EXECUTIVE SUMMARY
This Social Monitoring Report represents the status of the activities of the Land Acquisition and
Resettlement Plan (RP) of Chittagong – Cox‟s Bazar Railway Project, Phase 1 (Dohazari Cox‟s Bazar Railway Project) in Chittagong and Cox‟s Bazar District of Bangladesh. The project‟s target is to construct 101.477Km of new Single Line Dual Gauge Railway Track from Dohazari to Cox‟s Bazar via Ramu, to establish connectivity with the famous Tourist spot of Cox‟s Bazar and provide access to the proposed expected Trans-Asian Railway Corridor. The Government of the People‟s Republic of Bangladesh with the financial assistance from the Asian Development Bank (ADB) has launched Dohazari - Cox‟s Bazar Railway Project (DCRP).
The project requires new acquired land to construct a railway line and other structures which are shown in
the report details. The resettlement impacts include, but are not limited to (i) permanent loss of residential,
social and commercial structures, (ii) loss of income and livelihood, (iii) displacement of people and (iv)
loss of land.
The salient features of ADB‟s Safeguard Policy Statement 2009 (SPS 2009) and Resettlement Plan have been discussed in this report. At present, all the 10 (Ten) Land Acquisition (LA) cases are almost finalized
and the land of 6 (six) LA cases were already taken over by the Bangladesh Railway from DC‟s office. Compensation payment of CCL is going on. It is expected that land handover of the rest LA cases will be
completed soon. A Resettlement Plan (RP) was prepared in accordance with ADB‟s Safeguard Policy Statement (2009) and the Acquisition and Requisition of Immovable Property Ordinance 1982 (ARIPO) of the Government of
Bangladesh (GOB), detail engineering design and Census survey. The RP was approved by the Ministry of
Railway on 17 August 2016 as per concurrence of ADB. In accordance with ADB Safeguards requirements, the government of Bangladesh agreed to implement
“The ADB safeguard Policy” for the purpose of avoiding involuntary resettlement wherever possible; to
minimize involuntary resettlement by exploring project and design alternatives; to enhance, or at least
restore the livelihoods of all displaced persons in real terms relative to pre-project levels; and to improve
the standards of living of the displaced poor and other vulnerable groups. Bangladesh Railway engaged an NGO for the Implementation of the project's Resettlement Plan.
Accordingly, the Implementing NGO (INGO) commenced their activities effective 8 February 2017. This
Social Monitoring Report covers the status of Land Acquisition and Resettlement activities from November
2017 to June 30, 2018, including an action plan to speed up the compensation payment so that the civil
works are not delayed. BR, CSC and INGO are working to address the Affected Persons (Aps).
As of June 30, 2018, BR has taken over about 396.95 acres of land out of 1367.36 acres of land from the
DC office. CCL payments were made to 436 awardees out of 3442 identified awardees. Resettlement
compensation was paid to 56 NTH EPs out of 211 EPS following the recommendation of JVC. ID Cards,
were, 7750 leaflets and 3700 booklets were distributed to 150 EPS in the project area.

I. INTRODUCTION, PROJECT DESCRIPTION AND OBJECTIVES:
A. Introduction:
The report represents the present status of the Land Acquisition, Implementation of Resettlement
Plan (RP) and progress of the Dohazari – Cox‟s Bazar Railway Project, in Chittagong and Cox‟s Bazar district of Bangladesh. The Government of the People‟s Republic of Bangladesh represented
by the Ministry of Railways is the Project Sponsoring Agency while Bangladesh Railway (BR) is the
Project Implementing Agency. The Development Partner of the project is the Asian Development
Bank (ADB). For this project two loan agreements have been signed between Asian Development
Bank (ADB) and the Government of Bangladesh (GOB) on June 21, 2017.
The scope of the report is to provide a progress status of the land acquisition and resettlement
activities and to assess their compliance with ADB Safeguard Policy Statement 2009 (SPS 2009),
and to account for implementation of resettlement activities at field level. The first report covered the
period of October 2016 to March 20171, and the second covered April 2017 to November 2017.2
Both reports are disclosed on ADB website. Now, this third semi-annual report is covering the period
from November 2017 to June 2018.
During the first and second SMR, the land acquisition process was at its primary stage. During this reporting period, substantial progress has been achieved as reflected in this report.
B. Project description:
Chittagong – Cox‟s Bazar Railway Project, phase 1, involves new construction of 101.477 km Single Line Dual Gauge Railway Track from Dohazari to Cox‟s Bazar. The Project components include:
New Construction of 101.4771km Single Line Dual Gauge Railway Track
(Dohazari to Cox‟s Bazar); Construction of 09 Railway Station, namely Dohazari, Satkania, Lohagara, Harbang, Chakaria,
Dulahazra, Islamabad, Ramu and Cox‟s Bazar; Construction of 4 Large bridges (over 100 m), 39 Major bridges (50 m to 100 m) and 145
culverts; Construction of Elephant Crossing (underpass and overpass) Construction of Modern Computer Based Inter Locking (CBI) signaling system; Construction of an ICONIC station building at Coax‟s Bazar.
C. Project Objectives:
The objectives of the project are to promote the economic development and reduce poverty through
a new connectivity of railway in the southeastern part of Bangladesh, specifically Cox‟s Bazar where
the largest natural sea beach is situated. This project will link the Capital City (Dhaka) and other
integrated railway networks of Bangladesh. The project will directly contribute to earning Foreign
Exchange through the development of the Tourism Industry and the export of Garments and Agro
based products, including an internal carriage of imported and local goods.

D. Project Scope:
The name of the project is Single Line Dual Gauge Railway Track Construction Project Phase 1,
between Dohazari of Chittagong district to Cox‟s Bazar Sadar of Cox‟s Bazar district significant namely Chittagong and Cox‟s Bazar. The project area is shown below in a table:

II. METHODOLOGY FOR PREPARING THE SOCIAL MONITORING REPORT:
The resettlement activities information has been collected from the field. The Project Office (PIU)
frequently co-ordinates the entire work and processes the data for facilitating the smooth operation of
the RP implementation. Resettlement data have been collected by the INGO through the census and

In preparing this SMR, the following documents have been reviewed:
1) The first and second SMRs;
2) Acquisition and Requisition of Immovable Property Ordinance 1982 of GOB;
3) ADB Safeguard Policy Statement 2009 (SPS 2009);
4) The Project Administration Manual;
5) ADB‟s Residence Mission Aid Memoire;
6) Resettlement Plan (RP);
7) Contract Agreement for Implementation of RP between BR and Implementing NGO;
8) Allied document related to the LAP;
9) Monthly progress reports submitted to BR by INGO;
10) EP files of Non-title holders;
11) Activities of various committees (JVC, GRC & PVAC);
12) FGD documentation;
13) One to-one discussion meetings with different Stakeholders.
B. Field Visits:
The Project Director, Additional Project Director, DD-Resettlement, the CSC and INGO team visited
several sites. A meeting was organized with the Deputy Commissioner (DC) and the Additional
Deputy Commissioner (LA) and other officials and concerned representatives of Chittagong and
Cox‟s Bazar to expedite the Land Acquisition process. PVAC consultations with Eps were also attended. The field activities conducted by the INGO to expedite and provide necessary assistance to
the APs were reviewed. Details in Annexure-1 III. RESETTLEMENT PLAN IMPLEMENTATION:
A. Resettlement Plan Preparation and Objectives:
Where population displacement by the acquisition of land is unavoidable, a detailed Resettlement
Plan has been prepared with the development strategy and package aimed at improving or at least
restoring the economic base of those affected persons. A Resettlement Plan (RP) for SASEC
Chittagong – Cox‟s Bazar Railway Project, Phase 1 (Dohazari Cox‟s Bazar Railway Project) has been prepared by the Design Consultant in accordance with the ADB Involuntary Resettlement guidelines.
The Resettlement Plan (May 2016) has been approved by the Ministry of Railway vide memo No.
54.00.0000.006.014.2016-86 dated 17 August 2016. The approved RP is disclosed on ADB‟s

A legal framework outlining the principles and guidelines which will be used to acquire lands and other assets from private ownership, as well as to acquire public lands from authorized and unauthorized private uses;
A detailed policy matrix defining the entitlements, entitled persons, application guidelines and implementation , and the institutional responsibility to implement them;
An organizational framework to plan and implement the resettlement activities. In particular
identifies the location-specific impact details, and the tasks concerning policy revisions, budgeting, work planning and the like;(can't understand)
A grievance redresses procedure to deal with disputes and complaints related to the planning
and implementation of the resettlement activities;
A monitoring and evaluation framework to be used for land acquisition; and (please explain
further)
A planning process defining the tasks leading to preparation of the location-specific land
acquisition proposals, identification of the impact details, policy review, budgeting, task scheduling, etc. please define in what sections of the RP are these found.

C. Objectives of RP:
The objective of the resettlement plan is to assess and document impacts, develop mitigation, Land
Acquisition (LA), compensation and rehabilitation measures. Likewise, to restore the assets and
livelihood of all persons affected by this project. The resettlement plan covers titled & non-titled EPs. It
complies with national regulations for land acquisition, and ADB‟s Involuntary Resettlement outlined in the Safeguards Policy Statement (2009). It also includes income/livelihood restoration programs and
poverty reduction assistance to vulnerable PAPs. The executing agency (EA) for the project is
Bangladesh Railway (BR).

The RP complies with the ADB Safeguard Policy Statement (SPS) 2009 Principles as Follows;
To avoid Involuntary Resettlement-wherever possible; to minimize involuntary resettlement by exploring project and design alternatives; to enhance, or at least restore, the livelihoods of all displaced persons in real terms relative to pre-project levels; and to improve the standards of living of the displaced poor and other vulnerable groups;
Consulting with the affected people in project planning and implementation; Avoiding or minimizing impacts where possible; Consulting with the affected people in project planning and implementation; Disclosure of the project and safeguard documents to the community/ PAPs; Payments of compensation for acquiring assets at replacement cost; Ensuring that no one is worse off as a result of resettlement and would
maintain, at least, their original standard of living; Resettlement benefits to affected persons, including non-titled persons; and Special attention to vulnerable affected persons.
D. Revision of Alignment Revised of Land Acquisition:
Since original RP approved on 17.08.2016, no revision of alignment or LA has been made.
E. Resettlement Plan Implementation Arrangements: E.1 Bangladesh Railway (BR) – PIU:
Bangladesh Railway (BR) is the Executing Agency for the resettlement plan implementation
arrangements of Dohazari – Cox‟s Bazar Railway Project. The Project Management Unit (PMU) is run by a Project Director and includes BR officials to implement the LAP and RP. The
Deputy Director (Resettlement) is the convener of the JVC, PVAC and GRC and signatory of
the payment documents of RB in favor of Project Director. The DD (Resettlement) is assisted
by the Senior Sub Assistant Engineer –SSAE (Resettlement) for the implementation of the RP
at the field level. E.2 Resettlement Plan Implementing Non-Government Organization (INGO):
Bangladesh Railway has recruited the NGO, Development Organization of the Rural Poor (DORP)-PATHMARK- JV in February 2017 to assist BR in Land Acquisition & implement the Resettlement Plan (RP).
DORP PATHMARK has set up two field offices in Lohagara of Chittagong and Ramu of Cox‟s Bazar in the project area in addition to Project Coordination Office in Chittagong.

In short, the key responsibilities of the INGO are to support BR to effective, timely and efficiently
implement the RP. In addition, the NGO is updating the detailed surveys of the affected persons
(APs) and their assets, business, Common Property Resources (CPRs) and resettlement
benefits. The scope of work of INGO as mentioned in the RP is as follows;
1. Conduct census, inventory of lost assets and support to JVC and PVAC; 2. Assist in the Land Acquisition Process; 3. Support in the compensation/assistance distribution process; 4. Resettlement and Land Acquisition Consultation and Participation activities; 5. Resettlement activities data management and monitoring; 6. Assistance in finding an alternative place / plot to rent/buy; 7. Assistance and participation to Grievance Redress Committee (GRC) and 8. Coordinate with and support DORP-PATHMARK in conducting the Livelihood
Improvement Training Program (LITP) 9. Conduct/Liaise HIV/AIDS and Anti-Trafficking Awareness Campaign,
10. Support in the implementation of Gender-related activities; 11. Support the implementation of the Railway Safety Awareness campaign to the
communities. 12. Carrying out assistance in Land Acquisition and identification of titled and Non-titled holders.
E.3 Establishment of Resettlement Unit in Construction Supervision Consultancy (CSC):
Bangladesh Railway had recruited the Construction Supervision Consultant (CSC) SMEC international in JV with CANARAIL, SYSTRA and ACE under Contract No. PD/HHZ-COX/CSC1
Loan No.3439 (SF) -BAN dated 14 September, 2017. The CSC Resettlement Team is

The ADB Headquarters visited the project several times.ADB BRM conducts periodic review meetings on a regular basis.

E.5 Formation of Committees (JVC, PVAC and GRC):
The government constituted the Joint Verification Committee (JVC), the Property Valuation Advisory Committee (PVAC) and the Grievance Redress Committee (GRC) for the Project to ascertain the quantum of losses and valuation of affected assets through an administrative order No. 54.00.0000.006.014.11.2016-555 dated 02 November 2017. Meanwhile BR has formed all the committees and are all functioning accordingly.
E.5.1 Composition of the Joint Verification Committee (JVC):

INGO is conducting the inventory of losses (IOL) surveys. The Joint Verification Committee is jointly
verifying the IOL. It is updating and reviewing the IOL for titled and Non-titled APs. All verifications
are documented in a Joint verification form that is submitted to the PD for approval.

E.7 LA process in Bangladesh & Role of Deputy Commissioner (DC):
Legal Frameworks for Land Acquisition in Bangladesh Context: Constitutional Obligation-For development works, the acquisition of lands and payment of
compensation is a Constitutional Obligation under Article 42 of the Constitution of the Peoples
Republic of Bangladesh, quoted below:
“42. (1) Subject to any restrictions imposed law, every citizen shall have the right to acquire, hold,
transfer or otherwise dispose of property, and no property shall be compulsorily acquired,
nationalized or requisitioned save by authority of law.
[(2) A law made under clause (1) of this article shall provide for the acquisition, nationalization or requisition with compensation and shall fix the amount of compensation of specify the principles on which, and the manner in which, the compensation is to be assessed and paid; but no such law shall be called in question in any court on the ground that any provision of the law in respect of such compensation is not adequate)]
To acquire the lands for undertaking the project, Bangladesh Railway (BR) has followed the procedures and principles laid down in the Ordinance, as promulgated by the President of Bangladesh. The Deputy Commissioner (DC) of project influence Zones are exercising the Regulatory Authority as „Acquiring Body (AB)‟ some important sections of the Ordinance-1982 highlighted below,

The Government or, as the case may be, the Divisional Commissioner, after considering the report submitted by the Deputy Commissioner under section 4 (3), shall make a decision about the acquisition of the property and such decision shall be final.
Under Section 6
Notice to person interested.
When the Government, the Divisional Commissioner or the Deputy
Commissioner, as the case may be, has made a decision for
acquisition of any property under section 5 or the proviso to section
4 (3) (b), as the case may be, the Deputy Commissioner shall cause
public notice to be given in the prescribed manner at convenient
places on or near such property stating that decision has been
taken to-
Acquire the property and intends to take possession thereof and
that claims to compensation for all interests in such property may be
made to him.

Award of compensation by
Deputy Commissioner
On the date so fixed, or on any other date to which the enquiry has
been adjourned, the Deputy Commissioner shall proceed to enquire
into the statement, if any, which any person has made pursuant to a
enquire into the statement, if any, which any person has made
pursuant to a notice given under section 6 and into the value of the
property at the date of the publication of the notice under section 3,
and into the respective interests of the persons claiming the
compensation and shall make an award of:
(a) The compensation which, in his opinion, shall be allowed for
the property;
(b) The apportionment of the said compensation among all the
persons known or believed to be interested in the property, of
whom, or of whose claims he has information.
Will request the Requiring body to place the fund within a specified
period.
Under Section 8
Matters to be considered in determining
compensation
(1) In determining the amount of compensation to be awarded for
any property to be acquired under this Part, the Deputy
Commissioner shall take into consideration-
(a) The market value of the property at the date of publication of
the notice under section 3;
Provided that in determining such market value, the Deputy
Commissioner shall take into account the average value, to be
calculated in the prescribed manner, of the properties of similar
description and with similar advantages in the vicinity during the
twelve months preceding the date of publication of the notice under
section3;
(2) In addition to the market value of the property as provided in sub-
section (1), the Deputy Commissioner shall in every case award a
sum of “fifty percent” on such market value in consideration of
the compulsory nature of the acquisition.”
F. Land Acquisition (LA)
The Land Acquisition progress is implemented based on the approved RP as well as the
revised alignment. The Design Consultant prepared the Land Acquisition Proposals (LAPs)
and submitted the same to the BR. After verifications of the LA Proposals, some LAPs have
been corrected and changed. At present, a total of 553.5896 hectares (1367.3664 acres) of

the Land has been finalized for acquisition, which has been segregated in 10 LA Cases for
the two Districts.
Deputy Commissioners of Chittagong and Cox‟s Bazar have been disbursing the
compensation to the titled holders. BR will pay the Top-up including other entitlements as per
the approved RP.

F.1 Payments of Resettlement Benefits (RB) to THs and NTHs:
The payment of the Resettlement Benefits (RB) has started for Non-titled holders (NTHs).. INGO started the identification of NTHs as
per the existing alignment. The INGO is following the correct alignment as per the final LAP to identify the NTHs in the prioritized
section for a smooth handover to the Contractors. The PVAC is determining the price in the prioritized sections. The INGO prepared
the budget and the EP files accordingly, and BR will disburse the Resettlement Benefits priority area to start the construction work.
The payment of RB to Titled holders has not been initiated by BR.
Out of the 3 (three) Upazillas of Chittagong district, 88 Non-Title Holders were found in Chandanaish. Out of 88 Non-Title Holder, 51
EP ID cards have been prepared and distributed. Out of 3 (three) Upazillas of Cox‟s Bazar district, a total of 123 Non-Title Holders
were found in Cox‟s Bazar Sadar, 99 EP ID cards have been prepared and distributed. In terms of financial reporting, BDT 7,398,031
and BDT 3,140,569 have been disbursed till the end of June, 2018 in Chittagong & Cox‟s Bazar district, respectively. The progress
and status of disbursements of Resettlement Benefits and NTHs ID card distribution status are mentioned in the Tables 8 and 9.

F.2 Identification and assistance of vulnerable households:
In accordance with SPS, assistance measures to support the households who are physically displaced and special measures for vulnerable households have been included in the RP. As of June 30, 2018, the JVC has identified 61 vulnerable households out of 211, accordingly BR has paid 18 and the rest is in progress. Table -10 shows the details.

G. Common Property Resources:
As of June 30, 2018, a total of 48 CPRs were identified: 12 CPRs in Chittagong District and 36 in
Cox‟s Bazar . The JVC has approved 2 CPRs and the PVAC will determine their Replacement Value. BR will arrange compensation and other Resettlement Benefits. The INGO will continue
the consultation with individual CPRs meticulously. Details in Annexure-3
H. Income and Livelihood Restoration Program (ILRP):
The Livelihood Improvement Training will be provided to one member of each vulnerable and
severely affected household. It will be up to the household to designate the eligible member.
Training courses will be prepared through a needs assessment of the participants. Each participant
will also receive a seed grant upon completion of the course. To encourage families to send female
participants, the seed grant provided to women will be higher (BDT 35,000.00) than the one offered
to men (BD 25,000.00). A separate institution specialized in skills development will be recruited by
BR to conduct the training.
I. Consultation, Information Campaign and Participatory Process: At the onset of the RP implementation, the INGO started the distribution of a Leaflet and Booklet
among the affected people. During the field visit of the ADB External monitor, BR, the CSC and the
INGO, consultations were conducted with the affected persons and stakeholders which will be
continuing subsequently. Details shown in the Table-11 below;

J. GRIEVANCE REDRESS MECHANISM (GRM):
The Grievance Redress Mechanism (GRM) was formed to voice and resolve all concerns linked to
the project, and ensure accountability towards affected persons. This mechanism will be readily
accessible to all project- affected persons or other concerned people. The GRM will be composed
of a series of local-level committees (at municipality or local administration level) and one project-
level committee (based in Chittagong). Cases that are not resolved at the local-level will be
escalated to the project-level committee. The contact information of the local level committee focal
person will be posted on sign boards in different relevant locations along the alignment. In the
meantime, BR established GRCs to resolve any grievance during the project intervention.
Grievance Redress Committees (GRCs) will try to resolve amicably by bringing together the
contestants. The GRCs will however not provide legal advice to the contestants. Decisions made
by using this mechanism will be binding on Bangladesh Railway. Unless the land acquisition
process is completed, grievance petitions can‟t be enumerated. Until now, no petition has been received by any of the Grievance Redress Committees. Total 32 of GRC have formed and
circulated notice mentioned in the below table -12;

IV. GENERAL COMMENTS:
The following observations have been identified during the monitoring of project ongoing activities
and the action has taken on specific issues to speed up the activities mentioned in the below table -

Resettlement Sites There is no land for land option for this project.
INGO staff providing necessary assistance to EPs to identify their alternative place for relocation.
Implementation Arrangements
In the meantime INGO,CSC and Construction Contractor have been deployed and working. The Project Management Consultant (PMC) not yet deployed.
The Project Management Consultant (PMC) will be deployed shortly.
V. CONCLUSION:
The implementation of the Resettlement Plan (RP) is being done by BR with the assistance of the
CSC team and the INGO. BR will explore all possible ways to mitigate adverse situations. The
delay in the land acquisition process is being addressed. BR is giving priorities to the payment of
compensation and resettlement benefit to the affected people (Titled & Non-Titled) who are in
priority sections of construction works. This may be completed within the stipulated time to ensure
the start of construction work.
It is confirmed that during the implementation of the project, social safeguard issues are being
addressed properly. No issue has yet been raised. Because the PIU is following the safeguard
issue as well as ADB SPS 2009 from the beginning stage and it is being continued.

1. Information Sharing and Dissemination of Idea with PAPs
CSC Consultant proposed that the Project influence zones where notice U/S-7 has been issued
that interested persons should be invited with required documents to verify their strength to
prove the land ownership and receive compensation under law (As per DC‟s Checklist). INGO claimed that they have done so. Finally, the proposal was adopted and the NGO has been
given responsibility to identify the suitable spots and notify the PAPs to assemble at suitable
points/place.
2. Meeting with Deputy Director (Resettlement) on 28 March 2018
An exclusive meeting was held with BR, CSC & INGO at BR, presided by Mr. Mohammad
Salim, Deputy Director (Resettlement) of BR. Deputy Project Manager (DPM) Mr. ANM Khasru,
