Greetings and welcome back from the Summer! On July 1 we entered our new fiscal year and on July 27 we had our first Board meeting. We had a busy agenda and it was a dynamic meeting. We also had special guests from the International Headquarters – Randy A. Williams, SR/WA, MAI, FRIC, Inter-national President, Mark Rieck, Executive Vice President, and Daniel Stekol, Vice President and Business Development Officer. Mr. Wil-liams, who flew in from Texas, was our special guest speaker at the event following the board meeting, the Chapter’s traditional annual Past Presidents' luncheon, attended by over 60 members and guests. The most honored atten-dees were the chapter’s Past Presidents – the event was a tribute to their service to the chap-ter. Randy Williams shared about the contin-ued growth and success of the Association on the national and international arenas. IRWA’s designation of SR/WA and its career path certifications are gaining international recogni-tion and are becoming more and more desired and coveted. This is because IRWA training is

highly relevant to the sphere of delivering public projects involving the land factor – our educational courses provide crucial skills and specialized knowledge which can be immediately put to use. Many members have boosted their ca-reers by the valuable professional

knowledge gained in IRWA courses and semi-nars. The number of Candidates for SR/WA professional designation and career path certi-fications continues to grow as members recog-nize their value for their professional careers in both the public and the private sectors.

The Past Presidents' luncheon was a real fun event. The luncheon was held in a relaxing set-ting near the Marinas by the Ocean water. The food was great. The raffle gifts were excellent. Kudos to our luncheon chair Aaron Aftergut for organizing this great luncheon! The MC was the 2007 Past President, Bryan Riggs, SR/WA, MAI, who did a fantastic job of the MC. That day, some of the attendees were on their day off and stayed behind after the event to con-tinue enjoying the setting and perhaps a summer cocktail from the full bar of the restaurant. The Guest speaker at the Joint Luncheon at Stevens Steak House will be Mr. Michael A. Barbour, Executive Officer Highway Project Director, Los Ange-

les County Metropolitan Transportation Authority

Mike Barbour has been working on transportation projects for last 28 years. Though he has worked mainly on highway improvement projects, he also has transit, airport and military base reconstruction experience as well. Of the 28 years of engineering responsibilities, twenty of those years were in design and eight years were in construction. Bridge experience makes up the lion share of the design work, while roadway and bridge work is predominate on the con-struction side.

Mike started his career in engineering straight out of school with Caltrans Structure Design and went on to spend over eighteen years as Bridge De-signer, Bridge Representative, Office Chief for Structures Design Organization and finally completed his time at Caltrans as acting Design Deputy at Caltrans District 7, in Los Angeles. After leaving Caltrans, Mike worked as a consultant on various highway, rail and military projects over the next eight years. During this period he had the privilege of working on the Golden Gate Bridge, the new Bay Bridge, BART Station retrofits and the Sacramento Airport Moderni-zation Project. More recently, for the last three years, he has been working on the I-405 HOV/Improvements Project in West Los Angeles for Los Angeles County Metropolitan Transportation Authority as the Project Director.

Mike has lead and held various positions during his career; from Bridge De-signer to Structures Office Chief, Engineering Manager, Project Manager and Project Director. He was a Major in the Air Force Reserve and has been de-ployed to Iraq three times. He values all of the knowledge he has gained working in these organizations and specifically feels very fortunate to have worked on great projects with great people.

Mr. Barbour will speak about his experience organizing the tempo-rary closure of the 405 Freeway on July 16 and 17 of this year to avoid

the “Carmageddon”.

ORDER ON MOTION TO CONTINUE

―He who is his own lawyer has a fool for a client‖ is one of every lawyer’s favorite

proverbs. Among the several reasons why this is undoubtedly true, is that lawyers are trained

to handle disputes skillfully but without the emotional rancor that will mask the actual par-

ties’ reason and good sense.1 Regrettably, many attorneys lose sight of their role as profes-

sionals, and personalize the dispute; converting the parties’ disagreement into a lawyers’ spat.

This is unfortunate, and unprofessional, but sadly not uncommon. Before the Court, however,

is an uncommon example of this unhappy trend.

This matter is currently set for trial commencing June 14, 2011. Defendants seek a

brief continuance, noting that one of their counsel, Bryan Erman, along with his wife, is ex-

pecting their first child due on July 3. Given the proposed length of trial and the famous dis-

regard that newborns (especially first-borns) have for such schedules, and given that the trial

is scheduled in Kansas City while the new Erman’s arrival is scheduled in Dallas, Defendants

move this Court for a continuance. This in itself would not be remarkable, but in reviewing

the motion the Court was more than somewhat surprised to read that ―Plaintiffs have refused

to agree to continue the trial setting and have indicated that they intend to oppose this Mo-

tion.‖

Well, every party is entitled to file an opposition to a motion, and hoping that per-

haps Defendants’ had mis-characterized the vigor of Plaintiffs’ opposition, we have eagerly

awaited Plaintiffs defense of its opposition. The Memorandum in Opposition arrived yester-

day, and it was, sadly, as advertised.

First, Plaintiffs make a lengthy and spirited argument about when Defendants should

have known this would happen, even citing a pretrial conference occurring in early November

as a time when Mr. Erman ―most certainly‖ would have known of the due date of his child,

and even more astonishingly arguing that ―utilizing simple math, the due date for Mr. Er-

man’s child’s birth would have been known on approximately Oct. 3, or shortly thereafter.‖

For reasons of good taste which should be (though, apparently, are not) too obvious to ex-

plain, the Court declines to accept Plaintiffs’ invitation to speculate on the time of conception

of the Ermans’ child.

Further, Plaintiffs assert that there are currently five attorneys from two different

firms on Defendants’ signature block. While the Court might be inclined to agree with

Plaintiffs that this seems like a plethora of attorneys, it can’t help but note that, entered and

active on behalf of Plaintiffs in this case, are also five attorneys, from three different firms; so

perhaps Plaintiffs are ill- equipped to argue that Defendants have too many attorneys.

Finally, Plaintiffs argue that surely Mr. Erman will have sufficient time to make it

from the Kansas City trial to the Dallas birth, even helpfully pointing out the number of daily,

non-stop flights between the two cities; and in any event complain of the inconvenience of

this late requested continuance. Certainly this judge is convinced of the importance of federal

court, but he has always tried not to confuse what he does with who he is, nor to distort the

priorities of his day job with his life’s role. Counsel are encouraged to order their priorities

similarly.

Defendants’ Motion is GRANTED. The Ermans are CONGRATULATED.

IT IS SO ORDERED.

Jazmine's goal is to take as

many classes as she can and

eventually advance to a

SRWA designation.

Jazmine Sunico joined the International Right of Way Association (IRWA) in September 2010. Relatively new to the Port of Los Angeles, she was encour-aged by fellow IRWA members Kenneth Stanberry, SRWA, and Kenneth Caughlin, SRWA, to take classes to enhance her background. To date, Jaz-mine has taken 7 courses with IRWA, ranging from asset management to envi-ronmental awareness. She is hoping to become an Associate Right of Way Professional by the end of this summer.

Jazmine works as a Real Estate Associate II in the Real Estate Division of the Business Development Group for the Port of Los Angeles. She currently over-sees a portfolio consisting of tenants in the recreational boating and construc-tion operations industries. She performs necessary inspections with tenants to recommend and direct maintenance and reconditioning of property. To ac-complish this, she interacts regularly with tenants to respond to needs, issues, and concerns as per tenant lease agreements. In addition, Jazmine oversees compliance with lease terms to ensure compliance with City of Los Angeles policy and regulations.

Prior to joining the Port of Los Angeles in 2010, Jazmine previously worked in the Compliance Division for the Los Angeles Housing Department and CB Rich-ard Ellis. At the Housing Department, she had many opportunities to meet with tenants, landlords, bank officials, title insurance companies, etc. to con-vey the rules and guidelines of housing programs. Her work as a Financial Analyst for CB Richard Ellis allowed her to collaborate with real estate brokers to prepare financial analyses for the firm's clients. She was able to develop real estate financial models for commercial building leases, lease restructures, relocations, and subleases.

IRWA has helped her career because she was able to take advantage of the professional development IRWA has to offer. Ultimately, Jazmine's goal is to take as many classes as she can and eventually advance to a SRWA designa-tion. Jazmine also plans to be involved in the newly-formed IRWA's Young Professionals Group.

Jazmine earned her Bachelor's Degree in Business Administration at Boston University. She will be attending the University of Southern California in the Fall 2011 to pursue her Master's Degree in Business Administration.

We started the new fiscal year in a strong financial position and with a very strong Board of Directors, a team of volunteers who gener-ously donate their time and energy to serve ongoing needs of the chapter members and are dedicated to continuous improvement of the organization and success of its members. I am fortunate and privileged that the current Board of Directors includes five of the chapter’s past Presidents. This brings unparalleled experience to the table for the benefit of the members. We are very attuned to the members’ interest in continued advancement of their professional careers and we strongly focused on the priority of continued delivery of high quality educational and networking opportunities. The education and networking opportunities delivered by this chapter have gained recognition and popularity far beyond the Los Angeles region. Our seminars are regularly attended by professionals from the neighbor-ing counties and beyond. Attendees from out of state have become a norm. It appears that the many years of excellence have branded our chapter’s courses and seminars for high quality and dependability. The credit for this achievement undoubtedly goes all the volunteers who have so generously contributed over the past many years to start, create, maintain, and improve the things we do as a chapter today. As times and business environment continues to change, the priority of the current and the future chapter leaders will be to continue improving our functions and enhancing the value of our brand to members and constituents of the projects delivered by our members.

To continue on the path of improvement, I have created several new committees and I am fortunate that the most capable individuals have accepted the challenges of chairing these committees. The following are the new committees and their respective Chairs:

Effective communication with our members and audience is vitally important and Natasa Lenic has been one very busy Communicat ion Chair since day 1 of her joining the Board.

The new industry committees represent sectors highly relevant to the practice of Right of Way professionals. These committees will per-form a vital link between the chapter and the Association brining to you important industry updates, knowledge and best practices.

This year our chapter is fortunate to host the traditional annual Tri-Chapter Holiday Luncheon, at which members of the three local chapters – Los Angeles, Orange County, and Inland Empire – get together for celebration of the Holiday Season and rare networking opportunity. We are also anticipating members and chapter leaders from the San Diego and Santa Barbara joining us for the event. Please mark your calendars for December 6. This year’s Tri-chapter luncheon will be held at the “ultra cool” venue in L.A. Live – The Grammy Museum, across the street from the Nokia Theatre in the recently revitalized part of Downtown L.A. (I am proud that of our members have been part of those revitalization efforts and the fruits of labor are now evident as part of the new image of Los Ange-les.) Come and join the other 130+ Right Of Way professionals who are anticipated to attend (seating is limited).

2012 SR/WA & CERTIFICATION SCHOLARSHIPS

Chapter 1 of the International Right of Way Association is sponsoring educational scholarships for Chapter 1 SR/WA designation and professional Certification candidates. The scholarships support the professional development of Chapter 1 members. The 2012 calendar year Scholarship Award Applications must be received by mail no later than Friday, October 15, 2011, by the Chapter 1 Professional Development Committee Co-Chair at the following address:

Applications received after the due date and/or incomplete Applications will not be processed by the Professional Development Committee. The 2012 Chapter 1 Scholarship Awards consist of a five-day IRWA class equivalent for those Classes sponsored by Chapter 1 during the award calendar year for each Award recipient (i.e., may be allocated to multiple classes for up to five days duration). Candidates must be in good standing with a current SR/WA designation and/or professional Certification candidate status at the time of the Scholarship application and award. Please review the IRWA Chapter 1 Scholarship Policy and Procedures for details. 2012 CALENDAR YEAR – IRWA CHAPTER 1 – LOS ANGELES EDUCATION SCHOLARSHIP POLICY & PROCEDURES

Scholarship Policy and Procedures The following IRWA Chapter 1 – Los Angeles Scholarship Policy and Procedures outline the purpose, amounts, availability, application, selection are outlined by the following Scholarship Policy and Procedures as adopted by the Chapter 1 Board of Directors (Board). The Board, with the assistance of the Chapter 1 Professional Development Committee (PDC) shall announce annually the Scholarship amounts, availability, application, selection process and timetables for the following calendar year’s Scholarship awards. Scholarship Purpose The Chapter 1 Scholarship Award (Scholarship) provides Chapter 1 SR/WA designation and/or professional Certification designation Candidates assistance attaining their professional designations with respect to Chapter 1-sponsored required IRWA Classes. Scholarship Amounts Scholarship amounts are determined annually by the Board. Scholarships offset the tuition costs of Chapter 1-sponsored IRWA Classes fulfilling SR/WA designation and/or professional Certification designation requirements. Individual Scholarships are limited to one five-day IRWA Class equivalent for those Classes sponsored by Chapter 1 during the Scholarship calendar year. Scholarship Availability The Scholarship is funded annually by the Board and is available upon Board announcement to Chapter 1 members in good standing with current SR/WA designation and/or professional Certification Candidate status at the time of Scholarship application submission and award. Elected Board members as of the date of Application submission and the calendar year of Scholarship award. The Scholarship is available to qualified individual Chapter 1 members for a period of five consecutive years inclusive of the initial calendar year the Scholarship is awarded to the qualified Chapter 1 member. Scholarship Application Scholarship application is made annually by eligible Chapter 1 members by submission of a complete Chapter 1 – Los Angeles SR/WA Designation and Professional Certification Scholarship Award Application (Application) as announced annually by the Board. Scholarship Selection Initial review and selection of Scholarship Applications are made by the PDC. Only complete, properly submitted Applications will be reviewed by the PDC.
