During 2015 Mr. Richesin was an Oregon-licensed CPAand was responsible for all his pesticide application activities. On or about August 17, 2015 Mr. Richesin intentionally applied pesticides to an onion field in Oregon.The pesticides were sprayed onto a frequently flood-irrigated field, in a manner that allowed the product to drift onto neighboring property and contact anunprotected person working in the area, which was inconsistent with label provisions. Additionally, applicator violated ORS 634.372(9), which states A person maynot: … As a pesticide operator, engage in the business of, or represent or advertise as being in the business of, applying pesticides upon the land or property ofanother, without first obtaining and maintaining a pesticide operator’s license. The operator also may not engage in a class of pesticide application business that isnot specifically authorized by license issued by the State Department of Agriculture. The operator also may not employ or use any person to apply or spraypesticides who is not a licensed pesticide applicator or pesticide trainee.

Male complainant reported to OR-OSHA adverse health effects that he associates with being exposed to EPA Reg. No. 524-517 (glyphosate) whileusing a backpack sprayer. Reportedly, complainant sought medical attention. OR-OSHA made a referral to PARC. PARC made a referral toOHA/PEST. OR-OSHA conducted an investigation and issued three other than serious violations for PPE stored in the pesticide storage container; lackof a chemical resistant apron, and unlabeled backpacks. A hazard letter was also written to require the eyewash station be at the mix site of the companylocation and decontamination supplies.

Complainant heard ahelicopter, but did not see an application or notice of smell. PARC made referrals to OHA/PEST, ODA and ODF. ODF was able to locate a recent application thatoccurred 14 miles from the complainant's home.
