Proclamation

Point Pleasant Boro American Legion Ocean County Baseball Champions WHEREAS, for the first time since 1994, the Point Pleasant Boro American Legion

Baseball team won the Ocean County tournament this summer; and WHEREAS, Point Boro defeated Mystic Island Post 493 (Pinelands) in the

American Legion Ocean County doubleheader championship Friday, July 31, 2015 by the scores of 6 to 4 and 3 to 0; and

WHEREAS, Point Boro finished first in the regular season and had to successfully

navigate their way through the double-elimination tournament; and WHEREAS, the team, consisting of Sebastian Severio, Ryan Sansone, Tim Rossi,

Justin Rafi, Mark Leyble, John Duggan, Damon Del Priore, Thomas Paul, Kyle Lauria, Josiah Gliddon, Ethan Cannon, Chris Brower, Mike Falconetti, Frank Hulse, Frank Graziano, Ryan Carne, John Sullivan and Bill Feehan overcame every challenge; and

WHEREAS, recognition of this success also provides an opportunity to thank Head

Coach David Drew and assistants for the many valuable contributions they provide to the youth of our community; and

NOW, THEREFORE, I, Mayor Robert A. Sabosik, of the Borough of Point Pleasant,

County of Ocean, State of New Jersey, and on behalf of the entire Borough Council and all of our citizens, do hereby extend this expression of our pride in each of the members of the Point Pleasant Boro American Legion Baseball Team for winning the 2015 Ocean County Championship and hereby declare August 28, 2015 to be Point Pleasant Boro Baseball Day in the Borough of Point Pleasant.

MOTION: Adopt Resolution authorizing Mayor and Council to retire into Executive Session

WHEREAS, Mayor and Council are desirous of retiring into Executive Session to discuss applicable exceptions to the N.J. Open Public Meetings Act; and WHEREAS, those matters relate to the following:

1. Personnel Matters 2. Budget Items

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Point Pleasant, County of Ocean, State of New Jersey, as follows:

1. That the Mayor and Council shall retire into Executive Session to discuss the Aforesaid matters; and 2. That minutes shall be taken; and 3. That the matters to be discussed will be in all likelihood be known to the

Public when and if the necessity for confidentiality no longer exists; and 4. That at the conclusion thereof, the meeting shall again be opened to the

public.

RETURN FROM EXECUTIVE SESSION Mr. Dasti: In closed session we went over some budget items and with personnel council has concluded the interview process and there will be a few add-ons on the agenda tonight. Resolution 252-2015 will be appointing Mr. Frank Pannucci as the new Borough Administrator until December 31, 2015 and Resolution 253-2015 will be appointing Antoinette Jones as the Borough Clerk effective September 1, 2015 and she is in the audience tonight.

Mayor Sabosik has Antoinette Jones stand and welcomes her to the town of Point Pleasant. Mayor Sabosik: And I want to thank one person on this dais who has really helped this team and this mayor and council. She was thrust into this role of clerk rather abruptly, coming to every meeting. And I just want to thank her personally for all of her dedication and hard work and her ability to lead all of us for the last 5 months. So, Veronica Thwing, thank you. Frank Pannucci also stepped into the breach. I would like to thank him also. He will be appointed till December 31st. He has done an admirable job since March 23rd. We are rebuilding the structure of the administration of this town for the betterment of its citizens. We are here to serve you because we are you. We are your neighbors. You have elected us to do the best job possible and that is what we will continue to do. So thank you. B. WORKSHOP 1. Committee Reports Mrs. Snyder: The borough recently received from the department of transportation some applications for various grants for the year 2016. They include roadway reconstruction including new curbs and sidewalks. Another grant is a bikeway application. These applications are due no later than October 20th 2015. We have a new user friendly website up and running. As a reminder you can pay your property taxes as well as your water sewer charges on the website. And as of today, our minutes are completely up to date. Again, I would like to thank Veronica for all of her very hard, diligent work in getting all of those past minutes done and getting us all up to date on our minutes. Mr. Wisniewski: Would like to thank everyone in the Finance Department. The comments in the audit report are at an all-time low. Our CFO is here tonight and he has submitted to me the corrective action plan which normally in the past years have taken months and months. Second, we had a finance meeting last week and we are changing payroll companies which will save the borough a lot of money. It shouldn’t affect the employees at all. We talked about the budget. And the budget sheets should be given to all the department heads in September. Hopefully they are already preparing their budgets for next year. We are going to get a head start on that. Normally we are having meetings in July talking about it, hopefully in 2016 we will be done much sooner than that. We talked about digitizing our records. We are making great strides in technology in the Borough the past few years. Open Space Committee is looking to purchase a display cabinet for the front of Borough

Hall to display some historical items. We are working with the Mayor to get that in place. We are working on updating the ordinance for the Curtis Avenue Boat Ramp and finally, at the last meeting, we talked about the white lawn cleanup project. We all thought better of having the cleanup this month due to the hot weather so we are going to wait until the weather is a little bit cooler, Mr. Furmato: Wants to thank the Rec Department. They have done such a great job with all the programs and events. Karen thank you for putting all of that together. The skate park has been a great success. There have been no problems there. There are young adults there taking charge making sure the place is clean. There are even a few 40 year olds skating. Everything is good there and it will be a good program in the fall when we finalize what we will do there. We also have programs in the fall. We will have a couple movies in the park and Haunts in the Park which will be on mischief night. Mr. Thulen: Wants to say congratulations to the baseball team. As far as the Construction and Zoning committee, today we have one of our last changes to the fee structure that we had. Our construction official and our council committee has really brought that department up to speed. So now they have all the tools that they need for the town. Mr. Borowsky: August 1, we had a meeting with our JIF. Myself, Frank Pannucci, Bob Forsyth and Mike Avalon from the Joint Insurance Fund. Some of the things discussed were the field that we are trying to use for sports over on Arnold Avenue and the skate park and some of the repairs we are trying to do over there. We took a ride over there after our meeting and everyone was wearing their helmets and everything was good over there. I was happy to see that. I talked to the chief today and there has been minimal calls to the skate park. Everybody’s happy. There was a DPW meeting on August 3. In attendance was Mike Pizzi and Jude Walker and Bob Forsyth from Public Works. From RVV, John LeCompte and Felipe Contrares. From Mayor and Council, it was Councilman Wisniewski, Mayor Sabosik, Frank Pannucci and Myself. Some of the things that were discussed were the rebid to the area on Hardenberg, the painting of the memorial drive elevated tank that is going to be a spring project, Bradley Road/Meadow Point sewage pumping stations which is complete now. Dorsett Dock was discussed. There was a preconstruction meeting on August 12 regarding that project. Should take about a month. The new vehicle storage building, the bids will be opened on the 27th. The Bay Avenue road project which is complete but there is going to be a bicycle path put on the road now. The handicap accessibility to the DPW building, Gavin Construction got that award. The auction that was just finished a week and a half ago, we raised about $20,000 on some of our old equipment. Our schedule C which is the county roads project for 2014. That is going to start on August 24th. The following streets will be getting overlay: Hollywood Blvd from Foster to Patterson. Kilkare Pkwy from Patterson to Brooks Road. Nellie Drive, Brooks Road, North Road from Patterson to Brooks Road, High Court and Harrington Court. There has also been a couple meetings in the past few weeks between our DPW and other town DPW’s regarding some shared services from some of our equipment. Our DPW has some nice equipment which is very efficient for running a town and these other towns see this and want to know how they can possibly get into a shared services agreement with us to utilize that and they cannot afford these pieces of equipment themselves and it would be wise for us to explore this because it would help us pay for it and be less of a burden on our tax payers. Congratulations to the two police officers who got promoted. Congratulations to the baseball team. And lastly, I would like to say that my son was fishing at the Riverfront Park today by the new condos and he saw a manatee swim by. So take a ride down there and see something that you don’t get to see in our waters too often. Ms. DePaola: This summer we have been very active in seeing that the activities we offer to our residents keep up with the pace and growth of the residents in the borough. One of the events was sponsored by the community watch organization which was our national night out against crime. It was a great success. We showcased all of our volunteer services here in the borough. It was a great event for families. I would like to thank Karen Haycook, our director of Recreation for putting together a program for the senior population. For the first time we are going to be offering our seniors chair yoga, aerobics, senior step and a senior day here at the

borough. So with these activities moving forward we hope to serve all of our residents to meet there needs. I also would like to extend my congratulations to the new Police Lieutenant and Police Captain. They are an asset to our police department. With our Community Watch organization our next event will be coming up in October where we will have another trick or trunk event and then in December a toy drive again. And finally on Saturday, Mayor Sabosik and I were invited to attend a stop FEMA now event. Which was sponsored by the Stop FEMA now group. At that event, there was information available to residents who were affected by sandy. Sandy happened 3 years ago and we still have residents who have not been able to rebuild. So the point of the meeting was to get people together to let them know what is still available to help them. (Council President DePaola reads aloud all the dates of upcoming meetings and telephone helpline phone numbers) 2. Report of Mayor Mayor Sabosik: I received a letter from the ocean county library and I am happy to report that our town is #7 in the whole county for circulation. Libraries are an asset to help your children and grandchildren grow up and foster their intelligence. Go get a library card. They have great programs and great staff. Clean Ocean Action – they are the people who started years ago to keep our beaches clean. The next beach sweep will be on October 24 from 9-12:30. Information will be on our website. Lastly, Mayor Pete Marone passed away on 8/15 of this year. He was the Mayor of our town from 1979 to 1982. I kid when I say that being a Mayor is an hour a week. It really isn’t. It takes a very hard working individual. I knew Pete for a long time, he did a great job and I hope that you all can keep him in your prayers. He was a fine individual and he was a great Mayor. E. PRESENTATION – Holman & Frenia Annual Audit

Matt Holman presents the annual audit for the Borough of Point Pleasant. F. ORDINANCE – Final Reading, Public Hearing

1. Amending and Supplementing Chapter VII of the Borough Code Entitled “Traffic” in Particular Section 7-17, “Street Closings for Block Parties”

ORDINANCE NO. 2015-

ORDINANCE OF THE BOROUGH COUNCIL OF THE BOROUGH OF POINT PLEASANT, COUNTY OF OCEAN, STATE OF NEW JERSEY AMENDING AND SUPPLEMENTING CHAPTER VII OF THE BOROUGH CODE ENTITLED, “TRAFFIC”, IN PARTICULAR SECTION 7-17, “STREET CLOSINGS FOR BLOCK PARTIES”

BE IT ORDAINED by the Borough Council of the Borough of Point Pleasant, County of

Ocean, State of New Jersey (the “Borough”) that Chapter VII of the revised General Ordinances

of the Borough of Point Pleasant (entitled “Traffic”) be amended and supplemented to include

revisions and modifications, in particular Section 7-17 (“Street Closings for Block Parties”), to

modify the procedure governing applications for street closings for Block parties.

SECTION 1. Section 7-17.6 Issuance of Permit shall be modified to reflect the

following:

The Borough Clerk, upon receipt of any such application, shall submit a copy thereof to the Chief of Police of the Borough of Point Pleasant and shall provide a copy of same to each member of Council and the Mayor. The Chief of Police shall be given seven (7) days to comment upon such application, including the opinion of the Chief of Police and/or his designee as to whether or not it is in the best interest of the municipality to permit such a block party to take place and his reasons therefore. The Borough Administrator of the Borough of Point Pleasant shall determine whether or

not to issue a permit based upon the application submitted and any comments provided to it by the Chief of Police or his designee. The Borough Administrator shall have the discretion to grant the application and issue the permit, deny the application or to grant the application with any and all reasonable and necessary conditions it deems appropriate.

SECTION 2. Section 7-17.7 Notice of Reasons for Denial shall be modified to reflect

the following:

If the Borough Administrator disapproves of the application, the Borough Administrator shall notify the applicant of his decision. In the event of a denial, the applicant is permitted to file an appeal with the Borough Council for review and consideration.

SECTION 3. Section 7-17.8 Notice to Permits to Township Officials is amended and

supplemented to include new “Paragraph E” to read:

E. Chief of Police.

SECTION 4. All other Ordinances or provisions of the Code of the Borough of Point

Pleasant, or parts thereof, which are inconsistent with any provisions of this Ordinance are hereby

repealed to the extent of such conflict or inconsistency.

SECTION 5. If any section or provision hereof shall be adjudged invalid, such

determination shall not affect the other section or provision hereof, which shall remain in full force

and effect.

SECTION 6. This Ordinance shall take effect twenty (20) days after adoption and after

publication as provided by Law.

NOTICE IS HEREBY GIVEN that the foregoing Ordinance was introduced and passed

by the Borough Council of the Borough of Point Pleasant Borough on first reading at a meeting

held on the _21st_ day of July, 2015 at 7:00 p.m. The Ordinance will be considered for second

ORDINANCE OF THE BOROUGH COUNCIL OF THE BOROUGH OF POINT PLEASANT BOROUGH, COUNTY OF OCEAN, STATE OF NEW JERSEY, AUTHORIZING THE SALE/ASSIGNMENT OF LEASES WITH CELLULAR TELEPHONE COMPANIES, PRESENTLY LOCATED ON THE BOROUGH CELL TOWER AT BLOCK 349, LOT 5, POINT PLEASANT, NEW JERSEY TO BLACK DOT CAPITAL AND REAL ESTATE GROUP FOR AND IN CONSIDERATION OF $1,590,755.69.

WHEREAS, the Borough Council of the Borough of Point Pleasant Borough, County of

Ocean, State of New Jersey (hereinafter referred to as the “Borough”) has solicited bids for the

sale/assignment of cellular telephone leases located on the Borough Cell Tower, Block 349, Lot

5, Point Pleasant, New Jersey (hereinafter referred to as the “property”); and

WHEREAS, the solicitations have been undertaken in accordance with the provisions

of N.J.S.A. 40A:12-13 et seq., commonly known as the New Jersey Lands and Building Law; and

WHEREAS, as a result of the bid proposals an acceptable bid has been received from

Black Dot Capital and Real Estate Group in the amount of $1,590,755.69, which the Borough finds

to be acceptable.

NOW, THEREFORE, BE IT ORDAINED by the Borough Council of the Borough of

Point Pleasant Borough, County of Ocean, State New Jersey, as follows:

SECTION 1. The Borough accepts the offer from Black Dot Capital and Real Estate

Group to purchase the five (5) leases with cellular companies for and in consideration of

$1,590.755.69.

SECTION 2. This authorization and sale is in accordance with the provisions of N.J.S.A.

40A:12-13, et seq.

SECTION 3. The Borough authorizes and directs the Mayor, Borough Administrator,

Borough Clerk and Borough Solicitor to execute any and all necessary documents in order to

implement the intent of this Ordinance.

SECTION 4. All other Ordinances or provisions of the Code of the Borough of Point

SABOSIK, Deputy Municipal Clerk Mayor Ms. DePaola: Discussion – explains that the vendor that offered us that amount of money for five separate leases on the tower changed their mind on the terms. They decided that they only want four of the leases. That changes the terms of the agreement so I recommend to the council that we vote no on this. We can authorize to rebid. The company that we are working with on these bids believes that we can make more money on the sale. Andy Prizer: 1107A Beaver Dam Road – Where is this located? And is it a lease or is it a purchase? Mayor Sabosik: it is on the cell tower behind the stop and shop on Bridge Avenue. Mr. Dasti: The town is going to transfer its leases to the purchaser. Mayor Sabosik: We would basically be getting about 18-20 years rent ahead of time. We feel with the changing technology, it is better to be prudent. We are only selling the lease.

ORDINANCE OF THE BOROUGH OF POINT PLEASANT BOROUGH, COUNTY OF OCEAN, STATE OF NEW JERSEY AMENDING AND SUPPLEMENTING CHAPTER VIII OF THE BOROUGH CODE, ENTITLED, “BUILDING AND HOUSING”

NOW THEREFORE, BE IT ORDAINED BY the Borough Council of the Borough of

Point Pleasant Borough, County of Ocean, State of New Jersey, that Chapter VIII of the Borough

Code entitled “Building and Housing” in particular Subsection 8-1.2 “Fees” is hereby amended

and supplemented as follows:

SECTION 1. Subsection 8-1.2. Fees.

a. Fees for construction permits.

The building subcode fees shall be as follows:

For new construction: All fees shall be based on the volume of the structure and volume computations shall be made pursuant to N.J.A.C. 5:23-2.28. Use groups and types of construction are to be classified and defined as established in Articles 3 and 4 of the Building Subcode.

(1) New residential construction, alteration, or renovation:

Per cubic foot of volume $ 00.030 Minimum fee $ 75.00

(2) New construction all other use groups:

Per cubic foot of volume $ 00.030 Minimum fee $ 100.00

(ii) Large, open volume structures such as barns, silos, greenhouses, warehouses and similar structures $ 00.015

SECTION 4. This Ordinance shall take effect upon publication in an official newspaper

of the Borough, as required by and in conformance with law.

WHEREAS, the Chief of Police has requested that the Borough advertise bids for the purchase of Uniforms for the Police Department for the years 2015 and 2016; and,

WHEREAS, the Chief of Police has prepared and reviewed bid specifications for said

equipment and uniforms; and, WHEREAS, the Mayor and Council have approved said specifications and have

determined that they will advertise for sealed bids for Uniforms for the Police Department; and,

8. It is the sole responsibility of each bidder to see that bids are submitted on date and time

specified, and IN NO EVENT SHALL ANY BID BE CONSIDERED OR ACCEPTED AFTER THE DATE AND TIME SO SPECIFIED FOR RECEIPT OF BIDS. In the event that a bidder does not personally deliver the sealed bid on the date and time specified for receipt of bids, such bidder shall assume all risks of loss and misplacement of sealed bid by Municipal Officials or any other risk related to the failure of the bidder to personally deliver the bid.

9. The bid quote shall be net to the Borough of Point Pleasant and shall be exclusive of any

State or Federal taxes. Each and every deviation from the Specifications shall be clearly listed by bidder. Failure to comply with these requirements shall be grounds for rejection of the bid.

10. Each bid must be accompanied by a bid bond, certified check, or cashiers check payable

to the Borough of Point Pleasant for not less than ten percent (10%) of the amount of the bid, but not in excess of $20,000.00, and shall be delivered at the place and time specified above. This requirement will not be waived.

11. A contract will be awarded to the lowest responsible bidder. The Borough reserves the

right to reject any and all bids. The Borough Council reserves the right to waive insubstantial irregularities in any bid.

exclusive of any State or Federal taxes. Each and every deviation from the specifications shall be clearly listed by the bidder. Failure to comply with this requirement shall be ground for rejection of the bid.

8. Each bid must be accompanied by a bid bond, certified check or cashier’s check

payable to the Borough of Point Pleasant for not less than ten percent (10%) of the amount bid, but not in excess of $20,000.00 and shall be delivered at the place and time specified above. This requirement will not be waived.

9. A contract will be awarded to the lowest responsible bidder. The Borough

reserves the right to reject any and all bids.

10. A non-collusive affidavit in the usual form will be supplied with the specifications and shall be executed by the person or corporate officer submitting the bid. Said affidavit must accompany each bid. These requirements will not be waived.

11. Bidders are required to comply with the requirements of P.L. 1977, Chapter 33,

by submitting a list of the names and addresses of all stockholders and owners holding ten percent (10%) or more of the stock or owning a ten percent (10% or greater interest therein.) 24. (246-2015) Authorize Re-Advertisement of Public Auction of One (1) Retail Plenary Consumption License

WHEREAS, a municipality is permitted to issue new plenary retail consumption licenses in ratio to a municipality’s population; and,

WHEREAS, in accordance with the information from the 2010 federal census counts, the

Borough of Point Pleasant has a population of 18,392; and, WHEREAS, in light of such census information, the Borough of Point Pleasant is permitted

to issue one (1) plenary retail consumption license; and, WHEREAS, the Mayor and Borough Council, having considered the same, desire to

authorize the creation and issuance of one (1) plenary retail consumption license; and,

WHEREAS, pursuant to N.J.S.A. 33:1-19.3, it is the desire of the Borough to accept bids for the aforesaid new license as provided by law; and, NOW, THEREFORE, BE IT RESOLVED, this 21st day of July 2015, by the Borough Council of the Borough of Point Pleasant Borough, County of Ocean, State of New Jersey, as follows:

1. The Borough hereby determines that it will sell at public sale one plenary retail consumption license for the sale of alcoholic beverages in accordance with the procedures set forth in N.J.S.A. 33:1-19-3., et seq.

2. The Borough Administrator/Clerk shall publish a notice of the proposed

issuance of the aforesaid alcoholic beverage license indicating that applications therefore will be accepted by the Borough Council at the time, date and place specified in the notice, after which no further applications will be accepted.

3. Said notice shall be published in a newspaper circulating generally in

the municipality at least two times, at least one week apart, the second of which shall be at least 30 days prior to the date of sale.

4. The minimum acceptable bid for this new plenary retail consumption license

shall be $300,000. The public notice shall be published in an official newspaper of the Borough. All bidders shall submit in cash or certified check ten percent (10%) of the amount of the bid, submit to the Borough cash or certified check for the balance of the bid which shall be paid into the general fund of the Borough, subject to refund if the license cannot be issued to the bidder.

5. The plenary consumption license shall not be located less than 1,000 feet from

any retail liquor store. 6. The license will be awarded to the highest qualified bidder. The actual location

of the license will be determined through the normal licensing process that takes place after the highest bid is accepted. The Governing Body reserves the right to reject any and all bids where the highest bid is not accepted.

RESOLUTION OF THE BOROUGH COUNCIL OF THE BOROUGH OF POINT PLEASANT, COUNTY OF OCEAN, STATE OF NEW JERSEY, APPOINTING FRANK PANNUCCI, JR. AS BOROUGH ADMINISTRATOR.

WHEREAS, the Borough Council of the Borough of Point Pleasant, County of Ocean,

State of New Jersey (hereinafter referred to as the “Borough”) is in need to appoint a Borough

Administrator; and

WHEREAS, Frank Pannucci, Jr. has been performing the duties as Acting Borough

Administrator since March 19, 2015; and

WHEREAS, the Borough has been extremely satisfied with the job performance of Frank

Pannucci, Jr. in his role as Acting Borough Administrator; and

WHEREAS, the Borough has solicited applications for the position of Borough

Administrator; and

WHEREAS, the Borough has received and reviewed all resumes and applications from

individuals that applied for the position of Borough Administrator; and

WHEREAS, after careful consideration of all of the applicants, the Borough has

determined to appoint Frank Pannucci, Jr. as the full-time Borough Administrator for Point
