the City Manager and City Attorney.

    2 Dimensions of Proposed Encroachment: Existing Encroachments - Existing Retaining Wall approximately 20lf, 1 in width. Existing 8 caliper tree. Existing Parking lot light pole, approximately 10 diameter. New Encroachment - Landscaping consisting of trees and shrubs covering approximately 370 sf along the northern property boundary. Encroachment is approximately 8 wide and 46 long.

    3 Elevation/depth of Proposed Encroachment: The existing retaining wall is approximately 2.5 tall and the footing depth is unknown. The existing trees root system projects below grade to the limits of the tree canopy. The existing light pole projects into the ground to a unknown depth. New landscaping installed will be planted at finish grade elevation and roots will extend to a depth of approximately 3

    Existing encroachments will remain; the encroachment is necessary due to the right of way dedication along Oberlin Road. All proposed encroachments will be installed by the contractor during construction of the building.

    Encroachment Information

    1 Site(s) of Proposed Encroachment:

    Right of way located at the end of South Side Drive.

    2 Dimensions of Proposed Encroachment:

    5 X 2.5 Curb Inlet (Flow Splitter); 45 L.F. 4 PVC Diversion Pipe; 14 L.F. 15 RCP; 5 X 1 (Deep) Riprap Swale.

    3 Elevation/depth of Proposed Encroachment:

    The flow splitter box is 4.0 +/- feet deep. The two stormwater pipes will vary between flush with grade to 4.0 +/- feet deep and the bypass channel will be 1.0 feet deep.

    4 Timetable and Method of Installation:

    The installation will be completed using small grading & excavation equipment to include, but not limited to, a backhoe and a bull dozer. The installation date is estimated to begin in October 2015 and be completed in November 2015.

    5 Duration of Proposed Encroachment:

    6 Description and Purpose of Proposed Encroachment:

    South Side Drive terminates above a riparian buffer. The encroachment is required to install a flow splitter box, a 4 PVC diversion pipe, a 15 RCP stormwater pipe, and a bypass channel to a stormwater feature in the South Side Drive ROW to meet the Division of Water Resources requirement for diffuse stormwater flow to a riparian buffer.
