Part One – Statutory Section1.0 Structure Plan AreaThis Part applies to the Twin Bartram Local Structure Plan (LSP), being all the land contained within the inner edge of the red line shown on the LSP (Plan 1).

2.0 Structure Plan ContentThis Structure Plan comprises:

• Part One: Statutory section which comprises the structure plan map and statutory provisions and requirements;

• Part Two: Non-statutory (Explanatory) information which is used as a reference guide to interpret and justify the implementation of Part One; and

• Part Three: Appendices

3.0 Interpretation and Scheme RelationshipThe words and expressions used in this LSP shall have the respective meanings given to them in the City of Cockburn Town Planning Scheme No.3 (TPS3)

In the event of there being any inconsistencies or conflict between the provisions, standards or requirements of TPS3, then the provisions, standards or requirements of TPS3 will prevail to the extent of any inconsistency.

4.0 OperationIn accordance with sub-clause 6.2.12.1 (a) of TPS3, the LSP comes into effect on the day on which it is endorsed by the Commission pursuant to clause 6.2.10.2.

5.0 Land use and subdivision requirements

5.1 General Subdivision and Development RequirementsThe LSP delineates and depicts zones, reserves and residential density codes applicable to the LSP area according to the legend thereon.

5.1.1 Notifications on TitleA notification is to be placed on the Certificate(s) of Title(s) to advise of the following:1. Land or lots deemed to be affected by a Bush Fire Hazard as identified

in the Fire Management Plan for Lots 9014 & 9015 Bartram Road, Success (November 2013) contained within Appendix 3.

2. Building setbacks and construction standards required to achieve a Bushfire Attack Level -29 or lower in accordance with Australian Standards (AS3959): Construction of buildings in bushfire prone areas and with Figure 9 of the Fire Management Plan for Lots 9014 & (015 Bartram Road, Success (November 2013).

3. Land or lots deemed to be impacted by mosquito and midge nuisances that are subject to the Mosquito and Midge Management Plan (Twin Bartram Swamps Mosquito and Midge Management Plan) at Appendix 5.

5.1.2 Detailed Area Plan RequirementsDetailed Area Plans (DAPs) are required to be prepared and implemented pursuant to Clause 6.2.15 of TPS 3 for lots comprising one or more of the following site attributes:1. Lots with rear-loaded vehicle access; and/or2. Lots with direct boundary frontage (primary or secondary) to an area of

public open space; and/or3. Lots deemed to be affected by a recognised Bush Fire Hazard as

identified in the Fire Management Plan for Lots 9014 & 9015 Bartram Road, Success (November 2013) contained within Appendix 3.

5.2 Public Open Space

A minimum 10% Public Open Space (POS) in accordance with the WAPC’s Liveable Neighbourhoods is to be provided. In addition to this 7240m2 is to be provided as POS in accordance Provision 3 of DA36 in TPS3.

6.0 OtherThis Structure Plan is supported by a Fire Hazard Assessment and the Fire Management Plan for Lots 9014 & 9015 Bartram Road, Success (November 2013). Regardless of whether the land has been formally designated as bushfire prone, any buildings to be erected on land identifed as faling within 100metres of a bushfire hazard and designated as bushfire prone land shall comply with the requirements of Australian Standards 3959 under the Building Code of Australia.
