PUBLIC NOTICE D05PN-02-2018
All interested parties are notified that an application dated June 9, 2017, amended on January 2, 2018, has been received from the Maryland Department of Transportation, State Highway Administration, by the Commander, Fifth Coast Guard District, for approval of the location and plans for replacement of an existing highway fixed bridge over a navigable waterway of the United States. WATERWAY AND LOCATION: Neale Sound, mile 0.6, at Cobb Island, Charles County, MD. CHARACTER OF WORK: The proposed project is to replace the existing fixed highway bridge carrying the MD 254 (Cobb Island Road) over Neale Sound with a new fixed highway bridge. The new bridge will be constructed on a new roadway alignment just west of the existing bridge with a new fender system. The existing bridge will be removed to an elevation of two feet below the mud line and the existing fender system will be removed in its entirety. The purpose of the project is to replace the existing structurally deficient bridge, which serves as an essential link for all transportation needs between Cobb Island and mainland MD.

ENVIRONMENTAL CONSIDERATIONS: The U.S. Coast Guard (USCG) is the lead Federal agency for compliance with the National Environmental Policy Act (NEPA), National Historic Preservation Act (NHPA), and other applicable environmental control laws. The USCG has tentatively determined that the bridge project would not have any significant environmental impacts and would qualify for a categorical exclusion under NEPA. Environmental documents are available for review at the above address, Monday through Friday (except Federal holidays), from 8 a.m. to 4:30 p.m. Water Quality Certificate (WQC): The U.S. Army Corps of Engineers (USACE) published the Maryland State Programmatic General Permit-5 (MDSPGP-5) on September 30, 2016, via Corps Special Public Notice #16-56. The Maryland Department of the Environment (MDE) reviewed the MDSPGP-5 and issued Water Quality Certification, pursuant to Section 401 of the Clean Water Act, subject to the condition that applicants obtain all necessary permits and approvals from MDE, for all activities that meet the terms and conditions of MDSPGP-5, on September 13, 2016. The USACE issued CENAB-OPR-M (MD SHA/Bridge #0803800/MD 254/Bridge) 2016-61217-M24, in accordance with MDSPGP-5, on August 3, 2017. Wetlands: The project includes 320 square feet of permanent impacts to tidal open waters for construction of the bridge piles and fender system and 462 square feet of temporary impacts to tidal open waters for the construction of the trestle piles. No impacts to tidal wetlands or submerged aquatic vegetation (SAV) will result from the project. Coastal Zone Management: The USACE determined that all activities authorized under the MDSPGP-5 will be carried out in a manner consistent with the Coastal Zone Management Program pursuant to Section 307 of the Federal Coastal Zone Management Program of 1972, as amended. On September 13, 2016, the Maryland Department of the Environment concurred with the USACE' determination provided that the applicant obtains all necessary State permits and approvals. The State of Maryland, Board of Public Works, Wetlands Administration’s issuance of Wetland License No. 16-0701 on July 26, 2017, constitutes the State's determination that the authorized activities are consistent with the Maryland Coastal Zone Management Program, as required by Section 307 of the Federal Coastal Zone Management Act of 1972, as amended. Floodplain: The bridge is located in the floodplain. The 100-year flood level is + 5.2 feet from datum and low steel of the bridge in the navigation span is +20.75 feet from datum. Fish & Wildlife: Consultation with the National Marine Fisheries Service, U.S. Fish & Wildlife Service, and Maryland Department of Natural Resources resulted in findings that the proposed action is not likely to adversely affect any federal or state endangered or threatened species, no essential fish habitats exist in the project area, the proposed project is not within or adjacent to a National Marine Sanctuary, and the project will not involve the potential take of a migratory bird or potential take or harassment of a bald or golden eagle. Historic Properties: The applicant consulted with the Maryland State Historic Preservation Office/Maryland Historical Trust under the National Historic Preservation Act (NHPA) and received concurrence on a “no properties affected” determination on June 27, 2016.

Clean Air Act: The project is within Charles County, MD, which has been designated by the Environmental Protection Agency as a nonattainment area for 2008, 8-hour ozone criteria pollutant. The project involves a bridge replacement with no additional travel lanes, which is a safety project type exempt from transportation conformity requirements per Title 40 Code of Federal Regulations §93.126. In-Water Construction Restrictions: Sediment disturbing activities, which include pile driving activities or the removal of pilings, is prohibited between March 1 and June 30, inclusive, in order to protect fisheries. Environmental Disclaimer: The foregoing does not necessarily include information related to environmental control laws or Executive Orders in which there are no known adverse impacts. Therefore, comments are requested on any environmental control law or Executive order, with known adverse impacts, that has not been addressed or adequately addressed in this notice. SOLICITATION OF COMMENTS: Mariners are requested to provide navigational information, such as the sizes and types of vessels presently owned and operated on the waterway and nature of navigation (including the extent of nighttime navigation) on the waterway. Mariners are requested to comment on the navigational clearances and need for bridge protective systems, clearance gauges, and navigational lighting on the proposed bridge. Please submit the attached response form. The public is requested to comment and provide information concerning environmental impacts. Interested parties are requested to express their views, in writing, on the proposed bridge project, giving sufficient detail to establish a clear understanding of their reasons for support of, or opposition to, the proposed project.
