MEMORANDUM OF ORAL DECISION DELIVERED BY R. ROSSI ON JANUARY 6,2016 AND ORDER OF THE BOARD_________________________________

[1] This matter pertains to an appeal by the ApplicanVAppellant, Erskine Park

1-loldings Inc. (‘Applicant’) resulting from the failure of the Council of the City of Toronto

(“City’) to make a decision in respect of an application for a Zoning By-law Amendment

(‘ZBA”) for the property known municipally as 18 - 30 Erskine Avenue (subject

property”).

[2] The subject property is situated just west of Yonge Street and is currently

occupied by a vacant three-storey residential building and an underutilized parking lot.

The Applicant proposes to develop the property with a 32-storey residential building

fronting onto Erskine Avenue. The property is currently zoned Mainstreets Commercial

Residential (MCR T3.0 C2.0 R2.5) by Zoning By-law No. 438-86. The purpose and

effect of the proposed ZBA (Exhibit 2)is to provide site specific zoning permissions to

facilitate the subject development proposal along with various permissions for among

other things an increase in the maximum gross floor area and maximum building

heights.

[3] A Board-led mediation process preceded today’s settlement hearing and the

parties were joined in that process by the participants, Sherwood Park Residents’

Association and 17-30 Keewatin Neighbours Group. Participant Nancy Schmeler was

in attendance for today’s hearing. Now, a settlement has been reached.

141 The Board qualified the Applicant’s planner Lindsay Dale-Harris to provide an

overview of the proposed development (as revised), to furnish settlement details and to

provide her expert opinion on the appropriateness of the s. 37 Agreement (Exhibit 1)

and the proposed ZBA.

151 The s. 37 Agreement (Exhibit 1) and the aforementioned ZBA are comprehensive

in substance and form and they support a form of revised built form development that is

acceptable to all of the parties. In addition to Mrs. Dale-Harris’ comprehensivedocumentation and visual evidence, she offered to the Board her unchallenged opinionsthat the proposal and various facilitating documents all represent good planning and aredeserving of the Board’s approval. All of the requisite provincial and municipal planninginstruments and guidelines were referenced and all of the relevant policies aredetermined by the Board to be achieved through the revised proposal. Mrs. Dale-Harrisalso took the Board through the various revisions that were made in consultation withthe City, adjacent neighbours and the neighbourhood residents’ groups. The Board waspersuaded by the planning evidence and opinions of this witness that the ZBA shouldbe approved.

j6] It is noteworthy that while the demolition and replacement of six rental housingunits are also tied to this development proposal, City Council will not be consideringthese matters until late February or March 2016. The Board was persuaded by thesubmissions of the Applicant’s counsel, Adam Brown that the rental housingagreements and other matters, such as a substantial financial contribution, are alreadywell spelled out in and secured through the s. 37 Agreement. Accordingly, there is noestablished need to withhold the Board’s Order until after a future Council meeting. TheBoard was also not persuaded that it should withhold its Order for a future site planmatter that is not yet before the Board. The details and specifics of what will bepermitted on this site have largely been worked out by these parties so that a future siteplan matter will be appropriately informed by this proposed ZBA.

[7] The Board afforded additional time to the parties to finalize the ZBA documentand to submit the signed and executed s. 37 Agreement. As the parties have done so,the Board now makes the following Order:
