    Cap . 58 "th e ordinance" means the Prisons ordinance repealed by section 105;

    "prison" means a prison established or deemed to have been established

    under section 23;

    "prison officer" means any member of the Tanganyika Prisons Service

    of what ever rank;

    "prisoner" me an s any per son , wheth er convicted or not, unde r detenti on

    in any prison;

    PART n

    CONSTITUTION AND ADMINISTRATION OF THE SERVICE

    3-.(l)The Tanganyika Prisons Service shall consist of the membeEfopositionofthe Service app ointed or de em ed to have be en appointed undejibMceAct.

    (2) The Service shall con sis t of suc h ranks of seni or and s ubor dina tepri son officers as t he Min ister ma y, by noti ce in the Gazette, specify,and prison, officers shall have seniority as so specified.4.-(I) Wh en ev er i t is ne ce ss ar y for the safe custo dy of p ri s o n e rs T i n i p o r a r yany prison or hospital or being transported from one prison to anolfeejnor for any other purpose the Commissioner or, subject to the appKxfisaikof the Co mmi ssi one r, an officer-in-charge of a prison may appoin t so

    ma ny f i t an d pro per pe rso ns as ma y be de em ed ex ped ien t to ac t astemporary prison officers, upon such conditions as may be prescribed.

    (2) Every temporary prison officer shall, while so acting, be vestedwith the same powers, functions and responsibilities, perform the samedutie s an d be su bje ct to the s a me discipline and authority as a pris onofficer.

    (3) Wh ere in any priso n the n um be r of prison officers detaile d fordu t y t he r e i n i s i nsu f f ic i en t t o s ec ur e t he goo d m a n a g e m e n t an dadmin istra tion thereof, it shall be lawful for the officer-in-charge of su chpr i son, with the co ns en t of t he Ins pe cto r -G en era l of Pol ice or h i srep res ent ati ve, to emplo y temporarily su ch nu mb er of police officersas he m ay con sid er ne ce ss ar y to perform the d uties of prison officers insuch prison.

    (4) Every police officer appointed in pu rsu anc e of subsect ion (3) shallhav e all the po wer s, functions, and responsibilities and perform in re sp ec tof th e pris on for which he is so ap po in te d all -the du ties of a pri son

    officer of th e c las s to which the officer-in-charge sh all app oin t an d,for the p ur po se s of this Act, shal l be de em ed to be a priso n officer.

    5.-( l) The C om mi ss ion er shall, sub ject to the orde rs a nd directioo&eral

    ofthe President, have the administrative command, superintendeffiSe,control an d direction ofth e pr isons an d prison officers of Tanganyi kaean d, subj ect to this Act and to suc h regulation s as m ay be m ad e fi?g 1re l i S l o n

    under, and to any other wri t ten law, may make such appointments,prom otion s, transfers and reductio ns in ranks and grad es of subord inateofficers as he may see fit.

    (2) The Com mis sio ner may, su bject to, the provisions of this Act andto the or de rs a nd direction s of th e Minister from time to tim e, frameorde rs an d regu latio ns for the o bs er va nc e o f all priso n officers and ma yalso frame orders for the g ene ral gover nme nt of such pe rso ns in relationto their enlistment, discharge, training, arms and accouterments, clothingand equ ipmen t, place of res ide nce , classification and particular serv ices ,as well as their distribution and inspection and may also frame suchoth er ord ers an d reg ula tion s relative to the sa id, prison officers as hemay deem expedient for preventing neglect or abuse, and for renderingsu ch pris on officers efficient in the d is ch ar ge of their duties an d forpromoting discipline.

    Commiss ione r 6. The commissioner shall Periodically visit and inspect, or cause tobe visited and ins pec ted , all prisons within Tang any ika.

    7 . - ( l ) The Depu ty Com mis s io ne r may , on the di rec t ions o f theComm issi oner , exer cise any oft he powe rs or perform any ofth e duties

    ves ted in or ass ign ed to the Com mis sio ner by or un der this Act or anyregulations made thereunder or by or under any other written law.

    (2) The Com missio ner may delegate any ofthe powers ves ted in himby this Act or any regulations made thereunder or, save where a contraryintention appears therein, by any Other written law, to an Assistant

    commissioner.

    8 .-( l) The c ontrol of eve ry priso n shall be v es te d in su ch prisonoff icer as m a y b e app oin ted by the Co mm iss io ne r to be in charg ethereof.

    (2) Every officer-in-charge shall superv ise and cont rol all mat ters inco nn ec t io n with the pris on to which he is ap po in ted , and shal l beresp onsib le to the Co mmi ssi one r for the co ndu ct and treatm ent ofth eprison officers and prisoners under his control and for the due observanceby prison officers an d pris one rs o fth e req uir eme nts of this Act and of theregulations made and instructions and orders issued thereunder.

    (3) Every officer-in-charge s hall be ch ar ge d with the safe c ust odyof ar ms , ac co ut er me nt s , amm uni t ion, c lo thing and a ll o ther publ icsto res an d foodstuffs iss ue d an d deli vere d for the us e of th e prison,the pr iso n officers a nd the pris on ers un de r his con trol an d with allpublic mon ey for which he ma y be held accou nta ble , and also, su bjectto the prov is io ns of th i s Act an d of an y rules m a d e th er eu nd er ,with all va lu ab le s, mo ne y, ar t icles of clothing and ot her pro per ty

    ac co un t for the sa m e in c as e of their bein g lost or d am a g e d otherwise than by unavoidable accident, theft, robbery or lawful use.

    9.-(l) Every prison officer shall exe rci se su ch pow ers an d performsu ch dut ies as are by law conf erre d or im po se d on prison off icersof his ra nk, a nd s hal l ob ey al l lawful direc t ions in r es p ec t of th eex ec ut io n of his office which he m ay from time to time re ce ive fromhis senior officers.

    (2) Every prison officer shall be deemed to be on duty at all timesan d ma y at any time be deta iled for duty in any part of Tan gan yik a.

    10. While in ch arg e of priso ners for the p ur po se of conve ying a nypr iso ne r to or from a prison or for the p ur po se of ap pr eh en di ng an y

    pr i s one r who ma y ha ve e sc a pe d f rom a pr i son, or who ma y hav ees c ap e d while be ing co nv ey ed to or from a priso n, or for the p ur po seo f p r e v e n t i n g t h e r e s c u e o f a n y p r i s o n e r o r f or t h e p u r p o s e

    of preventing an, attack on a prison, every Prison officer shall have allthe powers and privileges of a police officer.

    11. Any prison officer ma y, on rea so nab le suspicio n tha t any pers onis a des ert er, a rre st suc h per so n without a warr ant and shall forthwithtake him before a magistrate.

    12.-(1) Any prison officer ma y examine anything within, or being p O W e r t obrought into or out of, a prison and may stop and search anvyninevehi cle or p e r s on within a pr is on or goi ng into or out of a p r i s iwr eon s o ror, w h e t h e r within or ou ts id e a pr is on, a ny p e r s o n w ho , or^afoiy^svehicle which, is without authority close to a pr isoner if he ha s re as onto suspect that such person or vehicle is carrying a prohibited articleor any property belonging to the Government in use in a prison.

    (2) A sen ior officer on duty in a prison m ay refus e ad mi ss ion tothe prison to any person who is not willing to be searched.

    (3) A senior officer on duty in a prison may order any personwithin a prison who refuses to be searched to leave the prison and,if su ch a per so n refuses to lea ve, may ca us e him to be rem ove d fromthe pris on, a n d for th at pu rp os e ma y u se su c h force as m a y benecessary.

    (4) If on stoppi ng and sea rchin g any vehicle or pe rs on un de r su bsection (1) a prison officer finds any prohibited article or any propertybelo ngi ng to the Go ve rn me nt in us e in a prison he ma y ar res t theper son or the per son in the vehicle who appe ar s to hav e cha rge of thearticle or prop erty an d shal l , as so on as prac tic abl e, c a us e su chpe r son to be ha n d ed ov er to a police officer or, in the a b s e n c e of apolice officer, to be taken to the nearest police station.

    (5) Any se ar ch of a w om a n und er this sec tion sha ll be m a d e byanother woman with due regard to decency.

    13.-(1) Any prison officer may use such force against a prisoneras is re as on ab ly ne c es s ar y in orde r to ma ke him obe y lawful o^fef f r 'whic h he ref us es to obe y or in or de r to ma int ai n discipline i g^ n

    prison.

    (2) Any prison officer ma y us e any weapo ns , including firearms,which ma y have been i ssu ed to him aga ins t a prisoner if such pri soner-

    (a) is es ca pi ng or attem pting to es ca pe an d ref use s, when calledupon, to re torn; or

    (b) is engaged with other persons in breaking out or attemptingto br ea k out of an y par t of a p rison a nd C ont inu es to bre akout or to attempt to break out when called upon to desist; or

    (c) is e n g a g e d with othe rs in riotous be ha vi ou r in a prison andrefuses to desist when called upon to do so; or

    (d) is endangering the life of, or is likely to inflict grave injuryto, the prison officer or to any other prison officer or to any otherper so n and the use of we ap on s, including firearms, is the onlypract icable way of controlling the pr isoner:

    Provided that wea pon s shall not be u se d as authorized in par ag raphs(a), (b) and (c) ofthis subsection unless the officer has reasonable causeto believe that he c ann ot otherwise preven t the e sc ap e, breaking out or

    riotous behavior, as the case may be, and has given a warning to suchpri sone r that he is ab out to us e s uc h we ap on s a ga ins t him an d su chwarning is unheeded:

    And provided further that no prison officer shall, in the presenceof his senior officer, use his weapons against a prisoner as authorizedund er par agr aph s (a), (b) or (c) ofthis subs ecti on exce pt und er theorders of such senior officer:

    And provided further that the u se of a we ap on un de r this secti on shal lbe aimed, as far as possible, to disable and not to kill.

    14. Any off icer- in-charge may cause photographs, measurements,footpr int s a n d ca s t s thereof , pa lm pr int s o r f ingerpr i nt s to betak en of any pri son er by any prison officer or oth er pe rs on auth orize d

    by the Commissioner in that behalf, and where any person refuses topermit his photo gra phs , me as ur em en ts , footprints or cast s thereof, palmprints or fingerprints to be ta ke n, the officer ma y, us e or ca us e to beused such force as may be necessary to secure the photographs, footprints or cas ts thereof, palm prints or fingerprints as the c as e m a y b e :

    15.-(1) Wh er e the d efe nce to a ny suit instituted aga in st a priso nofficer i s tha t the a c t co mp la in ed of wa s d on e in obe di en ce to acert i ficate or wa rr an t purp ort in g to be is su ed by a court or oth er

    co mp et en t authority, the co urt shall, up on production ofth e certificateor war ran t an d upo n proof tha t the ac t compl a ine d of wa s don e inob ed ie nc e to suc h cert i fi cate o r warran t , en ter ju dg me nt in favourof suc h p rison officer.

    (2) No pro of of th e sign atu re on a certificate or war ran t shal l berequired unle ss the court has rea so n to doubt the gen ui ne ne ss thereof;and where it shall be proved that such signature is not genuine, judgme nt shal l ne ve rt he le ss be g iven in f avour of. the pr iso n officer if it ispr ov ed that , at the t ime the ac t co mp la in ed of wa s c omm itte d, hebel iev ed on rea son abl e ground s that the signature was genui ne.

    16. Pris on officers shal l , subje ct to the exi gen cies oft he se rvic e,

    be gra nte d leave in acc ord an ce with the regulat ions ma de u nd er thisAct.

    RETIREMENT BENEFITS WHIC H MAYB E GRA NTED To NON-P ENSIO NABLE

    OFFICERS

    17. Ever y non- pe ns ion abl e prison officer of or bel ow the rank of prison officer Grade I shall, on discharge after continuous good service

    ext end ing ov er a perio d of not less tha n twelve y ea rs , be eligible tore ce iv e a gratuity cal cu lat ed at the r ate of two-th irds of a mon th 'spa y oft he rank in which he was servi ng at the time of dis cha rge foreve ry comp let ed yea r of service up to a ma xi mu m of twen ty-o neyears.

    (2) The medical officer shall examine daily every prisoner in solitaryconfinement or hospital, or reported to him as being sick.

    (3) The medical officer shall enter in a register, kept for the purpose,his comments on the cases sent to him for treatment.

    (d) the day on which he was admitted to hospital;

    (e) the day on which the medical officer was first informed ofthe

    illness;

    (f) the nature ofthe d isea se ;

    (g) when the d ec ea se d was last se en before his dea th by the medi cal

    officer;(h) wh en the priso ner died, an d ( in ca se s whe re a pos tm or te m

    PART VI

    ESTABLISHMENT AND CONTROL OF PRISONSDeclaration 23,(1) The Minister may, by notice in the Gazette, declare anytionof

    SSc a"building, en closure or place , or any thereof, to be a pri son for the

    prisons purposes of this Act , and may, in a l ike manner, declare that anypriso n shall c ea s e to be a prison for the pu rp os es ofthis Act an d ma yclassify prisons so decla red as afor esaid into gr ad es a nd ma y presc ribethe privileges applicable to each class ofprisons.

    (2) Ever y priso n sha ll include the gr ou nd s a nd buildings within theprison enclo sur e an d also an y oth er gro und s or buildings belongin g oratt ac he d thereto an d use d by pris oner s or the staff of the pr ison.

    (3) In any writ, warrant or other legal instrument in which it may bene ce ss ar y to describe a particular prison any description designating aprison by reference to the name ofthe place or town where it is situated,or other definite description, shall be valid and sufficient for all purposes.

    Temporary 2 4 . W h e n e v e r -prisons

    (a) it app ea rs to the Co mmi ssi one r that the nu mb er of prisoners inany prison is gre ate r than can convenient ly be ac co mm od at edtherein and that it is not convenient to transfer the excess numberto some other prison; or

    suc h provision shall be ma de as the Co mmis sion er, with the ap prov alofthe Minister, may direct for the shelter and safe custody in temporaryprisons of so man y ofth e pris oners as c an no t be conven iently or safelyacc om mo dat ed in the prison, and every such tempora ry prison shall bede em ed to be a prison for the purposes o fthis Act.

    ADMS S ION AND CUS TODY OF PRIS ONERS

    25.-(1) No priso ner shall be admi tted into a prison unl ess a c c on j mj s S i o n 0 fpanied by a remand warrant, certificate, warrant or other ordepr-isafersdetent ion, or wa na nt of conviction or of committal.

    (2) Subject to such conditions as may be prescribed, an infant childof a female pri son er ma y be re cei ved into prison with its mot her.

    (3) The officer-in-charge sha ll verify that the pr isone r is the pe rs onnamed in the warrant, certificate or order, and that such warrant, certificate or orde r be ar s the signa ture a nd se al oft he Cour t or co mp et en tauthority and in all other respects complies with the requirements ofl a w .

    (4) The officer-in-charge shall keep every such warrant, certificate ororder, or certified true copies thereof throughout the period during whichthe person refened to therein is in his custody.

    (5) Upon the admission to prison of any per son the officer-in-chargeshall cause to be recorded such particulars regarding such person asmaybe prescribed.

    26.     (a) corporal punishment with a cane, not exceeding such number ofstrokes as maybe prescribed:

    Provided that corporal pun ishme nt shall not be awar ded e xceptfor an offence involving pe rs on al violence to a prison officer:

    And provided further tha t no sen ten ce of corp oral pu ni sh men tshall be carried out unles s suc h sent enc e has be en confirmed bythe Commissioner;

    (b) con fin emen t in a se pa ra te cell on suc h pu ni sh me nt diet asmay be prescribed for a term not exceeding such period as maybe prescribed;

    (c) forfeiture of rem iss ion not ex ce ed in g s uc h term of rem iss ionearned as may be prescribed;(d) forfeiture of some or all ofthe privileges for such period as maybe

    prescribed.

    34,(1) The Commissioner may punish any prisoner found aftpfnjshmentdue inquiry by him to be guilty of a prison offence. of prisoners

    (b) the record of all the ev idence he h as t aken, including the evidenc eofthe prisoner;

    (c) the reasons why he has found the prisoner guilty; and(d)~ any representations the prisoner may wish to make to the Com

    missioner in regard to punishment.

    (4) The Commis sioner on receipt of a record forwarded to him undersubsection (3) may-

    (a) punish the prisoner; or

    (b) reverse the finding ofthe officer-in-charge and acquit the prisoner ,or

    (c) require the officer-in-charge to take further evi den ce and su bmi tit to him prior to his making a decision.

    (5) The Co mm is si on er ma y awar d a pris one r one or more oft hefollowing punishments: -

    (3) No sen ten ce of corporal pun ish men t shall be carried out unles sthe m ed ic al officer ha s certified th at the pr iso ne r is fit to un de rg o s uc hpunishment.

    (4) A me dic al officer ma y give su ch directio ns for the pre ven tion ofinjury to the h ealth oft he p ris one r ord ere d to receive corp oral pun ish me nt as he may deem ne ce ssa ry , and such directions shall be compliedwith before the punishment is inflated; and if, during the course oftheinfliction of su ch p un is hm en t the me di ca l officer sha ll direct it to bediscontinued, it shallbe discontinued accordingly.

    47. The Go ve rn me nt shall be ar the cos t of po st ag e o f letters writtenby prisoners.

    48 . Ev ery pr iso ne r ma y bring to the notice of an y visiting just ice

    who is visiting the pris on an y ma tt er which he cons ide rs sho uld bebrought to the visiting justice's attention.

    49,(I) Convicted criminal prison ers sen ten ce d to impr isonm ent ma yby industry a nd go od c on du ct earn a r emi ssi on of one-th ird of theirsentence or sentences:

    Provided that in no case shall any remission be granted to a prisonerse nt en ce d to imprison ment for life or to be d eta ined at the P resid ent ' s

    pleasure.

    (2) Fo rt he pur pos e ofgiving effect to sub sec tio n (1), a convictedcriminal prisoner shall, on admission, be credited with the full amount ofremi ssio n to which he would be entitled at the en d of his s en te nc e orsen ten ces if he lost no remission of sen te nce .

    (3) A pris oner may lose remis sion as a re sult of pu ni sh me nt for a

    priso n offence, an d shal l not ea rn an y rem iss ion in re sp ec t of an yp e r i o d -

    (a) sp en t in hosp ital, if his st ay in ho spi tal is c a u se d by his ownnegligence or if he is certified by the medical officer to be malingering; or

    (b) while undergoing confinement as a punishment in a separate cell.

    (4) The C om mi ss io ne r shal l ha ve the po wer to rest ore forfei tedremission in whole or part.

    (a) young prisoners serving indeterminate se nt enc es -as soon as theprison er has comple ted one ye ar ofthe s en ten ce an d thereafterannually;

    (b) adult prisoners serving fixed sen ten ces ofe ig hty ea rs or mo re -as soon as the prisoner has compl eted four year s of his sen ten ceand thereafter at quadrennial intervals;

    (c) adult prisoners serving indetermina te se nt enc es as soon as the

    pris oner has com ple ted one yea r of h is s en te nc e and therequadrennial intervals:

    Prov ided tha t nothing in this sec tion sha ll be d ee med to prohibit thePr es id en t from directing that the r eports shall be subm itt ed at morefrequent intervals or the Commissioner from submitting reports as andwhen he may consider desirable:

    And provi ded further tha t the pr ovis ions of this sec tio n sha ll notapply to criminal lunatics or prison ers receiving tr eat men t in men ta lhospitals.

    PART X

    REMOVAL OF PRISONERS

    52.-(l) The Commissioner may order that any prisoner shall b j m o v a i o f

    removed from one prison to another- and whenever any prisonpejjgerremoved to any prison other than that named in the warrant or

    PART XI

    TRAINING AND TREATMENT OF PRISONERS

    61 . Every prisone r sen ten ced to imprison ment and deta ined in prisonshall, subje ct to the provisions ofthis Act and su bject also to any spe cia lorder ofthe court, be employed, trained and treated, whether he is in or

    is not within the precincts of any prison, in such a manner as the Com-

    mis sio ner ma y det erm ine , and for that pu rp os e su ch a priso ner shall,at all 't im es, perform su ch labour , ta sk s a nd othe r duties as m ay beassigned to him by the officer-in-charge or any other prison officerin whose charge he may be.

    62. Eve ry prison or any portion of a priso n es ta bli sh ed or us ed forthe admi ssion , detent ion, t raining and t re atm ent of female prison ers

    shall have a sufficient number of women prison officers, and the Commis sion er shall determine whe the r a wo ma n prison officer shall be incharge thereof.

    63. Women prisoners shal l only be employed on labour which issuitable for women.

    64. The m edi cal officer ma y order any prison er to be ex cu se d lab ouror to perform light labour and any prisoner ordered to perform lightl a bo ur sha l l be r eq u i r e d t o pe r fo r m t he l a bo ur for whi ch he i sconsidered fit by the med ical officer.

    65 -(l ) Subje ct to the provisions of section 76 every pris oner shall

    be supplied with and shall wear such prison clothing as maybe deter-

    mined by the Commissioner.(2) Every prisoner shallbe provided with separate bedding adequate

    for war mth a nd hea lth as ma y be de ter mi ne d by the m ed ic al officerand be prescribed by regulations.

    (3) A child of a female pri son er admitted to prison sh al lb e p rovid edwith allnecessaries.

    (4) The dietary scale for prisoners shallbe prescribed.

    66. Prisoners may be paid gratuities by the Government in accordancewith rates prescribed.

    67-(l) Subjec t to any regulatio ns m ad e u nd er this Act, convictedcriminal pris oner s m ay be confined either m assoc iati on in ward s or

    individually in cells or partly in one way and partly in the other.

    (2) Cel ls an d wa rd s s ha l l be i l luminate d at nigh t an d be un d e rthe const ant supervision of a prison officer.

    68-(L) There shallbe provided in every prison, where practicablean d ne ce ss ar y, sufficient isolation cells of a patte rn ap pr ov ed by theCommissioner and such cells shall.be used forthe following purposesonly:

    (a) to confine a pr isone r se nt en ce d to confineme nt m a se pa rat e cellin acco rd anc e with the provisions of sectio ns 33 or 34;

    (b) to confine a pris oner in acco rda nce with the provisions of section7 0 :

    73.-(1) On the d ea th of any per so n det ain ed in a priso n the officer-

    (2) The medical officer, on receipt ofthe notice, shall cause the deadprisone r to be medically exam ined in a man ne r he con siders n ec es sa ry

    an d shal l issu e a cert i ficate stat ing the ca us e oft he d ea th an d shal lca us e su ch cert i ficate to be del iv ered to the ne ar es t coro ner.

    (3) The cor one r shall report to the C om mis sio ner the resu lt ofth einquest held.

    (4) The Commissioner shall also cause an inquiry to be held as toan y de at h in an y prison from Oth er tha n natura l c au se s, an d reportthereon to the Minister.

    PAR T xn

    DETENTION AND TREATMENT OF UNCONVICTED AND CIVIL PRI SONERS

    74. The officer-in-charge shall detain any person remanded to, prisonaccord ing to the ter ms oft he warr ant of committa l iss ued by a cou rt or

    co mp ete nt authority and shall ca us e suc h pe rso n to be d elivered to suc hcourt or co mp et en t authority at the time na m e d and acco rdin g to theterms of such warra nt.

    75. Civil and unc onvi cted priso ners shall as far as conditions p ermitbe kep t apart from other clas ses ofpri soner s. They ma y b e permit tedto assoc iate t oge the r in orderly ma nn er un de r suc h conditions as thecommissioner may direct.

    76.-(1) An unconvicted prisoner may be permitted to maintain himself an d to pur ch as e or rece ive from private s ou rc es at pr op er ho ur s,food, bedding, clothing or other necessaries, but subject to examinationand to such othe r conditions as the Com mis sio ner ma y direct.

    (2) No food, bedd ing , clothing or othe r ne ce ss ar ie s bel onging to anunco nvic ted Pr iso ner shall be gi ven, hired, loane d or sold to an y oth er

    prisoner; and any prisoner contra vening the provisions ofthis sectionsh al lb e liable to lose the privilege of pu rc ha si ng or recei ving food,clothing or oth er ne ce ss ar ie s from private s ou rce s for suc h time as theofficer-in-charge may think proper.

    (3) If a civil or unco nvic ted. Pri son er is u nab le to receive clothing,be dd in g or food suppl ie s, or if su ch food is in the opinion oft he officer-in-charge unsatisfactory suc h prison er shall receive th e, regula r prisondiet, clothing and bedding.

    (a) the prisoner's dress is insufficient or improper or is in an unsanitary condition; or

    (b) the prisoner's dress is required as an exhibit; and

    (c) he is un ab le to Pr oc ur e oth er suita ble clothin g from an y oth ersource.

    wearing of (a) wears any uniform or distinctive badge or button ofthe Service,uniforms, etc. or anything so closely resembling any such uniform, badge or

    button as to be likely to deceive; and(b) is not an officer ofthe Service entitled by reason of his appoint

    (c) has not be en grante d permission by the Comm issio ner to wearsuch uniform, badge or button,

    escaped prisoner,sh al lb e guilty of a felony an d sh al lb e liable on conviction to imprisonment for seven years.

    (e) without the authority in writing of the Com mis sio ne r-

    (i) sk et ch es or ph ot og rap hs an y prison, port ion of a pri son,pris one r or gro up o f pri son ers , wh et he r within or outsi deany prison;

    (ii) ca us es an y sketc h or pho tog rap h of any prison, portion of aprison, prisoner or group of prisoners to be published in anymanner; Or

    (f) publ ishe s a ny false information conc ern ing the be ha vio ur orexpe rien ce in prison of any prison er or ex-pr isoner or conc ernin gthe a dmini strat ion of any prison, knowi ng the s a me to be false,or without taking re as on ab le ste ps to verify su ch information,

    sha ll be guilty of an offence an d sha ll be liable on convi ction to a finenot excee din g two th ou sa nd shillings or to imp riso nmen t for a term notex ce ed in g six mo nt hs or to both suc h f ine an d imp r i s on me nt an dthe court convicting any pe rs on of an offence u nd er sub- pa rag ra ph (i)of paragraph (e)may, if it thinks fit, declare the sketches or photographsand the negat ives f rom which such photographs were taken to beforfeited to the Government.

    84.-(1) Any person who without lawful authority-

    (a) conveys, supplies or causes to be supplied or conveyed to ftjj jfityfbr

    pri so ner , w he th er within or witho ut a pris on, or hid es or plaffickingfor the us e o f any prison er, any do cu me nt letter or intoxicatingliquor, tobacco, bhang, drug, opiate, money, clothing, provisionsor any other article whatsoever; or

    (b) brings or att em pts to bring by an y m e a n s w ha te ve r into allypriso n, or pla ces or attemp ts to place wh ere pris oner s sha ll labour,any let ter or document or intoxicat ing l iquor, tobacco, bhang,dru g, opia te, mon ey , clothing, prov ision s or an y oth er articlewhatsoever; or

    (c) brings or att em pts to bring out of any pris on, or con ve ys fromany prison any letter or document or other article; or

    (d) communicates with any prisoner without lawful authority,sha ll be guilty of an offence and shall be liable on conviction to a fine notexc eed ing on e th ou sa nd shil l ings or to imp riso nmen t for a term notexceeding six months or to both such fine and imprisonment.

    (2) Any priso n officer or an y oth er pe rs on em plo ye d in the Servi cewho, without lawful authority-

    (a) allows any letter, document, intoxicating liquor, tobacco, bhang,drug, opiate, money, clothing, provisions or any other article to, be

    supplied or conveyed to any prisoner or to be hidden or placedfor his u s e ; or.

    (2) Any person who directly or indirectly instigates, commands,counsels, or solicits any mutiny, sedition or disobedience to any lawfulco mm an d of a pri son officer to a ny ot he r pris on officer or malic iousl yendeavors to seduce any prison officer from his allegiance or duty shallbe guilty of an offence a nd s h al lb e liable on conv iction to a fine no tex ce ed in g four th ou sa nd shillings or to imp ris onm en t for a term notexc eed ing two yea rs o r to both such fine and impris onme nt.

    (3) Any prison officer who~(a) takes part in a mutiny involving the use of violence or the threat

    of violence; or(b) incites a ny oth er Pris on officer or any me m be r oft he Tan za nia

    Peop le's Defence Force s or the National Service or the Police Forceto take part in any such mutiny, whether actual or intended,

    sh all be guilty of an offe nce an d sha ll be liable on con vic tio n by aSpecial Tribunal to suffer death or to imprisonment for life or for anylesser period.

    (4) Any prison officer who, in a case not falling within subsection

    (3). takes part in a mutiny or incites any su ch per so n as is refe rred toin Para gr ap h (b) of sub sect ion (3) to take pa rt in a mutiny, wheth er

    ac tua l or int end ed, shall be guilty of an offence an d shal l be liable onconv ict io n by a Sp ec ia l Tri bu nal to im pr is on me nt for life or an ylesser period.

    88. Any prison officer who- Desert ion

    (a) lea ves the Service or withdraws hi mself from duty otherwise thanin acc or da nc e with the pr ovision s of any written law gov ern ingretirement from Service or withdrawal from duty; or

    ( b ) is a deserter,sh al l be guilty of an offen ce an d sha ll be liable on con vic tion to a finenot excee din g two th ou sa nd shillings or to imp riso nmen t for a term notex cee din g twelve months or to both suc h fine and imprison ment.

    89. No money or other considerat ion shal l on any pretext whate^e^^ f o r

    Pena l ty for 90.-(1) No prison officer and no person acting for or employed bysupping him sha ll -

    (2) No prison officer shall, directly or indirectly-

    (a) have any pecunia ry interest in the p urc has e of any supplies for theuse oft he Pr ison s De pa rt me nt or receive any discount , gift oroth er cons ide rat ion from a ny co ntr act or for or sel ler of su chsupplies: or

    (b) have any pecuniary dealing with any prisoner; or

    (c) on b ehalf of any prisoner, hold any unau thoriz ed communic ationwith any person.

    (3) Any priso n off icer wh o c on tr av en es an y provision of thissec tio n sha ll be guilty of an offence an d sha ll be liable on convic tion toa fine not ex ce ed ing on e t ho us an d shillings or to imp riso nme nt for aterm not ex ce ed in g six mo nth s o r to, both suc h l ine an d imprisonment.

    shillings or to impr iso nme nt for a term not exc ee di ng three m ont hs orto both such fine and imprisonment.

Any prison officer who , without the p erm issi on oft he Co mm is-giving sioner , gives the pr es s or any other pe rs on an y information con cern ingunauthor i zed a prison or a prisoner or any information deriving from an official sourceinformation co nn ec te d with or rel ate d to the Ser vice sha ll be guilty of an offence

    and shall be liable on conviction to a fine not exceeding five hundredshillings.

    G e n e r a l 93 .-(1) There may be annexed to the breach of any regulation madepenalty un de r this Act su ch pen alt y not ex ce ed in g two th ou sa nd shillings or su ch

    term of impri sonme nt not excee din g six mont hs or both, as the Ministermay think fit.

    (2) Any pe rs on who commi ts any offence un de r this Act or con tra ve ne s or fails to comp ly with the pr ovision s of any regulat ions ma deth er eu nd er shal l , i f no penal t y is specia l ly provi ded, be l i able onconvi c t ion to a f ine no t ex ce ed in g on e th o u sa n d shil l ings , or toimprisonment for a term not exceeding two months or to both such fineand imprisonment.

    94 . For the avo idan ce of dou bt it is h er eb y decl are d that nothing inprosecute

    under other being prosecuted and punished under any other wri t ten law for anylaw not offence made punishable by this Act:affected Pro vid ed that no pe rs on shall be tried twice for the sa me offence.

    95 . Wh en any pe rso n, in the pr es en ce of any prison Officer, con^mjt^.,any offence specified in this Part and refuses on demand by sj^fitipris on officer to sta te his n a m e -an d re si de nc e, or gives a n a m e orre si de nc e which su ch prison officer kno ws or ha s re as on to believeto be f alse , su ch pris on off icer m a y ar re st him an d shal l with outu n d u e d e l a y h a n d h i m o v e r t o a p o l i c e o f fi ce r a n d t h e r e u p o nsuch police officer shall proceed as if the offence had been committedin his pr esen ce.

    96. The officer-in.charge shall cause to be affixed in a conspicuous pJa.ceoutside the prison a notice in Swahili and English setting forth the act^or a

    prohibited under sections 81.to 86 and' section 90 ofthis Act and thepenalties incurred by their commission.

    P A R T X V

    GENERAL PROVISIONS

    the expiration of six mon ths immed iately su cc ee di ng the date of hisrelease from prison, but in no case shall any such action be commencedafter the expir at io
