Board of Governors Agenda Date: 11/14/12 Page 3 13. Arizona Minimum Wage Increase for Unclassified Pay Rates for Temporary Employment

• Effective January 1, 2013 the minimum wage within the state will be increased to $7.80 per hour. This increase only affects the Unclassified Pay Schedule since the regular employee pay schedule begins at $12.94 per hour.

Public Comment on Agenda Items – Call to Audience

The Pima Community College Board of Governors welcomes public comment on issues within the jurisdiction of the College. Comments should be limited to items listed on the agenda and to five minutes per individual. At the conclusion of public comment, individual Board members may respond to criticism made by those who addressed the Board, may ask staff to review a matter, or may ask that a matter be put on a future agenda. Members of the Board, however, may not discuss or take legal action on matters raised during public comment unless the matters are properly noticed for discussion and legal action. Finally, be advised that internal College processes are available to students and employees for communication.

• Administration is requesting authorization to approve the Library’s participation in Maricopa Community College’s intergovernmental agreement with EBSCO Information Services for the purchase of library periodicals and subscriptions. Renew and initiate periodical and serial subscriptions with EBSCO for Fiscal Year 2013 and Fiscal Year 2014 not to exceed $116,000 annually.

15.5 Intergovernmental Agreement: Pinal County Community College District for Permission to Offer Courses in Pinal County

• Administration is requesting authorization to approve an Intergovernmental Agreement (IGA) with Pinal County Community College District entitled “Intergovernmental Agreement for Collaboration”. The contract renews an expired agreement in effect from July 1, 2011 through June 30, 2012, through which Central Arizona College grants permission for Pima Community College to offer courses in Pinal County. These courses are occupational dual enrollment courses through a separate IGA with Central Arizona Valley Institute of Technology (CAVIT), the Pinal County Joint Educational Technical Education District (JTED), and are only for courses not currently offered by Central Arizona College. The contract performance period is from January 1, 2013 through June 30, 2016.

15.6 Grant Proposal: Arizona Sun Corridor Get Into Energy Consortium, Pima Community College, Community Campus

• Administration is requesting authorization to approve the Arizona Sun Corridor Get Into Energy Consortium grant proposal, and if funded, acceptance of the grant award from the Department of Labor. If funded, the grant will run from October 1, 2012 through September 30, 2016. The total amount requested for Pima Community College is $1,796,610. The Consortium total amount being requested is 13,477,799.00.

15.7 Grant Proposal: Fulbright Scholar Program, Scholar-in-Residence Program, Pima Community College, Office of the Provost

• Administration is requesting authorization to approve the Fulbright Scholar Program, Scholar-in-Residence Program grant proposal, and if funded, acceptance of the grant award from the Fulbright Department of State Publication, Bureau of Educational and Cultural Affairs. If funded, the grant will run from August 1, 2013 through June 30, 2014. The College’s institutional commitment for the performance period of the grant is $7,423.

• Administration is requesting approval to award a contract in the amount of $9,064,000 to Lang Wyatt Construction for construction of the Northwest Campus New Building Expansion Project.

17. Creation of the Arizona Community College Coordinating Council (ACCCC)

• The Arizona Community College Presidents Council ACCPC (Executive Committee (EC) is requesting approval from the Community Colleges Governing Boards to create the Arizona Community College Coordinating Council (ACCCC).

Recommendation: Attached are the financial statements showing preliminary 2012/13 fiscal year results through September 2012. Time will be provided to discuss College fiscal matters. Justification: Pima Community College is continuing the year largely as expected, with positive net assets reported through the end of September. As indicated in the Statement of Revenues, Expenses, and Changes in Net Assets, the year-to-date decrease in net assets through month end is approximately $3.9 million, a change from the previous year’s gain of $94.8 thousand. The decrease is primarily due to decreases in tuition revenue and the timing of property tax receipts compared to the same time last year. In terms of operational performance, General Fund revenues and expenditures are in line with budget and our expectations. Personal services expenditures and commitments are 72.3 percent of budget, which is slightly higher than the previous year. Services and supplies expenditures and commitments are approximately 47.9 percent of the budget, which is slightly lower than the previous year. Statement of Net Assets As shown in The Statement of Net Assets, total net assets at the end of September were $213.9 million, which is a decrease of about $2.5 million compared to the same time last year.

Arizona Minimum Wage Increase for Unclassified Pay Rates for Temporary Employment

Recommendation: The Interim Chancellor submits the following information on the increase for the Arizona Minimum Wage: Effective January 1, 2013 the minimum wage within the state will be increased to $7.80 per hour. As of this date, every employer covered under the Act will be required to pay each employee wages not less than this amount. In order to comply with the change, the Unclassified Pay Schedule that exists to compensate temporary employees for work that does not fall within the College’s classification system has been increased as noted below. This increase only affects the Unclassified Pay Schedule since the regular employee pay schedule begins at $12.94 per hour. Additionally, as a result of the minimum wage change, the Event Assistant I was deleted and the Event Assistant II retitled. All other unclassified pay rates remain unchanged. Scott Stewart called the meeting to order at 7:05 p.m. Pledge of Allegiance Sherryn Marshall led the Pledge of Allegiance.

Public Comment and Reports Public Comment Phil Silvers, retired employee of the College, addressed the Board regarding open admissions. Greg Hart, retired employee of the College, addressed the Board regarding past administrative styles. Louise Haugh, retired employee of the College, addressed the Board regarding Prep Academy fees. AlfonsoValenzuela addressed the Board regarding his concerns about the College’s internal affairs. Mario Gonzalez, member of C-FAIRR (Coalition for Accountability, Integrity, Respect and Responsibility), addressed the Board regarding C-FAIRR’s letter to the Higher Learning Commission. Staff Representatives Staff Representatives Rose Bolz and Timothy Kelliher reported on the Staff Council meetings of September 7 and October 5. Highlights from September 7 included the following: Provost and Executive Vice Chancellor’s Report: Dr. Migler stated that the Online Standing Committee is ready to be launched. This committee will oversee the online education options. He also noted that Dr. Heather Tilson, moved to Director of Planning and Institutional Research, therefore leaving a vacancy in the Provost Office. Chancellor’s Report: On behalf of Dr. Suzanne Miles, Dr. Dolores Durán-Cerda, Interim Assistant Vice Chancellor informed everyone that College responded to the Higher Learning Commission regarding complaints about the College from C-FAIRR. She also informed that work is underway for the new Facilities Master Plan, Academics/Accreditation, and the search for a New

Chancellor is underway. Liaison Report: Leticia Anduaga, Human Resources Analyst, on behalf of Vice Chancellor Janet May reported on recruitment statistics. She also reminded everyone that the Web Time Entry is underway through September 14. AFSCME Report: There was no report. ACES Report: Jason Brown reported that the group conducted an online survey of exempt staff. A full report will be available in November. He also reported the ACES continues to have networking events. Campus/District Reports: Desert Vista Center for Training and Development is having a healthcare open house on September 18. Council Report: In coordination with the Day of Caring, each campus will “adopt” an elementary school and provide volunteers and support throughout the year. Highlights from October 5 included the following: Provost and Executive Vice Chancellor’s Report: Dr. Migler noted the Adult Education/East side Learning Center has moved to the 29th St. Coalition Center (formerly Roberts Elementary School) and that the Public Safety and that the Emergency Services Institute is in the process of moving as well. Chancellor’s Report: Dr. Suzanne Miles informed that the College won 10 awards from the National Council for Marketing and Public Relations in eight categories. She reported that the new Chancellor’s Staff Recognition award for October was given to Gary Hudman in Business Systems. Dr. Miles also clarified that internal audits are conducted to look at processes, not individuals. Dr. David Bea, Executive Vice Chancellor for Finance informed the College is reviewing its compliance with the state Smoke-Free Arizona Act. Liaison Report: Janet May, Vice Chancellor for Human Resources reported on recruitment statistics. Ms. May informed that Dr. James Sanchez, the College Psychologist, will be available for office hours at each campus on a rotating basis to assist with compliance and ethics issues. AFSCME Report: Rose Bolz informed the elections for Meet & Confer will be this month. She also reported the Downtown Campus will host the 2nd Annual Women’s Conference “We Make it Happen” on October 20. ACES Report: Jason Brown reported that ACES is in the planning stages for Meet & Confer. He also reported that a few more requests are awaiting approval for Staff Development. Campus/District Reports: East Campus is working with the Clements Center for their 16th Safe Halloween, October 27. Council Report: There was a suggestion to name a building after Larry Toledo, first executive director of athletics. There is a new and improved Nursing Program at the West Campus.

Student Representatives Student Representatives Josue Saldivar and John Valenzuela reported on recent events from each campus. Highlights included: Community Campus: Adult Education Student Leaders have been present at the Adult Education Learning Centers and GED 101s with a Voter Registration and Outreach campaign. Desert Vista Campus: a National Collegiate Alcohol Awareness Week was held the week of October 21-27. Downtown Campus: Had a Heroes’ Day: Recognizing Our Pima Community College Police on October 18. East Campus: Closed the Hispanic History Month with “389 Miles Living the Boarder a Human Journey” a film from Luis Carlos Romero-Davis. Northwest Campus: Held a Trunk O’ Treat to host a safe Halloween in partnership with the NW-YMCA. West Campus: Pride Week: Gay Straight Alliance hosted events during the week of October 8. Faculty Representatives Faculty Representatives Patricia Figueroa and Kimlisa Salazar Duchicela shared information about activities and communications that occurred at the September 7 and October 5 Faculty Senate Meetings. Highlights from September 7 included the following: Jeannie Arbogast reported that the Ad-Hoc Committee sent the surveys to the Faculty Senate for the Student Evaluation Response Forms and received great feedback. Mary Mitchell, Chair of the Adjunct Faculty Senate Committee thanked the senate for their support in the inclusion of adjunct faculty in the 3.5 salary raise. Faculty Senate President’s Report: Senate President Joe Labuda discussed the changes in the Faculty Senate Charter. PCCEA Update: Rita Flattley reminded everyone to do a step progression plan. She also mentioned that there are two important task forces needed for this semester: Internship Program Task Force and Department Chair Task Force. Provost Migler reported that the Online Standing Committee was schedule to meet the following Friday at 1:00 p.m. Interim Chancellor’s Report: Dr. Miles stated that the curriculum and placement is in the hands of faculty and will not change. She also reported that she will be looking at standing committee terms for staff and faculty. Dr. Miles reported the statewide Presidents Council is looking for an entity or a person from Arizona to represent all community colleges. Dr. Johnson Bia, President at Desert Vista Campus,

gave a campus up-date. Highlights from October 5 included the following: Dave Stephen proposed the possibility of an Emeritus program at Pima. He suggested that the existing SPG on Emeritus be updated and revised to sensible reflect what emeritus means. It was noted that this topic is being discussed in Chancellor’s cabinet. PCCEA Update: Rita Flattley reminded faculty to participate in the PCCEA fall faculty survey. During the adjunct faculty report, Mary Mitchell stated that adjunct faculty request that they be referred to as adjunct faculty and not just adjuncts as a matter of respect. Provost’s Report: Dr. Migler noted that the new Online Learning Committee was no actively meeting and the General Education committee had been reconstituted. He also informed that the College’s high school outreach is moving forward with TUSD targeting reading, writing and math. Interim Chancellor’s Report: Dr. Miles reported on the PCC’s Sculpture-on-campus reception at East campus that took place on October 10. She also reported that after feedback is obtained from the community, college employees will have an opportunity to participate in the development of the College Plan. In the president’s report Dr. Kajstura talked about the expansion of the NW Campus Student Life and Science Building. In open forum Dr. Dolores Durán- Cerda told the senate about the possibility of the College hosting an international Fulbright scholar in residence, which was supported by senate. Governing Board Member Reports Chairperson’s Report: Scott Stewart noted that attended the ACCT Conference in Boston, MA along with Dr. Lorraine Morales, Acting Community Campus President; Dr. Nancy Sorenson, East Campus Vice President of Student Development and Dr. Anne Vosberg, Community Campus Vice President of Student Development to give a presentation on placement requirements and give and update of the progress of the Prep Academy. He thanked them and acknowledged their good job at the conference. He also stated that while at the conference he attended a session on financial aid presented by the Regional Advisory Committee. He reminded everyone College Plan forums were being held to give the community an opportunity to provide insights and recommendations, the next forum to be held on October 2 at 3:30 p.m. at the Sam Lena Library. Board members Brenda Even and David Longoria, Co-chairs of the Chancellor Search Advisory Committee, gave an

update on the Chancellor search. Dr. Even stated they have a solid committee and that everyone is excited and committed to the selection of a new Chancellor for the long term. She also mentioned the advisory search committee went over the confidentiality requirements and that the confidentiality form was signed. Dr. Even reported that John Richardson, Legal Counsel to the Board, provided insights about executive session and open meeting laws. She also mentioned that Liz Rocklin the search consultant gave a background of previous searches and the stages of the search process. David Longoria informed that the Chancellor’s position profile was completed and posted on the web and advertised on educational magazines. He also mentioned the committee members were excited and looking forward to the challenge. Secretary to the Board Report — There was no report. Marty Cortez extended an invitation to members of the community who spoke during Public Comment and did not finish within the time allotted, to submit their comments to the Board. Sherryn Marshall invited the community to attend an event to be held October 31 at 3:30 p.m. at the Old Pueblo Neighborhood Center to protect Social Security and Medicare. Chancellor’s Report

Dr. Suzanne Miles mentioned that four more brainstorm sessions for the public would be held on the College Plan and will be advertised in the Tucson Weekly. She also informed the 29th Street Coalition Center Open House will be held October 25. Condolences were extended to the Downtown Campus Vice President of Instruction, Brigid Murphy, on the passing of her father. She congratulated Staff Council on the efforts to raise money for Gabriel Zimmerman’s Scholarship Fund. She informed that she met with student representatives again this semester and had a very healthy discussion. Dr. Louis Albert, Desert Vista President and Ted Roush, Vice President of Instruction gave a presentation about the Desert Vista Title V Grant. Scott Stewart informed that the Board will adhere and reinforce the time limit of five minutes for Public Comment.

The Board of Governors authorizes the PCC Library to renew and initiate periodical and serial subscriptions with EBSCO for Fiscal Year 2013 and Fiscal Year 2014 not to exceed $116,000 annually. Justification: Maricopa Community College, the largest community college district in the United States, completed a Request for Proposal process for library periodicals and subscriptions in 2009. The contract includes language that allows other institutions the same pricing terms and conditions. EBSCO Information Services was awarded the 4-year contract which has an option for a one year renewal. EBSCO is Pima Community College’s current provider of periodical and subscription services. The PCC Library would like to join the cooperative agreement in order to take advantage of the pricing offered to Maricopa and to streamline the efficiency of internal purchasing, invoicing and payment operations. Due to the fact we are already using this supplier, the implementation of this change is expected to be minimal. Recommendation: The Interim Chancellor recommends that the Board of Governors approve an intergovernmental agreement for collaboration with Pinal County Community College District. The purpose of this agreement is to for Pinal County Community College District to grant permission for Pima County Community College District to offer certain specified occupational courses in Pinal County. Justification: In 2009, the Central Arizona Valley Institute of Technology (CAVIT), the Joint Technological Education District (JTED) of Pinal County, expressed interest in entering into dual-enrollment, concurrent-enrollment, contract instruction or other agreements with Pima Community College for certain CAVIT occupational courses that are not currently part of the curriculum at Central Arizona College. In 2011, Pima Community College entered into an intergovernmental agreement with Central Arizona College, to meet the statutory requirements below. Arizona Revised Statute 15-1470, Subsection A, states “A [community college] district may offer credit and noncredit courses and services outside of the district in other districts within this state.” Subsection D states “Before a district may offer courses pursuant to Subsection A, the district shall enter into an intergovernmental agreement with the [community college] district in which the courses will be held.” Pima Community College also entered into an intergovernmental agreement for high school dual enrollment with CAVIT in 2011; this agreement is currently in force and expires June 30, 2016. Under this agreement, CAVIT and Pima Community College collaborated to offer dual enrollment courses during the 2011-2012 school year. It is the intent of CAVIT and Pima Community College to again offer high school dual enrollment courses in subsequent years. The original intergovernmental agreement with Central Arizona College expired June 30, 2012. The proposed new agreement will begin January 1, 2013 and expire June 30, 2016.

The grant funds development and expansion of innovative career training programs that meet industry needs, invest in staff and educational resources, and provide access to free, digital learning materials. The grant will train trade impacted and other unemployed workers for high skill, high wage employment in energy and mining industries, using the Center for Energy Workforce Development “Energy Industry Fundamentals Certificate” (model of industry approved course competencies). The grant performance period will be October 1, 2012 through September 30, 2016. The total amount requested for Pima Community College is $1,796,610. The Consortium total amount requested is $13,477,799.00 Justification: The Arizona Sun Corridor Get Into Energy Consortium (ASC- GIEC), led by Estrella Mountain Community College, is a collaboration between five of the states’ community colleges located within this high growth region. These colleges are Estrella Mountain Community College (EMCC), Chandler Gilbert Community College (CGCC), Pima Community College (PCC), Northland Pioneer College (NPC), and Yavapai College (YP). The five colleges each provide some segment of the current education pathway for two critical Arizona industries- Energy and Mining, but that pathway must be strengthened and expanded to meet the growing needs of the region. This project will link Arizona community colleges with all the electricity providers in the state and two of the largest mining companies, along with governmental agencies, and the Center for Energy Workforce Development (CEWD), in a coordinated effort to provide trade affected workers with the skills needed to fill these critical positions. Existing education pathways will be modified to provide accelerated options for workers with relevant skills and prior experience, common programs of study will be developed to allow student flexibility to move between programs to meet geographic demand and earn stackable credentials, innovative delivery options and advanced learning methodology will be introduced to accelerate learning, and two new degree options will be added to address industry demand. This project will provide a sustainable foundation for educating the energy and mining workforce for Arizona and support the needs of the thousands of workers affected by foreign trade.

If funded, the grant performance period will be August 1, 2013 through June 30, 2014. The College’s institutional commitment for the performance period of the grant is $7,423. Justification: The Fulbright SIR Program will provide activities that the scholar will be involved in, for example: Participating in special seminars or colloquia that would benefit the scholar's expertise, assisting in developing new courses or programs, assisting in upgrading existing course materials. The College will offer the Fulbright Scholar-in-Residence direct and indirect financial resources including in-kind contributions toward Professional Development. These contributions are aimed at supporting and enhancing the quality of life for the Scholar-in-Residence and provide for a fuller opportunity to experience the life and culture of community colleges in the United States. Other financial remuneration including relocation and travel costs, insurance, and a monthly stipend will be provided directly to the Scholar-in-Residence by the Department of State’s Bureau of Educational and Cultural Affairs. Recommendation: The Interim Chancellor recommends the Board of Governors approve the award of contract in the amount of $9,064,000 to Lang Wyatt Construction for construction of the Northwest Campus New Building Expansion Project. Justification: The Northwest Campus expansion is a 48,000 G.S.F. building that will include science labs, general classrooms, a large lecture classroom, math, and engineering labs, hotel restaurant management space, restrooms, an elevator and associated support space. In July the College issued a Request for Qualifications (RFQ) to identify qualified contractors for the new building project. A committee of five representatives from various College Campuses, District Office, and Facilities Operations and Construction evaluated the proposals and identified six pre-qualified contractors. Four of the pre-qualified contractors are from Tucson, one is from Tempe, and one is from Phoenix. All six pre-qualified contractors submitted bids on October 22, 2012. Purchasing and Facilities Operations and Construction personnel have reviewed the bid and found it to be responsive and responsible and are recommending approval of Lang Wyatt Construction. College Plan Initiative: Initiative 5 – Improve the Use of Physical Assets - Annual Capital Budget Financial Considerations: The costs associated with this action are included with proposed capital outlay projects presented during the annual capital budget process.

Creation of the Arizona Community College Coordinating Council (ACCCC)

(206-4747) Recommendation: The Interim Chancellor recommends the Board of Governors approve the resolution from the Arizona Community College Presidents Council (ACCPC) creating the Arizona Community College Coordinating Council (ACCCC). Justification: The mission of the ACCCC is to represent the common interests of community college districts in Arizona. The ACCCC will be governed by a Board composed of the chief administrative officers of the community college districts. However, no ACCCC Board action shall impair the sovereignty of a local district’s Governing Board. The ACCCC’s Executive Director will serve as a single point of contact for policymakers concerning the interests, perspective, and views of the state’s community colleges. Community college districts will be full members of the corporation (represented by their chief administrative officer). Each full member will be entitled to one seat on the Board of Directors, to be filled by the district’s chief administrative officer, with no designees. Dues shall be established at 110 percent of the adopted annual budget, less any projected unencumbered carry-forward from the prior year. Dues shall assessed to districts based on their proportion to total statewide average FTSE for prior two fiscal years, prior to adoption of annual budget. The Council shall support the activities of any association of Arizona community college district governing board members. Provisional districts may be provisional members of the Arizona Association of District Governing Boards (AADGB). Provisional members are not entitled to representation in the ACCCC. Financial Considerations: The costs associated are determined by the ACCPC.
