THIS MATTER comes before this Court 0 .1 Defer,dant's pleading filed on

February 26, 2019. Upon review, the Court will interpret Defendant's pleading as a

request for relief from judgment or order, pursuant to Rule 55(b) of the Ponca Tribal

Rules of Civil Procedure, which reads as follows:

Grounds for Relief from a Final Judgment, Order, or Proceeding. On motion and just terms, the court may relieve a party or its legal representative from a final judgment, order, or proceeding for the following reasons: (1) Mistake, inadvertence, surprise, or excusable neglect; (2) Newly discovered evidence that, with reasonable diligence, could not have been discovered in time to move for a new trial under Rule 54; (3) Fraud (whether intrinsic or extrinsic), misrepresentation, or misconduct by an opposing party; ( 4) When the summons in an action has not been personally served upon the defendant or respondent and the defendant or respondent has failed to appear in said action; (5) The judgment is void; (6) The judgment has been satisfied, released, or discharged; it is based on an earlier judgment that has been reversed or vacated; or applying it prospectively is no longer equitable; or (7) Any other reason that justifies relief.

Most of Defendant's pleadings attempts to argue provisions of the Uniform

Commercial Code (hereinafter "UCC"), a model set of statutes which has been

adopted in some form by all fifty states in the United States and is intended to

streamline and harmonize business transactions. The UCC is referenced by the Ponca

Tribal Code (see Ponca Tribal Code sec. 13-3-1), but has not been adopted by the

Ponca Tribal Council. Therefore, any provision of the UCC adopted by any state is

not binding on the Ponca Tribe of Nebraska, because the Ponca Tribe holds its own

sovereignty which can only be overcome by an act of Congress. Further, even if the

UCC was adopted by the Ponca Tribe of Nebraska, there is no provision of the UCC

which would have any effect on the validity of the protection order entered in the

above-captioned matter. Accordingly, any request for relief from judgment Defendant

makes based on any arguments regarding the UCC should be denied as failing to

state a claim upon which relief can be granted.

Additionally, Defendant alleges that Plaintiff made false statements on the

petition for a protection order. Rule 55(b) does permit Defendant to raise the issue of

"[f]raud, misrepresentation, or misconduct by an opposing party" as grounds for relief

from judgment. Further, the request was filed within three months of the entry of

judgment, so pursuant to Rule 55(d)(l) of the Ponca Tribal Rules of Civil Procedure,

the request is timely.

IT IS THEREFORE ORDERED AS FOLLOWS:

1) Any relief from judgment requested by Defendant based on the UCC is

denied for failing to state a claim upon which relief can be granted.

2) Defendant's request for relief from judgment based on allegations of

fraud, misrepresentation,. or misconduct by an opposing party shall be heard before

THIS MATTER comes before this Court on Plaintiffs Motion to Strike or

Motion for Extension of Time. Upon review of the pleadings, Plaintiff is correct in

observing that Defendant's most recent pleading, which the Court has interpreted as

subsequent briefing, does raise additional issues in Defendant's underlying Motion to

Vacate. Further, Plaintiff is correct in that Plaintiffs interests would be prejudiced if

all responding parties were not given ample time to respond to the additional issues

raised by Defendant, and Defendant's interests would not be prejudiced by such

delay.

IT IS THEREFORE ORDERED AS FOLLOWS:

1) Plaintiffs Motion to Strike is denied.

2) Plaintiffs Motion to Extend is granted, and both Plaintiff and the Tribe

shall have until October 10, 2019. After either responsive briefing is received from

both Plaintiff and the Tribe, or October 10, 2019, whichever is earlier, the Court will

rule on Defendant's Motion to Vacate .
