This document aims at providing a practical tool for the European Institutions and the Customs administrations of the Member States in relation to the existing prohibitions and restrictions at EU level at the date of the last reviewed version.

1. PRESENTATION OF THE P&R LIST:
1.1. What are prohibitions and restrictions?
The European Union acquis includes an important number of legal provisions that engage customs to carry out checks in the context of the enforcement of many different policies
aiming at the safety and security of the European Union. In accordance with Articles 134 and
267 Regulation (EU) No 952/2013 (Union Customs Code) prohibitions or restrictions may be imposed on imports, exports or goods in transit when they are justified on grounds of:
public morality, public policy or public security,
the protection of health and life of humans, animals or plants,
the protection of the environment,
the protection of national treasures possessing artistic, historic or archaeological value and
the protection of industrial and commercial property.
1.2. What is this document?
This document is a compilation of the existing prohibitions on goods and restrictions at EU level. It has been drafted by customs experts from the Member States and from the
European Commission as a practical instrument for the European Institutions and the customs administrations of the Member States.
The list of prohibitions and restrictions is presented in two formats:
This document providing a presentation of the list along with relevant explanations.
An excel table that enables features such as "search" and "filter".
It needs to be underlined that the list is non-exhaustive and non-binding. It is provided as a list of examples for which the European Commission does not assume any liability.
1.3. What is in this list?
The list contains references with hyperlinks to the Union legal acts that entail prohibitions and restrictions relevant for Customs. Some measures have direct implication for the customs administrations, while others are just provided for information as the decision to
involve Customs is a matter of national implementation.
This list has been built on the above mentioned concept of "prohibitions or restrictions". However, the complexity and interlinks of some measures require further explanations:
The protection of public policy and security is the aim of a number EU sanctions or
restrictive measures that are either autonomous or implementing binding Resolutions of the Security Council of the United Nations. Given their broad scope and temporary nature, these measures are only mentioned in one line of the list where a hyperlink is
provided to the place where updated information can be found.
A similar approach is followed for the Union marketing requirements for seed and propagation material, where a hyperlink to the website containing the relevant
information is provided.
Product safety and compliance is covered by import controls carried out by customs according to Regulation 765/20081 in close cooperation with the market surveillance

authorities. European Commission has published in its website2 the "Guidelines for import controls in the area of product safety and compliance", including the "positive and negative list" providing references to the specific pieces of legislation of which
compliance can be controlled at import stage according to provisions in Regulation 765/2008.
1.4. What is not in the list?
The list does not contain references to:
National legislation.
Commercial Policy and Agricultural Policy measures, unless they also have as a secondary objective the protection of the Union in the sense of prohibitions and restrictions imposed on goods.
Measures that do not include provisions applicable for imports, exports or goods in transit.
Measures that are solely implemented by a different agency.
Measures that are connected to another fundamental legislative act which provides the framework for customs controls and is mentioned in the list.
1.5. What do the headings mean?
The list has different headings that aim at classification or filtering (in the excel version).
Column Description
# Sequence number of the legal act presented in the list.
COM DG in charge European Commission Directorate General responsible for the policy.
Targeted goods Classification criterion as regards the goods subject to control.
Name of the Measure Short name for rapid identification.
Legal Act Name and number of the legal act and its EUR-Lex hyperlink.
Related Legal Acts
(implementing, etc)
Short name and hyperlinks to related legal acts for a better understanding of the
measure.
List of Competent Authorities Where a list of the competent authorities in the Member States is available, a
hyperlink is provided.
Relevant databases or IT
systems
Where a database or an IT system exists at the EU level, its name and/or an hyperlink
is provided.
Flow Entry/Import Those measures that apply at entry or import or at export or exit are marked with Y
(yes). Otherwise they are marked with N (no). Flow Export/Exit
Integrated in TARIC? Those measures that have been integrated in TARIC are marked with Y (yes).
Otherwise they are marked with N (no). Some cases are explained in footnotes (or
"comments" as regards the excel file).
Document description Many restrictions require the presentation of documentary evidence proving that
certain conditions are met. In those cases the main document that the customs should
be aware of is shortly described.
