Project Scope The project consists of construction a community science planetarium. This 12,000 square foot structure will be home to 129 seat auditorium. The new facility will also house a Foucault pendulum and a “Science on a Sphere” exhibit in the main lobby area. The work began in the summer of 2016 and is anticipated to be complete late spring of 2018. Requests for Information (RFI) There have been 100 RFI’s submitted and responded to. Responses are generally provided within 24 to 48 hours. There are no outstanding, unresolved RFI’s. Issues are being discussed and resolved on an ongoing basis at each project progress meeting. Submittals Submittals are 95% complete with all critical and immediate items of work submitted, reviewed and approved. The contractor has been advised to get the remainder of submittals completed. Scope Changes There has been one change order approved to date. The change order removed the installation of the projection equipment and projection dome screen from the contractor’s scope of work. As approved by the Board on April 19, 2017, this change was required due to complications with the procurement and installation of sole source equipment. The District, working with the LA/OC Trade Council, was able to obtain an exception to the Project Labor Agreement, and the District subsequently contracted directly with Spitz, Inc. for this work. Furthermore, the landscape and hardscape has been redesigned to save several legacy Eucalyptus Trees and address other campus pedestrian considerations. The contractor will be providing a proposal for this owner requested scope change.

Project Budget Inclusive of the change order referenced above and the separate contract issued to Spitz, Inc., the total expected construction cost-to-completion, as of the date of this report is $17,844,255. The estimated “hard cost” budget for this project is $17,192,000. To date $4,208,212 has been paid to the General Contractor, MS Construction Management Group (MSCMG). MSCMG’s contract includes a $400,000 construction allowance to address potential unforeseen and field coordination issues. To date $73,778 of allowance work has been authorized for various items which include:

1. Remove unforeseen buried concrete piles - $50,000. 2. Reroute sanitary sewer line and add manhole – $22,576. 3. Installation of sound attenuation blankets at Journalism buildings for noise control - $1,202.

Schedule The original project schedule reflected a completion date of January 3, 2018. The current schedule reflects a completion date of April 9, 2018. While the causes of such delay have not been assessed, attributed, nor agreed upon by any parties, the District has put the contractor on notice of such delays. For reference, please find formal notices associated with project delay attached as Exhibit A to this report. While all parties continue to reserve their rights as to the causes of delay, the contractor has provided a schedule indicating completion by April 9, 2018.

Response to letter dated August 7, 2017-Project Delay

Dear Mr. Marchbank,

Please accept this letter as our response to your letter dated August 7, 2017 related to the above mentioned

Project and subject.

Although we can appreciate your continued concerns about M.S. Construction Management Group’s

(hereafter referred to as MSCMG) ability to timely complete the above-mentioned project, however, we can only

Indicate that, MSCMG is very well capable, and has continually been working toward timely completion of the

above project, without interruption. Furthermore, in order to achieve the timely project completion, MSCMG on

numerous occasions have been working on Saturdays to meet or beat certain targets dates of the schedule.

It must be noted that, the above-mentioned project contains a very complicated and time consuming

structural details which must be attended to accordingly. The vast majority of the construction time for this project

relates to the grading, and construction of the cast in place concrete walls including foundation, and the concrete

dome.

Please be advised that, MSCMG takes exception to your comment indicating that, “Despite repeated

requests from the District, and it’s construction manager, Kitchel Corp, MSCMG has failed to produce a revised,

accurate, and measurable project schedule reflecting completion by this date.” For the following reason:

1. On June 21, 2017, MSCMG submitted an Updated Schedule UP04, reflecting a Substantial Completion

date of April 9, 2017. Enclosed, please find a copy.

The following are our response to the District’s relying on the qualitative factors in assessing MSCMG’S progress:

• Monthly Burn Rate: Distributing the contract amount for the duration of the project will not represent a

realistic monthly burn rate for any given project. The burn rate should be assessed based on the scheduled

Tasks monthly.

The above project contains a variety of tasks involving higher dollar amounts that starts in the lateral

portion of the project, which at that time the monthly burn rate will increase drastically.

• Percentage of overall completion: While figuring the percentage of completion, both the Burn rate and

the project delays due to weather precipitation should be factored in. Your assessment did not consider

neither the burn rate, nor the delay factors.

• Number of Outstanding Submittals: this matter was discussed with the District’s project manager, and

there were some submittals that were included in other submittals which were not counted for. Needless to

say, since then we have submitted additional submittals which as of today there are only few submittals

remains to be submitted, and are waiting for our subcontractors to submit.

• Lack of Labor Resources: We take exception in to your accountability of 6 to 8 persons of craft labor on

the project. There has been days that we had 11 to 13 employees on site. This is not considering the fact

that our Structural Steel Subcontractor has been fabricating, and welding the structural Steel components

of the project in their shop. As of today, approximately 75% of the project Structural Steel members has

been fabricated and inspected at our Structural Steel subcontractor’s shop.

Furthermore, please keep in mind that due the nature of the formwork, and the space inside the Dome area,

we can only have certain numbers of employees and equipment to be able to perform the work safely, and

expediently.

• Delays in completion of Orange Coast College Recycling Center and Coastline Le-Jao Center:

MSCMG takes exception in your accountability of the delays for both projects for the following reasons,

and will submit a separate letter for each project stating the same:

1. OCC Recycling Center: This project has been on target, and a lot of delay components has not been

accounted for. The following is a quick update of the project status:

MSCMG has substantially completed the project on August 3, 2017, and the District has started their

beneficial occupancy on August 3, 2017, by delivering and installing their office furniture’s inside the

building on August 3, 2017, as well as utilizing the storage area located North of Gen-7 building.

On August 10, 2017, MSCMG performed relocated the existing bailers from the existing Recycling

site to the new site, and ready for operation.

On August 11, 2017, Recycling staff started utilizing the existing relocated bailers at the new

Recycling Center location.

On August 11, 2017, MSCMG performed and passed the Fire Alarm testing, as well as completed the

Chlorination of the domestic water supply. Hence, the building was ready to be occupied by the

District as of August 11, 2017.

2. CCC Le-Jao Student Success Center: The 102 days beyond contract completion is totally unrealistic

and none of the delay effects, such as change orders, and rain delays has been accounted for.

The project was substantially completed on 8/4/17, and a Final punch list was generated on 8/4/17 by

the Architect of Record.

As of today 92% of the punch list items have been completed, and our goal is to complete all the

punch list items by tomorrow 8/18/17.

As we continue to value our relationship with the Coast Community College District, we hope that the

above responses will be sufficient, and that they clear any misundrestandings.

Dear Mr. Marchbank,

To begin with, I apologize that, due to unfortunate circumstances, there has been a delay in response to

your letter by the requested date of September 11, 2017.

Please accept this letter as our response to your letter dated August 28, 2017 related to the above-

mentioned Project and subject.

Our scheduler currently is working on completing the preparation of updated schedule #6- UP06 which

would be for 9/30/17 and will include the resource loading information.

Please be advised that the above mentioned updated schedule will be completed and submitted by no later

than 5:00 PM on Monday 10/2/17.
