SUBJECT: Determining Baseline Regions for Residential Customers

Southern California Edison Company (SCE) hereby submits to the California Public Utilities Commission (Commission) the following changes to its tariffs. The revised tariffs are listed on Attachment A and are attached hereto.

PURPOSE The purpose of this advice letter is to update the tariffs that establish a residential customer’s Baseline Region. In this advice letter, SCE proposes to revise SCE’s Preliminary Statement Part H, Baseline Service; Schedule DM, Multifamily Accommodation - Residential Hotel - Qualifying RV Park; Schedule DMS-3, Domestic Service Qualifying RV Park Accommodation – Submetered; and the Index of Communities tariff to include clarifying Baseline Region information and to include new communities and/or incorporated cities as further discussed below. Additionally, SCE withdraws its tariff entitled, Boundary Descriptions for Map Showing Baseline Regions for Determining Baseline Quantities. BACKGROUND

Baseline service applies to all residential customers who live in permanent single-family dwellings served on a domestic rate schedule.1 Under Baseline, each customer is allocated a number of kilowatt-hours (kWh) to support a portion of the reasonable energy needs of the average residential user.2 The Baseline allocation is based on the bill frequency methodology,3 which sets the allocation on the daily average usage of

customers in the target percentile.4 The residential consumption is determined for summer and winter for each Baseline Region and, therefore, takes into consideration climate and seasonal factors. It also considers those customers whose space heating or sole source of energy is electric. Each incorporated city or unincorporated community within SCE’s service territory falls within a Baseline Region and has a specific Baseline allocation, as required by law and Commission regulation.5 SCE’s Index of Communities tariff lists each city and community along with its applicable Baseline Region(s) and SCE’s Preliminary Statement Part H, and Schedules DM and DMS-3, include the Baseline Regions and their respective Baseline allocation. In 1977, SCE introduced its Lifeline Rate Climatic Regions maps pursuant to D.86-08-007 in Advice 433-E.6 In 1985, the Lifeline Rate Climatic Regions maps were replaced with Baseline Region Maps to reflect the implementation of Baseline Service.7 At this same time, SCE also established its tariff entitled, Boundary Descriptions for Map Showing Baseline Regions for Determining Baseline Quantities (Boundary Descriptions).8 The Boundary Descriptions tariff provides a written description of the peripheries for each Baseline Region. In its 2009 General Rate Case Phase 2 Application (A.)08-03-002, SCE proposed to use the Climate Zones established by the California Energy Commission (CEC) as its Baseline Regions “for the purpose of determining region specific baseline allowances” (except for zone 15) because the “CEC zones provide a more accurate description of the various microclimates.”9 SCE further explained to the Commission that “[s]ince weather conditions are a major driver of customer energy use, the CEC zones represent a better grouping of customers with similar usage characteristics.”10

In August 2009, the Commission adopted SCE’s proposals in D.09-08-028, Decision Adopting Settlements on Marginal Cost, Revenue Allocation, and Rate Design. Specifically, the Commission approved the proposal in the Residential and Small Commercial Rate Design Settlement Agreement to align SCE’s six Baseline Regions with the climate zones established by the CEC (CEC’s Climate Zones). In Advice 2386-E, SCE incorporated into its Boundary Descriptions tariff the CEC’s written survey boundary descriptions of its Climate Zones, which SCE had obtained from the CEC. SCE also updated its Baseline Regions Map and Index of Communities tariff accordingly. The Commission approved SCE’s realigned Baseline Regions in Advice 2386-E, effective October 1, 2009. Because the CEC Climate Zones are closely tied to climate patterns, the realigned Baseline Regions resulted in a more equitable distribution of Baseline allowances based on differentials in energy use by climate zone and season, consistent with PU Code Section 739. DISCUSSION

A. The Boundaries Defined In The CEC’s Written Survey Descriptions Incorporated Into SCE’s Tariffs Differ From The CEC Maps SCE Used To Assign Customers To Baseline Regions

When SCE updated its Baseline Regions in 2009 to align with the CEC’s Climate Zones, SCE incorporated the CEC’s written survey boundary descriptions (CEC Written Descriptions)11 for each Climate Zone into its tariffs. At the same time, SCE updated customers’ Baseline Regions in its billing system using Geographic Information System (GIS) maps12 of the Climate Zones SCE obtained from the CEC in 2009 (2009 CEC GIS Maps). SCE believed the 2009 CEC GIS Maps followed and mapped the CEC Written Descriptions of the CEC Climate Zones incorporated into SCE’s tariffs.

SCE believes that there have been updates to the GIS maps of the climate zones that the CEC has made available on its website since 2009, including GIS maps with a reference date of 2017 available recently. As of the date of this letter, however, the link to GIS maps on the CEC’s website has been disabled, although other climate zone search tools remain available on the CEC website. SCE has not analyzed or determined what changes the CEC made to its GIS maps of the climate zones since 2009 or any differences in the results yielded from the CEC’s climate zone search tools, but SCE does not believe any differences in the maps are significant because the CEC Written Descriptions have not been changed. SCE notes that since 2009, it has used the 2009 CEC GIS Maps in its billing system, and it is the 2009 version of the maps that SCE intends to use to define its Baseline Regions, as set forth in this advice letter.

Unbeknownst to SCE, however, the CEC Written Descriptions differed in minor respects from the 2009 CEC GIS Maps. These differences were discovered only recently after litigation filed against SCE in September 2019 raised distinctions between the written boundaries in SCE’s tariffs and the Plaintiffs’ assigned Baseline Regions.13 To evaluate the extent of the issue, SCE remapped all of its Baseline Regions using the CEC Written Descriptions and overlaid those maps with the 2009 CEC GIS Maps used to assign customers to Baseline Regions since 2009. SCE discovered there were discrepancies between the boundaries in the 2009 CEC GIS Maps and the boundaries in the CEC Written Descriptions. The differences between the boundaries were fairly minor (sometimes no more than a few blocks), but some customers who lived near the Baseline Region boundary lines were assigned to an incorrect Baseline Region based on SCE’s use of the 2009 CEC GIS Maps. B. As A Result Of The Distinctions Between The CEC Written Boundaries And

2009 CEC GIS Maps, Certain Customers Were Assigned To Incorrect Baseline Regions; However, 65 Percent Of Impacted Customers Were Undercharged

SCE analyzed the impact of the discrepancies between the boundaries based on the CEC Written Descriptions and the 2009 CEC GIS Maps.14 SCE estimates that approximately 55,820 residential customer service accounts (or approximately 1.2 percent of SCE’s total residential customers) were not assigned to correct Baseline Regions according to the CEC Written Descriptions incorporated into SCE’s tariffs. The approximate bill impacts are set forth in Table 1.

Accordingly, this analysis does not replicate the processes in SCE’s billing system nor precisely project the dollar impact but instead is intended only to be a high-level approximation to evaluate the impact and inform the determination of the best solution to address the issue identified. SCE cannot identify the precise amounts until it calculates the refunds and credits pursuant to Rule 17.D, as discussed below. Infra notes 17-19.

Total 55,820 100% N/A N/A N/A N/A As Table 1 shows, a significant number of the customers impacted – approximately 36,000 or 65 percent of the total customers impacted – were undercharged. If those customers were reassigned to Baseline Regions based on the CEC Written Descriptions incorporated into SCE tariffs in 2009, those customers would see an average annual bill increase of $14.00, and some individual customers would see annual increases in excess of $400 per year. Moreover, in some communities, there would be a disproportionate impact on low-income customers enrolled in SCE’s California Alternate Rates for Energy (CARE)15 program. In one city, for example, 40 percent of undercharged customers are CARE customers. In contrast, relative to the total customers impacted, a small percentage of customers were overcharged as a result of their assignment to the incorrect Baseline Region. C. SCE’s Will Change Its Tariffs So That The Baseline Regions Are Defined

Primarily By The 2009 CEC GIS Maps And Credit Customers Who Were Overcharged Prior To This Proposed Tariff Change

SCE proposes a solution that will maintain operational status quo with respect to Baseline Region assignment by continuing to use the 2009 CEC GIS Maps in its billing system. SCE’s proposal recognizes that a change to status quo (i.e., reassignment of baseline region per the CEC’s Written Descriptions) would burden over 36,000 customers and significantly impact low-income CARE customers. SCE seeks to avoid that adverse result. Accordingly, SCE proposes the least disruptive solution for customers, one that promotes fairness by maintaining past practice and rate consistency by not changing the Baseline Regions and allowances for more than 55,000 impacted customers and continues to consider climatic variations.

1. SCE Will Withdraw The Written Boundary Descriptions And Continue Use Of The 2009 CEC GIS Maps To Minimize Adverse Impacts on Customers

SCE will withdraw its Boundary Descriptions tariff and use the 2009 CEC GIS Maps as its primary resource to assign customers to Baseline Regions. The continued use of the 2009 CEC GIS Maps will minimize the impact to customers and avoid bill increases that would have a disproportionate negative impact on CARE customers. Maintaining the status quo with respect to SCE’s Baseline Region assignments also is consistent with customers’ expectations, as customers rates will continue to be determined using the Baseline Regions assigned since 2009. Moreover, because the 2009 CEC GIS Maps were informed by the CEC Climate Zones, SCE’s Baseline Regions will continue to be aligned with the CEC Climate Zones in SCE’s service territory, and therefore are consistent with PU Code Section 739. Finally, due to ambiguities and potential confusion with written survey boundary descriptions previously incorporated into SCE’s tariffs, as well as the advances in technology and the capabilities now available with GIS mapping software, relying on written survey boundary descriptions may not be the most effective or precise way to define and assign customers to Baseline Regions. GIS has provided SCE better visibility and spatial information that enables SCE to make more accurate decisions in determining city and community perimeters in relation to the Baseline Regions. Using maps is also easier for customers to understand. SCE also will make every effort to maintain the accuracy and consistency between SCE’s Index of Communities tariff and the 2009 CEC GIS Maps. SCE anticipates that in most instances, SCE will be able to definitively establish a customer’s Baseline Region using these two data references. In the event ambiguous circumstances (e.g., customer’s property straddles two Baseline Regions) arise regarding Baseline Region assignment, a customer may contact SCE’s Customer Call Center to inquire. Under such circumstances, SCE will make best efforts and use reasonable judgment in making the final Baseline Region determination, on a case-by-case basis, using available GIS mapping tools and/or field observation.

2. SCE Will Credit Or Refund To Customers Three Years Of Overcharged Amounts In Compliance with Rule 17.D

For customers who have been overcharged prior to the effective date of the tariff changes proposed herein16, SCE plans to refund or credit three (3) years of overcharged amounts consistent with SCE’s Rule 17.D. Rule 17.D. provides:

Where SCE overcharges or undercharges a customer as the result of a Billing Error, SCE may render an adjusted bill for the amount of the undercharge, and shall issue a refund or credit to the customer for the amount of the overcharge for the period of the Billing Error, but not exceeding three years in the case of an overcharge for all service accounts, and, in the case of an undercharge, not exceeding three months for residential service to a SCE-metered Single-Family Dwelling or Accommodation . . .

To facilitate the timely correction of the overcollection, in accordance with Rule 17.D, SCE will utilize its Baseline Billing Data Tool (BBDT) to perform mass rebill calculations for all of the impacted service accounts. This tool is designed to mimic the functionality of SCE’s billing system and can perform mass rebill calculations across multiple billing periods, rate changes, rate schedules, and associated service billing attributes (i.e., Medical Baseline), using the same data available in SCE’s billing system, with the same accuracy and precision as SCE’s billing system. Accordingly, using the BBDT satisfies SCE’s obligations under Rule 17.D. BBDT also is cost beneficial as it can perform billing calculations for large volumes of service accounts over extended periods of time, without impacting SCE’s customer billing operations or Information Technology (IT) routine work functions, systems, and/or resources. By utilizing the BBDT, SCE can determine the total credit owed to each impacted customer overcharged (active and closed accounts) for the relevant three-year period within approximately 3 to 4 weeks of approval of this advice letter.17 SCE will provide the credits using its regular processes and procedures. If the customer account is active, SCE will provide the credit through a bill adjustment. If the customer has moved from the street address where the credit is owed, but remains a

on the 2009 CEC Written Descriptions), as of the effective date of that tariff change, customers who previously were overcharged because they were assigned to the incorrect Baseline Region per the CEC Written Descriptions will be assigned to the correct Baseline Region and therefore no longer be overcharged.

Using SCE’s billing system instead of the BBDT to calculate the refunds or credits would take much longer than the BBDT process, cost more, unnecessarily burden SCE’s limited resources (including, in particular, substantial IT time and resources), and divert SCE resources from multiple ongoing billing-related projects, including extensive work associated with SCE’s developing Customer Service Re-Platform (CSRP) system. As a result, utilizing an alternative approach outside of SCE’s billing system is both more feasible and efficient than the traditional rebill process.

customer of SCE and the customer retains the same Customer Account number, any credit will be applied to the current customer’s bill. However, if a Customer Account is closed, the billing system will automatically trigger a refund check within 30 days. Where a check is mailed and the check is uncashed for three years, if the check was mailed to an address in California, it will become escheatable, and the funds will be turned over the to the State. If the check was mailed to a non-California address, the established threshold in each state for unclaimed checks will apply.18

3. SCE Elects To Forego The Collection Of Three Months Of Undercharged Amounts

For customers who have been undercharged, SCE proposes to forgo the collection of three (3) months of undercharges pursuant to Rule 17.D. Consistent with past practices in connection with Rule 17.D rebills, credits, or refunds, the resulting revenue under-collection (or lost revenue) would be recorded in SCE’s Base Revenue Requirement Balancing Account (BRRBA) and allocated to both bundled service and unbundled service customers for recovery via the distribution rate component. The bill impacts from this proposed allocation are projected to be insignificant. By way of example, assuming $124,500 of undercharges for three months (as reflected in Table 1), to recover the lost revenue associated with this under collection, SCE estimates there would be a 0.001% increase to the revenue requirement.19 When spread over SCE’s 5.1 million customers, the impact on customer rates and bills is negligible.

* * * In sum, SCE proposes the following multi-component solution to address the Baseline Region boundaries:

1. Provide an adjustment to customer bills to account for overcharges for a three (3) year period to make adversely impacted customers whole by refunding or crediting customers, consistent with Rule 17.D.

2. Forgo collection of three (3) months of undercharges from customers, consistent with Rule 17.D.

3. Withdraw SCE’s Boundary Descriptions tariff. 4. Continue to use of the 2009 CEC GIS Maps (consistent with the Commission’s

adoption of SCE’s proposal in the 2009 GRC Phase 2) in SCE’s billing system. This single primary data reference will continue to govern how SCE assigns customers to Baseline Regions.

5. Amend SCE’s Index of Communities tariff to include updated information to be consistent with the 2009 CEC GIS Maps. This data reference together with SCE’s Map Showing Baseline Regions for Determining Baseline Quantities tariff (a visual representation of the 2009 CEC GIS Maps) are intended to serve as secondary data references only.

PROPOSED TARIFF CHANGES

Consistent with information provided above, the following tariffs are revised as follows:

SPECIAL CONDITIONS 1. Seasonal Service: For summer cottage Customers and others who normally require service

for only part of the year, service under this Schedule may be applicable only on annual contract.

2. Notification: It is the responsibility of the Customer to advise SCE within 15 days following any change in the number of Single-Family Dwellings in a Multifamily Accommodation, Qualifying Residential Units in a residential hotel, or Qualifying RV Units in a Qualifying RV Park that qualify for basic Baseline allocations, and any change in qualifications for other than Basic Baseline Allocations. 3. Qualifying Residential Unit: A residential unit in a residential hotel as defined in Rule 1,

Definitions, leased for a minimum of one month and occupied (excluding organizations or groups of persons) as a permanent primary residence for at least nine months of the year.

4. Qualifying RV Park: An RV park which has at least 50% of its spaces on the same meter

occupied at least nine months of the year by a tenant in a Qualifying RV Unit used as a permanent residence and renting on a month to month basis. Such meter shall not include nondomestic enterprises as described in Special Condition 7.

5. Qualifying RV Unit: An RV Unit that is used as a permanent single-family residence at the

same location in an RV park for at least nine months out of the year. Baseline allocations shall be based on the number of units that meet this criteria.

6. Miscellaneous Loads: Miscellaneous electrical loads on the same meter such as general

lighting, laundry rooms, general maintenance, and other similar usage incidental to the operation of a Multifamily Accommodation will be considered as domestic usage.

7. Nondomestic Enterprises: Electric energy used for nondomestic enterprises such as offices,

stores, shops, restaurants, service stations, and other similar establishments will be separately metered and billed under applicable schedules.

8. Multifamily Accommodation Baseline Allocations: The applicable baseline quantity of

electricity to be billed under rates designated as applicable to Baseline Service shall be the total of any Medical Baseline Allocation permitted under Preliminary Statement, Part H, Paragraph 4, plus the applicable daily baseline quantities for the customer's Baseline Region (as referenced in the Index of Communities tariff and displayed on the Baseline Region Map) shown below:

c. When SCE receives an application from a qualifying CARE submetered tenant, the information will be forwarded to SCE's Customer receiving service under this Schedule.

d. The proration of the DMS-3 Customer's bill by SCE under the provisions of the

Energy Charge shall commence no later than one billing period after receipt and approval by SCE of a qualifying tenant's application.

e. It is the responsibility of the DMS-3 Customer to notify SCE immediately of the date

each CARE tenant is no longer receiving service from the DMS-3 Customer. In addition, if the DMS-3 Customer has good reason to suspect that a tenant is not eligible, the DMS-3 Customer should notify SCE.

8. Failure of a DMS-3 Customer to abide by SCE's tariffs may result in a change of rate, rebilling

and/or discontinuance of service in accordance with SCE's tariffs. The DMS-3 Customer's account may also be rebilled consistent with Rule 17.

9. Multifamily Accommodation Baseline Allocations: The applicable baseline quantity of

electricity to be billed under rates designated as applicable to Baseline Service shall be the total of any Medical Baseline Allocation permitted under Preliminary Statement, Part H, Paragraph 4, plus the applicable daily baseline quantities for the Customer's Baseline Region (as referenced in the Index of Communities tariff and displayed on the Baseline Region Maps) shown below:
