On behalf of the American College of Legal Medicine’s President Kent E. Harshbarger, MD, JD, FCLM, and the Board of Governors, I take pride in welcoming you to our 53rd Annual Conference: Law, Medicine and Your Professional Practice.

The excellent faculty of speakers will be addressing many contem-porary and controversial issues such as the outcome of the Supreme Court’s opinion in National Federation of Independent Business v. Se-belius, Supreme Court Docket No. 11-393; Decided June 28, 2012, which examines the constitutionality of the Patient Protection and Af-fordable Care Act’s (Pub. L. 111-148, 124 Stat. 119 (2010)) mandate that individuals must have health insurance beginning in 2014; and the Ninth Circuit’s opinion in Buckwalter v State Board of Nevada, Docket No. 11-15742 (Feb 16, 2012), which functionally removes many, if not all, of a physician’s procedural rights during Board actions.

The program also includes a number of sessions designed to provide physicians and attorneys with tools they can use as soon as they re-turn home. These sessions include: the traditional update of judicial and legislative actions, a session on whether the healthcare market is friendly to providers, an applied technology session, a session on the application of the Art to life, medical malpractice, globalization & health care, societal impact on health care and a session on regulator issues.

NEW THIS YEAR: There is a special medical ethics session. This session is designed for physicians who are required to receive two hours of medical ethics CME credits to renew their license. State of Nevada physicians who need to meet this requirement can at-tend this stand-alone session at a reduced rate.

This year the S. Sandy Sanbar Lecture will be given by Indiana Uni-versity Professor of Law Nicolas Terry. Professor Terry will address the College on how the HITECH Act’s (42 U.S.C § 13400 et seq.) mean-ingful use requirements (42 C.F.R. § 495.4) are likely to reshape the market.

Finally, Bruce H. Seidberg, DDS, MScD, JD, FCLM, will again host the dental program, which will run concurrently with the main program.

In addition to these fine presentations, the 53rd Annual Meeting will also contain several traditional sessions including: the annual Cyril Wecht Luncheon, the Professional Development Luncheon, the Annual Wom-en’s Leadership Breakfast and the poster presentation session. Per-haps most importantly, the College will again host two receptions on Friday and Saturday evening, which will provide valuable networking opportunities.

EDUCATIONAL NEEDSMedical practice is controlled by complex legislation, administrative rules and regulations, and Federal/State court decisions interpreting those laws. The day-to-day practice schedule of the typical physician does not allow them the opportunity to maintain a working knowledge of these de-velopments. Nor do typical physicians have the luxury of time to analyze new trends that will change, effect, or streamline their medical practice. This meeting will provide reporting of new legislation, rules and court de-cisions, societal changes and shifts in the market place that will impact the practice of medicine.

Key changes impacting the practice of medicine during the past one to two years include: Infrastructural changes that will lead to market consoli-dation at both the hospital and provider levels, the impact of technology including Electronic Medical Records (EMRs) on the practice of medi-cine; State imposed ethics requirements as part of the continuing edu-cation process; physicians seeking non-traditional employment; medical malpractice; the outsourcing of healthcare services, climate change’s im-pact on communicable diseases; and social networking’s impact on the practice of medicine.

OBJECTIVES The 53rd Annual Conference of the American College of Legal Medicine will focus on a diverse range of current legal medicine topics. By the conclusion of this meeting, participants should be able to:

1. Describe recent legislative and court opinions2. Recognize why the market for physicians’ services is be-

coming extremely hostile3. Assess Medical Technology and the ability of EMRs to

DENTAL NEEDS The overall program developed for the 5th Annual Conference on Ethics and Legal Aspects of Dentistry is designed to educate the dental and medical communities about current issues that involve scientific aspects of dentistry as well as access to care. All aspects of the program ulti-mately relate to the art and science of dental practice.
