Highlights for the Fourth Quarter of 2009

The 4th Quarterly Compliance and Enforcement Summary for 2009 outlines 6 Orders, 101 Administrative Sanctions, 480 Tickets and 10 Court Convictions for a combined total of $281,214 in fines.

Notable highlights this Quarter:

EOG Resources Canada Inc. was convicted in provincial court of three counts of introducing business waste into the environment and for the unlawful use of a Crown resource. EOG was fined a total of $58,845, with $47,000 of that going to the Habitat Conservation Trust Foundation for environmental conservation and management in the Liard area.

The Environmental Management Act and Water Act charges stem from EOG's drilling and pipelining operations near Maxhamish Lake, north of Fort Nelson. These convictions were the result of a year long investigation by the B.C. Oil and Gas Commission.

Teck Cominco Metals Inc. was convicted in provincial court of introducing waste into the environment and fined a total of $114,300, with $55,000 of that going to the Columbia River Integrated Environmental Monitoring Program, and another $55,000 going to the Upper Columbia White Sturgeon Recovery Initiative.

This was the largest fine ever awarded on one count under the Environmental Management Act . Teck Cominco discharged 900 kilograms of lead refinery electrolyte and 360 litres of acid into the Columbia River following the failure of a heat-exchange unit at its lead and zinc refinery.

Walker Rook Addison was back in provincial court to face charges under the Wildlife Act for hunting in a residential neighbourhood of Nanaimo. He was fined $8,495, forfeited his vehicle and prohibited from hunting for ten years. In 2008 Addison was charged with illegal hunting in the Kootenays and fined a total of $17,400.

Rakowski, Donald Nanaimo Water Act 76 An Engineer's Order was issued to address the unauthorized removal of a well cap. The order requires that the following conditions be met: (1) secure a water tight, vermin proof cap on the well within 24 hours of receiving the order; and (2) ensure that in the future, the well cap is only removed temporarily for the purposes of inspecting, developing, disinfecting, maintaining, repairing or altering the well or the works associated with the well.

Holland, Geord & Eastpoint Ocean Cottages Ltd

Saturna Island Water Act 78 An investigation was undertaken in response to complaints from the public, suggesting that a well was being operated in a manner that might cause the intrusion of saltwater to an aquifer. Following the investigation, an Engineer's Order was issued requiring that the following conditions be met: (1) cease pumping ground water from the identified well; (2) pumping may resume only for the purpose of testing if done under supervision of a qualified professional (QP) and the ministry is notified; (3) pumping of water from the well is not to resume until ministry staff indicates in writing the following: (a) the well is shown to be capable of consistently producing fresh water in both wet and dry seasons; and (b) the operation of the well will be altered to eliminate the adverse effects of potential leaks in the water distribution system. If the conditions noted above are met, and pumping is resumed, yearly monitoring reports by a QP must be submitted to the ministry for a period of three years.

Hauer Creek Power Inc McBride Water Act 93(2) An Engineer's Order was issued to ensure conditions of a water licence be met, and required that the following actions be taken: (1) submit to the ministry an Annual Power Return Report; (2) prepare a plan specifying the flow monitoring devices to be used, their locations, approach and frequency of calibration and format of data recording; (3) submit "as built" drawings signed by a professional engineer for all installed works (including head pond configuration, spillway design and bypass, arrangement for emergency release, powerhouse, penstocks, and other pertinent structures); and (4) provide details on how the "as built" facilities address the recommendations from the consultant concerning: (a) erosion berms at intake; (b) spillway capacity to meet the design criteria for bypass; (c) settling pond to reduce fine particles in penstock; (d) fulfill conditions of the Water Licence at the completion of the mitigative works; and (e) prepare a report identifying the long term operation and maintenance of these works.

Kootenay Lake Water Act 93(2)(q) An Engineer's Order was issued to address the unauthorized construction of a break water in sensitive fish habitat. The order requires that the break water be removed and the following conditions be met to ensure the beachfront is restored to its pre-construction state: (1) all works shall be completed during the scheduled water level drawdown; (2) works shall be supervised by a contracted environmental monitor to minimize the impacts of the construction on the foreshore habitat and water quality of Kootenay Lake; (3) wherever possible, heavy machinery shall not be operated in the water and shall be free of any fluid leaks to prevent deleterious liquids from entering the water; and (4) all disturbed areas on land adjacent to the break water is to be stabilized and reclaimed to pre-construction condition so as not to contribute sediment to the lake.

Smithers Water Act 93(2)(q) An Engineer's Order was issued to address unauthorized works causing detrimental watershed conditions downstream of Hebbel Spring. The order requires that the following conditions be met: (1) cease and discontinue any further works that may cause or allow further erosion; (2) submit to the ministry a site remediation plan designed by a QP containing: (a) immediate application of the measures required to protect the site from further surface erosion, eliminate soil movement into the spring, and stabilize the slopes from continued failure; (b) all measures required to re-establish riparian vegetation for stream function and habitat values; and (c) all measures to promote ongoing soil and slope stability.

West, Tom & Oasis Campground

Oliver/South Okanagan Wildlife Management Area

Wildlife Act 4(4);7(4)

A campground owner contacted ministry staff to report his accidental trespass into a Wildlife Management Area (WMA) while installing utilities service to the adjacent campground. He was ordered to immediately cease work in the WMA, under authority of the Wildlife Act . Ministry staff is exploring options with the campground owner to resolve the issue.

Robinson, Raymond Victoria Wildlife Act 338/82 3.06 1 month ineligibility to renew trapping licence

Prior to this Wildlife Act section 61 hearing, Robinson pled guilty in provincial court for illegally setting a conibear trap in a residential neighbourhood (within 200m of a dwelling). The courts ordered him to pay a fine of $500 plus restitution of $3,200 to cover associated veterinarian bills to the owners of a domestic cat that was accidentally caught in the trap.

Under section 61 of the Wildlife Act , a Regional Manager may hold a quasi-judicial hearing to consider licensing actions in response to the conduct of a Guide Outfitter, Guide Angler or Trapper. Through their licence, guides and trappers are representatives of the Crown in British Columbia. As such, they need to be held to a high standard of conduct and must always operate within the law.
