    Retirement Under R.A. 8291 When availing of the retirement program under

    RA 8291, only two things should be considered:age and the length of service. To qualify for this retirement mode:

    The retiree must have rendered at least 15 years

    of service and must be at least 60 years of ageupon retirement.He /she must not be a permanent total disabilitypensioner.

    Unlike other retirement modes, the last threeyears of service of a retiree need not to becontinuous under RA 8291

    Packages in store for you Retiring members who will opt to retire under

    RA 8291 are entitled to either of the following: Option 1: 5-Year Lump Sum and Old Age

    Pension

    Under this option, the retiree can get his/herfive-year worth of pension in advance. Thelump sum is equivalent to 60 months of theBasic Monthly Pension (BMP) payable at the

    time of retirement. After five years, the retireewill start receiving his/her monthly pension.

    Option 2: Cash payment and Basic Monthly

    In option 2, the retiree will receive a CashPayment equivalent to 18 times the BasicMonthly Pension (BMP) payable upon

    retirement and then a monthly pension for lifepayable immediately after his retirement date.

    The BMP is computed as follows:

    a) If length of service is less than 15 years:

    BMP = .375 x RAMC (Revalued Average MonthlyCompensation)

    b) If length of service is 15 years and more : BMP = .025 xRAMC x Length of service

    The BMP, however, shall NOT exceed 90% of the AverageMonthly Compensation (AMC).RAMC stands for Revalued Average Monthly

    Compensation and is computed as follows :RAMC= P700 + AMC (Average Monthly Compensation)

    AMC = Average Monthly Compensation

    = Total Monthly Compensation received during the

    last 36 months of service divided by 36Application of the AMC Limit

    The maximum amount of the Average MonthlyCompensation (AMC) to be used as the base for

    computing pensions and other benefits of a membershall be the AMC limit prevailing at the time thecontingency/ies occurred. Thus, pursuant to thelifting of the AMC limit, the monthly pension of amember with at least 15 years of creditable servicewho is in the service on or after January 1, 2003 shallbe computed on the basis of his/her AMCs withoutlimit.

    Retirement under Republic Act 660 Retiring under RA 660 requires the following:

    1. The retiree's last 3 years of service prior toretirement must be continuous, except in cases ofdeath, disability, abolition, and phase- out ofposition due to reorganization.

    2. His/her appointment status must bepermanent in nature.3. He/she must meet the age and servicerequirements under the "Magic 87" formula.Based on the formula, a retirees age and years inservice should be added up and should total atleast 87.

    Under RA 660, GSIS members as young as 52 yearsold can already avail of a retirement package for aslong as they have already been in governmentservice for the past 35 years.

    The Magic 87 formula is shown below:

    The maximum monthly pension for thoseabove 57 years old shall be 80% of the

    Average Monthly Salary (AMS) received duringthe last 3 years immediately precedingretirement. The Maximum pension for those

    aged 57 and below shall be 75% of the AMS.Packages in store for you

    RA 660 lets you choose among the following

    options to let you enjoy a new beginning:

    Option 1: Automatic Pension - Under this

    option, pensioners below 60 years old maychoose to receive either an automaticmonthly pension for life or an option to avail

    of a lump sum. The lump sum, which can berequested every six months, means they canreceive their one-year worth of monthlypension in advance for a period of five years.

    On the sixth year, they will start receiving theirlifetime monthly pension.

    Option 2: Initial three-year lump sum - For thosewho are at least 60 years old but less than 63

    years on date of retirement, the benefit is a 3-year lump sum. The subsequent two -year lump-sum shall be paid to the retiree on his 63rd

    birthday. If the retiree is still living after the 5-year guaranteed period, he shall be entitled to amonthly pension for life.

    Option 3: 5-Year Lumpsum - For those who are63-65 years old, they can avail of a five-year lumpsum then after five years, they will receive amonthly pension for life.

    REPUBLIC ACT No. 1616

    RA 1616 provides for a gratuity benefit forretiring members who will qualify under thisretirement mode. The gratuity is payable by

    the last employer. The employee shall also beentitled to a Refund of Retirement Premiumspaid, personal share with interest and

    government share without interest.

    To qualify under the mode, a retiree must:

    be in government service on or before May 31,1977

    has rendered at least 20 years of serviceregardless of age and employment status

    His/her last 3 years of service prior to retirementmust be continuous, except in cases of death,disability, abolition or phase out of position dueto reorganization.

    What is in store for youSince RA 1616 is considered as the Take AllRetirement mode, it provides the followingbenefits:

    1. Gratuity payable by the last employer basedon the total creditable service converted into

    gratuity months multiplied by the highestcompensation received. The gratuity months shallbe:

    Years of Service Gratuity Month First

    20 years one (1) month salary20 years to 30 years 1.5 months salary

    Over 30 years two (2) months salary

    (There is no limit to the amount of gratuitybenefit.) and

    Portability Law (RA 7699)

    Admittedly most of us move from one job toanother in a move to find a higher pay and bettercareer. Many government retirees have had ahistory in the private sector. In certain cases, they

    dont have enough years of service in thegovernment to qualify to any GSIS retirementprogram.

    With the help of RA 7699, otherwise known asthe Portability Law, government retirees who donot meet the required number of years providedunder PD 1146 and RA 8291 can still avail of

    retirement and other benefits.

    Under the scheme, you may combine your yearsof service in the private sector represented by

    your contributions to the Social Security System(SSS) with your government service andcontributions to the GSIS to satisfy the requiredyears of service under PD 1146 and RA 8291.

    However, if you have satisfied the required yearsof service under the GSIS retirement option youhave chosen, you would not be allowed to

    incorporate your contributions to the SSSanymore for availment of additional benefits.

    In case of death, disability and old age, theperiods of creditable services or contributions to

    the SSS and GSIS shall be summed up to entitleyou to receive the benefits under either PD 1146or RA 8291.

    If qualified under RA 8291, all the benefits shallapply EXCEPT the cash payment. The reason forthis is that the Portability Law or RA 7699provides that only benefits common to bothSystems (GSIS and SSS) shall be paid. Cashpayment is NOT included in the benefits providedby the SSS.

    Retirement under Presidential Decree 1146

    Retirement under PD 1146 can only be availedby those who were in service after May31,1977 but prior to June 24, 1997. A retiringmember under PD 1146 is entitled to eitherOld Age Pension or Cash Payment, depending

    on his age and years in service.

    The AMC is computed as follows:

    AMC =

    Total compensation received during the last 3 years Totalnumber of months during which compensation wasreceived Option 2: Cash Payment (CP)

    This option is available to retirees who are at least 60

    years old and have rendered at least 3 years but less than15 years of service. Qualified under this mode option willreceive a cash payment that is equal to 100% of theAverage Monthly Compensation (AMC) for every year ofservice.

    The Cash Payment is computed as follows: CP = Total monthly contributions paid x AMC

    A disability may either be:Permanent TotalPermanent Partial

    insanity or other irreversible conditions

    The benefits for Partial Total Disability are as follows.1. If the member is in the service with less than 15 years of

    service, benefit can be either:a. Basic Monthly Pension

    2. If the member is in the service with at least 15 years ofservice, benefit can be either:

    a. Basic Monthly Pensionb. Cash payment of 18 times the Basic Monthly Pension

    3. If the member is separated from service with 36 monthlycontributions within the 5-year period immediately precedingPTD, benefit can be either:

    5. If the member has at least 3 years service withcontributions, but PTD occurs 5 years afterseparation from the service, benefit is:

    Cash payment equal to 100% of AMC X Service (butnot less than P12,000) payable immediately. Nomore separation benefit shall be paid in the future.

    Injuries resulting in any of the following aredeemed Permanent Partial Disability (PPD)Complete and permanent loss of the use of: anyone finger, any toe, one arm, one hand, one foot,one leg, one or both ears, sight of one eye or suchother cases as may be determined by the System

    The benefits for Permanent Partial Disability are asfollows:

    1. If member is in the service, benefit is:

    Cash payment CP = BMP X nos. of PTDmonths as recommended by the GSIS medicalevaluator

    2. If the member is separated from the servicebut has paid 36 monthly contributions within thelast 5 years immediately preceding the disabilityor has paid at least 180 monthly contributions,benefit is:

    Cash payment CP = BMP X nos. of PTDmonths as recommended by the GSIS medicalevaluator

    Burial

    Beneficiaries are entitled to a P20,000 funeralbenefit payable upon the death of a member or old

    age pensioner.

    The requirements to avail of the burial benefit are:1. NSO-certified copy of Death Certificate

    2. NSO-certified copy of Marriage Contract3. Affidavit of funeral expenses4. Official receipt of funeral expenses with the nameof the payee (if claimant is other than the spouse)5. NSO-certified copy of payee's birth certificate (fornon-GSIS members or non-GSIS eCard holders).

    Employees' Compensation

    The Employees' Compensation (EC) benefits ordisability benefits is a compensation packagefor public and private sector employees and

    their dependents in the event of work-relatedinjury, sickness, disability or death. The EC is apurely employer-based contribution benefit.

    Thus, the employee is not required tocontribute any amount to the program.

    The benefits given to the employee or his beneficiaries arein the form of:

    Daily cash income benefit for temporary total disability (TTD)

    Monthly cash income benefit for permanent total disability(PTD) on a lifetime basis

    Monthly cash income benefit for death, also on a lifetimebasis, except for benefit paid to secondary beneficiaries,which is a monthly pension not to exceed 60 months but notless than fifteen thousand pesos

    Medical services, appliances and supplies for injury orsickness

    Rehabilitation services for permanent disability

    Carer's allowance for permanent disability.
