and the act shall be adopted.

Statement by Hungary
"Hungary considers the Youth Guarantee an excellent tool for supporting the employment of
young people throughout Europe and is fully committed to the implementation of the
programme. Hungary remains dedicated to its commitments in the field of human rights,
including the rights of young people. Hungary ensures these rights within the framework of
the Hungarian national legal system in accordance with internationally binding human rights
instruments and within the framework of fundamental values and principles of the European
Union. In this context, Hungary interprets the term of “diversity” in recommendation (1) of
the text in line with the content and scope of Article 22 of the Charter of Fundamental Rights
of the European Union."

"Equality between women and men is enshrined in the treaties of the European Union as a
fundamental right. Poland ensures equality between women and men within the framework
of the Polish national legal system in accordance with internationally biding human rights
instruments and within the framework of fundamental values and principles of the European

interpret it as a equality between women and men, according to Article 8 TFEU."

Statement by Slovakia
"The Slovak Republic recognizes and promotes equality between men and women in
accordance with the Constitution of the Slovak Republic and primary law of the European
Union. In this context, the Slovak Republic interprets the concept of „gender“ in the text of
the Council Recommendation and Council Conclusions as reference to sex and concept of
„gender equality“ as reference to the equality between men and women."
Statement by Sweden
"Supporting job creation and social inclusion is important, therefore Sweden welcomes the
reinforced Youth Guarantee as a valuable tool to support Member States in combatting youth
unemployment. Sweden believes that recommendations should allow member states to
organise work with respect for and in accordance with national circumstances and for instance
regarding the age span of the unemployed young people in the Youth Guarantee.
With regards to the implementation of the recommendation, Sweden interprets the first part of
the recommendation pertaining to the Youth Guarantee schemes as follows; implementation
should consider the guidelines in the recommendation, structured around the four phases
mapping, outreach, preparation and offer, and be organised with respect for and in accordance
with national, regional and local circumstances and structures, paying attention to the gender
and diversity of the young people who are being targeted."

Statement by Romania
"Romania welcomes the approval of the Council Conclusions on Improving the working and
living conditions of seasonal and other mobile workers, which reflect the essential role of
these categories of workers in the European Union and underline the importance of protecting
them.
While the EU seasonal workers perform critical activities in the member states and support
the functioning of the Single Market, they have proven to represent a category at greater risk.
In this context, they deserve a stronger protection and effective enforcement of their rights
throughout the Union. Both their crucial contribution and their vulnerabilities have been
strongly emphasised during the health crisis, which has unfolded since the beginning of this
year.
Approaching this issue at the European level is timely and Romania welcomes the strong
emphasis on the necessity to fully apply and enforce the EU and national legislation on
working and living conditions and social security coordination. This would adequately protect
seasonal and other mobile workers, especially in times of crisis such as the COVID-19
pandemic. We are confident that the approval of these Conclusions will bring new impetus at
the EU and national level.
In our view, the text could have benefited further from the explicit reference to domestic
caregivers, as they provide essential personal and household care services but are often
confronted with discriminatory treatment and precarious working conditions. We consider,
nevertheless, that the Council Conclusions apply as well to this category of workers.

Furthermore, Romania would have preferred a more ambitious language when calling for
setting specific requirements for temporary work and recruitment agencies, together with
additional elements on the information list they have to provide to workers.
Having regard to the above, we consider important to keep this subject high on the European
agenda in the forthcoming period. We are also looking forward to the Commission’s
assessment of the areas where the protection of seasonal workers should be enhanced and its
study aimed at the challenges they face and the subsequent policy recommendations."

"Österreich erklärt zu den Schlussfolgerungen des Rates zur Stärkung des
Mindesteinkommensschutzes zur Bekämpfung von Armut und sozialer Ausgrenzung während
der COVID-19-Pandemie und darüber hinaus (11084/20):
Als allgemeine Anmerkung hält Österreich fest, dass es ausschließlich Sache der
Mitgliedstaaten ist über Systeme der Mindestsicherung zu befinden – sei es legislativ oder
exekutiv.
Da die Mindesteinkommenssysteme auf die Bekämpfung sozialer Ausgrenzung abzielen, ist
unter anderem gemäß Artikel 153 Absatz 2 Buchstabe a AEUV nur die Annahme von
"Maßnahmen zur Förderung der Zusammenarbeit zwischen den Mitgliedstaaten durch
Initiativen, die die Verbesserung des Wissensstandes, die Entwicklung des Austausches von
Informationen und bewährten Verfahren, die Förderung innovativer Ansätze und die
Bewertung von Erfahrungen zum Ziel haben", durch das Europäische Parlament und den Rat
zulässig. Eine Harmonisierung der Rechts- und Verwaltungsvorschriften der Mitgliedstaaten
ist ausgeschlossen. Als Rechtsgrundlage für diese unverbindlichen Maßnahmen ist Artikel

Protection to Combat Poverty and Social Exclusion in the COVID-19 Pandemic and Beyond
(11084/20):
As a general remark, Austria states that it is exclusively up to the Member States to regulate
minimum income protection systems – be it legislative or executive.
As minimum income schemes aim at combating social exclusion, inter alia Article 153(2)(a)
TFEU only allows the adoption by the European Parliament and the Council of "measures
designed to encourage cooperation between Member States through initiatives aimed at
improving knowledge, developing exchanges of information and best practices, promoting
innovative approaches and evaluating experiences". Harmonisation of the laws and
regulations of the Member States is excluded. The legal basis for these non-binding measures
is Article 153(1)(j) TFEU. Subsequently, Member States shall, in strict compliance with the
principle of subsidiarity, exchange information and experience by using the method of open
coordination in order to develop their national systems while respecting their national
competence."

Statement by Germany
"Deutschland geht davon aus, dass die deutsche Fassung der Erwägungsgründe wie folgt
geändert wird: Im zweiten Erwägungsgrund werden die ersten drei Sätze wie folgt geändert
„Die Zahl der Menschen in der Union mit Tätowierungen oder Permanent Make-up,
insbesondere unter der jungen Bevölkerung, steigt stetig an. Die für Tätowierungen oder
Permanent Make-Up (im Folgenden zusammenfassend „Tätowieren“) eingesetzten Verfahren
bedeuten zwangsläufig eine Verletzung der Hautbarriere, unabhängig davon, ob Nadeln
verwendet oder eine andere Technik wie Mikroblading angewandt wird. Dies führt dazu, dass
die Tätowierfarben oder sonstige zum Tätowieren verwendeten Gemische in den Körper
aufgenommen werden.“ Zudem wird in Satz 6 des gleichen Erwägungsgrundes „so dass“ in
„sodass“ geändert. In Erwägungsgrund 7 wird im letzten Satz das Wort „angegangen“ durch
„adressiert“ ersetzt. In Erwägungsgrund 8 wird im ersten Satz „Hautallergen“ durch
„hautsensibilisierend“ ausgetauscht und im letzten Satz „bei Einatmen“ durch „nach
Exposition durch Inhalation“. In Erwägungsgrund 9 wird der erste Satz wie folgt geändert
„Darüber hinaus wurden in dem Dossier nach Anhang XV eine Reihe von
Kennzeichnungsvorschriften vorgeschlagen, von denen einige nach Stellungnahme des
Forums für den Austausch von Informationen zur Durchsetzung der Agentur (im Folgenden
„Forum“) im Verlauf der Ausarbeitung der Stellungnahme geändert wurden.“ Im zweiten Satz
dieses Erwägungsgrundes und im ersten Satz des Erwägungsgrundes 29 wird das Zitat von
„Anhang VI Teil 3 der Verordnung (EG) Nr. 1272/2008“ in „Teil 3 des Anhangs VI der
Verordnung (EG) Nr. 1272/2008“ geändert. Im letzten Satz dieses Erwägungsgrundes 9 wird
der Ausdruck „an die Hand“ gestrichen. In Erwägungsgrund 10 wird am Ende von Satz 3 der
Ausdruck „aufgeführt sind“ in „aufgeführt werden“ geändert. Der Erwägungsgrund 13 wird
wie folgt geändert: „(13) Der RAC stimmte dem Vorschlag nicht zu, zwei in Tabelle 1 der
ResAP (2008)1 aufgeführte primäre aromatische Amine, nämlich 6-Amino-2-
ethoxynaphthalin (CAS-Nr. 293733-21-8) und 2,4-Xylidin (EG-Nr. 202-440-0, CAS-Nr. 95-
68-1), aus dem Anwendungsbereich der vorgeschlagenen Beschränkung auszunehmen.“ In
Erwägungsgrund 14 werden die ersten beiden Sätze wie folgt gefasst „Dagegen stimmte RAC
dem Vorschlag der Dossiereinreicher zu, karzinogene und keimzellmutagene Stoffe der
Kategorie 1A, 1B oder 2 auszuschließen, von denen eine solche Gefahr nur nach Exposition
durch Inhalation ausgeht. Der RAC war der Auffassung, dass Stoffe, von denen eine solche
Gefahr nur aufgrund von Wirkungen nach Exposition durch Inhalation ausgeht, bei
intradermaler Exposition gegenüber zu Tätowierungszwecken verwendeten Gemischen nicht
relevant seien.“ In Erwägungsgrund 15 wird der letzte Satz wie folgt geändert: „Des Weiteren
nahm der RAC zur Kenntnis, dass Interessenträger bei der öffentlichen Konsultation darauf
hingewiesen hatten, dass nur zwei dieser Farbstoffe, nämlich die auf Phthalocyanin
basierenden Farbstoffe Pigment Blue 15:3 und Pigment Green 7, für das Tätowieren
wesentlich seien, da für sie keine sicheren und technisch angemessenen Alternativen
verfügbar seien.“ Die ersten beiden Sätze von Erwägungsgrund 18 sollten lauten „Am

Analyse (im Folgenden „SEAC“) eine Stellungnahme an, in der er die vorgeschlagene
Beschränkung mit den vom RAC und dem SEAC vorgeschlagenen Änderungen als die
hinsichtlich des sozioökonomischen Nutzens und der sozioökonomischen Kosten
zweckmäßigste unionsweite Maßnahme zur Adressierung der erkannten Risiken bewertete.
Der SEAC gelangte auf der Grundlage der besten verfügbaren Informationen zu dieser
Schlussfolgerung und ging davon aus, dass der durch die vermiedenen schädlichen
Auswirkungen auf die Haut und übrigen gesundheitlichen Auswirkungen erzielte erhebliche
gesellschaftliche Nutzen die zur Einhaltung der Beschränkung erforderlichen Kosten für die
Industrie wahrscheinlich überwögen.“ In Erwägungsgrund 21 wird im letzten Satz aus der
Formulierung „es sei nicht zu erwarten“ „da es nicht zu erwarten sei“. In Erwägungsgrund 23
wird aus „Buchstabe h“ „Buchstabe (h)“. In Erwägungsgrund 27 wird das Wort „Einatmen“
durch „Inhalation“ ersetzt und der Ausdruck „beim Einatmen“ durch „bei Exposition durch
Inhalation“. Im Erwägungsgrund 30 wird der erste Satz wie folgt geändert „Für Stoffe, die
infolge einer künftigen Änderung von Teil 3 des Anhangs VI der Verordnung (EG)
Nr. 1272/2008 unter die Beschränkung fallen, sollte die Beschränkung ab dem
Geltungsbeginn der Einstufung in Teil 3 des Anhangs VI der genannten Verordnung gelten.“
und der dritte Satz „Dieser Zeitraum von 18 Monaten gibt den Formulierern ausreichend Zeit,
um sicherere Alternativen zu finden;“. In Erwägungsgrund 31 wird im ersten Satz das Wort
„Einstufung“ durch „Listung“ ersetzt und in Erwägungsgrund 32 „Allerdings“ durch
„Nichtsdestotrotz“.
Ferner geht Deutschland davon aus, dass im Artikelteil folgende Änderungen erfolgen: In der
ersten Spalte wird „Anhang VI Teil 3 der Verordnung (EG) Nr. 1272/2008“ in „Teil 3 des
Anhangs VI der Verordnung (EG) Nr. 1272/2008“, „bei Einatmen“ jeweils durch „nach
Exposition durch Inhalation“, „Hautallergen“ durch „hautsensibilisierender Stoff“ und „in
Anhang IV der Verordnung (EG) Nr. 1223/2009 aufgeführte Stoffe“ durch „Stoffe, die in
Anhang IV der Verordnung (EG) Nr. 1223/2009 aufgeführt sind“. Im letzten Satz werden die
Buchstaben a und d jeweils geklammert geschrieben (also „(a) bis (d)“). Die Auflistung unter
Nummer 1 wird wie folgt geändert: „
(a) im Fall eines in Teil 3 des Anhangs VI der Verordnung (EG) Nr. 1272/2008 als
karzinogen der Kategorie 1A, 1B oder 2 oder als keimzellmutagen der Kategorie 1A,
1B oder 2 eingestuften Stoffes, wenn die Konzentration des Stoffes im Gemisch
mindestens 0,00005 Gewichtsprozent beträgt;
(b) Im Fall eines in Teil 3 des Anhangs VI der Verordnung (EG) Nr. 1272/2008 als
reproduktionstoxisch der Kategorie 1A, 1B oder 2 eingestuften Stoffes, wenn die
Konzentration des Stoffes im Gemisch mindestens 0,001 Gewichtsprozent beträgt;
(c) Im Fall eines in Teil 3 des Anhangs VI der Verordnung (EG) Nr. 1272/2008 als
hautsensibilisierend der Kategorie 1, 1A oder 1B eingestuften Stoffes, wenn die
Konzentration des Stoffes im Gemisch mindestens 0,001 Gewichtsprozent beträgt;
(d) Im Fall eines in Teil 3 des Anhangs VI der Verordnung (EG) Nr. 1272/2008 als
hautätzend der Kategorie 1A, 1B oder 1C, als hautreizend der Kategorie 2, als schwer
augenschädigend der Kategorie 1 oder als augenreizend der Kategorie 2 eingestuften

(h) Im Fall eines in der Anlage [XX] dieses Anhangs aufgeführten Stoffes, wenn der Stoff
im Gemisch in einer Konzentration vorhanden ist, die dem in der genannten Anlage
festgelegten Grenzwert für diesen Stoff entspricht oder diesen überschreitet.“
Bei Nummer 3 wird „Buchstaben a bis g“ in „Buchstabe (a) bis (g)“ geändert. Bei Nummer 5

"In order to better address the external dimension of migration management, Austria
would have welcomed, if the regulation establishing the Asylum and Migration Funds
(AMF) would have stated clearly that measures of the external dimension can be financed
through the Thematic Facility as well as through national programmes. A clear wording
concerning the external dimension would facilitate the work of the Member States in
implementing specific measures in relevant third countries.
Furthermore, as expressed during the negotiation process, Austria has concerns regarding
the method of calculation of the initial allocation of funds as stipulated in Annex I,
paragraph 5, where only the statistical data covering the preceding three calendar years are
taken into account. Austria would have welcomed the inclusion of a provision in the
regulation ensuring compensation for the financial burden borne by the most affected
Member States during the migration crisis 2015/2016.
Therefore, AT votes against the proposal."

Joint statement by Sweden, Finland and the Netherlands
"Sweden, Finland and the Netherlands welcome the German Presidency’s ambition to
advance the negotiations of the Home Affair Funds with a view to meeting the timeframe
ahead of the forthcoming budget period 2021-2027.
Nevertheless, we regret that the CEAS-provisions covered by the general approach have not
been negotiated after the Commission adopted the Asylum and Migration Pact. Further
discussions are necessary, especially in light of the concerns expressed by Member States
regarding the provision on resettlement leaving out the common Union resettlement priorities.
The current wording makes it very difficult in practice to determine if a resettled person
belongs to the category vulnerable group.
While voting in favor of the general approach in a spirit of constructive approach, Sweden ,
Finland and the Netherlands wish to underline the importance of amending the resettlement
provision during the interinstitutional negotiations in order to encourage and diminish the
administrative burden for those Member States showing solidarity and engaging in
resettlement of persons from the most vulnerable groups."
