    This isa civil action for patent infringement, injunctive relief, and damages arising underthe United States PatentAct, 35 U.S.C. 1, etseq. This Court has subject matter jurisdictionoftheclaims asserted herein under 28U.S.C. 1331 and 1338(a).

    Each defendant has systematic and continuous contacts with theState ofOregon and haspurposefully availed itself the privilege ofconducting activities inOregon by soliciting and/orconducting businesstransactions in Oregon.

    VENUE

    Asubstantial part of theacts,eventsandomissions giving rise to theclaimsasserted in

    thisaction occurred within thisjudicial District, andvenue is therefore proper in thiscourt undertheprovisions of 28U.S.C. 1391(b) and(c), and 1400(b).

    OnMarch 30,2004,U.S. PatentNo. 6,711,856 ("the '856" patent") entitled "DoorOpenerAssistDevice"wasduly and legally issuedto DrewHoffman, Mr. Hoffman and hissuccessors in interest subsequently assigned theentire right, titleand interest inandto the '856patentto PatentEnforcement Group, LLC. Acopyof the patent is attachedas EXHIBITA.

    Plaintiffs predecessor-in-interest,The Hoffman Group L.L.C, has fully complied with allthe requirements of35 U.S.C. 287(a) to ensure constructive notice beaccorded by affixing theword "patent" ortheabbreviation "pat", together with thenumber ofthepatent (6,711,856), onall packaging of apparatuses whichembody thepatentedinventionandaremanufactured or soldby Plaintiff.///

    For itscomplaint against defendants, plaintiff alleges the following:CLA IM FOR REL IEF(Patent Infringement)

    In violationof 35U.S.C. 271 (a), (b) and (c), Defendants, and each of them haveinfringed and continue to infringe directly or under thedoctrine of equivalents; have induced andcontinueto induceothers to infringe; and/or have committed and continue to commitacts ofcontributory infringement ofoneormore ofthe claims ofthe '856patent. Defendants'infringing activities intheUnited States andinthisDistrict include manufacture, use, sale andoffer for sale ofcertain door poppers inboth a retail and wholesale capacity.

    Defendants offer the infringing product for sale and also for sale aspart ofa largerassemblage, orkittowhich the infringing product provides necessary function and ofwhich it isan integral part.

    Asa consequence ofthe infringing activities ofDefendants, andeach of them, regardingthe '856patent as complained of herein, Patent Enforcement Group, L.L.C. hassufferedmonetary damages in an amount not yet determined and will continue to suffer seriousirreparable injury unless Defendants' infringement of the '856patent is enjoined by this Court.

    PRAYER FOR RELIEFWHEREFORE, Plaintiff respectfully requests and prays that this Court enter judgment in

    its favor against defendants, andeach of them, andgrant the following relief:A. Ajudgmentdeclaring thatdefendants' conducthas infringed, induced othersto

    and wanton;C. Immediately andpermanently enjoining Defendants, theirofficers, directors,

    agents, servants, employees, representatives, attorneys, related companies, successors, assignsand all others inactive concert orparticipation with them, from any further acts of infringement,inducement of infringement, or contributory infringement ofthe'856patent;

    D. Anorder pursuant to35U.S.C. 284, awarding Plaintiff damages adequate tocompensate PlaintiffforDefendants' infringement of the '856 patent, in an amountto bedetermined at trial, butinno event less than a reasonable royalty ontheproducts or thekitsofwhich they comprise a part;

    E. An order pursuant to 35 U.S.C. 284, and based on Defendants' willful andwanton infringements of the '856 patent, trebling all damages awarded to Plaintiff;

    F. Anorder, pursuant to35U.S.C. 284, awarding to Plaintiffpre-judgment andpost-judgment interest on the damages anditscosts incurred in this action;

    G. An order, pursuant to 35U.S.C. 285 directing Defendants to deliver to Plaintiff,fordestruction at Plaintiff's option, allproducts that infringe the '856 patent; and

    H. Awarding plaintiffsuch other reliefas theCourt may deem just andequitable.
