PERSATUAN INSURANS AM MALAYSIA(General Insurance Association of Malaysia)

The Persatuan Insurans Am Malaysia (PIAM) was formed in May 1979 in compliance with Societies Act, 1966 (Revised 1987).

PIAM constitutes the statutory association recognised by the Government of Malaysia for all registered insurers who transact general insurance business in this country.

The key objects and powers of PIAM are :-

• To promote the establishment of a sound insurance structure in Malaysia in co-operation and consultation with Bank Negara Malaysia.

• To promote and represent the interests of members in or connected with Malaysia by all means and methods consistent with the laws and Constitution of Malaysia.

• To render to members where possible such advice or assistance as may be deemed necessary and expedient.

• To take note of events, statements and expressions of opinion affecting members, to advise them thereon and represent their interests by expression of views thereon on their behalf as may be deemed necessary and expedient.

• To work as far as possible in co-operation with other similar associations elsewhere in the world.

• To circulate information likely to be of interest to members and to collect, collate and publish statistics and any other relevant information relating to general insurance.

• To work in conjunction with any legal body or any chamber or committee or commission appointed or to be appointed for consideration, framing, amendment or alteration of any law relating to insurance.

• To organise and manage arrangements and matters of common interest, concern or benefit to members or any group of members and to collect and manage funds for the same.

• To make rules, regulations and bye-laws in accordance with these Articles in consultation with Bank Negara Malaysia.

MANAGEMENT COMMITTEE REPORT 2013/2014

We have pleasure in presenting the 2013/2014 Report of the Management Committee. This report provides an overview of the general insurance industry and highlights of the activities and projects of the Association for the period under review.

BUSINESS REPORT

The domestic financial system remained resilient in 2013 with major reforms to strengthen its stability. The insurance industry in Malaysia has evolved over the years to become a significant contributor of economic growth, with total net premiums and contributions (from the takaful sector) collected by the industry in 2013 amounting to 4.9% of the gross domestic product (GDP) of Malaysia. Results of updated and multi-year stress tests by Bank Negara Malaysia (BNM) continue to indicate sufficient earnings and capital buffers for financial institutions, including insurance companies, to withstand severe scenarios of adverse portfolio flows and contraction in the domestic economy. Insurance companies maintained strong capital adequacy in 2013 with the capitalization of the insurance industry strengthening further to achieve an aggregate capital adequacy ratio (CAR) of 245.9% (2012: 219.1%). The capital buffers of insurance companies were also above the minimum regulatory requirement, totalling RM23.5 billion.

In the general insurance sector, losses from the compulsory motor insurance segment have continued to impact overall claims and underwriting performance. The implementation of the New Motor Cover Framework remains critical to support the long term sustainability of this segment. The implementation of this framework progressed further with the third round of motor insurance premium adjustments to re-balance the premiums against the risk of this class. The Accident Assist Call Centre (AACC) was also introduced to provide immediate assistance to consumers involved in road accidents. There is also a well-documented Motor Claims Guide for use by the public. These are all measures which are expected to contribute to more efficient claims processes and greater control over claims costs. It is to be noted that all the measures introduced under the framework have contributed to a reduction by up to three months in the average time taken to settle third party bodily injury claims.

The insurance industry saw several legislative, structural and institutional enhancements with the introduction of

Sistem kewangan dalam negeri kekal berdaya tahan pada tahun 2013 dengan reformasi besar untuk mengukuhkan kestabilannya. Perkembangan industri insurans di Malaysia sejak beberapa tahun yang lalu menjadikan industri ini penyumbang utama pertumbuhan ekonomi, dengan jumlah premium bersih dan sumbangan (daripada sektor takaful) yang dikumpul oleh industri pada tahun 2013 mencatatkan 4.9% daripada keluaran dalam negara kasar (KDNK) Malaysia. Keputusan dikemaskini dan ujian tekanan pelbagai tahun oleh Bank Negara Malaysia (BNM) masih menunjukkan pendapatan yang mencukupi dan penimbalan modal bagi institusi kewangan, termasuk syarikat-syarikat insurans, dalam menangani senario teruk aliran portfolio buruk dan penguncupan dalam ekonomi domestik. Syarikat-syarikat insurans mengekalkan kecukupan modal yang kukuh pada 2013 dengan permodalan industri insurans diperkukuhkan lagi untuk mencapai agregat nisbah kecukupan modal (CAR) sebanyak 245.9% (2012: 219.1%). Penimbalan modal syarikat-syarikat insurans juga melebihi keperluan pengawalseliaan minimum, yang berjumlah RM23.5 bilion.

Dalam sektor insurans am, kerugian daripada segmen insurans motor wajib terus memberikan kesan ke atas keseluruhan tuntutan dan prestasi pengunderaitan. Pelaksanaan Rangka Kerja Baru Perlindungan Motor masih kritikal untuk menjamin ketahanan jangka panjang segmen ini. Pusat Panggilan Bantuan Kemalangan (AACC) juga telah diperkenalkan untuk menyediakan bantuan segera kepada pengguna yang terlibat dalam kemalangan jalan raya. Terdapat juga Panduan Tuntutan Motor yang disediakan untuk kegunaan orang ramai. Ini adalah langkah-langkah yang dijangka akan menyumbang kepada proses tuntutan lebih cekap dan kawalan yang lebih sempurna ke atas kos tuntutan. Semua langkah-langkah yang diperkenalkan di bawah rangka kerja ini telah menyumbang kepada pengurangan sehingga tiga bulan, masa yang diambil untuk menyelesaikan tuntutan kecederaan anggota pihak ketiga.

Industri insurans menyaksikan beberapa penambahbaikan dalam bidang perundangan, struktur dan institusi dengan pengenalan Akta Perkhidmatan Kewangan (FSA), Akta Persaingan (CA) dan Akta Perlindungan Data Peribadi (PDPA). Selain daripada mengenakan peraturan-peraturan

the Financial Services Act (FSA), the Competition Act (CA) and the Personal Data Protection Act (PDPA). Aside from imposing certain rules and regulations, these Acts also change the way insurers carry out their businesses with focus on prudence, governance, transparency and consumer protection. With the development of a comprehensive regulatory and supervisory framework for the insurance industry and a more competitive insurance market, the industry is directing its efforts to ensuring a firm foundation for orderly transition into this new and challenging environment.

As consumer awareness on the benefits of insurance coverage increases and with the demand for more sophisticated products in the past few years, the general insurance industry expects a similar trend of growth in 2014 which will result in an increase in market penetration. In addition, the general insurance industry will also benefit from the current ongoing projects in Malaysia like the LRT and high speed rail between Malaysia and Singapore with demand of Workmen’s Compensation Insurances and CAR and Engineering classes. Stronger demand is also expected for Medical and Personal Accident which has been in tandem with the rising per capita income of Malaysians.

One of the main challenges for the insurance industry and the Association in particular is the preparation towards liberalization. Malaysia has been regulated by a tariffed market for the two major classes i.e. the Motor and Fire classes. It will be a challenge for the industry to transition to a non-tariff market and the insurance industry is working closely with the regulators to facilitate an orderly transition to a liberalized market.

Association Membership As at 1 April 2014, the Association had 29 members comprising licensed general insurance and reinsurance companies operating in Malaysia. There were 18 general insurers, 5 composite insurers and 6 general reinsurers. Out of the 29 member companies, 13 were domestic operations whilst 16 were foreign owned.

Permintaan yang lebih besar juga dijangka untuk Perubatan dan Kemalangan Diri sejajar dengan pendapatan per kapita rakyat yang semakin meningkat di Malaysia.

Salah satu cabaran utama bagi industri insurans dan Persatuan ini khususnya adalah persediaan ke arah liberalisasi. Malaysia sehingga kini telah dikawal selia oleh pasaran tarif untuk kedua-dua kelas utama iaitu kelas Motor dan Kebakaran. Ia akan menjadi satu cabaran bagi industri untuk beralih kepada pasaran bukan tarif, dan industri insurans sedang bekerjasama rapat dengan pihak pengawal selia untuk memastikan peralihan yang lancar ke arah pasaran yang liberal.

General Insurance Business Performance In 2013, the general insurance industry registered a growth of 6.4% in Gross Written Premiums to reach RM16.151 billion compared to an increase of 8.2% in 2012 at RM15.180 billion. Net Premiums grew at a rate of 9.9% to reach RM11.569 billion (2012: 8.3% at RM10.527 billion).

General Insurance Business Market ShareIn terms of market share, Motor Insurance remained the dominant class with a share of 46.6% of the total business underwritten (2012: 46.0%). This was followed by the Fire insurance class which improved to 17.3% (2012: 16.9%).

The Motor and Fire classes of business achieved an increase in gross written premium of 7.8% to reach RM7.524 billion (2012: RM6.978 billion, 9.3%), and 8.6% to reach RM2.793 billion (2012: RM2.571 billion, 7.2%) respectively.

Net Claims Incurred Ratios (NCIR) By SectorsThe overall Net Claims Incurred Ratio (NCIR) dropped slightly to 56.7% in 2013 from 56.8% in 2012. The overall Motor NCIR increased to 72.7% (2012: 72.3%), whilst Medical and P.A. dropped to 50.6% (2012: 56.6%) and 27.0% (2012: 28.9%) respectively.

The NCIR for “Motor Act” cover (i.e. cover for compulsory third party bodily injury and death liabilities), dropped this year to 206.5% from 249.5% in 2012.

Underwriting Margin The general insurance industry recorded an underwriting margin of 12.9% amounting to RM1.446 billion compared to 12.8% amounting to RM1.297 billion in 2012. The combined management expenses and commissions ratio of insurance companies remained stable with a slight decrease to 30.3% in 2013 from 30.4% in 2012.

DEVELOPMENTS IN THE GENERAL INSURANCE INDUSTRY

Personal Data Protection Act 2010The Personal Data Protection (PDP) Act 2010 came into force on 15 November 2013 to regulate the processing of personal data in commercial transactions. This Act affects the personal data life cycle management processes from the point the personal data is collected to the point it is used, stored and destroyed.

Akta Perlindungan Data Peribadi 2010Akta Perlindungan Data Peribadi (PDP) 2010 telah dikuatkuasakan pada 15 November 2013 untuk mengawal selia pemprosesan data peribadi dalam transaksi komersial. Akta ini memberi kesan terhadap proses pengurusan kitar hayat data peribadi dari mula data peribadi itu dikumpulkan hingga ia digunakan, disimpan dan dimusnahkan.

The seven principles under the PDP Act are:-

• General Principle - data user is not allowed to process personal data of a data subject without the data subject’s consent

• Notice and Choice Principle - the initial purpose of the data to be collected and processed should be informed to the data subject

• Disclosure Principle - purpose of the personal data to be processed should be clearly disclosed to the data subject

• Security Principle - a data user shall take practical steps to protect the personal data from any loss, misuse, modification, unauthorized or accidental access or disclosure, alteration or destruction

• Retention Principle - personal data shall not be retained longer than is necessary for the fulfilment of the purpose for which it is processed

• Data Integrity Principle - requires a data user to take reasonable steps to ensure that the personal data is accurate, complete, not misleading and kept up-to-date, having regard to the purpose (and any directly related purpose) for which it was collected and processed

• Access Principle - confers on a data subject a right of access to his own personal data held by a data user and to correct and update the same

The Act also identifies eleven categories of data users and insurance companies have been categorized as data users under the Act. For this purpose, all insurance companies have been registered as data users under the Act. The Act imposes additional obligations on a data user as follows:-

a) the data user will be obliged to comply with any conditions or restrictions that may be imposed on him in the certificate of registration;

b) it is an offence for a data user who falls within a class specified by the Minister to process personal data without a certificate of registration;

c) records - The Act requires a data user to maintain in such form as determined by the PDP Commissioner, a record of application, notice, request or any other information relating to personal data that has been or is being processed by him; and

d) transfer of personal data - Section 129 of the Act prohibits a data user from transferring personal data to any place outside Malaysia other than a place specified by the Minister, however Section 129 (3) sets out eight exceptions to this prohibition.

Tujuh prinsip di bawah Akta PDP tersebut adalah:-

• Prinsip Am - pengguna data tidak dibenarkan memproses data peribadi seseorang subjek data tanpa kebenarannya

• Prinsip Notis dan Pilihan - tujuan awalan data yang akan dikumpul dan diproses perlu dimaklumkan kepada subjek data

• Prinsip Penzahiran - tujuan memproses data peribadi harus dizahirkan secara jelas kepada subjek data

• Prinsip Keselamatan - pengguna data hendaklah mengambil langkah yang praktikal bagi melindungi data peribadi daripada hilang, salah guna, pengubahsuaian, akses atau pendedahan tanpa kebenaran atau secara tidak sengaja, pengubahan atau pemusnahan

• Prinsip Penyimpanan - data peribadi tidak dibenarkan disimpan lebih lama daripada had masa yang diperlukan bagi memenuhi tujuan ia diproses

• Prinsip Integriti Data - seseorang pengguna data perlu mengambil langkah yang wajar bagi memastikan bahawa data peribadi tersebut adalah tepat, lengkap, tidak mengelirukan dan menepati tujuan data itu dikumpul dan diproses (dan apa-apa tujuan yang berkaitan secara langsung)

• Prinsip akses - memberi subjek data hak akses terhadap data peribadinya sendiri yang disimpan oleh pengguna data dan boleh membetulkan datanya supaya terkini

Akta ini juga telah mengenal pasti sebelas kategori pengguna data dan syarikat-syarikat insurans telah dikategorikan sebagai pengguna data di bawah Akta ini. Bagi tujuan ini, semua syarikat insurans telah didaftarkan sebagai pengguna data di bawah Akta. Akta ini mengenakan kewajiban tambahan pada pengguna data seperti berikut:-

a) pengguna data bertanggungjawab mematuhi mana-mana syarat atau sekatan yang boleh dikenakan ke atasnya dalam sijil pendaftaran;

b) adalah satu kesalahan bagi pengguna data yang termasuk dalam kelas yang dinyatakan oleh Menteri, memproses data peribadi tanpa sijil pendaftaran;

c) rekod - Akta menghendaki pengguna data menyimpan

sebarang bentuk rekod bagi permohonan, notis, permintaan atau apa-apa maklumat lain yang berhubung dengan data peribadi yang telah atau sedang diproses olehnya sebagaimana yang ditentukan oleh Pesuruhjaya PDP; dan

d) pemindahan data peribadi - Seksyen 129 dibawah Akta melarang pengguna data daripada memindahkan data peribadi ke luar Malaysia selain daripada tempat yang ditentukan oleh Menteri, bagaimanapun Seksyen 129 (3) membenarkan lapan pengecualian kepada larangan ini.

A registered data user will also be required to ensure compliance with all the provisions of the Act failing which such registration may be revoked and the data user will then be precluded from processing public data. The Minister may upon recommendation of the PDP Commissioner, exempt the application of any of the Personal Data Protection Principles to any data user or class of data users or exempt any data user or class of data users from all or any provisions of the Act. The Act will have major implications for data users in terms of implementation of IT policies, data management policies, human resource management and the expenditure on IT security will become necessary. Each sector of data users will form their own forums and they may adopt their own Codes of Practices as a standard guide for use by their forum members. PIAM together with LIAM and MTA has been working jointly to formulate a Joint Code of Practice which upon approval by the PDP Commissioner will be adopted for use by members as a guideline on compliance with the Act.

Competition Act 2010Further to the implementation of the Competition Act 2010 on 1 January 2012, a Competition Act Tribunal was formed on 15 January 2012 to ensure the enforcement of the Competition Act is more systematic and effective. The Tribunal has the power to analyze any decisions made by the Malaysia Competition Commission (MyCC) under Sections 35, 39 and 40.

The Tribunal will assist to consider the following:-

a) Appeals on decisions made under the Competition Act 2010;

b) Damages and other financial claims under the Competition Act 2010; and

c) Re-evaluation of the decisions enforced by MyCC towards the regulation under the Competition Act 2010.

Financial Services Act 2013The Financial Services Act 2013 came into force on 30 June 2013 with the exception of Section 129 and Schedule 9 which are targeted to come into force on 1 January 2015. Section 129 and Schedule 9 are both in relation to pre-contractual disclosure and representations and propose remedies for these misrepresentation. As these new requirements will result in changes to the processes of insurance companies, BNM and the Insurance Associations have formed a Working Group to look into the preparation and revised procedures that must be in place to implement these requirements.

Seseorang pengguna data yang berdaftar juga perlu memastikan pematuhan terhadap semua peruntukan Akta dan jika gagal berbuat demikian, pendaftaran tersebut boleh dibatalkan dan pengguna data itu selanjutnya akan dihalang daripada memproses data awam. Menteri boleh, atas syor Pesuruhjaya PDP, mengecualikan pemakaian mana-mana Prinsip Perlindungan Data Peribadi kepada mana-mana pengguna data atau golongan pengguna data atau mengecualikan mana-mana pengguna data atau golongan pengguna data daripada semua atau mana-mana peruntukan Akta.

Akta ini memberi implikasi yang besar bagi pengguna data dari segi pelaksanaan dasar IT, dasar pengurusan data, pengurusan sumber manusia dan biaya bagi keselamatan IT akan menjadi perlu. Setiap sektor pengguna data akan membentuk forum mereka sendiri dan mereka boleh menyediakan Kod Tata Amalan mereka sendiri sebagai panduan untuk diguna pakai oleh ahli-ahli forum mereka. PIAM bersama-sama dengan LIAM dan MTA telah bekerjasama merangka Kod Tata Amalan Bersama yang apabila diluluskan oleh Pesuruhjaya PDP akan diguna pakai oleh ahli sebagai garis panduan pematuhan Akta.

Akta Persaingan 2010Lanjutan daripada pelaksanaan Akta Persaingan 2010 pada 1 Januari 2012, Tribunal Akta Persaingan telah ditubuhkan pada 15 Januari 2012 bagi memastikan penguatkuasaan Akta Persaingan lebih sistematik dan berkesan. Tribunal mempunyai kuasa untuk menganalisa sebarang keputusan yang dibuat oleh Suruhanjaya Persaingan Malaysia (MyCC) di bawah Seksyen 35, 39 dan 40.

Tribunal akan membantu dalam mempertimbangkan perkara berikut:-

a) Rayuan-rayuan terhadap keputusan yang dibuat di bawah Akta Persaingan 2010;

b) Ganti rugi dan tuntutan kewangan lain di bawah Akta Persaingan 2010; dan

c) Penilaian semula keputusan yang dikuatkuasakan oleh MyCC ke arah peruntukan Akta Persaingan 2010.

Akta Perkhidmatan Kewangan 2013 Akta Perkhidmatan Kewangan 2013 telah dikuatkuasakan pada 30 Jun 2013 dengan pengecualian Seksyen 129 dan Jadual 9 yang disasarkan akan mula berkuatkuasa pada 1 Januari 2015. Seksyen 129 dan Jadual 9 kedua-duanya adalah berhubung penzahiran dan penyataan pra-perjanjian dan cadangan penyelesaian bagi salah nyata. Oleh kerana keperluan baru ini akan mengakibatkan perubahan kepada proses kerja syarikat-syarikat insurans, BNM dan Persatuan-Persatuan Insurans telah membentuk satu Kumpulan Kerja bagi mengkaji persediaan yang perlu untuk memastikan prosedur yang disemak semula bertepatan dalam melaksanakan keperluan ini.

New Motor Cover Framework (NMCF) And The Accident Assist Call Centre (AACC)The New Motor Cover Framework which was introduced in 2012 has a two-prong strategy, i.e. to enhance efficiency in the provision of motor cover by the industry with a gradual price adjustment that will ensure that the public is able to purchase motor insurance at affordable premiums. There have been numerous enhancement measures under the Framework implemented by the various stakeholders which include Government agencies, insurers and takaful operators, consumer and transport groups and the Malaysian Bar Council.

As part of the Framework, three revisions in the Motor Tariff premium rates were implemented and the latest revision came into effect on 15 February 2014. The gradual revisions are necessary steps to ensure that the premium rates progressively become reflective of the claims experience. These premium adjustments, although small in quantum, are the initial steps towards de-tariffing of the motor insurance business.

A significant development for the year 2013 was the setting up of Accident Assist Call Centre (AACC) under the hotline number 1300-22-1188.

The AACC had its pilot run in the Klang Valley in September 2013 and has since gone nationwide in the 4th quarter of 2013.

The AACC is a 24-hour, one single hotline number for the whole country, to assist the general public who are involved in road accidents. The service provides access to towing services and advice on claims processes. This service prevents the intervention of any unscrupulous parties at the point of an accident and empowers the public to deal directly with their insurer. The call center is also able to pass calls to the 999 Response Centre in the event other emergency services like the police or ambulance are required.

The benefits for the insurers include early notification of claims especially from third party claimants which will assist the industry to make more accurate reserve estimation; quicker direct access to third party potential claimant and which may allow insurers to settle non-complicated cases earlier; ability to use AACC to serve Private Car third party policyholders for towing of accident vehicles/claims inquiries; match and merge own data with data available at the AACC for better fraud control; and enhance the industry’s image and branding as a caring corporate citizen.

Rangka Kerja Baru Perlindungan Motor (NMCF) Dan Pusat Panggilan Bantuan Kemalangan (AACC)Rangka Kerja Baru Perlindungan Motor yang telah diperkenalkan dalam tahun 2012 mempunyai strategi dua serampang iaitu, untuk meningkatkan kecekapan dalam peruntukan perlindungan motor oleh pihak industri dengan pelarasan harga yang berperingkat untuk memastikan orang awam boleh membeli insurans motor pada premium berpatutan. Beberapa langkah penambahan di bawah Rangka Kerja Baru ini telah dilaksanakan oleh pelbagai pihak berkepentingan, termasuk agensi kerajaan, penanggung insurans dan pengendali takaful, pengguna dan kumpulan pengangkutan dan Majlis Peguam Malaysia.

Sebagai sebahagian dari Rangka Kerja ini, tiga pindaan ke atas kadar premium Tarif Motor telah dilaksanakan dan pindaan yang terbaharu berkuatkuasa pada 15 Februari 2014. Semakan yang beransur-ansur adalah langkah perlu untuk memastikan kadar premium secara beransur-ansur dapat mencerminkan pengalaman tuntutan. Pindaan keatas premium, walaupun kecil dalam kuantum, merupakan langkah awal menuju ‘de-tariffing’ perniagaan insurans motor.

Satu perkembangan penting untuk tahun 2013 adalah penubuhan Pusat Panggilan Bantuan Kemalangan (AACC) di bawah nombor talian mudah 1300-22-1188.

Projek perintis AACC telah dilancarkan di Lembah Kelang pada September 2013 dan semenjak itu telah diperluaskan ke seluruh negara dalam suku ke-4 tahun 2013.

AACC merupakan talian mudah tunggal yang beroperasi 24 jam bagi seluruh negara, untuk membantu orang awam yang terlibat dalam kemalangan. Perkhidmatan ini menyediakan laluan untuk mendapatkan perkhidmatan penundaan kereta dan nasihat dalam proses tuntutan. Perkhidmatan ini, menghalang campur tangan dari pihak-pihak yang tidak bertanggungjawab pada masa kemalangan dan memberi kuasa kepada orang awam untuk berurusan terus dengan penanggung insurans mereka. Pusat panggilan ini juga boleh menghantar panggilan kepada Pusat Jawapan 999 sekiranya memerlukan perkhidmatan kecemasan lain seperti Polis atau Ambulan.

Manfaat kepada penanggung insurans termasuk pemberitahuan awal tuntutan terutamanya dari penuntut pihak ketiga yang mana akan membantu industri untuk membuat rizab anggaran tuntutan yang tepat; laluan terus dan lebih cepat kepada penuntut pihak ketiga dan yang mana membolehkan penanggung insurans menyelesaikan kes-kes yang tidak rumit terlebih dahulu; boleh menggunakan AACC untuk memberi perkhidmatan kepada pemegang polisi pihak ketiga Kenderaan Persendirian untuk penundaan

On 26 January 2014, the Association together with the Malaysian Takaful Association (MTA) undertook an exercise to promote the AACC to motorists by handing information leaflets on the AACC and goodie bags to about 5,000 motorists passing through the Sungai Besi toll booth. In addition to promoting the AACC, the industry also aimed to drive home the important message about road safety and offer useful tips in the event of accidents.

Disamping mempromosikan AACC, pihak industri juga bermatlamat membawa mesej penting mengenai keselamatan jalanraya dan memberi tips-tips penting semasa berlakunya kemalangan.

Task Force On LiberalizationPIAM and MTA have set up a Joint Task Force (JTF) on Liberalization to craft a robust roadmap to prepare the Malaysian general insurance and takaful industry for liberalization. The JTF had reviewed the current practices in the general insurance and takaful industry in Malaysia, conducted a study on the de-tarrification approaches adopted by other markets and analyzed their subsequent market developments/trends. This review and analysis was to synthesize the information collated to articulate the liberalization roadmap for Malaysia.

The JTF had been set up in response to a request from BNM to PIAM and MTA to submit a proposal on liberalization of the Malaysian general insurance

Kajian semula dan analisa ini adalah untuk mensintesiskan maklumat yang dikumpul bagi memperjelaskan lagi pelan hala tuju liberalisasi di Malaysia.

and takaful industry as well as identify areas requiring special consideration (including any “wish list”) and prudent measures which should be introduced post-liberalization.

An external consultant had been appointed to assist the JTF in the development of a strategic roadmap on the liberalization of the Malaysian general insurance and takaful industry. The areas covered under this project to prepare for liberalization included:-

• Tariffed classes of business - Motor and Fire• Non-tariffed classes of business - these are currently

monitored by several guidelines issued by PIAM and BNM

• Agency - which is currently regulated through market agreements

The benchmarking and assessment of the proposed roadmap undertaken by the appointed consultant covered:-

• Liberalization processes and approaches• Impact on the industry and practices• Impact on distributors and key success factors, risks

and challenges• Development of diversified distribution channels • Strengthened disclosure requirements

The JTF has submitted the final paper to BNM in March 2014 and awaits BNM’s comments on the proposals from the insurance industry.

Malaysian Motor Insurance Pool (MMIP) The Malaysian Motor Insurance Pool (MMIP) was formed by insurance companies to provide motor insurance cover to vehicle owners who are unable to obtain insurance protection for their vehicles from the local insurers. The MMIP, was previously known as the High Risks Motor Insurance Pool, and is run based on a pooling concept through a collective agreement among members of the Pool.

After the set-up of the MMIP, its entire motor business was placed through two direct insurance companies acting as Servicing Insurers. In July 2009, the Pool appointed POS Malaysia as its additional servicing agent, to make the Pool’s service more accessible to the public at large. The Pool’s services had been further expanded in May 2011, when BNM issued a directive to all Insurers and Takaful Operators to act as Servicing Agents for MMIP. With the involvement of all the insurance companies, takaful operators and POS Malaysia, the Pool is now underwriting a greater volume of motor business.

The overall performance of the MMIP for 2013 (unaudited) showed a high gross written premium of RM310.8 million compared to RM273.9 million the

oleh beberapa garis panduan yang dikeluarkan oleh PIAM dan BNM

• Agensi - buat masa ini dikawal selia melalui perjanjian industri

Tanda aras dan penilaian cadangan pelan tindakan yang dilaksanakan oleh perunding yang dilantik termasuk: -

• Proses dan pendekatan liberalisasi • Kesan ke atas industri dan amalan • Kesan ke atas pengedar dan faktor-faktor kejayaan utama,

risiko dan cabaran • Pembangunan saluran pengedaran pelbagai • Memperkukuhkan keperluan penzahiran

JTF telah mengemukakan kertas cadangan akhir kepada BNM pada Mac 2014 dan sedang menunggu komen BNM berkenaan cadangan yang dikemukakan oleh industri insurans.

Malaysian Motor Insurance Pool (MMIP) Malaysian Motor Insurance Pool (MMIP) telah ditubuhkan oleh syarikat-syarikat insurans untuk menyediakan insurans motor kepada pemilik kenderaan yang tidak berjaya mendapatkan perlindungan insurans daripada syarikat-syarikat insurans tempatan. MMIP sebelum ini dikenali sebagai “High Risks Motor Insurance Pool”, di mana penubuhannya adalah berdasarkan pada konsep perkongsian diatas perjanjian kolektif di kalangan ahli-ahli Pool.

Selepas ditubuhkan keseluruhan operasi perniagaan motor MMIP dijalankan melalui dua syarikat insurans yang bertindak langsung sebagai ‘Penanggung Insurans Khidmat’. Pada bulan Julai 2009, Pool melantik POS Malaysia sebagai ejen khidmat bertujuan agar orang ramai keseluruhannya mendapat perkhidmatan insurans dengan lebih mudah. Perkhidmatan Pool terus berkembang pada Mei 2011, apabila BNM mengeluarkan arahan kepada semua Penanggung Insurans dan Pengendali Takaful untuk bertindak sebagai Ejen Khidmat untuk MMIP, ini adalah untuk menjamin kesediaan perlindungan untuk kenderaan ‘berisiko tinggi’ di pasaran. Dengan penglibatan kesemua syarikat insurans, pengendali Takaful dan POS kini berada di dalam lingkaran perkhidmatan MMIP telah menunjukkan peningkatan yang lebih besar dalam pengendalian Motor insurans.

preceding year. Albeit a slower stabilized growth rate of 13.5% compared to 30.2% in 2012, the growth in 2013 was attributed to the increasing demand for MMIP cover due to its easy accessibility and also the gradual annual premium adjustments introduced under the new Motor Cover Framework.

The MMIP recorded a net loss of RM220.0 million in 2013 (Unaudited) as compared to RM183.5 million in 2012; the large deficit was mainly contributed by the Bus segment and the rapid growth in Private Car segment. The Pool incurred an overall loss ratio of 173.5% for 2013 (Unaudited) as compared to 170.6% in the year 2012. The MMIP’s loss ratio is expected to remain high since the Pool’s objective is to provide cover for unplaced, high risk vehicles.

The number of policies issued increased slightly by 8.5% while the premium revenue reported a higher increase of 13.5%. The average premium per policy for 2013 and 2012 was RM283 and RM271 respectively, reflecting the effect of the gradual premium adjustment on Act cover which was implemented since 2012.

Prestasi keseluruhan MMIP untuk tahun 2013 (belum diaudit) menunjukkan premium kasar yang tinggi iaitu RM310.8 juta berbanding RM273.9 juta pada tahun sebelumnya. Walaupun pertumbuhan yang lebih stabil dan rendah dilaporkan pada kadar 13.5% pada 2013 berbanding 30.2% dalam tahun 2012, pertumbuhan ini adalah hasil daripada peningkatan permintaan polisi perlindungan MMIP yang senang didapati, serta pelarasan harga premium tahunan berperingkat yang diperkenalkan di bawah Rangka Kerja Baru Perlindungan Motor.

MMIP mencatatkan kerugian bersih sebanyak RM220.0 juta pada tahun 2013 (belum diaudit) berbanding dengan RM183.5 juta pada tahun 2012; defisit yang besar terutamanya disumbangkan oleh segmen Bas dan pertumbuhan pesat dalam segmen Kereta Persendirian. Pool menanggung nisbah keseluruhan kerugian 173.5% untuk tahun 2013 (belum diaudit) berbanding dengan 170.6% pada tahun 2012. Nisbah kerugian MMIP dijangka kekal tinggi kerana objektif utama Pool adalah untuk memberi khidmat bagi pemunya kenderaan yang tiada beroleh perlindungan insurans dan yang berisiko tinggi.

Peningkatan polisi insurans yang dikeluarkan adalah sebanyak 8.5% manakala pendapatan premium kasar pula dilaporkan meningkat lebih tinggi iaitu 13.5%. Premium purata bagi setiap polisi untuk tahun 2013 dan 2012 masing-masing adalah sebanyak RM283 dan RM271, ini mencerminkan kesan yang drastik daripada tindakan pelarasan premium secara beransur-ansur yang dilaksanakan dari 2012.

27th East Asian Insurance CongressThe 27th East Asian Insurance Congress (27th EAIC) will be held from 2 to 6 November 2014, at the Taipei International Convention Center, Taipei, Taiwan.

This is the 3rd time Taipei will be the host city to this biennial congress. This year’s theme “Insurance at the Cross Roads: Coping with Change” will focus on presentations and discussions on key topics which include managing CAT risks, investment management, future of life insurance in a rapidly ageing society and whether reinsurers have risen to the challenge of making the industry technical and professional.

Since its establishment in 1962, the EAIC has been a vital platform for its member cities and insurance practitioners in the region to exchange ideas and information on all aspects of insurance practices and to explore solutions for problems and issues facing the insurance industry.

39th ASEAN Insurance Council (AIC) MeetingThe 39th ASEAN Insurance Council (AIC) Meeting and the 16th Asean Insurance Regulators Meeting was held in Danang, Vietnam from 4 to 6 December 2013.

At the end of the sessions of the AIC and the ASEAN Insurance Regulators meetings, the AIC had a joint meeting with the ASEAN Insurance Regulators. Some of the issues raised at this joint meeting was the request for an update on the ASEAN Economic Community (AEC) from the Regulators, the proposal to conduct a regional study on the barriers that each country will have to transition into a liberalized market, to revisit the formation of the Reinsurance Pool concept for the ASEAN region and Capacity Building in the ASEAN as there was a need to review the different levels of skills and knowledge required in the region to better prepare itself for the future challenges.

As in previous years, the ASEAN Insurance Congress was held concurrently with the AIC. The Congress is organized under the auspices of the AIC and aims to foster a stronger integration of international standards and best practices among ASEAN insurance community members. Themed “ASEAN – Transformation for Faster Growth”, the Congress discussed the AEC 2015 and what effects it would have on the free movement of goods, services, investment, skilled labour and free flow of capital.

Kongres Insurans Asia Timur Kali ke-27Kongres Insurans Asia Timur ke-27 (EAIC Ke-27) akan diadakan dari 2 hingga 6 November 2014, di Pusat Konvensyen Antarabangsa Taipei,Taiwan.

Ini adalah kali ke-3 Taipei menjadi tuan rumah kepada kongres dua tahun sekali ini. Tema tahun ini iaitu “Insurance at the Cross Roads: Coping with Change” akan memberi tumpuan kepada penyampaian dan perbincangan mengenai topik-topik utama termasuk pengurusan risiko CAT, pengurusan pelaburan, masa depan industri insurans hayat dalam masyarakat penuaan yang berkembang dengan cepat, serta samada syarikat insurans semula dapat mengatasi cabaran untuk menuju ke arah industri yang lebih teknikal dan profesional.

Sejak penubuhannya pada tahun 1962, EAIC telah menjadi pentas penting untuk bandar-bandar anggotanya dan pengamal insurans di rantau ini untuk bertukar-tukar idea dan maklumat mengenai semua aspek amalan insurans dan mencari penyelesaian bagi masalah dan isu-isu yang dihadapi oleh industri insurans.

Mesyuarat Majlis Insurans ASEAN (AIC) Ke-39 Mesyuarat AIC ke-39 dan Mesyuarat Pengawal Selia Insurans ASEAN ke-16 telah diadakan di Danang, Vietnam dari 4 hingga 6 Disember 2013.

Pada akhir sesi AIC dan mesyuarat Pengawal Selia Insurans ASEAN, AIC mengadakan mesyuarat bersama dengan Pengawal Selia Insurans ASEAN. Beberapa isu yang dibangkitkan dalam mesyuarat bersama ini adalah permintaan maklumat terkini mengenai Komuniti Ekonomi ASEAN (AEC) dari Pengawal Selia, cadangan untuk menjalankan kajian serantau mengenai halangan yang setiap negara hadapi untuk menuju ke arah liberalisasi pasaran, untuk mengkaji semula pembentukan konsep ‘’Reinsurance Pool’’ untuk rantau ASEAN, serta peningkatan kapasiti di dalam ASEAN kerana ia diperlukan untuk mengkaji semula pelbagai peringkat kemahiran dan pengetahuan yang diperuntukan di rantau ini supaya industri lebih bersedia untuk cabaran masa depan.

Seperti tahun-tahun sebelum ini, Kongres Insurans ASEAN telah diadakan serentak dengan AIC . Kongres ini dianjurkan di bawah naungan AIC dan bertujuan untuk menggalakkan integrasi yang lebih kukuh dalam piawaian antarabangsa dan amalan terbaik di kalangan ahli-ahli masyarakat insurans ASEAN. Bertemakan “ASEAN - Transformasi Untuk Pertumbuhan Yang Lebih Segera”, Kongres ini telah membincangkan AEC 2015 dan kesan daripada pergerakan bebas barangan, perkhidmatan, pelaburan, buruh mahir serta aliran bebas modal.

Analisa Perniagaan Saluran Pengedaran

In 2013, agents garnered 61% or RM9,811.0 million of the total business in comparison to other distribution channels. Of the business acquired by the agency force in 2013, about 9% of total business was acquired via motor vehicle franchise holders. This analysis indicates that insurance agents continue to play a significant role in the acquisition channels in this market.

Dalam tahun 2013, saluran ejen telah mengumpul 61% atau RM9,811.0 juta dari jumlah keseluruhan perniagaan berbanding dengan saluran pengedaran lain. Dari perniagaan yang diperolehi oleh pengedaran pasukan agensi pada tahun 2013, lebih kurang 9% dari jumlah keseluruhan perniagaan diperolehi melalui pemegang franchise kenderaan bermotor. The percentage of agents earning above RM100,000 increased from 36.6% in 2011 to 37.5% in 2012. On the other hand, the percentage of agents earning less than RM5,000 has increased slightly as well i.e. from 14% in 2011 to 14.3% in 2012.

In terms of quantum, the total remuneration earned by agents increased by 12% to RM1,192 billion in 2012.

Trend In PCEIA PassesThe trends in the percentage of passes of the Pre-Contract Examination for General Insurance Agents (PCEIA) as at 31 December 2013 are as below:-

Peratusan ejen-ejen berpendapatan lebih daripada RM100,000 meningkat dari 36.6% pada tahun 2011 ke 37.5% pada tahun 2012. Sebaliknya, peratusan ejen-ejen berpendapatan kurang dari RM5,000 telah juga meningkat ia itu dari 14% pada tahun 2011 ke 14.3% pada tahun 2012. Dari segi kuantum, jumlah pendapatan yang diterima oleh ejen meningkat sebanyak 12% menjadi RM1,192 bilion pada tahun 2012.

There were 9,659 candidates who sat for the PCEIA examination – General Insurance Route from January to December 2013 and the overall passing rate was 75%. Degree holders account for the highest percentage of passes at 90%.

The state of Selangor has the largest number of agents comprising 7,317 agents (20%) of the total agency population followed by Kuala Lumpur at 5,286 (15%). The state with the lowest number of agents (in Peninsular Malaysia) is Perlis at 139 (0.4%).

Age Distribution of Agents

From the analysis, there were almost equal percentages of agents in the age bracket of 31 to 40 years, 41 to 50 years and above 50 years i.e. about 28.9%. Those in the age bracket of 21 to 30 years stand at about 13%.The minimum age to be an agent is 18 years old.

Negeri Selangor mempunyai jumlah ejen terbesar merangkumi 7,317 ejen (20%) daripada jumlah keseluruhan agensi diikuti oleh Kuala Lumpur seramai 5,286 (15%). Perlis mencatatkan jumlah ejen yang terendah (di Semenanjung Malaysia) iaitu seramai 139 (0.4%).

Agihan Ejen Mengikut Umur

Berdasarkan satu analisa, peratusan ejen dalam golongan usia 31 hingga 40 tahun, 41 hingga 50 tahun dan 50 tahun ke atas hampir setara iaitu kira-kira 28.9%. 13% daripada jumlah ejen terdiri daripada golongan berusia 21 hingga 30 tahun. Usia minimum untuk menjadi ejen adalah 18 tahun.

Duration As General Insurance Agent

Agents who have been in the industry for more than 9 years formed 53% of the total agency force. In contrast, about 19% of the agency force had been in the industry for less than 2 years. Those with 5 to 6 years of experience in the industry formed the smallest group at 0.6%.

Statistics on Overlapping of Agents

A joint initiative between PIAM, MTA and LIAM was undertaken to determine the number of general insurance agents who are also registered as a life or takaful agent. Based on the statistics as at 30 September 2013, the number of general insurance agents who are also life agents stands at 7,448 whilst the number of general insurance agents who are also takaful agents stands at 1,362. The number of agents who are involved as general, life and takaful agents stands at 6,557.

Revised Item 16 - Declaration By Agent

In line with the Personal Data Protection Act (PDPA) and the setting up of the joint “referred agents’ database” between PIAM, LIAM and MTA, two new additional items have been included in the existing “Declaration by Agents”. The revised Declaration by Agents is applicable to all new agents from 1 October 2013, including all existing active agents.

Continuing Professional Development (CPD) Program for General Insurance Agents

Since the implementation of the revised CPD Requirement in year 2009, the number of agents that have been suspended due to non-compliance with the 20-CPD training hours showed a slight improvement i.e. from 1.2% (436 agents) in 2011 to 0.9% (313 agents) in 2012. Under the CPD Requirement, registered agents are required to complete 20-CPD training hours annually.

Guidelines To Control Operating Costs Of General Insurance Business- Paper On “Regulations Relating To Management Expenses Of General Insurers”

The paper on “Regulations Relating to Management Expenses of General Insurers” has been drawn up with the main intention to allow insurers to self-regulate their management expenses as allowed under BNM’s Guidelines so as to ensure a level playing field and a healthy general insurance environment. In summary, the paper contains a list of prohibited expenses to agents and other intermediaries and controlled expenses allowed to be paid to agents and other intermediaries, subject to prescribed stipulated guidelines.

The paper was submitted to BNM for approval and as BNM had noted the proposals/changes made in the final revised paper and had no further comments, the Association will be releasing the paper to member companies for adoption. The Association is currently looking into the mechanism to ensure compliance by member companies in respect of this revised guidelines, including the enforcement thereof.

Satu inisiatif bersama antara PIAM, MTA dan LIAM telah dilaksanakan untuk menentukan jumlah ejen insurans am yang juga didaftarkan sebagai ejen hayat atau takaful. Berdasarkan statistik setakat 30 September 2013, jumlah ejen insurans am yang juga terlibat sebagai ejen insurans hayat ialah 7,448, manakala ejen insurans am yang juga terlibat sebagi ejen takaful adalah 1,362. Bilangan ejen yang terlibat sebagai ejen insurans am, hayat dan takaful adalah 6,557.

Pembaharuan Perkara16 - Pengakuan Oleh Ejen

Selaras dengan Akta Perlindungan Data Peribadi (PDPA) dan penubuhan bersama “pangkalan data senarai hitam ejen” antara PIAM, LIAM dan MTA, dua perkara tambahan telah dimasukkan kedalam “Pengakuan oleh Ejen” yang sedia ada. Pengakuan oleh Ejen perlu diakui oleh kesemua ejen baru mulai 1 Oktober 2013, termasuk semua ejen yang masih aktif.

Program Pembangunan Profesional Berterusan (CPD) bagi Ejen Insurans Am

Sejak pelaksanaan keperluan CPD yang diperbaharui dalam tahun 2009, bilangan ejen yang telah digantung kerana tidak mematuhi 20 jam latihan CPD menunjukkan penurunan iaitu daripada 1.2% (436 ejen) pada tahun 2011 kepada 0.9% (313 ejen) pada tahun 2012. Di bawah keperluan CPD, ejen berdaftar dikehendaki melengkapkan 20 jam latihan CPD setiap tahun.

Garis Panduan Kawalan Kos Operasi Bagi Perniagaan Insurans Am- Kertas Kerja ”Peraturan-Peraturan Berkaitan Dengan Perbelanjaan Pengurusan Syarikat Insurans Am”

Kertas kerja mengenai “Peraturan-Peraturan Berkaitan dengan Perbelanjaan Pengurusan Syarikat Insurans Am” telah disediakan dengan tujuan utama untuk membenarkan syarikat-syarikat insurans mengawal selia perbelanjaan pengurusan yang dibenarkan di bawah garis panduan BNM bagi memastikan satu tahap sama rata dan persekitaran insurans am yang sihat. Ringkasnya, kertas kerja ini mengandungi senarai perbelanjaan yang tidak dibenarkan kepada ejen-ejen dan perantara lain dan perbelanjaan terkawal yang dibenarkan untuk dibayar kepada ejen dan perantara lain, tertakluk kepada garis panduan yang telah ditetapkan.

Kertas kerja ini telah dikemukakan untuk mendapat kelulusan daripada BNM. BNM telah mengambil maklum cadangan/perubahan yang dibuat dalam kertas kerja semakan akhir dan tidak mempunyai sebarang komen lanjut. Persatuan akan mengeluarkan kertas kerja ini kepada ahli-ahli syarikat untuk digunapakai. Persatuan kini sedang menyediakan

MOTORCentral No Claim Discount (NCD) Database

The Central NCD Database which has been in operation since January 2007 has been further enhanced to provide online submissions of Policy, Endorsements and Claims data via web services. This is to ensure that the data in the Central NCD Database is up to date with the latest records and also provides timely claims statistics so as to ensure accuracy of the No Claims Discount Entitlements.

Regular Dialogues With Stakeholders To Enhance Insurance Servicesa) The Motor Sub-committee since May 2012 have been

having regular meetings with ISM to discuss issues and problems encountered by member companies in respect of motor business.

One of the issues discussed with ISM is the collation of comprehensive data by rating factors for the motor database so as to avoid members from modifying their systems each time there is additional data required. This proposal is also for the preparation for motor de-tariffication in the near future where more rating factors will be required to determine prices.

b) The Association has had two dialogue sessions with FMB to understand better their basis for decisions made on general insurance claims. The first dialogue session was held on 11 April 2013 and was attended by all PIAM’s technical sub-committees. The second dialogue was held on 19 November 2013 and was focused on motor issues. Both PIAM and FMB agreed that it was a good practice to continue with the dialogue on regular basis.

c) PIAM through the JPJ REVAMP Project Task Force has had various meetings with JPJ since 2011 on the project and has provided input on the changes that will take place in the licensing and registration of motor vehicles. The changes in JPJ system (from SIKAP to mySIKAP) will have significant impact on the business processes of insurance companies and their intermediaries. Some of the changes that will come in effect will be:

• New transactions - International Circulation Permit (ICP), Motor Trade Plate and Foreign Commercial Vehicles.

Pusat Pengkalan Data Diskaun Tanpa Tuntutan (NCD)Pusat Pengkalan Data NCD yang beroperasi sejak Januari 2007 telah dipertingkatkan lagi untuk menyediakan penghantaran data Polisi, Pengendorsan dan Tuntutan atas talian melalui perkhidmatan laman sesawang. Ini untuk memastikan bahawa data di dalam Pusat Pengkalan Data NCD adalah yang terkini dengan rekod terbaru dan juga memberikan statistik tuntutan yang tepat bagi memastikan ketepatan Kelayakan Diskaun Tanpa Tuntutan.

Dialog Berterusan Dengan Pihak Berkepentingan Untuk Mempertingkatkan Perkhidmatan Insuransa) Sejak Mei 2012, Jawatankuasa Kecil Motor telah

mengadakan mesyuarat dengan Insurance Services Malaysia Berhad (ISM) untuk membincangkan isu-isu dan masalah yang dihadapi oleh ahli-ahli syarikat insurans berkaitan urusniaga Motor.

Salah satu daripada isu yang dibincangkan dengan ISM adalah pengumpulan data yang komprehensif melibatkan faktor-faktor perkadaran bagi pengkalan data motor untuk mengelakkan ahli-ahli daripada mengubahsuai sistem setiap kali ada data tambahan yang diperlukan. Cadangan ini juga adalah sebagai persediaan untuk Motor detariffication pada masa akan datang di mana lebih banyak faktor perkadaran akan diperlukan bagi menentukan harga insurans.

b) Persatuan ini juga telah mengadakan sesi dialog dengan Biro Perantara Kewangan (FMB) untuk lebih memahami dasar FMB terhadap keputusan yang dibuat ke atas tuntutan insurans am. Sesi dialog yang pertama telah diadakan pada 11 April 2013 dan telah dihadiri oleh semua Jawatankuasa Kecil Teknikal PIAM. Dialog kedua telah diadakan pada 19 November 2013 dan telah memberi tumpuan kepada isu-isu Motor. Kedua-dua pihak PIAM dan FMB bersetuju bahawa ini adalah satu amalan baik dan sesi dialog tersebut akan diteruskan secara kerap.

c) PIAM melalui Pasukan Petugas Projek Revamp JPJ telah mengadakan beberapa pertemuan dengan JPJ sejak 2011 dan telah memberikan input mengenai perubahan yang akan dilakukan dalam Pelesenan dan Pendaftaran Kenderaan Bermotor. Perubahan dalam sistem JPJ (dari SIKAP kepada mySIKAP) memberi kesan yang besar ke atas proses urusniaga syarikat-syarikat insurans dan pengantara mereka. Beberapa perubahan yang akan berkuatkuasa adalah:-

• Cancellation of road-tax prior to cancellation of insurance coverage

• Transfer of Ownership • Total Loss reporting. • Interchanged Vehicles reporting.

PIAM had organized two market briefings to share details on the revamped system and to update members on the changes required to the technical specifications, procedures and implementation schedule under mySIKAP system. The discussion with JPJ is still on going to ensure smooth implementation of the new system.

Guidelines On Product Transparency And Disclosure - Plain Language Policy The final draft of the Plain Language Policy for Private Car and its relevant endorsements had been submitted to BNM on 2 July 2013 and the Draft is still under review for approval by the BNM. The next phase to be undertaken would be focused on Motorcycle Plain Language Policy.

Claims ManagementTask Force To Address Claims Expenditure

The above Task Force was formed at the request by BNM to look into concerns for industry players to be able to manage the claims expenditure.

BNM had advised that the preliminary Terms of Reference of this Task Force would be:-

a) How to keep cost manageableb) Preserving consumers interestc) Ensuring sustainability of the industry

Taking into consideration the above direction from BNM, the Task Force agreed that as an initial phase of the project it will focus on the following efforts to contain leakages and to ensure sustainability of the industry:-

a) Third Party Bodily Injury (TPBI) Claims/Payment to Public Trustee - to ensure fair payment/reimbursement to consumer/by insurer respectively.

b) Malaysian Motor Repair Times - to reduce subjectivity and repairer-adjuster-insurer dispute in repair industry.

c) The adoption of Group Rating for Vehicle Safety and Security - for acceptable car built that will benefit both consumer and insurer.

• Transaksi baru - Permit Edaran Antarabangsa (ICP), Plat Kenderaan Perdagangan dan Kenderaan Perdagangan Luar negeri.

• Pembatalan cukai jalan sebelum pembatalan perlindungan insurans.

• Pemindahan Hakmilik. • Laporan Kerugian Menyeluruh/Lupus (Total Loss). • Laporan Pertukaran Kenderaan

PIAM telah menganjurkan dua taklimat pasaran untuk berkongsi maklumat pada sistem yang dirombak dan mengemaskini ahli-ahli tentang perubahan yang diperlukan terhadap spesifikasi teknikal, prosedur dan jadual pelaksanaan di bawah sistem mySIKAP. Perbincangan dengan JPJ masih lagi berterusan bagi memastikan kelancaran pelaksanaan sistem baru itu.

Garis Panduan Ketelusan dan Pendedahan Produk – Polisi Bahasa MudahDeraf akhir Polisi Bahasa Mudah untuk Kenderaan Persendirian dan Pengendorsan yang berkaitan telah dikemukakan kepada BNM pada 2 Julai 2013 dan deraf itu masih dalam semakan untuk diluluskan oleh BNM. Fasa seterusnya yang akan dilaksanakan akan memberi tumpuan kepada Polisi Bahasa Mudah Motosikal.

Pengurusan Tuntutan Pasukan Petugas Untuk Menangani Perbelanjaan Tuntutan

Pasukan Petugas di atas telah ditubuhkan atas permintaan BNM untuk mengendali isu-isu para peserta industri bagi membolehkan mereka mengurus perbelanjaan tuntutan.

BNM telah menyarankan Terma Rujukan awal Pasukan Petugas ini seperti berikut:-

a) Bagaimana untuk memastikan kos terurusb) Menjaga kepentingan konsumerc) Memastikan kemampanan industri

Mengambil kira arahan BNM di atas, Pasukan Petugas ini bersetuju bahawa sebagai fasa permulaan projek ini, ia akan memberi tumpuan terhadap usaha-usaha dibawah untuk mengekang kebocoran dan memastikan kemampanan industri:-

a) Pembayaran kepada Trustee Awam untuk Tuntutan Kecederaan Anggota Pihak Ketiga - untuk memastikan pembayaran/pampasan yang telus kepada pengguna/oleh penanggung insurans.

b) ‘Malaysian Motor Repair Times’- untuk mengurangkan kesubjektifan dan pertelingkahan antara bengkel pembaikan-ajuster-penanggung insurans dalam industri pembaikpulihan.

PIAM Approved Repairers Scheme (PARS)

The Association is currently upgrading the PARS database to provide for online registration and processing of applications from the workshops. The project is targeted to go live in the 3rd Quarter of 2014.

NON-TARIFFPre-Authorization Form To Facilitate The Issuance Of Guarantee Letter For Hospital Admission

A standard Pre-Authorization Form to facilitate the issuance of guarantee letters for hospital admission for individual policies, group policies and takaful plans was drawn-up by the Joint Technical Committee (JTC) of PIAM, LIAM and MTA on Medical and Health Insurance in collaboration with the Association of Private Hospitals of Malaysia (APHM). The JTC and APHM agreed that the form be adopted as the standard form to be used by all life and general insurance companies, takaful operators, third party administrators and managed care organizations. Member companies adopted and started using the form with effect from 1 September 2013.

Borang ‘Pre-Authorization’ yang seragam untuk memudahkan pengeluaran surat jaminan untuk kemasukan hospital bagi polisi individu, polisi berkumpulan dan plan-plan takaful telah disediakan oleh Jawatankuasa Teknikal Bersama (JTC) PIAM, LIAM dan MTA bagi Insurans Perubatan dan Kesihatan, dengan kerjasama Persatuan Hospital Persendirian Malaysia (APHM). JTC dan APHM bersetuju borang tersebut digunakan sebagai borang seragam oleh semua syarikat insurans hayat dan am, pengendali takaful, pentadbir pihak ketiga dan organisasi penjaga kesihatan. Ahli-ahli syarikat telah melaksanakan dan mula menggunakan borang tersebut bermula dari 1 September 2013.

Pelaksanaan Sistem Bersepadu Untuk Pembelian Secara Terus (Online) Insurans Pekerja Asing Kementerian Dalam Negeri (KDN) dan Jabatan Imigresen Malaysia (JIM) telah melaksanakan Sistem Pengurusan

Workers Centralised Management System (FWCMS) which is an integrated system for online purchase of foreign workers insurance (i.e. Foreign Workers Compensation Scheme (FWCS), Health Insurance Scheme for Foreign Workers (SPIKPA) and Insurance Guarantee (IG).

A seminar was organized by the service provider on 4 July 2013 to brief insurers on the implementation of the online transaction for the sale and purchase of foreign workers insurance and subsequently on 5 December 2013, a technical briefing was conducted to insurers (i.e. IT details of the integration to be done between FWCMS via the two gateway providers linking all the insurance companies). Prior to insurers link-up with the FWCMS, discussions are being held by PIAM and MTA with the service providers to resolve some implementation issues and concerns on the link-up with the FWCMS.

Personal Accident (PA) Plain Language PolicyThe final revised draft of the PA Plain Language Policy had been submitted to BNM on 25 November 2013 for their consideration. Under the Guidelines on Product Transparency and Disclosure issued by BNM, insurers are required to use plain language in contracts, agreements and policy documents issued to individuals and SMEs.

Skim Pampasan Pembantu Rumah Asing (SPPRA)Arising from the meeting the Association had with the Ministry of Human Resources to discuss their proposed scheme for Foreign Workers, the Association was requested to co-ordinate with its members and revert to them with a standard proposal for the SPPRA Scheme for their consideration. A meeting was held with a few panel insurers of SPPA and a standard proposal was drawn-up which was circulated to the industry for approval prior to submission to the Ministry. As the Ministry had no objection to PIAM’s proposal, the Association has formed a working group to craft the policy text for the said scheme.

Vehicle Theft Reduction Council Of Malaysia Berhad (VTREC) For the year 2013 the Vehicle Theft Reduction Council of Malaysia Berhad (VTREC) continued to pursue the recovery of stolen vehicles from Thailand together with the assistance of the Polis DiRaja Malaysia (PDRM) and the office of the Consulate General of Malaysia in Songkhla, Thailand. The authorities in Thailand have requested for further discussions with the Malaysian counterpart on the various legal issues involving this recovery processes.

Berpusat Pekerja Asing (FWCMS), yang merupakan satu sistem bersepadu untuk pembelian ‘online’ insurans pekerja asing (iaitu Skim Pampasan Pekerja Asing (FWCS), Skim Insurans Kesihatan untuk Pekerja Asing (SPIKPA) dan Jaminan Insurans (IG).

Satu seminar telah diadakan oleh pembekal perkhidmatan pada 4 Julai 2013 untuk memberi taklimat berhubung pelaksanaan transaksi ‘online’ untuk penjualan dan pembelian insurans pekerja asing dan berikutnya pada 5 Disember 2013, satu taklimat teknikal lagi telah diberi kepada penanggung insurans (iaitu butiran IT untuk integrasi yang perlu dibuat antara FWCMS melalui dua pembekal get laluan menghubungkan semua syarikat insurans). Sebelum menghubungkan penanggung insurans dengan FWCMS, perbincangan sedang diadakan oleh PIAM dan MTA dengan para pembekal perkhidmatan untuk menyelesaikan beberapa isu berkaitan pelaksanaan dan isi-isu mengenai penghubungan dengan FWCMS.

Polisi Bahasa Mudah Kemalangan Diri (PA)Deraf Pindaan Akhir Polisi Bahasa Mudah PA telah dihantar kepada BNM pada 25 November 2013 untuk pertimbangan. Di bawah Garis panduan ‘Ketelusan dan Kezahiran Produk’ yang dikeluarkan oleh BNM, penanggung insurans adalah dikehendaki menggunakan bahasa mudah dalam dokumen kontrak, perjanjian dan polisi dikeluarkan kepada individu-individu dan SMEs.

Skim Pampasan Pembantu Rumah Asing (SPPRA)Berikutan dari mesyuarat yang diadakan antara Persatuan ini dengan Kementerian Sumber Manusia untuk membincangkan cadangan skim untuk Pekerja Asing, Persatuan ini telah diminta untuk menyelaras dengan ahli-ahlinya dan mengemukakan satu cadangan bagi Skim SPPRA untuk pertimbangan mereka. Satu mesyuarat telah diadakan dengan beberapa, panel penanggung insurans SPPA dan satu cadangan seragam telah di sediakan yang mana telah diedarkan kepada industri untuk kelulusan sebelum dihantar kepada Kementerian. Memandangkan pihak Kementerian tiada bantahan terhadap cadangan PIAM, Persatuan ini telah menubuhkan satu kumpulan kerja untuk mengkraf teks polisi untuk skim tersebut.

Vehicle Theft Reduction Council Of Malaysia Berhad (VTREC) Bagi tahun 2013 Vehicle Theft Reduction Council of Malaysia Berhad (VTREC) telah meneruskan usaha untuk membawa pulang kenderaan-kenderaan hilang yang dijumpai di Thailand dengan bantuan Polis DiRaja Malaysia (PDRM) dan pejabat Konsulat Jeneral Malaysia di Songkhla, Thailand. Pihak berkuasa Thailand telah memohon perbincangan lanjutan bersama rakan-sejawat dari Malaysia berhubung isu-isu perundangan yang berkaitan dengan proses pemulangan kenderaan tersebut.

The insurance industry had completed two of the initiatives derived from the ‘Awana Workshop’ in 2011. The platform for the risk based premium assessment had been launched by ISM Insurance Services Malaysia Berhad (ISM) in early 2013 under its Knowledge Management System (KMS). KMS allows member companies to access data on the frequency of theft of vehicles by models for their underwriting purposes. Another initiative that has been completed is the Motor Anti-Fraud Register (MAFR) which was launched in July 2013. The MAFR was a joint effort of VTREC and ISM in developing a system for detection of fraud in the ‘rebirthing’ of stolen or Total Loss vehicles into the market. As at end of 2013, MAFR had detected 116 cases of renewals of insurance with prior records of theft and also of total loss vehicles. Although cases of errors or discrepancies were discovered, 33 renewals were cancelled or deleted from Insurers’ records which could be for avoidance of attempts to defraud member companies.

VTREC in cooperation with PEMANDU, the Performance Management & Delivery Unit of the Prime Minister’s Department, is currently embarking on its laboratory with all its stakeholders in the private as well as in Government sectors to enhance its effort in deterring fraud and vehicle theft.

FIRE INSURANCE Flood Model for the Insurance Industry PIAM had decided on a joint initiative with Malaysian Reinsurance Berhad (Malaysian Re) in developing a flood model for the insurance industry. The project is divided into three phases as follows:-

a) Phase 1 – Klang Valley (completed)b) Phase 2 – Peninsular Malaysia (ongoing)c) Phase 3 – East Malaysia

The flood model will allow the insurance companies to:- a) understand the effects of flooding on property

portfolios in Malaysiab) derive the PML to their portfolios for different return

periods and quantify the financial implicationsc) appreciate the flood risk at different locations and

therefore be able to manage them accordinglyd) make an informed decision in their reinsurance

programming

Di samping itu, industri insurans telah melaksanakan dua inisiatif yang dihasilkan di ‘Awana Workshop’ pada tahun 2011. Platfom bagi inisiatif penaksiran ‘risk based premium’ telah dilancarkan oleh ISM Insurance Services Malaysia Bhd (ISM) pada awal tahun 2013 di bawah Sistem Pengurusan Maklumat (KMS). KMS membolehkan syarikat-syarikat ahli mengekses data kekerapan kecurian kenderaan mengikut model bagi tujuan menentukan kadar dan terma-terma insurans.Satu lagi initiatif yang telah dlaksanakan ialah mewujudkan Daftar Pencegahan Penipuan Kenderaan (MAFR). Daftar ini telah dilancarkan pada Julai 2013. MAFR adalah hasil usahasama antara VTREC dengan ISM bagi mengesan penipuan dalam ‘kelahiran-semula’ kenderaan-kenderaan yang telah dilaporkan curi atau ‘Total Loss’ ke dalam pasaran. Pada penghujung tahun 2013, MAFR telah berjaya mengesan 116 kes-kes kecurian kenderaan dan ‘Total Loss’ sebelum pembaharuan insurans motor bagi kenderaan tersebut dibuat. Walaupun terdapat banyak kes-kes yang meragukan, 33 kes pembaharuan insurans telah dibatalkan atau dilupuskan dalam rekod insurans bagi mengelak sebarang kemungkinan adanya usaha menipu syarikat-syarikat insurans.

Pada masa ini VTREC dengan kerjasama Unit Pengurusan Prestasi dan Pelaksanaan (PEMANDU) dari Jabatan Perdana Menteri sedang menganjurkan satu makmal bersama-sama semua ‘stakeholders’ dari sector-sektor swasta dan Kerajaan untuk meningkatkan lagi usaha mencegah penipuan dan kecurian kenderaan.

INSURANS KEBAKARANModel Banjir Untuk Industri Insurans

PIAM telah bersetuju dengan inisiatif bersama Malaysian Reinsurance Berhad (Malaysian Re) dalam membangunkan model banjir bagi industri insurans.

Projek ini dibahagikan kepada tiga fasa seperti berikut:-

a) Fasa 1 - Lembah Klang (selesai) b) Fasa 2 - Semenanjung Malaysia (berterusan) c) Fasa 3 - Malaysia Timur

Model banjir yang dibangunkan akan membolehkan syarikat-syarikat insurans:-

a) memahami kesan banjir ke atas portfolio hartanah di Malaysia

b) memperolehi PML terhadap portfolio mereka untuk tempoh pulangan yang berbeza dan dapat mengukur implikasi kewangan

c) menghargai risiko banjir di lokasi yang berbeza dan membolehkan pengurusan sewajarnya

d) membuat keputusan bermaklum dalam pengaturcaraan insurans semula

Phase 1 of the Flood Model (called Re.Banjir) was launched on 23 September 2013 by Malaysian Re. The users of the model include PIAM and MTA members. To further complement the existing Malaysian Re Project Team, PIAM and ISM representatives were invited to the project team. The Fire Sub-Committee has been working with ISM to refine additional information/data that is required for the model accuracy and success.

Working Group On Fire Database

The Fire Sub-committee continued to work closely with ISM to further improve the Fire Database. ISM has recently drawn up a set of Data Guidelines and Data Enhancement. The Data Guidelines are to ensure the improvement of the quality of the industry fire database whilst the Data Enhancement is to facilitate the collection of additional data to ensure accurate information of the fire data collected, to support the flood model and for purposes of development of future fraud detection initiatives.

Recommended Guidelines For The Timber/Furniture Industry

Following the implementation of the above Guidelines, the Malaysian Timber Industry Board (MTIB) in collaboration with PIAM had conducted a series of programmes to create awareness to the timber/furniture sector on insurers’ expectations when insurers underwrite timber/furniture risks and the need for proper risk management practices to be adopted.

To facilitate assessment and rating of the timber/furniture sector in terms of the risk profile, financial standing, historical claims, etc., a database on the risk profile and star rating of the timber/furniture players is currently being developed by MTIB. The Working Group formed by PIAM and MTIB is currently working on the specifications to be included in the database.

FINANCE AND CORPORATE GOVERNANCEMigration To Electronic Payment In The General Insurance Industry

BNM has been actively promoting the migration to electronic payment (e-payment) in the financial sector which was laid out in its Financial Sector Blueprint 2011-2020. Since the announcement of the efforts by BNM, the general insurance industry has also been working towards full migration to e-payment for all payments to staff, agents, adjusters, repairers and service providers. This year, the migration to e-payment has entered into

Kumpulan Kerja Pangkalan Data Kebakaran

Jawatankuasa Kecil Kebakaran terus bekerja rapat dengan ISM untuk meningkatkan lagi Pangkalan Data Kebakaran. ISM telah menyediakan sebuah Garis Panduan Data dan Peningkatan Data. Garis Panduan Data adalah untuk memastikan peningkatan kualiti pangkalan data industri kebakaran manakala Peningkatan Data adalah untuk memudahkan pengumpulan data tambahan bagi memastikan maklumat data kebakaran yang dikumpul adalah tepat untuk menyokong model banjir dan untuk tujuan pembangunan inisiatif mengesan isu penipuan pada masa hadapan.

Garispanduan Yang Disyorkan Untuk Industri Perkayuan/Perabot

Lanjutan daripada pelaksanaan Garispanduan di atas, Lembaga Perindustrian Kayu Malaysia (MTIB) dengan kerjasama PIAM telah menjalankan satu siri program bagi mewujudkan kesedaran kepada sektor kayu/perabot berkenaan jangkaan penanggung insurans apabila syarikat insurans menjalankan pengunderitan risiko kayu/perabot dan memberi kefahaman kepada mereka tentang keperluan amalan pengurusan risiko yang perlu diikuti.

Bagi memudahkan penilaian dan sektor pengusaha kayu/perabot dari segi profil risiko, kewangan, sejarah tuntutan dan lain-lain, satu pangkalan data mengenai profil risiko dan penarafan bintang terhadap pengusaha kayu/perabot sedang dibangunkan oleh MTIB. Kumpulan Kerja yang dibentuk oleh PIAM dan MTIB kini sedang bekerjasama menentukan spesifikasi yang perlu dimasukkan ke dalam pangkalan data MTIB.

KEWANGAN DAN TADBIR URUS KORPORATMigrasi Kepada Pembayaran Elektronik Dalam Industri Insurans Am

BNM telah mempromosikan perpindahan kepada pembayaran elektronik (e-pembayaran) dalam sektor kewangan yang telah disediakan di dalam Pelan Sektor Kewangan 2011-2020. Sejak pengumuman usaha BNM ini, industri insurans am juga telah berusaha ke arah penghijrahan sepenuhnya kepada e-pembayaran untuk semua pembayaran kepada kakitangan, ejen, adjuster, bengkel pembaikan kereta dan pembekal perkhidmatan yang lain. Tahun ini, perpindahan kepada

its second stage which will require insurance companies to provide options to policyholders to receive payments for claims, refunds and other forms of payments electronically.

The Bank had a meeting with PIAM, LIAM and MTA recently to discuss measures that the insurance and takaful industry can introduce for full migration to e-payment. BNM had decided on the following measures for the industry to implement in migrating to e-payment:-

• insurance and takaful companies are to improve their internal business processes to encourage and facilitate the use of e-payment; and

• insurance and takaful companies are to undertake measures to further reduce cheque usage by 50% by end of 2014.

Insurance companies and takaful operators are required to submit regular reports on their progress in implementing the above measures.

BNM had also reported that currently, 1.6 billion financial transactions are carried out using electronic means, which is twice the volume in 2006. BNM is targeting to increase the number of electronic payments per capita from 56 in 2012 to 200 by 2020 and to reduce the number of cheques cleared in the country by half from 204 million to 100 million during the same period. The increase in electronic payment transactions was achievable with the downward adjustments made by banks on their service charges for such payments. Adjustments in pricing for the other payment channels and methods, including automatic teller machines (ATM) will be phased in progressively to steer consumers to adopt the more cost effective electronic payment methods. By the year 2020, the pricing of all payment services will be based on the cost of providing the service.

Financial Services Act 2013 Knowledge Sharing Forum

The Enterprise Risk Management Working Group formed by the Finance and Corporate Governance Sub-committee of the Association organized a Knowledge Sharing Forum titled “Financial Services Act 2013: Opportunities and Challenges -How It Will Affect You And Your Operations”. The Forum was held on 23 May 2013 and was sponsored by Malaysian Reinsurance Berhad. The speakers at the Forum were Ms. Julia Leong, Deputy Director, Insurance & Takaful Supervision Department, Bank Negara Malaysia and En. Wan Saifulrizal Wan Ismail, Director of Towers Watson Malaysia.

e-pembayaran telah memasuki peringkat kedua yang akan memerlukan syarikat insurans untuk menyediakan pilihan kepada pemegang polisi untuk menerima bayaran untuk tuntutan, bayaran balik dan lain-lain bentuk pembayaran secara elektronik.

BNM telah mengadakan mesyuarat dengan PIAM, LIAM dan MTA baru-baru ini untuk membincangkan langkah-langkah yang industri insurans dan takaful boleh memperkenalkan dalam penghijrahan penuh kepada e-pembayaran. BNM telah memutuskan langkah-langkah berikut untuk diambil oleh industri insurans untuk migrasi kepada e-pembayaran:-

• syarikat-syarikat insurans dan takaful perlu meningkatkan proses perniagaan dalaman bagi menggalakkan dan memudahkan penggunaan e-pembayaran; dan

• syarikat-syarikat insurans dan takaful perlu mengambil langkah-langkah untuk mengurangkan lagi penggunaan cek sebanyak 50% pada akhir tahun 2014.

Syarikat-syarikat insurans dan takaful dikehendaki menghantar laporan pencapaian masing-masing dalam pelaksanaan langkah-langkah tersebut di atas dari masa ke semasa.

BNM juga telah melaporkan bahawa pada masa ini, sejumlah 1.6 bilion transaksi kewangan dijalankan menggunakan cara elektronik, iaitu dua kali ganda jumlah pada tahun 2006. BNM mensasarkan untuk meningkatkan bilangan bayaran elektronik per kapita daripada 56 pada 2012 kepada 200 sebelum 2020 dan untuk mengurangkan bilangan cek dijelaskan di negara ini dengan separuh daripada 204 juta kepada 100 juta dalam tempoh yang sama. Peningkatan dalam urus niaga pembayaran elektronik itu boleh dicapai dengan pelarasan yang dibuat oleh bank-bank ke atas caj perkhidmatan mereka untuk bayaran tersebut. Pelarasan dalam harga untuk saluran pembayaran lain dan kaedah, termasuk mesin juruwang automatik (ATM) akan dilaksanakan secara beransur-ansur untuk mengarahkan pengguna ke arah menerima pakai kaedah pembayaran elektronik yang lebih kos efektif. Menjelang tahun 2020, bayaran semua perkhidmatan akan berdasarkan kos menyediakan perkhidmatan.

Akta Perkhidmatan Kewangan 2013 Forum Perkongsian Pengetahuan

Kumpulan Kerja Pengurusan Risiko Interpris yang dibentuk dibawah naungan Jawatankuasa Kecil Kewangan dan Tadbir Urus Korporat telah menganjurkan Forum Perkongsian Pengetahuan bertajuk “Financial Services Act 2013 : Opportunities and Challenges -How It Will Affect You And Your Operations”. Forum ini ditaja oleh Malaysian Reinsurance Berhad dan telah diadakan pada 23 Mei 2013. Penceramah-penceramah Forum ini adalah Cik Julia Leong, Timbalan Pengarah, Jabatan Pengawalan Insurans & Takaful, BNM dan En. Wan Saifulrizal Wan Ismail, Pengarah Towers Watson Malaysia.

GST Preparations The Royal Malaysian Customs Department (RMCD) in collaboration with PIAM had organized two sessions of the GST Awareness Campaigns for member companies of PIAM. The awareness campaigns, held on 22 August and 21 October 2013 were aimed at raising the awareness of the general insurance industry on GST, as well as to gather feedback on issues faced by the industry on transition to the GST regime. The topics covered during the Awareness Campaign included the general concepts and implementation of GST and the GST treatment on insurance and takaful businesses.

In addition, a GST Working Group formed by PIAM has been in consultation with RMCD on a regular basis to seek clarity and discuss the various issues raised by member companies with regard to the GST implementation. GST Task Forces were also set up to look into the various issues affecting the operations of insurance companies in areas of HR & Admin, Marketing, Claims, Underwriting and Reinsurance. Issues and concerns of member companies on GST will be discussed at these sessions and resolutions and solutions identified. Recommendations of the insurance industry will be submitted to RMCD for endorsement.

Persediaan Cukai Barang dan Perkhidmatan (GST)Jabatan Kastam Diraja Malaysia (JKDM) dengan kerjasama PIAM telah menganjurkan dua sesi Kempen Kesedaran GST untuk syarikat-syarikat ahli PIAM. Kempen-kempen kesedaran, yang diadakan pada 22 Ogos dan 21 Oktober 2013 bertujuan untuk meningkatkan kesedaran industri insurans am mengenai GST, dan juga untuk mengumpul maklum balas mengenai isu-isu yang dihadapi oleh industri mengenai peralihan kepada rejim GST. Topik-topik yang dibincangkan semasa Kempen Kesedaran termasuk konsep-konsep umum dan pelaksanaan GST serta rawatan GST pada insurans dan takaful.

Di samping itu, Kumpulan Kerja GST PIAM telah mengadakan rundingan dengan JKDM untuk mendapatkan penjelasan dan membincangkan pelbagai isu yang dibangkitkan oleh syarikat-syarikat ahli berkenaan dengan pelaksanaan GST. Pasukan Petugas GST juga ditubuhkan untuk mengkaji pelbagai isu yang membawa kesan kepada operasi syarikat-syarikat insurans dalam bidang Sumber Manusia & Pentadbiran, Pemasaran, Tuntutan, Pengunderaitan dan Insurans Semula. Isu-isu dan kebimbangan syarikat ahli mengenai GST telah dibincangkan dan resolusi dan penyelesaian telah dikenal pasti dalam sesi-sesi ini. Cadangan-cadangan industri insurans akan diserahkan kepada JKDM untuk pengesahan.

ICAAP - Its Implementation And Challenges

The Guidelines on Internal Capital Adequacy Assessment Program (ICAAP) came into effect on 1 September 2012. As an insurer ICAAP is a key process in the management of the insurer’s business and is integrated with the insurer’s business planning, risk management processes and day-to-day operations.

The Enterprise Risk Management Working Group of PIAM organised a roundtable discussion entitled “ICAAP – It’s Implementation and Challenges” which served as a platform for risk managers within the insurance industry to share their views, knowledge and experiences on ICAAP, and to accelerate the learning and understanding on the various risk management subjects amongst the participants. The panelists highlighted some of the challenges in the implementation of ICAAP among which included creating board awareness, monitoring of risk appetite and threshold. Some 16 risk/compliance managers/personnel from member companies attended this roundtable discussion held on 20 November 2013. The session was facilitated by En. Wan Saifulrizal Wan Ismail, Director of Towers Watson Malaysia.

Kumpulan Kerja Pengurusan Risiko Interpris PIAM telah menganjurkan perbincangan meja bulat bertajuk “ICAAP - Pelaksanaan dan Cabaran” yang menyediakan platfom bagi pengurus-pengurus risiko dalam industri insurans untuk berkongsi pandangan, pengetahuan dan pengalaman mengenai ICAAP, serta untuk mempercepatkan pembelajaran dan pemahaman pelbagai topik pengurusan risiko di kalangan para peserta. PIAM, in taking the cue of the need for a more skilled workforce to support the demand in the insurance industry towards liberalization and de-tariffication is undertaking several measures in understanding the needs of its member companies. It is apparent that there should be focus on attracting and retaining talent in the insurance industry to be able to meet the global challenges.

The Association has formed a Young Managers Think Tank (YMTT) which aims to promote the sharing of ideas and networking amongst young managers in the insurance industry. This gives an avenue for the young

managers to share their experiences, voice their concerns and allows the YMTT to address areas highlighted by these young managers.

To motivate these young managers, the YMTT recently organized a breakfast talk with the theme “Passion for Success” which was attended by 60 young managers from the general insurance industry. This is an annual event and the Think Tank invited Teach for Malaysia Co-founder and Managing Director, En. Dzameer Dzulkifli, to speak at the breakfast talk held on 14 November 2013 in Kuala Lumpur. Established in 2010, Teach for Malaysia, is an independent, non-profit organization which aims to end education inequity in Malaysia. During the session, Dzameer engaged the young managers by sharing his personal experiences which contributed to his success as a young leader at Teach for Malaysia.

PIAM HR Dialogue With Member Companies

PIAM organized a dialogue with Human Resources Heads of its member companies on 22 October 2013 in Kuala Lumpur. The dialogue session was to update the HR Managers on some of the key activities/initiatives that the PIAM Education/HRD Sub-committee is embarking on, and to gather relevant feedback and initiatives that its members would like to share with the industry.

The session covered a presentation from the YMTT on their activities. The MII was also invited to this dialogue had also shared an overview and highlighted the key project milestones of the Integrated Learning Management System (iLMS) Project, which is one of the Capacity Building Initiatives of MII. The other

important topic discussed was the Centralized Induction Programme (CIP) initiated by the PIAM Education/HRD Sub-committee. The objective of the CIP is to harmonize, improve and elevate the quality as well as to implement a sustainable long term internship programme in the general insurance industry for young entrants. This will orientate fresh talent in the insurance industry with some comprehensive knowledge on the industry and its operations.

The session was well received by the participants and it promoted networking and sharing of information amongst the HR personnel of PIAM member companies with representatives from the Education Sub-committee and the YMTT. Close collaboration between the Association and its members is important to ensure a joint effort in meeting the requirements of insurance companies and the industry as a whole.

Sistem Pengurusan Pembelajaran Bersepadu (iLMS), yang merupakan salah satu daripada Inisiatif Pembinaan Keupayaan MII. Topik-topik penting lain yang dibincangkan ialah Program Induksi Berpusat (CIP), iaitu satu inisiatif Jawatankuasa Kecil Pendidikan/Pembangunan Sumber Manusia (PSM). Objektif CIP adalah untuk menyelaraskan, memperbaiki dan meningkatkan kualiti dan juga untuk melaksanakan program latihan jangka panjang yang mapan dalam industri insurans am bagi kemasukan pekerja muda. Ini akan memberi orientasi kepada nakat-bakat baru dalam industri insurans dengan pengetahuan yang komprehensif tentang industri dan operasinya.

Sesi ini telah diterima baik oleh para peserta dan ia telah menggalakkan rangkaian dan perkongsian maklumat di kalangan kakitangan sumber manusia syarikat ahli-ahli PIAM dengan wakil-wakil dari Jawatankuasa Kecil Pendidikan/Pembangunan Sumber Manusia dan YMTT . Kerjasama erat antara Persatuan ini dan ahli-ahlinya adalah penting untuk memastikan usaha bersama bagi memenuhi keperluan syarikat-syarikat insurans dan industri secara keseluruhannya.

4th Young Managers Forum: “Stepping Into the Future”

The 4th Young Managers’ Forum was held on 21 February 2014 with participation of 60 young managers from member companies. In his welcome speech, Dr. Michael Heng Kian Ngan, Convenor of the Education/HRD Sub-committee of PIAM emphasized the importance of support and encouragement from the top management towards the industry’s effort and initiatives in retaining and promoting talent management in the insurance industry. He acknowledged that the theme “Stepping into the Future” was aptly chosen and aimed at motivating young managers of the industry to step up in their confidence and passion towards realizing their career aspiration.

Forum Young Managers Kali Ke-4 telah diadakan pada 21 Februari 2014 dengan penyertaan 60 pengurus muda dari syarikat ahli. Dalam ucapan aluannya, Dr Michael Heng Kian Ngan, Pengerusi Jawatankuasa Kecil Pendidikan/Pembangunan Sumber Manusia PIAM telah menekankan pentingnya sokongan dan galakan daripada pihak pengurusan atasan terhadap usaha dan inisiatif dalam mengekalkan dan menggalakkan pengurusan bakat dalam industri insurans. Beliau bersetuju bahawa pemilihan tema “Stepping Into the Future” adalah tepat untuk memberi motivasi kepada pengurus muda dalam industri untuk meningkatkan keyakinan dan semangat mereka ke arah merealisasikan aspirasi kerjaya mereka.

The two speakers selected to share their input with the young managers were Dr Rumesh Kumar and Mr Michael Teoh Su Lim. Dr Rumesh is a certified professional trainer and performance improvement consultant specializing the areas of leadership development, continual productivity improvement and enhancement of interpersonal skills, whilst Mr Michael Teoh, is a global award-winning speaker and trainer who is passionate about talent development. During his session, Dr Rumesh shared his views on the importance of leadership amongst managers, whilst Mr Michael Teoh’s presentation focused on how to maximize ones potential in winning the mind and heart of the people, as well as to maximize one’s efforts and leave a positive impact on people.

PUBLIC RELATIONS/CSR PIAM Launches Insurance History Book

PIAM launched its 2nd history book entitled “A Matter of Risk: Insurance in Malaysia 1826 - 1990” detailing the history of the insurance industry in Malaysia at a launching ceremony on 18 April 2013 in Kuala Lumpur.

In addition to the history of the insurance industry, the book highlights the significant role and contributions of the insurance industry in the economic development of Malaysia. Based on an in-depth research, the book traces back on how insurance companies established themselves in an ever changing business environment, marketed new products and responded to diverse demands. It also captured the challenges faced by local firms as overseas insurance companies moved from agency offices to the setting up of branches, taking over or collaborating with existing companies and eventually incorporating themselves as local companies. PIAM melancarkan buku sejarah ke-2 yang bertajuk “A Matter of Risk: Insurance In Malaysia 1826 - 1990” yang memperincikan sejarah industri insurans di Malaysia pada majlis pelancaran buku pada 18 April 2013 di Kuala Lumpur.

Selain dari sejarah industri insurans, buku ini menonjolkan peranan dan sumbangan industri insurans dalam pembangunan ekonomi Malaysia. Berdasarkan kepada penyelidikan yang mendalam, buku ini mengkaji bagaimana syarikat-syarikat insurans memantapkan diri mereka dalam persekitaran perniagaan yang sentiasa berubah, memasarkan produk baru dan memberi respons kepada pelbagai permintaan. Authored by Professor Lee Kam Hing, “A Matter of Risk: Insurance in Malaysia 1826 -1990”, is the second volume of the historical development of the insurance industry in Malaysia. The first book, “Insurance Industry in Malaysia – A Study on Financial Development and Regulation”, was written by Professor Lee Hock Lock from the Faculty of Economic and Administration, University Malaya, and published in 1997. While independent of each other, the two volumes are a first of its kind which play a crucial role in fulfilling the need for literature on the local insurance industry.

Insurance And Takaful Day 2013

Kuala Lumpur as host of the 26th East Asian Insurance Congress (EAIC) which was held from 29 October to 2 November 2012 was offered a grant of USD30, 000 for a CSR project under the EAIC.

The organizing associations of this Conference i.e. PIAM, LIAM, LIIA and MTA took the opportunity of associating the EAIC CSR project with the Insurance and Takaful Day annual CSR activity of the industry. The event was commemorated with a donation of RM100, 000, which included the EAIC grant and additional contributions from the organizing associations to four charitable organizations.

Kuala Lumpur sebagai tuan rumah Kongres Insurans Asia Timur (EAIC) ke-26 yang diadakan dari 29 Oktober hingga 2 November 2012 telah diberikan geran sebanyak USD30,000 untuk projek tanggungjawab sosial korporat yang dianjurkan di bawah naungan EAIC.

Persatuan-persatuan penganjur Kongres ini iaitu PIAM, LIAM, LIIA dan MTA telah mengambil kesempatan mengaitkan projek tanggungjawab sosial korporat EAIC dengan aktiviti social korporat tahunan industri insurans iaitu Hari insurans dan Takaful. The four recipients which received RM25,000 each were the Community Service Centre for the Deaf (Silent Teddies Café project), Kuala Lumpur; Pertubuhan Kebajikan Dan Penjagaan Nur Hidayah, Kuala Lumpur; the Orang Asli Community Service Centre, Jerantut, Pahang; and the Cancer Research Initiatives Foundation (CARIF), Kuala Lumpur. The cheque presentation ceremony was held on 9 September 2013 in Kuala Lumpur. The objective of the Insurance and Takaful Day is to spread the values of sharing and caring and also spreading goodwill and harmony by supporting various charitable organizations.

2013 Insurance And Takaful Industry Annual Dinner (ITIAD)- “Box Office Nite”

The 2013 Insurance and Takaful Industry Annual Dinner (ITIAD) was held on 15 November 2013 at the Shangri-La Hotel Kuala Lumpur. The ITIAD 2013 was jointly organized by the five insurance associations in the industry i.e. PIAM, LIAM, MTA, AMLA and MITBA and the MII. Each Association takes turns to host the dinner and this year the dinner was hosted jointly by AMLA and MITBA.

The dinner was graced by Y. Bhg Dato’ Muhammad bin Ibrahim, Deputy Governor of BNM. In his speech Y. Bhg Dato’ briefed on some regulatory changes that have taken place, in response to the changing operating environment, placing strong emphasis on consumer protection.

Majlis Makan Malam Tahunan Industri Insurans Dan Takaful (ITIAD) 2013- “Box Office Nite”

Majlis Makan Malam Tahunan Industri Insurans dan Takaful 2013 (ITIAD) telah diadakan pada 15 November 2013 di Hotel Shangri-La Kuala Lumpur. ITIAD 2013 telah dianjurkan bersama oleh lima persatuan industri insurans iaitu PIAM, LIAM, MTA, AMLA dan MITBA serta MII. Setiap Persatuan mengambil giliran untuk menjadi hos majlis makan malam industri ini dan majlis makan malam tahun ini telah dihoskan secara bersama oleh AMLA dan MITBA.

Majlis makan malam ini telah disempurnakan oleh YBhg Dato’ Muhammad bin Ibrahim, Timbalan Gabenor BNM. Dalam ucapannya YBhg Dato’ telah memberi makluman mengenai beberapa pindaan peraturan dalam perkembangan persekitaran operasi yang berubah-ubah, yang member penekanan pada perlindungan pengguna.

Educational Talk

PIAM participated in two educational talks on 30 November 2013 and 16 February 2014 respectively on fire insurance.

The first session had Mr. Vidhyanandh Benjamin, a member of the Fire Sub-committee who shared some tips on Houseowner/Householder Insurance with visitors at the iProperty Expo held at the Setia City Convention Centre, Shah Alam.

The second session had Puan Nur Basmin Md Amin, also a member of the Fire Sub-committee who spoke on “Buying the Right Insurance Coverage to Effectively Protect Your Investments” to the potential buyers of properties in Cheras.

Kakitangan dan tetamu daripada industri insurans dan takaful menghadiri majlis dengan berpakaian mengikut tema “Box Office Nite” dan mereka juga telah dihiburkan dengan persembahan pentas. Ini adalah satu platfom sesuai untuk mewujudkan rangkaian industri insurans dalam persekitaran mesra dan menyenangkan.

Ceramah Pendidikan

PIAM mengambil bahagian dalam dua ceramah pendidikan mengenai insurans kebakaran pada 30 November 2013 dan 16 Februari 2014.

Pada sesi kedua, Puan Nur Basmin Md Amin, yang juga Ahli Jawatankuasa Kecil Kebakaran bercakap mengenai “Membeli Perlindungan Insurans Yang Betul Untuk Perlindungan Pelaburan Dengan Efektif” kepada bakal pembeli hartanah di Cheras.
