What is your Product Care Plan? What benefits and services are available to You? What is excluded from Your Product Care Plan? Accessories: includes, but is not limited to headphones, microphones, cords, cables, memory cards, AC adapters, keyboard, mouse, remote controls and ancillary game controllers. Australian Consumer Law or ACL: has the same meaning as the expression “Australian Consumer Law” in the Competition and Consumer Act 2010. Camera Product: means – Digital Still Cameras, Digital SLR Cameras, Compact Pro Digital Cameras, Digital Video Cameras, Video Cameras. Claim Period: means the Term plus 14 days. Eligible Minor Fault: means, in respect of Your Product, a failure of Your Product to operate which does not entitle You to a replacement of Your Product, under the Australian Consumer Law, and: (i) which does not amount to a major failure; (ii) which does not result from Your Product failing to be of acceptable quality; (iii) which is not caused by an Eligible Minor Fault Exclusion; and (iv) which is not merely superficial or cosmetic. Eligible Minor Fault Exclusion: means, in respect of Your Product during the Term, a fault or failure which is caused by: (i) the installation, uninstalling, dismantling, or re-installation of Your Product by any person other than Us; (ii) acts, omissions or damage that occurs during transportation, installation, uninstalling, dismantling or re-installation of Your Product, where the damage is not caused by Us; (iii) accident, misuse or abuse of Your Product; (iv) negligent acts or omissions of any person other than Us, accidental or deliberate misuse, or unauthorised alterations of or to Your Product; (v) liquid penetration; (vi) infestations of vermin, pests or insects; (vii) rust, corrosion or mould; (viii) use of Your Product outside of manufacturer’s operation and care instructions. You must ensure that You read the manufacturers operational and care instructions prior to using the equipment and maintain any servicing on the Product that may be described within the manufacturer’s instructions; (ix) failure or consumption of consumables used with Your Product, including, but is not limited to, batteries, cables, cords, fuses and bulbs; or (x) failure of any Accessory used in conjunction with Your Product. Hardware Computer Product: means – Laptop computers, Desktop computers, All in one computers, Tablet computers. Health Check: means when You return Your Product with the USB storage device supplied to You, We will perform the following checks: virus & spyware check, hard drive optimisation, memory optimisation. Multi Function Centre (Office) Product: means – inkjet printers, laser printers, colour laser printers, colour laser multifunction printers, Scanners, inkjet multifunction printers. Original Documents: means Your original purchase receipt and tax invoice issued by the Retailer which sold Your Product to You. Original Date of Purchase: means the date of purchase of Your Product shown on Your Original Documents. Original Purchase Price: means the amount shown on the purchase receipt and/or Tax Invoice as the purchase price of Your Product. Term: means the period specified on Your Original Documents, but commencing from the Original Date of Purchase. User Generated Data, Your Data: All data generated by You and stored on or in Your Product. For example, songs, photos, telephone numbers, electronic documents and computer programmes. You, Your: means the person/s or business named as the purchaser on the original purchase receipt and/or Tax Invoice in respect of Your Product. Your Product: means the product that You purchased with Your Product Care Plan, as described in the purchase receipt and/or Tax Invoice. Your Product Care Plan: means the Product Care Plan that You have purchased with Your Product. We, Us, Our, Retailer: refers to the selling Retailer or an authorised agent of the selling Retailer whose name appears on the original purchase receipt and/or Tax Invoice as the supplier. Any term or expression used in these terms and conditions and brochure which has a defined meaning in the Australian Consumer Law shall have the same meaning in these terms and conditions and brochure as is ascribed to that term or expression in the Australian Consumer Law. For these purposes, You acknowledge and consent to Us, Our agents and Our related entities collecting Your personal information and disclosing Your personal information to Our agents, Our related entities or Our service providers. You also acknowledge and consent to Us, Our agents and Our related entities collecting and using Your personal information to contact You for market research or to provide You with information and offers about products and services offered by Us, Our agents and Our related entities. If You do not want to receive any marketing information You can opt out by contacting Us on the numbers set out in this document. Before calling please conduct a basic check of Your Product. Is Your Product plugged in? Does Your Product require new batteries? Have You checked the manufacturer’s instruction booklet in respect of Your Product? Many manufacturer’s instruction booklets contain “trouble shooting” tips. If the problem still persists follow our simple claims procedure to make a claim under Your Product Care Plan. Please have Your Original Documents ready before phoning. Please make sure that You have Your Product model and serial numbers available before calling. A claim can also be notified on line by visiting www.productcareclaims.com.au and completing the online claims notification form. We take Our customer service seriously and want to hear about any problems that You may have had with Your claim or the level of service. We will confirm the receipt of Your complaint within 48 hours of receiving it. We will endeavour to have a resolution to Your complaint within 5 working days. Eligible Minor Fault Exclusion: means, in respect of Your Productduring the Term, a fault or failure which is caused by:

(i) the installation, uninstalling, dismantling, or re-installation ofYour Product by any person other than Us;

(ii) acts, omissions or damage that occurs during transportation,installation, uninstalling, dismantling or re-installation of YourProduct, where the damage is not caused by Us;

(iii) accident, misuse or abuse of Your Product;

(iv) negligent acts or omissions of any person other than Us,accidental or deliberate misuse, or unauthorised alterationsof or to Your Product;

(v) liquid penetration;

(vi) infestations of vermin, pests or insects;

(vii) rust, corrosion or mould;

(viii) use of Your Product outside of manufacturer’s operation andcare instructions. You must ensure that You read themanufacturers operational and care instructions prior tousing the equipment and maintain any servicing on theProduct that may be described within the manufacturer’sinstructions;

(ix) failure or consumption of consumables used with YourProduct, including, but is not limited to, batteries, cables,cords, fuses and bulbs; or

(x) failure of any Accessory used in conjunction with YourProduct.

Your Product Care Plan: means the Product Care Plan that Youhave purchased with Your Product.

We, Us, Our, Retailer: refers to the selling Retailer or an authorisedagent of the selling Retailer whose name appears on the originalpurchase receipt and/or Tax Invoice as the supplier.

Congratulations on Your decision to take Product Care as part of Your purchase from Us.

We recognise that Your rights under the Australian Consumer Law are important, andcannot be limited or excluded.Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitledto a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss ordamage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable qualityand the failure does not amount to a major failure. The benefits under Your Product Care Plan are in addition to Your rights and remedies under the AustralianConsumer Law.You are not required to pay for Your rights and remedies under the Australian Consumer Law. Nothing in YourProduct Care Plan excludes, restricts or modifies Your rights under the Australian Consumer Law.There may be some features in Your Product Care Plan which overlap with Your Australian Consumer Law rights.The price You paid for Your Product including Product Care does not include any amount for rights or benefits towhich you are entitled under the Australian Consumer Law.

Your Product Care Plan services, offers and entitlements are available to You from theOriginal Date of Purchase of Your Products. Your Product Care Plan allows You to access a range of services, specified in this brochure and the Terms andConditions, for the Term of Your Product Care Plan. Please ensure that You keep Your Original Documents that record the purchase of Your Product with Your ProductCare Plan. Your Original Documents constitute proof of the purchase and in the event of a claim, the OriginalDocuments may need to be produced.If You have purchased more than one Product on the same purchase receipt, then Your Product Care Plan will onlycover those Products specifically described on the purchase receipt and/or Tax Invoice as being covered by thisProduct Care Plan. This Product Care Plan is only available from Us, at the same time You purchase Your Product.Any claim for replacement of Your Product as a result of an Eligible Minor Fault pursuant to this Product Care Planmust be made during the Claim Period.

Your Product Care Plan gives You access to all of these benefits, subjectto the Terms and Conditions and exclusions in this brochure.

Replacement of Your Product Under the Australian Consumer Law, You are entitled to areplacement or refund for a major failure, and forcompensation for any other reasonably foreseeable loss ordamage. You are also entitled to have Your Product repaired orreplaced if Your Product fails to be of acceptable quality andthe failure does not amount to a major failure.

Your Product Care Plan gives You a benefit over and above Yourrights under Australian Consumer Law, arising out of a failurein respect of Your Product which does not amount to a majorfailure.

If:

(a) during the Term, Your Product fails to operate as a result ofan Eligible Minor Fault in Your Product; and

(b) You make a claim for replacement of Your Product duringthe Claim Period in respect of Your Product;

then We will replace Your Product.

In addition to Your rights in respect of a Eligible Minor Fault inYour Product, if, during the Term, Your Product fails to operateas a result of:

(a) normal wear and tear; or

(b) dust, internal overheating, internal humidity orcondensation;

then We will replace Your Product.

Eligible Minor Fault, Term and Claim Period are terms definedin the “Definitions” section of this Product Care Plan brochure.

The maximum amount payable by Us under Your Product CarePlan in respect of Your Product will be an amount equivalent tothe Original Purchase Price of Your Product (inclusive of GST).

Exclusions under Your Product Care Plan Subject to the Australian Consumer Law:

(a) We have no liability or responsibility to You in respect ofany Eligible Minor Fault Exclusion;

(b) Your Product Care Plan is not intended to provide You withany right or entitlement in respect of any Eligible MinorFault Exclusion or Accessories which are part of, or usedin conjunction with Your Product; and

(c) We have no liability or responsibility to You for indirect orconsequential loss, including but not limited to, loss ofprofits.

(d) We have no liability or responsibility for costs incurred inrespect to Your Product if Our assessment determines YourProduct does not have a fault.

For the avoidance of doubt, the exclusions set out above do notaffect any right or entitlement You may have under the AustralianConsumer Law.

Replacement TermsWe will replace Your Product with a new product, or a like forlike product that is the nearest equivalent to Your Product asdetermined by Us. When We replace Your Product under YourProduct Care Plan, We will take into account features, qualityand specifications of the original item as well as availability ofthe technology.

The value of the replacement product shall not exceed theOriginal Purchase Price You paid for Your Product. Due tochanges in product technology and availability, thereplacement product We supply under Your Product Care Planmay have a lower selling price and is not limited to the originalmanufacturer brand of Your Product. Replacement pricedifferences, if any, will not be refunded.

Under Your Product Care Plan, if we cannot offer You a suitablereplacement, we may give You a store credit or cashsettlement. The decision toreplace, offer a store credit or cash settlement under YourProduct Care Plan is always at Our sole discretion.

If Your Product is replaced, a store credit is given or a cashsettlement is made under Your Product Care Plan, this shallconstitute fulfilment of Your Product Care Plan and the faultyitem will become Our property.

Freight costs are coveredYour Product will be required to be sent to Our service agentfor assessment. We will cover any freight costs associatedwith the assessment or replacement of Your Product.

Data StorageIf Your Product is capable of storing User Generated Data, it ispossible that Your data may be lost during the claim process.We are not liable for any loss or corruption of Your UserGenerated Data.

Your Product Care Plan comes withinternational coverageYour Product is covered by Your Product Care Plan in anycountry where a Domayne®, Harvey Norman®, Joyce Mayne®

or Norman Ross® store exists.

If You are in a country where a Domayne®, Harvey Norman®,Joyce Mayne® or Norman Ross® does not exist and You areentitled to a replacement of Your Product under Your ProductCare Plan, and You replace Your Product in that country, We willpay up to A$200 of the cost of replacement. You will need tocontact Our customer service centre before You replace YourProduct. You will need to pay for the replacement and claimA$200 from Us. You will need to show an itemised invoice ofthe replacement costs in order to claim A$200 under YourProduct Care Plan.

If You sell Your Product, Your Product CarePlan can be transferred to the new ownerIn the event that You sell Your Product, Your Product Care Plan asit applies to Your Product can be transferred to the new ownerprovided the written advice of the transfer from You and the newowner is given to Our customer service centre. Please provide acopy of the Original Documents to the new owner on Transfer.Please call Our customer service centre on 1300 880 459, duringOur operating hours as set out at the end of this Product CarePlan, or mail Your advice to the address shown at the end of thisProduct Care Plan.

Your Product Care Plan can not be sold separately to Your Product.

Redeem 100 prints per year at no additionalcostUnder Your Product Care Plan, You are eligible to claim 100 6x4photo quality prints, per year from Us, computed from YourOriginal Purchase Date.

An allowance of no more than 100 prints can be claimed per 12months from Your Original Purchase Date. Any entitlement nottaken up in any year during the Term cannot be carried forwardto any subsequent year.

To claim Your prints, You will be required to present Your OriginalDocuments, and photo identification at store. The OriginalDocuments must clearly identify Your Product, including YourProduct Care.

Annual Health Check at no additional costUnder Your Product Care Plan, You are eligible to claim from Us1 Health Check per year, in respect of Your Product, computedfrom Your Original Purchase Date.

To claim Your Health Check, You will be required to present YourOriginal Documents, and photo identification at Our store. TheOriginal Documents must include Your Product, including YourProduct Care Plan purchased.

If Your Product is capable of storing User Generated Data, Wewill make every reasonable endeavour to secure and protectYour Data. We will back up Your data prior to thecommencement of any health Check, using Your USB storagedevice received as a part of Your Product Care Plan.

If Your Product is capable of storing User Generated Data, it ispossible that Your data may be lost during the check-upprocess. We always recommend that You back-up Your UserGenerated Data.

USB Storage DeviceWhen purchased with a Computer Hardware Product, You willbe provided by Us, within 30 days of Your Original Date ofPurchase, a USB storage device capable of storing up to 4GB ofdata, at no additional cost to You.

Data Backup SoftwareWhen purchased with a Computer Hardware Product, You willbe provided by Us, within 30 days of Your Original Date ofPurchase, a software package to assist You in backing up YourUser Generated Data, at no additional cost to You.

Additional benefits when You purchaseProduct Care with a Multi Function (Office)Centre ProductDiscounted Ink or TonerYour Product Care Plan entitles You to purchase from Us, eachyear during the Term, one complete set of ink or tonerreplacements, in respect of Your Product (“replacement set”),for a price equivalent to 25% off the price advertised by Us inrespect of the replacement set. The discount cannot be used inconjunction with any other discount or offer.

You are eligible to claim for Your discounted ink or toneranytime after 30 days from Your Date of Purchase.

Redemption of entitlementsTo redeem Your entitlements, You will be required to presentYour Original Documents, and photo identification to Us. TheOriginal Documents must include You Product, including YourProduct Care Plan.

Upon our provision of the yearly entitlements to You, Yourbrochure will be noted by Us as satisfying the entitlement. Weare not responsible for lost or damaged brochures where Weare unable to reasonably determine if the redemption has beensatisfied. Entitlements may only be redeemed if the time periodin which to claim has not expired and are not able to besubstituted for another product or cash.

Any entitlement not taken up within any year of the Term,cannot be carried forward to any subsequent year.
