Since year 2013 onwards, he is engaging in fraudulent, malicious

and criminal disposal of RTI requests (During period in Railways) and appeals (during present posting in CIC). In this regard, during his posting in Railways, CVC Complaint 687/2014 was registered. It was referred to Railway Board in February 2014. In February 2014, he disposed 59 RTI cases in summary manner without supply of information. In this regard, CVC Complaint 18464/2014 was filed by CVC in February 2015. (iii) RTI appeal CICOM/A/2015/60033 dated 24/02/2015 was disposed on 19/06/2015 by Sh S P Beck Joint Secy/CIC after writing to Director/CBI on 11/06/2015 in connection with CVC Complaint 17197/2011 (iv) CIC decision no. CIC/VS/C/2014/900113/10193 dated 30/06/2015 has not been complied with by CVO cum SDGM/NFR till date. The decision is related to malafide role of Sh D B Singh DyCEE/TL/NFR in illegal and coercive medical examination of appellant in May/June 2013 after referral of CVC Complaint 7343/2013 to Railways. (v) For hearing held on 03/07/2015 for 21 RTI cases, till date PIO and FAA/CIC have not revealed identity of official representing Railway Board. In this regard, RTI appeal CICOM/A/2015/60105 dated 08/09/2015 remains pending with Mrs Achla Sinha FAA/CIC and Ex-ED/Statistics/Railway Board. Corresponding to it, RTI request MORLY/R/2015/68826 dated 08/09/2015 remains pending with Director (Vigilance)/Mechanical/Railway Board Sh Mayank Tiwari since 29/09/2015 which is the same date on which CVC Complaint 22618/2015 was registered. (vi) One day after fraudulent CIC decision dated 09/07/2015, APO/DBWS Sh Anjani Kumar (CVC Complaint 23362/2015) issued letter dated 10/07/2015 to Sh K P Singh DyCPO/G/NFR (CVC Complaint 22407/2015) fraudulently stating that whereabouts of appellant is not known despite the fact that his movement was informed to him on 11/04/2015 (vii) Fraudulent CIC decision dated 09/07/2015 was uploaded on CIC website on 22/07/2015 (viii) On 23/07/2015, CIC was requested through

FAA (of N F Railway) directly and illegally responded on 19/02/2014 for which complaint was preferred with CIC on 09/04/2014. 5. On 30/06/2015, CIC directed PIO and SDGM of N F Railway for enabling the appellant within 30 days to inspect the records and take copies of pertinent documents. Reply :- In the RTI application, the appellant has sought information in relation to first appeal decision No.CICOM/A/2015/60105 and an email dt. 26.06.2017 to Shri Rakesh Kumar Singh, Addl. Secretary, CIC. PA to AS/FAA provided information on Point (ii) under section 5(4) vide letter dated 06.07.2017. He also endorsed a copy to Shri K.L. Das, DO to IC(BJ) for providing information on Point (i) of the RTI application to the appellant. Shri K.L. Das has provided information vide letter dated 11.07.2017 (copy attached). 09/07/2015 pending with Shri Ratul Barua, Aditional Secretary, Transport Deptt, Govt of Assam since 26/12/2016 1) Grievance GOVAS/E/2014/00065 dated 24/04/2014 is pending with Guwahati Police since 03/01/2017. Present Guwahati Police Commissioner Sh H C Nath was HoB/CBI/Guwahati during the period from May 2013 to September 2013. 2) On 24/07/2013 (Pl see Supporting Document - SD) , email was sent to Honourable Prime. No response was received. In July 2013, FIR No. 393/13 dated 24/05/2013 of Assam Jalukbari Police Station relating to illegal and coercive medical examination of applicant (mentioned on Page 1 of SD) was under investigation 3) On getting no response and for sequence of events upto 08/07/2015, grievance PMOPG/E/2015/0028809 dated 09/07/2015 was registered seeking redressal from Government of Assam. 4) Related to above, RTI request PMOIN/R/2016/50964 dated 09/04/2016 was disposed on 17/05/2016 after which office of the then CPO/NFR Sh C Saikia (Now Chairman/RRB/Guwahati) enhanced fraudulent recovery from salary towards fraudulent claim of unauthorised absence and damage rent recovery. 5) Resultant RTI appeal PMOIN/A/2016/60160 dated 23/05/2016 was disposed on 07/12/2016 by Sh S E Rizwi Director/PMO resulting in death of mother of applicant on 09/12/2016 which is also the date on which Sh Praveen Kumar CPIO/PMO issued interim response for RTI request PMOIN/R/2016/53300 dated 08/11/2016 disposed online on 18/01/2017 after which office of present CPO/NFR Sh A K Sonik (Ex-Controller/Admin/NTRO) caused complete stoppage of salary from January 2017 onwards 6) RTI appeal PMOIN/A/2017/60026 dated 18/01/2017 was disposed on 04/05/2017 after issuance of 3rd major penalty chargesheet dated 18/04/2017 by GM/NFR Sh Chahatey Ram who has till date not accorded personal hearing and has not appointed inquiry officer
