Well, Ok Then….. One of my favorite sayings is “ the only reason to look back is to see how far you have come”. This is also a time of thanks for what we have accomplished in retrospect and where we are presently. So for me, my choice is clear, to give thanks. I am doing so with conviction, as this is my farewell article for the Peninsula REALTOR. I suppose I could list all this year’s achievements, but what we accomplished is no different from any previous years. Each year brings new challenges and in turn, new opportunities for resolutions. I am proud of the fact we are ushering in new leaders that are stepping up and are engaged in our Association’s future. I am proud of our REALTORS, our ded-icated three person Association Staff (Jim, Jo, and Cindy) that continually amaze me as they accomplish so much for our 1000 plus members. To our partners and affiliates, thank you for your continued support, enthusi-asm, and providing a level of quality and service to our members. I had the honor of working with a dynamic, informed and dedicated Board of Directors. As volunteers, we engaged in challenging discussions and topics ger-mane to the benefit of our membership.

My hat is off to Mr. Carl Burt, President–Elect and soon to be President Mr. Andy Cohen, Ms. Sandra Hood, Ms. Amanda Walsh, Ms. Dee Karlsson, Ms. Carla Car-ney, Ms. Eugenia Jackson, Ms. Peggy Todd, soon to be President Elect Ms. Chandra Patterson, and after years of stellar ser-vice and volunteerism to VPAR, our imme-diate past President Ms. Kimbel Dornan . This year, we engaged in challeng-ing discussions, respectful debates and in the end allowed for the flourishing of innovative thinking and progressive ideas befitting our membership, and the com-munity we serve. I am especially thankful for the volunteers that served as commit-tee chairmen and members who served alongside to educate our members. VPAR is only as good as those who participate and give of their time, energy, and expertise. Of course, our GAD, Susan Gaston, for protecting our industry and private property rights for our clients dur-ing the General Assembly sessions. It’s a secure feeling having the years of support, knowledge, and engaging service she pro-vides. Thanks again to everyone for the op-portunity to serve as your 2015 President. God Bless

Helping clients understand the com-plexities of title insurance keeps potentially small legal issues from snowballing.

Your client is under contract to buy a condo. The seller’s disclosure statement mentions: “The deeded parking stall is space #8, but all present and previous owners have been using space #3.” The transaction closes smoothly, but after-ward, your client receives a letter from another owner notifying her that the parking space she’s using isn’t hers. Your client notifies her title insurer, who denies coverage because space number eight was insured by the policy, her use of #3 was not insured, and the issue was disclosed by the seller. As a result, your client is left to address the issue at her own expense. A lawsuit will most likely be filed unless a compromise between the affected unit owners can be reached. Your client is left wondering why you didn’t help her catch this in the first place.

As you can see, it’s important for home buyers to be aware of title insurance mat-ters during transactions. And while it is not your role as a real estate practitioner to offer advice about specific policies, it is helpful if you can point out issues that clients need to investigate further. After all, the seller’s disclosures may affect your client’s title insurance coverage for future claims. Here we clarify eight common misconceptions that consumers and real estate professionals may have about title insurance.

1. Title insurance only insures “clear title.” Policies typically cover defects, liens, or encumbrances on titles. But, de-pending on the form, they may also cover losses related to access, building permits, subdivision of the land, zoning, land use, encroachments, setbacks, easements, damage to structures, and supplemental tax assessments.

2. Title insurance covers matters shown in the policy. If an item is listed in Schedule B of the policy, any loss arising from that item is exempt from coverage. For example, if Schedule B of the policy lists a roadway easement in favor of the owner of the adjacent property, any dis-pute or loss arising from that easement is not covered by the policy.

3. Title insurance guarantees a prop-erty is free of liens and clouds against title. Title insurance is not a guarantee. It’s an insurance contract, indemnifying the insured for actual loss arising from matters covered under the policy’s terms. Not everything is covered. For example, if an insured person, before closing, knew of an unrecorded roadway easement in favor of her neighbor, the policy would not cover loss arising from the easement.

4. If a title issue is discovered, the title insurer must fix it so escrow can close on time. The title insurer has the right and obligation to investigate the claim, even if it was tendered under time con-straints imposed by a pending escrow. The title insurer is not required to fix the problem so escrow can close on time, nor is the insurer liable for loss arising from delay or loss of the sale.

5. The title insurer won’t do anything if there’s no coverage under the policy. In cases where there’s no coverage for a claim, the title insurer has the right, but not the obligation, to address the claim and the insured has a duty to cooperate.

6. The title insurer will clear title if a covered title problem is discovered. The title insurer is not required to clear title. If a claim is covered, the title insurer has options it can exercise, such as 1) attempting to fix the problem; 2) filing a lawsuit; 3) negotiating a settlement with

the insured or a third party; or 4) paying the insured’s compensable loss.

7. Only one title insurance policy is paid for at closing. If the property is purchased with a loan, two title policies are usually paid for at closing: an owner’s policy and a loan policy. The owner’s policy insures the person or entity that acquired title and the loan policy insures the lender.

8. Refinancing a loan does not require a new title insurance policy. The lender will generally require a new loan policy insuring the refinance mortgage. Some-times an endorsement to the original

to our elected officials. Clearly, the PPC is very representative of the demographics of the Association.

The PPC is staffed by VPAR’s Legisla-tive and Public Affairs Consultant, Susan Gaston, who has served in that role for 15 years. Prior to becoming VPAR’s Consul-tant, Susan served as the Association’s first Governmental Affairs Director and worked to initiate VPAR’s successful pub-lic policy program.

The PPC reviews proposed local ordinanc-es and Comprehensive Plans, working in many cases to develop pro-housing and pro-businesses language to benefit the in-dustry; reviews and develops positions on state legislation and regulations, working with our consultant on strategy and posi-tion; assists in the creation and passage of proactive legislation; and monitors gov-ernmental and political events, including interviewing and endorsing candidates seeking elected office.

VPAR’S PUBLIC POLICY PROGRAM: A RECIPE FOR SUC-CESS!

Each month, VPAR dis-tributes “THE MONI-TOR,” the public policy newsletter intended to inform members of the various issues in which VPAR is engaged at the local, state and federal levels. It is full of details and illustrates the depth of VPAR’s influence and involvement in legislative and political matters.

But we thought it might be interesting this month to focus on the why and the how, rather than on the what, explaining to our members the purpose of VPAR’s public policy program. What does it mean to you? How does it benefit your business? Why should you care?

VPAR has a large, active, fully engaged Public Policy Committee (PPC) that includes 33 members from each of the governmental jurisdictions in our foot-print. The Committee also includes seasoned agents and brokers as well as REALTORS® who are relatively new to the industry, and affiliate members, too; in-cludes both Republicans and Democrats, all of whom are members of the pro-housing, pro-business “My REALTOR® Party”; and includes members who have personal and professional connections

Some of the key activities provided by the PPC and the Consultant are:

Local Legislative RepresentationBuilding on relationships spanning over two decades, VPAR members regularly are asked to serve in leadership positions on local task forces, work groups, boards and commissions. From the Hampton Rental Inspection Program Work Group to the Hampton Neighborhood Commission and the Zoning Advisory Committee, from the Newport News Comprehensive Plan Citi-zens Advisory Committee to the Newport News Regulations Committee, as well as Planning Commissions, Economic De-velopment Authorities and others, VPAR is well-represented at the local decision making level, positioning you as members for success.

State Legislative RepresentationVPAR is involved in lobbying at the Gen-eral Assembly of Virginia each day during the legislative Session in Richmond, focus-ing on bills that affect the real estate in-dustry and the transfer of property. While key relations with our Peninsula delega-tion are critical, VPAR members benefit from relationships that run across the Commonwealth, and include the Gover-nor’s office and the Administration. Sever-al local VPAR PPC members also serve on the state PPC, giving VPAR a distinct voice in state legislative decision making. In ad-dition, VPAR maintains close contact with Virginia’s Congressmen including VPAR

member Chandra Patterson, who serves as the NAR Federal Political Coordinator for Congressman Bobby Scott -- and Sena-tors, so that they are well-informed on federal issues that affect REALTORS® and property owners.

Political Affairs & Grassroots Initia-tivesVPAR also works to assist in the political process and encouraging active participa-tion in that process. Members are urged to become involved by supporting a candi-date or issue, either through support of RPAC, through direct support to the candi-date or responding to Calls-to-Action. The Association works closely with VAR and with NAR to deploy “boots on the ground” during elections and campaigns, and encourages members to contact decision makers when high stakes issues are in play. With one of the largest memberships in the region, VPAR’s political influence is highly sought, and highly regarded.

Issues Research and Analysis – VPAR spends considerable time researching and analyzing emerging or current issues of concern to the real estate profession. From local land use issues such as cash proffers, to the current status of city housing stock to underground petroleum storage tanks to sea level rise and coastal flooding, VPAR works with economists, land use attorneys, professional planners and the extensive resources at NAR to provide the Association and our elected

officials with the most current, accurate information possible. We are the trusted resource for housing data, real estate and land use legislation, and a myriad of other issues that impact the transfer and use of property.

REALTORS® Political Action Commit-tee (RPAC) – The PPC is the local fund-raising arm of the REALTORS® Political Action Committee (RPAC) of Virginia. PPC members, through direct asks and per-sonal contacts, raise both awareness and financial support of RPAC so that the PPC can assist the campaigns of REALTOR®-friendly candidates running for state, lo-cal and national office. Following a strict candidate interview and endorsement protocol that is widely modeled through-

out Virginia and the country, VPAR’s PPC members conduct thorough interviews with candidates to learn their positions on issues of particular concern to prop-erty owners and the real estate industry. This process just was undertaken by the VPAR PPC in conducting all-day candidate interviews to endorse candidates at the local and state levels! All RPAC funding decisions for members of the Virginia House of Delegates and the Senate of Virginia candidates are made by the RPAC of Virginia Trustees; VPAR PPC and BOD member Chandra Patterson serves as an RPAC Trustee, giving VPAR a voice at the state funding table. The RPAC Trustees also make recommendations to NAR on contribution for federal candidates.

So, given this snapshot, we hope that you can appreciate the time and energy, and the commitment that VPAR provides to keep you well-positioned for success in a REALTOR®-friendly legislative environ-ment. To sum it up, VPAR is either at the table or on the menu. As a result of years of work and investment by your PPC, VPAR members can be confident that you sit at the head of the table!

This year REIN unveiled a new and improved REINMLS.com website.  If you haven’t logged in yet, please be sure to do so and take advantage of all the site has to offer. 

If you have never been to REIN’s member website, and are wondering what it offers, think of it as a “hub” to all things REIN‐related. From REINMLS.com you can access Fusion and Matrix, find market statistics and graphs, the current month’s training calendar, PDF copies of REIN’s contracts and forms, and much more. You can even access your membership account to review and pay invoices online.

A ‘SYSTEM STATUS’ section has been added to the home page of the website to identify when REIN’s MLS systems and programs are experiencing known issues, such as updates, service interruptions or down time.  

The second new feature is ‘ASK REIN’ – a robust technical support module. ASK REIN allows you to search online documentation that can help you troubleshoot commonly asked technical questions, and if you can’t find the answers you are searching for, then you can ‘Submit a Support Request’ to REIN’s Tech Support Department directly  from the website.

Defeated a 500% Increase We helped to defeat a budget amendment that would have increased the deductible that property owners, including

YOUR clients, pay to have their leaking underground oil tanks cleaned up and repaired by 500%. The current $500 deductible was proposed to go up to $2,500.

The petroleum tank increase was a budget amendment.

Prison time: 1 to 6 years We added a felony charge to any criminal who lures or entices a REALTOR® to a property with the intent to do harm.

The added felony will increase a criminal’s sentence by up to 6 years. The 1-6 years are the statutory sentencing guidelines.

Save $150 - $500/hr. on attorneys’ fees We continued to refine legislation that allows property managers to represent your clients in General District court

without needing an attorney. So, how much would your attorney charge per hour? Typically, attorney fees range from $150 - $500/hr.

$12,000 back to consumers Under a new law that VAR drafted, we have made it easier for Virginia consumers who have received a court judgment to

collect damages from the Real Estate Transaction Recovery Fund. The average claim is approximately $12,000. The $12,000 figure is an estimate by the DPOR finance staff on the average claim that comes before the Board.

Wiped out $200/per Sign Fines We worked with a state legislator to prevent a proposal creating daily fines of $200 for any sign in any public right of

way. How often do you use such signs for your listings? 10 days for 1 sign = $2,000 The $200 per sign was the language in the proposed bill VAR was able to stop.

The Virginia Association of REALTORS® Third Quarter 2015 Home Sales Report indicates a rise of 11 percent from the same period last year, with a significant increase in volume and a slight increase in median price. There have been four con-secutive quarters of increased volume. The pace of sales has quickened by nearly 7 percent from the same period last year. Third quarter sales represent over $10 billion in transactional value, contributing to a year-to-date volume totaling $27 bil-lion. The median sales price has risen to $265,000, an improvement of 2.3 percent from the same period last year. Performing ahead of the national rate, the continued decline in Virginia’s unemployment rate to 4.3 percent in September may contrib-ute to buoyed consumer confidence and, along with continued low interest rates, may encourage buyers into the market.
