The subject property, R29264103, is located at 3215 S. Stanford St., Nampa, Idaho, in a portion of the SW ¼ of Section 4, T2N, R2W, BM, Canyon County, Idaho. Background The subject property is currently zoned “R-1” (Single Family Residential), The average minimum lot size in an “R-1” zone is one (1) acre. The proposed lots meet the average minimum. The P&Z Commission will consider the Preliminary Plat and make a recommendation to the Board to approve, approve conditionally, modify or deny the plat. The Planning & Zoning Commission is not a signatory on the final plat. The Board will consider and sign the final plat at a later date. Analysis: Stanciu Subdivision No. 2 contains two (2) residential lots. One of the lots contains the existing homesite. The subdivision will utilize: Individual domestic wells Individual septic systems The property does not have surface irrigation water available to it. See plat note no. 6. Lot 2 will access Stanford St. via a 28 ft. wide access easement. An easement reduction from 60 ft. to 28 ft. was approved by the Director on 3/29/19, Exhibit 7. Keller & Associates has reviewed the plats (Exhibit 5) and their comments have been added as recommended conditions of approval (Exhibit 1). The City of Nampa will require that the access easement/agreement be recorded as a separate document and the instrument number shall be placed on the final plat. The city also requested that the easement/agreement be reviewed concurrent with the Final Plat at the time of signature (the city is a signatory on the final plat) Exhibit 6. Staff has added this as a condition of approval.

The proposed development is located within the Boise-Kuna Irrigation District, Nampa Fire District, Nampa School

District, and Nampa Highway District No. 1.

The subdivision meets Idaho Code and CCZO, Article 17 requirements for the preliminary plat.

Alternatives

The Planning and Zoning Commission may recommend that the Board approve, approve conditionally, modify or

deny the preliminary plat application for Stanciu Subdivision No. 2.

Recommendation

Staff recommends the Planning and Zoning Commission open a public hearing and discuss the proposed

Preliminary Plat.

Staff is recommending approval of the application, subject to the recommended conditions of approval.

Findings

1. The property is currently zoned “R1” (Single Family Residential). 2. The subdivision contains two (2) residential lots. One of the lots contains the existing residence. 3. The average residential lot size in an “R-1” zone is one (1) acre, and the proposed lots meet the lot size

requirement. 4. The proposed preliminary plat is in conformance with CCZO Article 17, Idaho Code, Sections 67-6512, 6509

and 6535 (Subdivisions, Hearings, Decisions, and Idaho Code, Sections 50-1301 through 50-1329 (Platting). 5. The property is located within Nampa’s Area of City Impact. 6. The lots will be served by individual domestic wells and individual septic systems. 7. The subject property does not have surface irrigation water rights. 8. The subject property is located within Nampa School District, Nampa Fire District, Nampa Highway District

No. 1, and Boise-Kuna Irrigation District. 9. Notice of the public hearing was provided in accordance with CCZO §07-05-01. Agency notice was provided

on 4/2/19, JEPA Notice on 4/2/19, Newspaper notice was provided on 4/28/19, property owners within 300’

were notified by mail on 4/23/19, and the property was posted on 5/1/19.

10. The record includes all testimony, the staff report, exhibits, and documents in case file SD2019-0001.

Conclusions of Law

The Planning and Zoning Commission has the authority to hear this case and recommend that it be approved,

denied or modified. The public notice requirements were met and the hearing was conducted within the guidelines

of applicable Idaho Code and County ordinances.

Conditions of Approval

1. Historic irrigation lateral, drain, and ditch flow patterns shall be maintained unless approved in writing by the local irrigation district or ditch company.

2. Finish grades at subdivision boundaries shall match existing finish grades. Runoff shall be maintained on subdivision property unless otherwise approved.

3. The development shall comply with Southwest District Health requirements. 4. The development shall comply with Nampa Highway District No. 1. 5. The easement agreement shall be recorded and the instrument number shall be noted on the Final Plat as

requested by the City of Nampa (Exhibit 6).
