That Council approve in principle the 2013-2017 Parks Capital projects as listed in the report

dated November 26 t h , 2012 and forward them to the Director of Finance for inclusion in the

budget with the following amendments:

1. That $25,000 be removed f rom the Video Screen Budget;

2. That $25,000 be added to the Centennial Park Budget; and

3. That the Centennial Park Ball Field upgrades be amended from

$65,000 to $90,000.

Subject: Kettle Creek - Community Gardens

Background Some residents f rom Kettle Creek have approached the Parks and Recreation Department requesting

that the City consider allowing al lotment gardens in the green space at Kettle Creek (Schedule A}.

Other residents (Schedule B) have asked that this area be used for a park and that a playground be

constructed at Kettle Creek.

Commentary Kettle Creek is a growing community wi th young families thus the need for public open space. Presently

there is limited public open space in Kettle Creek however the City wil l be receiving additional green

space as more development occurs. At this t ime there is no proposed funding f rom the City to build a

playground.

Financial Implications The construction of a playground or addition of park amenities would require financial support. In most

cases there are some City costs associated wi th a community garden.

Legal Implications

If a community gardens area/allotment garden was recommended this would require some form of legal

agreement wi th the group or society.

(iii) have a per unit fair market value certified by an independent quantity surveyor or architect of not less than $100 000 and not more than $150 000 not including GST;

(iv) be provided in a location acceptable to the City;

(v) be subject to a further housing agreement with the City to be entered into within one month of the date on which the City approves the location of the dwelling, which.further agreement provides that:

(a) the dwellings shall be owner-occupied and snail not be occupied under a residential tenancy agreement;

(b) the maximum resale price of the dwelling unit, for a period of at least five years after the issuance of the original occupancy permit, shall be the price paid by the first purchaser plus the annual interest rate paid on a daily interest savings account at a specified bank or credit union, and the owner and any subsequent purchaser of the dwelling unit must provide to the City prior to transferring the dwelling unit to a purchaser a statutory declaration disclosing the full selling price of the dwelling unit; and

(c) provides that, in the event that the unit is occupied under a residential tenancy agreement or sold for more than the price specified in the agreement, all rental payments made under the tenancy agreement and any excess portion of the price for which the unit has been transferred, as the case may be, shall be forfeited to the City; and

(vi) be constructed and ready for occupancy such that four affordable dwelling units are constructed and ready for occupancy prior to the authorization of every 50 t h dwelling unit in excess of three in Area 2 - Mixed-Use of the CD1 Zone.

(3) For the purposes of subsection 6.90.02(2)(b) and (c), a dwelling unit is authorized in the CD1 Zone when a building permit authorizing the construction of the dwelling unit is issued. (Bylaw No. 1215)

(4) Notwithstanding subsection 6.90.02(1), there may be more than 300 residential dwellings within Area 3 - Cluster Housing of the CD1 Zone if the owner: (Bylaw No. 1215)

(a) has at the owner's expense conducted a neighbourhood consultation process with residents of the CD1 Zone to determine the features they wish to be included within the community park on Lot A, Plan 81816, in consultation with and to the satisfaction of the City Parks Manager, has prepared a concept plan for the improvement of the community park with a certified construction value of not more than $100 000 excluding any site preparation works such as backblading and seeding, and has obtained the approval of the Parks Manager to the concept plan; and

(b) has either constructed the park improvements shown on the approved concept -- • pfan-to~tfte^tisfaetiort-oH^

City under s.219 of the Land Title Act requiring that the owner construct the community park within one (1) year of the date of approval.of the concept plan, and provided security satisfactory to the Parks Manager securing the owner's obligations under the covenant.

Subject: Island Radio Operated Car Club (IROC)

Background Island Radio Operated Car Club (IROC) has approached the City requesting that a permanent site in

Langford be found for the club to hold radio control model car races. The Club is currently using the Old

Island Highway at the Juan-de-Fuca Centre (Schedule A).

Commentary Presently, radio operated cars are being run at Eagle Ridge Arena under Westshore RC. IROC has been

in contact wi th Westshore RC and Performance Plus. There may be opportunity for IROC to join wi th

Westshore RC or rent t ime at Eagle Ridge Arena.

Financial Implications If IROC rents t ime and operates out of Eagle Ridge Arena, there are no financial costs to funding a new

permanent site and the City wil l receive a percentage of the rentai of Eagle Ridge Arena.

Legal Implications if IROC rents t ime and operates out of Eagle Ridge Arena, there are no legal implications f o r t he City.

In relation to our discussion on Friday June 29th, the Island Radio Operated Car Club (IROCC) is interested in applying for a permanent facility for the purpose of holding radio

control model car races.

As stated we have a temporary site near the Jaun-de-Fuca center opposite Wendy's, on the Old Island Highway.

Background Parks and Planning Departments have revised the Bylaw 1449 to more dearly reflect appropriate park

uses in Langford's municipal park system, park permit requirements, and new park classification

definitions.

Commentary With the new revisions to this Bylaw, the Langford Bylaw Enforcement Department will be appraised of these changes so that they will be able to provide appropriate enforcement of park usage offences. The new park classifications will also improve rezoning and development permit applications to the Planning Department

A BYLAW TO AMEND BYLAW NO. 177 BEING THE Langford Municipal Park Regulation Bylaw No. 177, 1996.

The Council of the City of Langford in open meeting assembled enacts as follows:

3. Operating Hours

3.1 Ail-Glass < ^ closed to public-access between sunset and sunrise daily, unless otherwise specified in this bylaw or in an operating agreement pertaining to the park.

3.3 Notwithstanding subsections 3.1 and 3,2 all parks listed on Schedule "A", attached to and forming part of this bylaw.are hereby closed between 5:00 p.m. and 7:00 a.m.

4. Park Use

4,1. No person shall enter, use, occupy or.remaln in a municipal park contrary to Section 3 of

this bylaw.

or in any way destroy or'damage any tree shrub plant, turf, seat, bench, swing,

playground equipment, sports equipment, or ornaments of-any kind ih any park, trail or

on any beach.

4.4. No person shall, whether or not with the use or aid. of any ahimaj, vehicle or other thing, perform of engage in any stunt or other activity within a park that is likely to distract, startle or interfere with other users of the park or cause damage to public or private property,

4.5. No person shall, in a park, possess or consume liquor as defined in the Liquor Control and Licensing Act, except as is authorized under a Special Occasion Licence.

5.2. Any person issued a paiik permit to hold an event in a municipal Park must be responsible/for c lean^ (Schedule B)

6. Enforcement

6.1. The Municipal Bylaw Enforcement Officer or a Royal Canadian Mounted Police Officer is hereby authorized to enforce this bylaw.

6.2. Municipal Bylaw Enforcement Officer or a Royal Canadian Mounted Police Officer may issue, in writing, such notices or orders as may be necessary to inform a park user where a contravention of this bylaw has been observed.

6.3. The Municipal Byfaw Enforcement Officer or a Royal Canadian Mounted Police Officer may order a person who contravenes this bylaw to comply within the period specified.

7. Offence

7.1. No person shall do any act or suffer or permit any act or thing to be done in contravention of this bylaw.

7.2. Every person who contravenes this bylaw commits-ail offence and is liable, on summary conviction, to a fine, of not more than $10,000.

Re: Invitation to Host the BC Seniors Games

Dear Mayor Young

On behalf of the BC Seniors Games Society, it is my pleasure to invite your Community to host the 28 h and 29 t h consecutive annual BC Seniors Games to be held in August or September in 2015 and 2016. Your Community may bid on one or both of these Seniors Games, however, only one will be awarded.

The BC Seniors Games has become an Economic Tourism Sporting Event for any Community. The last economic factor was completed after the 2009 Richmond BC Senior Games, where 3,900 55+ residents of BC participated in 29 sports, leaving over $2,000,000.00 in the Business Community of Richmond.

The BC Seniors Games Society assists the Host Communities and Volunteers by providing Event Management Services through an Agreement with the BC Games Society. We provide $85,000.00 in funds from the Ministry of Community, Sport and Cultural Development as well as a portion of all Participant registration fees.

A Bid Document Package has been included. The deadline for bid proposals is 12 noon on June 28, 2013 to be received at the BCSGS temporary office at 2089 Vallis Place, Sidney, BC V8L 2L3.
