Mandate of State Prosecutor

Organizational structure of State Prosecutor:

State Prosecutor is an independent Institution and it exercises its functions

independently and impartially. During the exercise of its functions it ensures equal and

objective treatment of all persons, without any discrimination on national, gender,

racial basis, political and religious views and social status.

• Basic Prosecution Offices, Seven (7) Basic Prosecutions, spread accros territories of

seven (7) regions of Kosovo.

• Special Prosecution of the Republic of Kosova, being the specialized prosecutorial

body, has the jurisdiction over the entire territory of the Republic of Kosova;

• Appellate Prosecution, as a second instance having the authority over the entire

territory of the Republic of Kosova;

• Office of Chief State Prosecutor, the highest instance of State Prosecutor, having the

authority over the entire territory of the Republic of Kosovo;

We will be independent, fair and will seek justice in

every case, acting professionally and aiming to

achieve excellence.

For this purpose, during the implementation of the

constitutional and legal mandate, the work plan

contains specific, measurable and achievable

objectives, which will be realized according to

concrete activities and measures, as well as certain

time limits.

Protection of society against criminality and

providing a safe environment for all is a cornerstone

of the work of State Prosecutor. Bringing all

offenders before Court and prosecute them, until the

issuance of a decision based on a merit trial, is our

primary goal.

• Creation of trust in the public that State Prosecutor

is professional, transparent, accountable, efficient,

effective and independent;

• Advancement of the State Prosecutor's

professional work;

• Detection, investigation and successful

prosecution of persons committing criminal offenses

and

• Sequestration and confiscation of assets acquired

by criminal offense.

Objective 1

Advancement of the State

Prosecutor's professional work

We shall:

▪ Contribute in meeting objectives as defined in the

strategic Plan "Justice 2020";

▪ Work with institutions of the rule of law in

empowerment of criminal justice system;

▪ Contribute in the reform of the justice system in our

country;

▪ Improve the method o f p rov i s i on and

administration of evidence;

▪ Work with police and other insitutions to advance

the criminal offences;

▪ Provide data from Appellate Prosecution on the

grounds of dismissals and termination of

investigations.

Objective 2 • Creation of trust in the public that State Prosecutor is professional, transparent, accountable, efficient, effective and independent;

▪ Provide trainings on ethics and professional conduct

and we will establish an advisory mechanism for all

prosecutors in accordance with the new Code of Ethics

and relevant guidelines.

 ▪ Strengthen the integrity of the State Prosecutor

through the efficient functioning and implementation of

the new disciplinary system of prosecutors in

accordance with the applicable law;

▪ Implement the Strategy for Public Communication

2018-2020 and media, aiming at building a strong

partnership between State Prosecutor and wider

community;

▪ Provide trainings on ethics and behavior

We shall:

▪ Improve the services offered to victims and witnesses;

indiscriminately;

▪ Establish new high quality and clear standards for

timely communication with crime victims;

▪ Organize campaigns that will inform the public about

our work and role in fighting and preventing criminality;

▪ Ensure that cases of domestic violence, criminal

offences of hatress and violence against journalists will

be dealt with according to national guidelines and best

practices;

These shall be achieved through:

Objective 3•Providing justice through efficient case management;

We will:

▪ provide guideline to investigators on cases that

may or may not be successful;

• Make the right decisions and treat every case fairly

and equally, and propose adequate measures

against the accused persons;

• Speed up actions of justice through the preparation

of cases on timely manner and the efficient

application of alternative procedures and other

procedures (mediation, plea agreement);

• Build effective partnerships at local and

international level to strengthen the criminal justice

system in order to prevent crime in the country.

We will:

▪ Make interconnection of new databases and advancement of actual SP

databases to those of the police and key information exchange

institutions;

• Use the electronic case management system according to a prepared

dynamic plan

• Provide adequate information to staff on application of CMIS;

• Provide on-the-job training for application of CMIS;

• Invest in information technology and provide working equipment through

CMIS for all staff.

• Memorandums of cooperation with CBK, TAK, Customs and

other agencies, in order to provide information for efficient

investigation and prosecution of committers of criminal

offenses

• Completion of CMIS platform and registration of new and old

cases in this system;

• Round Tables and Brochures for Notification of

Implementation of CMIS

• Organization of trainings for implementation of CMIS;

• Identification of needs, allocation of budget funds and

provision of equipment on timee

• Regular supervision of implementation and drafting of

reports

Objective 5 Detection, investigation and successful prosecution of criminal offenses prioritized by State Prosecutor

We will:

▪ Strengthen SPRK in addressing high level

corruption and economic crimes;

▪ Handle cases of organized crime with priority;

▪ Handle cases of organized crime with priority;

▪ Handle high-level corruption cases;

▪ Prevent cases against human trafficking;

▪ Prevent cases against trafficking narcotics;

▪ Handle cases of domestic violence and attacks on

journalists with priority;

▪ Prevent criminal offenses against property

(robery);

▪ Increase efficiency in proceding cases of terrorism;

▪ Increase number of solved cases for serious

undisclosed criminal offenses;

▪ Continue targeting serious crime and high profile

corruption cases;

▪ Continuing the work of the Unit for Corruption and

Economic Crime in the Basic Prosecution of Prishtina;

▪ Lodge appeals and extraordinary legal remedies

and

▪ Handle the cases transferred from EULEX with

priority.
