With regard to the Marsden Jacob Associates report commissioned by the Nature Conservation Council that showed the desalination plant proposed for Sydney could by deferred until 2022 or beyond if rainwater tanks were installed in 5 per cent of Sydney households each year:(1) What action has the NSW Government taken in response to the report? (2) Has the NSW Government accepted the report's findings? (3) If not, why not? (4) Does the NSW Government accept that the environmental costs of installing rainwater tanks

including reduced greenhouse gas emissions and urban footprints, is less than the environmental costs of the desalination plant proposed at Kurnell?

(5) What assessment has the NSW Government undertaken on funding rainwater tanks in homes in replacement of the proposed desalination plant?

(6) What assessment has the NSW Government undertaken on funding rainwater tanks in homes together with large scale waste-water recycling in replacement of the proposed desalination plant?

Answer—(1) The NSW Government already includes rainwater tanks as one of the mix of measures that secure the balance between supply and demand in Sydney, both in drought and over the longer term.(2) and (3) The Department accepts the report finding that it "is unlikely that rainwater tanks could be installed in time, or provide sufficient security, to off set emergency water sources".Otherwise there are assumptions on cost and rainfall which cast significant doubt in the conclusions reached in the report.According to a Canberra Times report of 23 April 2007: "The Australian Conservation Foundation misrepresented the findings of a (Marsden Jacob) Report which it jointly commissioned to claim that rainwater tanks are a solution to Australia's urban water crisis"The article went on to say that:"In research for the National Water Commission, Marsden Jacob has twice found the rainwater tanks are an uneconomic means of obtaining water and useless for finding water during a crisis""Marsden Jacob' Principal John Marsden said he was disappointed with the "enthusiastic" treatment of

his report by the Australian Conservation Foundation."(4) The desalination plant will not impact on greenhouse gas emissions as it will be powered by renewable energy.(5) Sydney Water's Rainwater Tank Rebate program has already resulted in approximately 35,800 rebates being paid (to 1 June 2007). In addition, 250 rebates have been given to schools.(6) Sydney's rainwater tank rebate program complements the measures in the 2006 Metropolitan Water Plan to increase recycling and in particular, the Government's massive recycling projects at Camellia and in Western Sydney, which will see, respectively, 6 billion litres and 27 billion litres of waste water recycled each year by 2015.

Given that the laying aside of the Royal Arms of New South Wales in line with the State of Arms Act 2004, has been accomplished in two of the three branches of Government, namely in the Legislature and by the Executive:(1) When will action be taken to replace the huge modern Royal Arms of the United Kingdom in the

Queens Square foyer of the Supreme Court of New South Wales with a representation of the State Arms?

(2) What action has been taken to re-house the Royal Arms, which have been removed from various buildings, and their appropriate conservation, interpretation and display as part of the constitutional, legal, cultural and artistic heritage of the State in accordance with the requirements of the Section 5 (5) of the State Arms Act?

Answer—(1) The Act requires Royal Arms to be removed from buildings "as soon as practicable". Premier's

Department Circular 2004-03 states that agencies should replace the Royal Arms when refurbishments or structural changes are made, which enables the cost to taxpayers to be minimised as far as possible. I am advised that replacement of the Royal Arms will be considered by the building owner, Law Courts Limited, as part of the ongoing refurbishment of the Law Court building.

(2) Agencies are currently considering issues concerning the housing or conservation of Royal Arms in accordance with the Act and the Premier's Department Circular 2004-03. For example, the Attorney General's Department is consulting with the Heritage Office on the heritage significance of the various Royal Arms removed from certain court buildings.

In relation to the NSW Government's Rural Lands Protection Board Rate Review:(1) (a) Will the Minister make a submission to this review?

(b) If not, why not? (2) Will the Minister represent the interests of landholders managing land in NSW for Nature

Conservation and not livestock purposes as part of this review? Answer—The Minister for Primary Industries has indicated that the matter of Rural Lands Protection Board rates that apply to landholders who manage their land for nature conservation, rather than for livestock purposes, will be considered as part of the review of the Rural Lands Protection Board rating system being conducted by Mr Richard Bull. The Department of Environment and Climate Change is participating in the review which I understand is due for completion in July 2007. I will be seeking advice on the recommendations when they are released, and will continue to explore how we can best support the efforts of landholders who manage their land for conservation in NSW.
