others in the (( massacre of ?@ "uslims in aroda =atiya. "s ,agnikhas recei0ed at least threat letters since the 0erdict5 as well as

7lank phone calls at her home. he ) year old !udge has informed the

Supreme /ourt-appointed Special %n0estigation eam a7out the threats

and phone calls5 7ut instead of strengthening her protection5 the

go0ernment has scaled down her security co0er. he S% con0enor and

3dditional 8%4 of =olice has denied knowledge of the letters5

according to the news-report. "eanwhile con0ict "aya >odnani5

condemned to life imprisonment as principal conspirator in a massacre5

sentenced to imprisonment till death is now a7out to en!oy three

months 7ail for medical treatment.

he %ndian criminal !ustice system is 7eing politically degraded with

e0ery passing day. Bith regard to the 0iolence in 4u!arat in ((5

there ha0e 7een instances of se0eral encounter-accused policemen 7eing

re-instated and cases against them 7eing Cuietly dropped. "eanwhile in

"aharashtra5 there is no sign that the murderers of arendra 8a7holkar

and 4o7ind =ansare will e0er 7e caught. %n 1ihar5 the acCuittals of

those accused of massacring 8alits in Shankar7igha and 1athani-tola

show that the !ustice system is incapa7le or unwilling to punish those

who commit mass crimes. ow we ha0e an upright !udge 7eing threatened5

whilst murder con0icts guilty of heinous crimes are out on 7ail5 and

suspended policemen o7tain re-instatement.

3n onslaught on !ustice is taking place in 7road daylight. %t is now

clear that the "odi-led go0ernment finds %ndiaDs criminal !ustice

system and independent !udiciary to 7e an o7stacle 7locking its

long-term plans. he incidence of pre!udice in the courts is nothing

new - the $?A pogrom inaugurated a new era in the erosion of %ndian

!ustice. he 83 go0ernment has gi0en impetus to this process. he

ideological hooligans of the so-called DSangh pari0arD are con0inced

they are a7o0e the law. /orruption does not merely ha0e monetary

implications. he erosion of !udicial independence taking place 7efore

our eyes is also corruption. 1uilding trustworthy pu7lic institutions

/onsta7ulary speaks 0olumes a7out the status of law and order in 9ttar =radesh5 the most populous state of %ndia. Bho will 7e safe on the

streets when e0en a !udge is not spared 7y the rapistsH o one5 in

fact is5 as e0idenced 7y the recent spate of incidents of seual

0iolence against women from marginalised and dispossessed 7ackgrounds.

he gruesome gang rape and murder of two minors in 1adaun5 the most

ghastly of them5 has caused a national outrage !ust a few days 7efore

this incident. he 7raen attack on the mother of a rape sur0i0or in

order to force her to withdraw the complaint against the accused5

currently in !ail5 in near7y Etah was another glaring eample of total

collapse of rule of law in 9ttar =radesh.

Sadly5 the state has ne0er 7een known for maintaining e0en law and

order5 forget enforcing rule of law. %t has rather had the du7ious

distinction of 7eing the pro0er7ial 1ad Gands5 the countryside run 7y

might and not 7y rule7ooks. Bith 7oth political and 7ureaucratic

leadership oscillating 7etween the denial to dodging mode5 the recent

chief minister and current parliamentarian5 terming rape as minor

here were others5 largely in the secular li7eral intelligentsia of the country5 who saw a political conspiracy hatched 7y the 6indu right

7ehind defaming the state. hey came up5 rightly5 with the data from

the ational /rime #ecords 1ureau that shows "adhya =radesh as the

rape capital of %ndia and raised Cuestions o0er the undue scrutiny of

9ttar =radesh. he intelligentsia5 unfortunately5 seems to ha0e got it

wrong once again5 first time 7eing its silence on the cases where

0ictims came from dispossessed and marginalised communities. he lack

seual harassment 7y a !udge of the "adhya =radesh 6igh /ourt. he

!udge asked her to Mdance to an item songM and influenced her transfer
