Introduction Pursuant to Article 8(2) of Regulation (EU) No 603/20131 of the European Parliament and of the Council (here

after referred to as the “Eurodac Regulation”), at the end of each year statistical data on Eurodac for each

Member State2 shall be made public as follows:

the number of data sets transmitted on persons referred to in Article 9(1), 14(1) and 17(1) of the Eurodac

Regulation,

the number of hits for applicants for international protection who have lodged an application for

international protection in another Member State,

the number of hits related to data for persons apprehended when irregularly crossing the external

border of a Member State who have subsequently lodged an application for international protection,

the number of hits related to data for persons found illegally staying in a Member State who had

previously lodged an application for international protection in another Member State,

the number of data sets marked, unmarked, blocked and unblocked in accordance with Article 18(1)

and (3) of the Eurodac Regulation,

the number of hits related to marked data for persons referred to in Article 18(1) for whom hits have

been recorded following an application for international protection in another Member State,

the number of hits related to marked data for persons referred to in Article 18(1) for whom hits have

been recorded with a view to checking whether a third-country national or a stateless person found

illegally staying within the territory of a Member State has previously lodged an application for

international protection in another Member State,

the number of fingerprint datasets rejected by the Central System due to insufficient quality and thus

not lending to comparison,

the number of requests by law enforcement designated authorities to access Eurodac and the number

of hits received as referred to in Article 20(1) of the Eurodac Regulation and as referred to in Article

21(1)3 of the Eurodac Regulation.

This document provides the above-mentioned statistics for the entire 2017.

The statistical data presented in this document is a collection of data available from the Eurodac Central system.

1 Regulation (EU) No 603/2013 on the establishment of 'Eurodac' for the comparison of fingerprints for the effective application of Regulation (EU) No 604/2013 establishing the criteria and mechanisms for determining the Member State responsible for examining an application for international protection lodged in one of the Member States by a third-country national or a stateless person and on requests for the comparison with Eurodac data by Member States' law enforcement authorities and Europol for law enforcement purposes, and amending Regulation (EU) No 1077/2011 establishing a European Agency for the operational management of large-scale IT systems in the area of freedom, security and justice (recast). OJ L 180, 29.6.2013 2 Under the term "Member States" the current document refers to the Member States of the EU and Associated Countries which are bound under Union law by the Regulation (EU) No 603/2013, if not further explained. Member States of the EU connected to Eurodac on 31 December 2016 were: Austria, Belgium, Bulgaria, Cyprus, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, the Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and the United Kingdom. Associated Countries connected to Eurodac were: Iceland, Liechtenstein, Norway and Switzerland. 3 Europol is searching Eurodac since 22 June 2017 using the Dutch National Access Point (NAP).

1. Number of data sets transmitted on persons referred to in Article

9(1)4 , 14(1)5 and 17(1)6 of the Eurodac Regulation

4 Category 1 data as per Article 9(1) of Eurodac Regulation represents applicants for international protection of at least 14 years of age. 5 Category 2 data as per Article 14(1) of Eurodac Regulation represents every third-country national or stateless person of at least 14 years of age that is apprehended by the competent control authorities in connection with the irregular crossing by land, sea or air of the border of that Member State having come from a third-country and who is not turned back. 6 Category 3 data as per Article 17(1) of Eurodac Regulation represents a third-country national or a stateless person found illegally staying within the territory of a Member State.

7 Hits repartition category1 against category 1. Member States on the left have sent, over the reporting period, a certain amount of cases which have produced hits against the Member States listed across the top. Local hits are produced when the two datasets generating the hit are from the same country. Number of local hits depends on Member State settings when performing a search on Eurodac. Member States might exclude own searches, which will result on the fact that local hits will not be returned and, at the same time, it will not be recorded in the statistics.

10 It is not technically possible to retrieve the number of unblocked datasets. 11 A category 1 dataset shall be marked (by the initiating Member State) as soon as international protection is granted, as per article 18.1. 5.3 Number of datasets blocked13

13 As per article 18.2, a blocked dataset represents a marked record, which is no longer accessible to law enforcement searches as international protection was granted at least 3 years ago. As per the point 5.1 above a marked record can be a category 1 data following the granting of international protection and thus marked as initiator or category 1 and/or category 2 data which were linked to the dataset initially marked as thus marked following the initiator. The dataset blocked for law enforcement searches remains, on the other hand, accessible (not blocked) for asylum purposes. The table shows the number of datasets which are blocked, therefore not accessible for law enforcement searches. To be noted that datasets from the Associated Countries (Iceland, Liechtenstein, Norway and Switzerland) and Denmark are also not accessible for law enforcement as the law enforcement elements of the Eurodac Regulation do not yet apply to them. Those datasets are not counted in the table as the table shall only consider dataset from countries implementing the law enforcement elements of Eurodac. The table shows the number of records (Category 1 and Category 2) stored in Eurodac which are marked due to the fact that international protection was granted before 01 January 2014.

17 Category 4 data as per Article 20(1) of Eurodac Regulation represents the searches performed by the law enforcement designated authorities. The law enforcement elements of Eurodac Regulation do not apply for the time being to the Associated Countries (Iceland, Liechtenstein, Norway and Switzerland) and to Denmark. This will be possible only after the conclusion of separate agreements currently under negotiations. Practically this means that the five countries cannot perform category 4 searches, and their data is blocked for law enforcement purposes (i.e. not searchable by other Member States). 18 Category 5 data as per Article 21(1) of Eurodac Regulation represents the searches performed by Europol.
