"Thank you for scheduling Bill No. 200 for a public hearing. This

legislation will provide more clarity in Police Clearance Forms and would

reform the police clearance process so that charges that do not result in convictions would not be included in the report. Bill No. 200-32 (COR)

provides for a fairer and less confusing clearance process and would abide by the principle of 'Innocent until proven guilty'. This legislation provides that issued Police Clearances shall only include 'charges for

which the arrestee is convicted' and 'charges for which a juvenile is

convicted as an adult.'

"This measure is [sic]line with concerns both nationally and locally about

the use of arrest information, particularly when the charges resulted in no

conviction. A majority of states across the country have enacted limits on the use of arrest histories when making employment decisions. Also,

under the United States Civil Rights Act, the Equal Employment

Opportunity Commission's guidelines protect job seekers from discrimination based on arrest histories. Locally, the Attorney General's Office recently sent the Chief of Police "Information and Guidance" (Ref:

GPD13-0361, dated August 23, 2013) also recommending reforms for

police clearance reports.

Senator Cruz stated Phillip J. Tydingco, Chief Deputy Attorney General, Attorney General's Office, signed up to testify but was no longer present, and that the Chief of

Police, also not present, has been invited and is expected to provide written testimony.

III. FINDINGS AND RECOMMENDATIONS

The Committee hereby recommends approval of Bill No. 200 as substituted by the

Committee on General Government Operations and Cultural Affairs. The Substitute version of the measure incorporates recommendations by the Attorney General's office f

that fulfills the intent of the legislation while preserving the full access and utilization by law enforcement agencies of criminal histories.

AN ACT TO AMEND TITLE 10 GUAM CODE ANNOTATED §77135 RELATIVE TO POLICE CLEARANCES, TO BE KNOWN AS THE "POLICE CLEARANCE CLARITY ACT OF 2013."

1 BE IT ENACTED BY THE PEOPLE OF GUAM:

2 SECTION 1. Legislative Findings and Intent. I Liheslatura finds that

3 the principle that all citizens are innocent until proven guilty, is the

4 foundation of our system of justice and our democratic form of

5 governance. Therefore, any clearance report issued by a government

6 agency involved in law enforcement, such as the Guam Police

7 Department, shall be in accordance with this principle.

8 I Liheslatura further finds that a majority of jurisdictions across

9 the country have enacted limits on the use of arrest histories when

10 making employment decisions. Under the United States Civil Rights

11 Act, the Equal Employment Opportunity Commission's guidelines

2 Employers are being advised to stop using arrest information, and to

3 comply with the specific rules for their jurisdictions, in order to make

4 it clear to all parties that the law maintains that an individual is

5 innocent until proven guilty.

6 I Liheslatura further finds that local police clearance reports are

7 in need of clarification as evidenced by the Office of the Attorney

8 General's recent "Information and Guidance" (Ref: GPD13-0361,

9 dated August 23, 2013) submitted to the Chief of Police, Guam Police

10 Department, relative to the content of police clearances.

11 According to such updated guidance and clarity on the subject

12 of police clearances relative to "arrest records and not to police

13 reports that deal with traffic accidents and other matters/' Assistant

14 Attorney General David J. Highsmith notes that "Such police reports

15 are confidential pursuant to Title 10 GCA § 77129 and can be released

16 only according to its terms."

17 It is therefore the intent of I Liheslatura to add a new Title 10

18 Guam Code Am1otated §77135 relative to police clearances, based on

19 the above referenced guidance.

3 "§ 77135. The Establishment of Procedures regarding Police

4 Clearances SHALL ONLY include the following relative to

5 arrests and police reports:

6 1. Charges for which the arrestee is convicted.

7 2. Charges for which a juvenile is convicted as an adult.

AN ACT TO AMEND TITLE 10 GUAM CODE ANNOTATED §77135 RELATIVE TO POLICE CLEARANCES, TO BE KNOWN AS THE "POLICE CLEARANCE CLARITY ACT OF 2013, AND TO PROVIDE REVISED LANGUAGE FOR SECTION 2 RELATIVE TO THE USE OF CRIMINAL HISTORY RECORDS."

1 BE IT ENACTED BY THE PEOPLE OF GUAM:

2 SECTION 1. Legislative Findings and Intent. I Liheslatura finds that

3 the principle that all citizens are innocent until proven guilty, is the

4 foundation of our system of justice and our democratic form of

5 governance. Therefore, any clearance report issued by a government

6 agency involved in law enforcement, such as the Guam Police

7 Department, shall be in accordance with this principle.

8 I Liheslatura further finds that a majority of jurisdictions across

9 the country have enacted limits on the use of arrest histories when

1 making employment decisions. Under the United States Civil Rights

2 Act, the Equal Employment Opportunity Commission's guidelines

3 protect job seekers from discrimination based on arrest histories.

4 Employers are being advised to stop using arrest information, and to

5 comply with the specific rules for their jurisdictions, in order to make

6 it clear to all parties that the law maintains that an individual is

7 innocent until proven guilty.

8 I Liheslatura further finds that local police clearance reports are

9 in need of clarification as evidenced by the Office of the Attorney

10 General's recent "Information and Guidance" (Ref: GPD13-0361,

11 dated August 23, 2013) submitted to the Chief of Police, Guam Police

12 Department, relative to the content of police clearances.

13 According to such updated guidance and clarity on the subject

14 of police clearances relative to "arrest records and not to police

15 reports that deal with traffic accidents and other matters," Assistant

16 Attorney General David J. Highsmith notes that "Such police reports

17 are confidential pursuant to Title 10 GCA § 77129 and can be released

18 only according to its terms."

2 Guam Code Annotated §77135 relative to police clearances, based on

3 the above referenced guidance, in language that has been vetted by

4 the Office of the Attorney General.

5 SECTION 2. A NEW Title 10 Guam Code Annotated §77135 is

6 added to read:

8 Clearances SHALL ONLY include the following relative to

9 arrests and police reports:

10 1. Charges for which the arrestee is convicted.

Thank you for scheduling Bill No. 200-32 (COR)- "An act to amend Title 10 Guam Code Annotated §77135 Relative to Police Clearances, to be known as the "Police Clearance Clarity Act of 2013," for a public hearing. This legislation will provide more clarity in Police Clearance Forms and would reform the police clearance process so that charges that do not result in convictions would not be included in the report. Bill No. 200-32 (COR) provides for a fairer and less confusing clearance process and would abide by the principle of '"Innocent until proven guilty". This legislation provides that issued Police Clearances shall only include "charges for which the arrestee is convicted" and "charges for which a juvenile is convicted as an adult."

This measure is line with concerns both nationally and locally about the use of arrest information, particularly when the charges resulted in no conviction. A majority of states across the country have enacted limits on the use of arrest histories when making employment decisions. Also, under the United States Civil Rights Act, the Equal Employment Opportunity Commission's guidelines protect job seekers from discrimination based on arrest histories. Locally, the Attorney General's Office recently sent the Chief of Police "Information and Guidance" (Ref: CPD13-0361, dated August 23, 2013) also recommending reforms for police clearance reports.

Thank you for the opportunity to submit written testimony on Bill No. 200-32. I apologize for not being able to stay and present verbal testimony on Bill No 200-32 as I had to attend another scheduled noon commitment that day.

As writlen the bill sets forth the establishment of procedures for police clearances to contain only charges for which the arrestee is convicted and charges for which a juvenile is convicted as an adult. Delegations of lawmaking power to the executive branch or administrative agencies are impermissible if they were unduly broad. The Supreme Court of the United States held that delegations of legislative power contain "intelligible standards'". Panama Refining Co., v. Ryan. 293 U.S. 388 (1935), Schechter Poultrr Co. v. United States, 29! U.S. 495 (1935). Yakus v. Uniied States, 321 U.S. 414 ( 1944).

In this instance. the bill can easily avoid the potential unlawful delegation of legislative authority and accomplish the bill's intent without establishing procedures by eliminating the ""establishment of Procedures regarding"' to read as follows:

If I may, I would like to request further clarification with respect to your submission. As I understand it, Bill No. 200.32, if enacted with your amendment, would restrict Police Clearance forms only to charges for which the arrestee was convicted as an adult and no further information regarding other charges would be publicly released through the Police Clearance process. The phrasing of your amendment to add a new subsection (b) does raise the question as to whether this language would completely reverse the restrictions in subsection (a) since the only records in question are criminal histories that I assume would include arresls without conviction and the context of the bill deals directly with Police Clearances. In reading your correspondence,. you indicate your intent to allow ;JCce-ss and use of full crime histories by ia\V enforcement officials. Would it perhaps be more clear if your subsection (b) read:

"(b) the restrictions in subsection (a) do not apply to the use by federal and local law enforcement agencies of criminal history records:'

Thank you for your letter of October 22, 2013 requesting claritication on Bill No. 200-32.

Based on the original draft of Bill No. 200-32. our oftice recommended the elimination of the phrase "establishment of Procedures regarding" fi·om the Bill in order to avoid a potential unlawful delegation of legislative authority challenge and to accomplish the Bill's intent.

Our office also proposed language to ensure that the restrictions to the police clearance do not apply to law enforcement criminal records. "Rap Sheets" arc critical to law enforcement investigations as they provide law enforcement officers with all arrest information.

Police clearances are provided to the general public for many needs such as employment, licensing, or rentals whereas "rap sheets" arc arrest records kept hy law enforcement authorities and used for internal investigatory purposes. Although the Bill would apply to police clearances, we want the Bill to be clear that the proposed restrictions to a police clearance do not apply to a "rap sheet".

Therefore, the language proposed by your oflicc would help to ensure it.

I wanted to offer some comments on the above-referenced bilL First. let me thank you for introducing this bilL I have been practicing law in Guam since 1977, and have first hand experience with difficulties that the police clearances cause in our community. I, like many attorneys in this community, had never heard of a police clearance in any jurisdiction where I had been before Guam that were obtained for employment purposes. The Civil Rights Act of 1964 is a federal statute aimed at insuring that people are not discriminated against for numerous reasons. One of the matters that is addressed in that act is that an employer cannot ask a prospective employee if they have ever been arrested, There are certain exceptions to that, for instance, law enforcement. military, etc., but they are based upon need. The reason behind that is, of course, because people can get arrested and never get convicted and they should not have to bear the heavy burden of that arrest in an attempt to find employment

The Guam Police Department has had a habn of placing anything that is in a person's record on a police clearance, I presume they issue police clearances so they can make additional income, But, by allowing the police to put matters on a police clearance requested by an employer which is not a question the employer could ask the employee personally, circumvents the 1964 Civil Rights Act

At a time when it is difficult enough for people to gain employment, allowing employers to circumvent the 1964 Civil Rights Act by asking for a police .:.iearance wh1ch the Guam Police Department will include everything that has ever transpired is clearly inappropriate, I endorse your Bill to limit the information on police clearances, and oppose the convoluted amendments sought by the Attorney GeneraL They obviously do not understand the need for our people to try to gain employment, and they should not be circumventing federal statutes by allowing employers to gain information which the employer cannot obtain directly from the prospective employee.
