Chair Page called to order a scheduled virtual hearing of the Mesa County Planning Commission at 6:00 PM. Chair Page led the Pledge of Allegiance. The hearing was held in Grand Junction, Colorado.

In attendance representing the Mesa County Planning Commission, were Chair Page, Dean Harris,Robert Erbisch, Steve Damm, Larry Anna, Bob Witham, Sean Norris and Ed Krey.

In attendance representing the Mesa County Planning Division, were Greg Moberg, and Todd Hollenbeck. Rose Tafoya was present to record the minutes.

There were four (4) citizens present throughout the hearing.

Community Development Director Todd Hollenbeck called upon Alternate Commissioner Krey to participate in Commissioner Erbisch’s absence. Commissioner Erbisch did return to the meeting and attempt to vote but the motion had been approved and the meeting had been adjourned, therefore that vote was not recorded.

III. PROJECT DESCRIPTION

A. Proposed Project Site

The subject property is unplatted, approximately 15.5 acres in size, and located at 681 33 Road. Theproperty has recently been cultivated but is otherwise vacant. There are agricultural and low- and medium-density residential land uses surrounding the subject property. The property is situated east of the I-70Business Loop and south of Interstate 70 and has direct access to 33 Road. The property is located withinthe Urban Development Boundary.

B. Proposed Project

The applicant has requested a rezone from Agricultural, Forestry, Transitional (AFT) to Limited Industrial (I-1) for the purpose of developing an eight-lot industrial park. The current AFT zoning does not allow the lightindustrial land uses the applicant is proposing for the subject property; I-1 zoning does allow those uses, aslisted in Table 6-1 of the 2020 Mesa County Land Development Code (as amended). The applicantenvisions the south half of the property being used for his own company’s office, shop, and laydown yardfor utilities and traffic control devices. A heating and plumbing company has expressed interest in acquiringa lot in the north half of the subject parcel. Approximately two-thirds of the property has a future land-usedesignation of Residential Low (RL); about one-third of the property has a future land-use designation ofBusiness Park Mixed Use (BPMU). The BPMU future land-use designation calls for light industrial landuses such as those proposed by the applicant. The current AFT zoning does not implement the BPMUland-use designation; the proposed I-1 zoning does implement the BPMU land-use designation.

IV. FUTURE LAND USE

The property is within the planning area of the Grand Junction Comprehensive Plan, which was adoptedjointly by the Mesa County Planning Commission and the Grand Junction City Council (Resolution MCPC2010-01). The plan, effective at the start of 2010, replaced the 2000 edition of the Joint Urban Plan of theMesa Countywide Land Use Plan. The Clifton-Fruitvale Community Plan, which applies to the subjectproperty, calls for a business park in this area.

The subject property is designated both Residential Low (RL) and Business Park Mixed Use (BPMU) onthe Future Land Use Map of the Mesa County Master Plan. As mentioned above, approximately two-thirdsof the subject parcel is designated RL, about one-third BPMU. The RL future land-use designation calls forresidential land uses at gross densities of one dwelling unit per two acres to two dwelling units per acre.The Residential Single Family Estate (RSF-E), Residential Single Family 1 (RSF-1), and Residential SingleFamily 2 (RSF-2) zoning districts implement the RL future land-use designation. The BPMU future land-usedesignation calls for multi-family residential, commercial, and light industrial land uses. The ResidentialMulti-Family 12 (RMF-12), Residential Multi-Family 16 (RMF-16), Residential Multi-Family 24 (RMF-24),Residential Office (R-O), Limited Business (B-1), Limited Commercial (C-1), General Commercial (C-2),and Limited Industrial (I-1) zoning districts implement the BPMU future land-use designation. The currentAFT zoning does not allow the proposed light industrial land uses and does not implement the BPMU land-use designation. The proposed zoning of I-1 allows light industrial land uses and implements the BPMUland-use designation. The I-1 zoning district allows a maximum gross density of eight lots per acre and aminimum lot size of one acre. A determination has been made that, while over half the property isdesignated RL, the BPMU land-use designation can be applied to the entire subject parcel for purposes ofthis rezoning request.

V. COMPLIANCE WITH THE MESA COUNTY LAND DEVELOPMENT CODE

Section 4.15.C Rezone Approval Criteria:

In evaluating the proposed request, the General Approval Criteria under Section 3.09, the stated purposeof the proposed zoning district and the following shall be considered:

1. The rezoning is consistent with the Mesa County Master Plan;

The Mesa County Future Land Use Map classifies the subject property Residential Low (RL) and Business Park Mixed Use (BPMU). The proposed rezone to Limited Industrial (I-1) is consistent with the intent of the BPMU future land-use designation.

Pursuant to Table 6-1 of the 2020 Mesa County Land Development Code (as amended), the I-1 zone implements and is consistent with the Business Park Mixed Use Future Land Use classification. The I-1zoning district allows light manufacturing, light industrial, limited retail, and office uses in a business park setting. The Use Table (6-1) in the Mesa County Land Development Code indicates contractors and trade shops, indoor operations, and outdoor storage (including heavy vehicles) are allowed uses in the I-1 zoning district. Examples of industrial services found in Section 12.06.A of the land development code include storage facilities and heating and plumbing contractors. The General Commercial (C-2) and I-1 zoning districts are the only zoning districts that allow these uses and implement the BPMU future land-use designation. Given that the C-2 zoning district also allows uses less suitable for the area than those allowed in the I-1 zoning district, rezoning to I-1 is the more appropriate option.

The medium-density residential development to the south of the subject property is some 900 feet away; the open space and canal between the subject property and those residential areas should provide a buffer that mitigates off-site impacts.

This criterion has been met.

2. The land to be rezoned was previously zoned in error or conditions have changed so thatthe rezoning is consistent with the Mesa County Master Plan;

There is no evidence that the subject property was previously zoned in error. The BPMU land-use designation appears to have followed the property’s zoning to AFT. Because the I-1 zoning district implements the BPMU future land-use designation, the proposed rezone is consistent with the Master Plan.Rezoning the property to I-1 would implement the Master Plan and allow the proposed light industrial land uses to operate in that location.

This criterion has been met.

3. Public facilities and services are or can be made adequate to serve the types and scopeof land uses allowed in the proposed zoning district.

The subject property is located in the Clifton Fire District as well as the Clifton Water, Clifton Sanitation,and Grand Valley Rural Power service areas. The Mesa County Sheriff’s Department provides law enforcement services to the area. The property has direct access to 33 Road, which is a County-maintained Road.

This criterion has been or can be met.

Section 3.09 General Approval Criteria:

A. Complies with all applicable standards, provisions, and purposes of this Land DevelopmentCode.

The proposed rezone complies with applicable standards, provisions, and purposes of the Land Development Code.

B. Is consistent with review agency comments.

The proposed rezone is or can be made consistent with review agency comments.

C. Is consistent with applicable intergovernmental agreements between the County and otherentities.

The proposed rezone is consistent with applicable intergovernmental agreements with the City of Grand Junction (MCA 83-26). The City of Grand Junction was notified of the rezoning application. No comments from the City were received by the Mesa County Planning Division.

This criterion has been met.

VI. PUBLIC COMMENTS

Public hearing notices were sent to owners of property within 2,500 feet of the subject parcel. Two letters ofopposition from nearby property owners have been received by the Planning Division.

VII. REVIEW AGENCY COMMENTS

The application was transmitted to 14 review agencies, nine of which provided comments. All reviewagency comments are in the project file and hearing binder.

VIII. STAFF RECOMMENDATION

The Planning Division recommends APPROVAL of the rezone from AFT to I-1 on the basis that:

The proposed rezone satisfies the rezoning approval criteria in Section 4.15.C of the Mesa CountyLand Development Code;

The proposed rezone satisfies the general approval criteria in Section 3.09 of the Mesa County LandDevelopment Code;

The proposed rezone is consistent with the Grand Junction Comprehensive Plan’s future land-usedesignation of the subject property and the Clifton-Fruitvale Community Plan.

If this development, at any point of being developed, increases traffic volumes by 20% at highway 6 and 33 Rd, a CDOTaccess permit application and traffic study will be required to be submitted to CDOT.
