The Committee suggested to prepare Data Bank for the teachers. 7. The institution needs to install Fire Safety equipment and submit the Fire Safety Certificate if not submitted earlier. 8. The cutoff date for granting/refusal of recognition for the session 2017-18 was 3 rd March, 2017 and now Hon’ble Supreme Court of India extended the time for getting recognition/refusal up to 2 nd May, 2017, hence, the institution may submit the compliance on the basis of proceedings uploaded in the ERC NCTE website.

The 239th Meeting of the Eastern Regional Committee (ERC), National Council for Teacher Education

(NCTE) was convened on 28th

April – 2nd

May, 2017 at Conference Hall, ERC, NCTE, 15, Neelakantha Nagar,

Nayapalli, Bhubaneswar. The Chairperson, Members and Convener as listed below were present at the time of

the 239th ERC Meeting.

At the outset, the Regional Director welcomed all the members of Committee and apprised them about

the provisions of the NCTE Act, Rules, Regulations and Guidelines issued from time to time. With the

permission of Chairperson, Shri Pradeep Kumar Yadav (Convener) presented the Agenda before the Committee

for its due consideration and appropriate decision.

ATTENTION!

1. The committee unanimously decided that the institution may reply in

response to the decision of the committee uploaded on the ERC website

without waiting for formal letters from the office of ERC. The replies so

received will also be considered by the committee.

2. The Endowment Fund / Reserve Fund (5 Lakhs + 7 Lakhs) is 12 Lakhs per

programme. (See ERC website: www.ercncte.org for detail).

3. The institution needs to submit list of 10 schools for internship and school

based activities duly approved by District Education Officer.

4. Institutions must give the affidavit for consent / willingness for number of

units either one or two if it was not submitted earlier.

5. As per provisions u/s 17(4) of the NCTE Act, 1993, if an institution offers

any course or training in Teacher Education without obtaining recognition

or permission under this Act, the qualification in teacher education obtained

pursuant to such course or training or after undertaking a course or training

in such institution, shall not be treated as a valid qualification for purposes

of employment under the Central Government, any State Government or

University, or in any school, college or other educational body aided by the

Central Government or any State Government.

6. The Committee suggested to prepare Data Bank for the teachers.

7. The institution needs to install Fire Safety equipment and submit

the Fire Safety Certificate if not submitted earlier.

8. The cutoff date for granting/refusal of recognition for the session

2017-18 was 3rd

March, 2017 and now Hon’ble Supreme Court of India

extended the time for getting recognition/refusal up to 2nd

May, 2017,

hence, the institution may submit the compliance on the basis of

proceedings uploaded in the ERC NCTE website.

ER-239.3 Circular / Guidelines received from NCTE Hqrs.

1. 239.3.1

Decision o f the General Body of NCTE in its 46th

Meeting held on 28th March 2017

in the matter of relaxation of land requirement for new TEIs in Hilly,

Metropolitan/Urban areas (File No. F.3-17/NCTE/ERC/REG./2017)

The NCTE Hqrs. vide its letter No. F. NCTE-CDN011(11)/1/2017-MS(NCTE)-HQ dated 12.04.2017 has

conveyed the decision of the General Body of the NCTE in its 46th meeting held on 28

th March, 2017 in the

matter of relaxing the land requirement i.e. flxibility in requirement of land for new TEIs in Hilly,

Metropolitan/Urban areas and such cases may be placed before the Regional Committee for final recognition,

or refusal thereon, only after Gazette Notification of Regulations in this regard has taken place.

The Committee noted for further compliance.

2. 239.3.2 Compliance of Appellate Orders. (File No. 18-1/NCTE/ERC/Appeal/2017).

The NCTE Hqrs. vide its letter No. 92-08/2016/Corres.ERC/Appeal/52545 dated 13th April, 2017 has

conveyed the decision of Appeal Committtee to refer all 16 cases as per list enclosed which have been

forwarded by ERC to the Appeal Committee with requested to re-visit the cases as per decision of the

Appellate Authority as contained in the Appellate Orders pertaining to the institutions.

The Committee noted that it has already considered these 16 cases in its previous meeting and taken decision.

matter in detail and decided as under:

Formal recognition order under clause 7(16) of the NCTE Regulation 2014 for applied D.El.Ed. programme

with an intake 100 (two basic units) from the academic session 2017-18 be issued to the institution.

discussed the matter in detail and decided as under:

Formal recognition order under clause 7(16) of the NCTE Regulation 2014 for applied B.Ed. programme

with an intake 50 (one basic unit) from the academic session 2017-18 be issued to the institution.

5. 239.8.1

Chanakya College of Education, Vill - Tithpukur, Street/Road - NH 34,

After considering and examining the application along with the documents submitted by the institution, the

agenda note, the NCTE Act, the NCTE Regulations 2014 including Norms and Standards, guidelines received

from the NCTE Hqrs. from time to time, the Committee discussed the matter in detail and observed as under:

a. Show cause Notice was issued on 02.03.2017. In response, the institution submitted representation

dated 21.03.2017 without any supporting documents, hence, reply is not satisfactory as per

requirement of SCN. The institution is still deficient on the following grounds:

(i) NOC for the applied B.Ed. course by the affiliating Unviersity issued on 15.07.2015.

The institution is required to submit NOC for the academic session 2017-2018 or duly

(ii) Submitted building plan is not approved by Govt. Engineer/authority.

(iii) Building completion certificate issued from Govt. Engineer/Authority is not submitted.

(iv) Non-encumbrance certificate issued from Land Registering Authority is not submitted.

In view the above, the committee decided as under:

The institution be directed to submit the compliance on or before 2nd

May, 2017 as the cut of date for

granting/refusal of recognition for the session 2017-2018 is 2nd

May, 2017.

Show Cause Notice be issued to the institution as to why the application applied for recognition be not refused

on the above points. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE

Act 1993 to the institution to submit its reply within the stipulated time as mentioned above before the

Committee takes final decision.

6. 239.8.2

Tata Institute of Social Sciences, Vill - Guwahati, Street/Road - 14-A, Bhuban Road,

After considering and examining the application along with the documents submitted by the institution, the

agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received

from the NCTE Hqrs. from time to time, the Committee discussed the matter in detail and observed as under:

(i) The institution has not submitted consolidated blue print of building plan demarcating the teacher

education programme and mentioning the details of plot number, total land area, total built up area

etc. duly approved by Govt. Engineer.

(ii) Building completion certificate duly approved by Govt. Engineer/Authority is not submitted.

In view the above, the committee decided as under:

The institution be directed to submit the compliance on or before 2nd

agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received

from the NCTE Hqrs. from time to time, the Committee discussed the matter in detail and observed as under:

b. In response, the institution submitted reply vide letter dated 28.03.2017 with copy of No Objection

Certificate issued by Director, Directorate of Primary Education, Jharkhand, Ranchi on 09.08.2016

i.e. after 15th July, 2016 as per Regulation, 2014 which is not accepted by the Committee.

In view the above, the Committee decided as under:

The committee is of the opinion that application bearing No. ERCAPP201646386 of the institution regarding

recognition of D.El.Ed. Programme is hereby refused under section 14(3)(b) of NCTE Act 1993.

agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received

from the NCTE Hqrs. from time to time and VTR, the Committee discussed the matter in detail and decided as

under:

Letter of Intent under clause 7(13) of NCTE Regulation 2014 be issued to the institution. The institution which

is already recognized for B.Ed./D.El.Ed course(s) and sought recognition/permission for additional

course/additional intake are required to furnish the previous faculty list along with compliance of the Letter of

Intent.

The institution be asked to submit the FDRs of Rs.5.00 and Rs. 7.00 lakh towards endowment fund and

reserve fund in the joint name of RD, ERC, NCTE and institution with the reply of letter of intent.

11. 239.2.1

After considering and examining the application along with the documents submitted by the institution, the

agenda note, the NCTE Act., the NCTE Regulations 2014 including Norms and Standards, guidelines received

from the NCTE Hqrs. from time to time and Order dated 13.04.2017 passed by Hon’ble High Court of Patna

in CWJC No. 11749 of 2016, the Committee discussed the matter in detail and decided as under:

VT be constituted.

The institution is directed to submit LOI from NAAC to the VT Members during inspection.

12. 239.2.2

Bhagawan Prasad Sheonath Prasad B.Ed College, Plot No. 336 to 945, Street No –

Ptana Road, Vill- Kera, P.o-Bhakharuan More, Daud Nagar, Tehsil /Taluka, Tehsil-

DaudNagar, Town City-DaudNagar, Dist-Auraganbad, Bihar-824113 (B.Ed.-

Additional Intake) (Private) (ERCAPP3478)

The institution was granted recognition for B.Ed. course with an additional intake 50 (existing 100 intake +

additional 50 intake), thus making the total intake of 150 (one hundred fifty) vide Order No. 46318 dated

02.05.2016 from the academic session 2016-2017 as decided in 213th ERC Meeting.

The institution, being aggrieved with the decision of ERC, filed Writ Petition bearing No. W.P.(C) No. 8762

of 2016 before the Hon’ble High Court of Orissa and the same matter was placed in 225th ERC Meeting held

on 16-18 November, 2016. The Committee decided that the prayer of the Petitioner to accord revised

recognition for the required another one unit is not at all possible at present as the cut of date for grant of

recognition is over for the session 2016-2017 and in no circumstances, the same can be taken for

consideration. As such the application of the petitioner for grant of recognition/permission for another one unit

stands disposed of and it is open for the applicant to make afresh application as per NCTE Regulation, 2014

for the next academic session for consideration.

The institution has submitted representation dated 25.04.2017 along with D.D. of Rs. 1,50,000/- and a copy of

the Order passed in Writ Petition bearing W.P. No. 22417(w) of 2016 by the Hon’ble High Court of Orissa.

The Hon’ble High Court disposed of the matter on 17.04.2017 with a direction interalia:

“We dispose of this writ petition with the direction that although the time for filing of the application for the academic session 2017-18 has already expired, but in case the said application, along with requisite

fees and necessary documents, is filed by the petitioner with the opposite party No. 1-NCTE along with

certified copy of this order on or before 25.04.2017, the same shall be treated as fresh application filed within time, and shall be decided on its own merit and necessary orders for intake of students in the

institution of the petitioner for the academic session 2017-18 shall be passed in accordance with Law.”

In view of the above, the Committee decided as under:

In addition to 150 intake already granted up till academic session 2016-2017 earlier, the Committee decided

that formal recognition Order under clause 7(16) of the NCTE Regulation, 2014 for applied B.Ed. programme

with another 50 intake from the session 2017-2018 be issued to the institution, thus making the sum total

grant of 200 intake.

13. 239.2.3

Vidya College of Professional Studies, Plot No. 410 & 411, Vill.- Rasulpur Varuna,

PO. - Chipura, Tehsil/Taluka- Sampatchak, Town/City-Patna, Dist.- Patna, Bihar-

804453 (D.El.Ed.-Addl. Course) (Bihar School Examination Board) (ERCAPP3171)

The institution was granted recognition for D.El.Ed. course with an intake 50 (One basic unit) vide Order No.

44316 dated 03.03.2016 from the academic session 2016-2017 as decided in 207th ERC Meeting.

The institution, being aggrieved with the decision of ERC, filed Writ Petition bearing No. W.P.(C) No. 9124

of 2016 before the Hon’ble High Court of Orissa and the same matter was placed in 225th ERC Meeting held

on 16-18 November, 2016. The Committee decided that the prayer of the Petitioner to accord revised

recognition for the required another one unit is not at all possible at present as the cut of date for grant of

recognition is over for the session 2016-2017 and in no circumstances, the same can be taken for

consideration. As such the application of the petitioner for grant of recognition/permission for another one unit

stands disposed of and it is open for the applicant to make afresh application as per NCTE Regulation, 2014

for the next academic session for consideration.

The institution has submitted representation dated 25.04.2017 along with D.D. of Rs. 1,50,000/- and a copy of

the Order passed in Writ Petition bearing W.P. No. 22418(w) of 2016 by the Hon’ble High Court of Orissa.

The Hon’ble High Court disposed of the matter on 18.04.2017 with a direction interalia:

In view of the above, the Committee decided as under:

The Appellate Authority vide Order No. 89-840/2016 Appeal/6th Meeting-2017 dated 18.04.2017 remanded

back the case to ERC for suitably modifying the impugned recognition order dated 02.05.2016 on the

submission of the additional list of faculty by the appellant institution.

The ERC re-viewed the matter in accordance with the appeal order and decided as under:-

The institution was granted recognition for B.Ed. course with an additional intake 50 (existing 100 intake +

additional 50 intake), thus making the total intake of 150 (one hundred fifty) vide Order No. 46337 dated

02.05.2016 from the academic session 2016-2017 as decided in 213th ERC Meeting.

The institution, being aggrieved with the decision of ERC, filed Writ Petition bearing No. W.P.(C) No. 5564

of 2016 before the Hon’ble High Court of Delhi and the same matter was placed in 225th ERC Meeting held

on 16-18 November, 2016. The Committee decided that the prayer of the Petitioner to accord revised

recognition for the required another one unit is not at all possible at present as the cut of date for grant of

recognition is over for the session 2016-2017 and in no circumstances, the same can be taken for

consideration. As such the application of the petitioner for grant of recognition for another one unit stands

disposed of and it is open for the applicant to make afresh application as per NCTE Regulation, 2014 for the

next academic session for consideration.

The institution preferred an appeal to the NCTE Hqrs. against the ERC’s order dated 02.05.2016.

The Appellate Authority vide Order No. 89-98/2017 Appeal/6th Meeting-2017 dated 18.04.2017 remanded

back the case to ERC for granting recognition for two additional units of B.Ed. programme instead of one

additional unit. Appellant is required to submit the list of two faculty members (one each in Math and

Science) to ERC within 15 days of the issue of appeal order. In compliance of Appeal Order, the institution

submitted reply vide letter dated 20.04.2017 along with requisite list of faculty approved by the concerned

affiliating body.

The ERC re-viewed the matter in accordance with the appeal order and decided as under:-

In addition to 150 intake already granted up till academic session 2016-2017 earlier, the Committee decided

that formal recognition Order under clause 7(16) of the NCTE Regulation, 2014 for applied B.Ed. programme

Committee vide order dated 15.01.2016, Inspection was conducted on 11.05.2016. Show Cause Notice was

issued on 26.08.2016 as decided in 220th ERC Meeting. The reply received from the institution was considered

Being aggrieved with the decision of ERC, the institution preferred an appeal to the NCTE Hqrs.

The Appellate Authority vide Order No. 89-758/2016 Appeal/4th Meeting-2017/52431 dated 07.04.2017

remanded back the case to ERC with a direction to consider the submissions of the appellant and issue

appropriate order as per the NCTE Regulations. The appellant is directed to submit all the relevant documents

in this regard to the ERC within 15 days of receipt of the order on the appeal.

The ERC re-viewed the matter in accordance with the appeal order and observed as under:-

(i) The institution is required to submit the land transfer certificate in the name of institution duly signed

by the competent Govt. authority.

(ii) Building completion certificate in the name of institution duly signed by the Govt. Engineer/Authority

nd May, 2017 as the cut of date for

granting/refusal of recognition for the session 2017-2018 is 2nd

May, 2017.

Show Cause Notice be issued to the institution as to why the application applied for recognition be not refused

on the above points. The Committee therefore, provides last opportunity under section 14(3)(b) of the NCTE

Act 1993 to the institution to submit its reply within the stipulated time as mentioned above before the

Committee takes final decision.
