Militant killed by SF in encounter SRINAGAR: A militant, reported- ly belonging to Hizbul Mu- jahideen (HM), was killed by se- curity forces in an encounter on Tuesday during a Cordon and Search Operation (CASO), offi- cial sources said. They said on a tip-off about the presence of militants, troops of Rashtriya Rifles (RR), Special Operation Group (SOG) of Jam- mu and Kashmir police and CRPF launched a joint CASO at village Seel, Awantipora, today. However, when the security forces were sealing the village and moving towards a particular area, militants hiding there opened fire, they said, adding that security forces also returned the fire ensuing in an encounter. The militant reportedly belonged to HM, they said, adding that some arms and ammunition were recovered from the slain militant. Nationwide bank strike today NEW DELHI: Services at various bank branches and ATMs are likely to be affected as hundreds of employees will go on a bank strike across the country on Wednesday. The bank strike is part of the Bharat Bandh call given by trade unions to protest against the labour reforms and economic policies of the Central govern- ment, according to reports. The protestors' main demand during the Bharat Bandh is that the Centre should drop the pro- posed labour reforms. The new bye laws, cover- ing construction of residen- tial, commercial and industri- al buildings, including hotels, miniplexes and other infra- structure projects, are aimed at making construction activ- ity in the state more seamless and hassle-free for all the stakeholders, thus reviving the sector in the state, accord- ing to Local Government Minister Brahm Mohindra. To- day, the District Judge DK Shar- ma asked the investigation agency to give the scheduled list of witnesses pending in the case on the next date, which is on Jan- uary 30. Ghosh, who appeared on national TV on Sunday evening with a blood-soaked face and with a bandage on Monday, is now been alleged to have played a key role in the violence in JNU, which took place on Sunday. She has been booked un- der Sections 341, 323 and 506 of the IPC and various sec- tions of the Prevention of Damage to Public property Act. Currently, the central govern- ment's ambitious initiative is be- ing implemented on a pilot basis in a cluster of six states. It wants to implement this facility across the country from June 1, 2020. Under the initiative, eligible bene- ficiaries would be able to avail their entitled foodgrains under the National Food Security Act (NFSA) from any Fair Price Shop in the country using the same ra- tion card. Additional Session Judge Satish Kumar Arora issued the death warrant in the presence of all convicts, who were produced before the court through video conferencing. Earlier in the day, the court reserved the order on the plea of parents of Nirbhaya seeking is- suance of death warrant against all the four convicts in the case. The court heard the plea of parents of the 2012 Delhi gang- rape victim seeking to expedite the procedure to hang all four convicted in the case and also seeking issuance of death warrant against them. It was informed by the lawyers of the convicts that they are in the process of filing the curative plea. On Monday, the court had dismissed an application filed by the father of one of the death-row convicts in the Nirbhaya rape case, who had questioned the credibility of the sole witness by claiming that he was "tutored" and sought the registration of FIR against him. The court had on De- cember 20 reserved the order on an application filed by Pawan Kumar Gupta's father till today. The petition had stated that the girl's friend committed perjury for giving false testimony in the court. The Expression of Interest (EoI) and the share purchase agreement would be issued in January 2020. The GoM on Civil Aviation led by Union Home Minister Amit Shah met today and ap- proved all proposals on debt transfer from Air India to a special purpose vehicle (SPV). "In the meeting, the commit- tee has cleared the proposal relat- ed to debt transfer from Air India to SPV. Expression of Interest would come out in January 2020," a government official told ANI. A stampede erupted on Tuesday at afuneral procession for a top Iraniangeneral killed in a US airstrike lastweek, killing 35 people and injuring48 others, state television reported.

The Expression of Interest(EoI) and the share purchaseagreement would be issued inJanuary 2020.

The GoM on Civil Aviationled by Union Home MinisterAmit Shah met today and ap-proved all proposals on debttransfer from Air India to a special

purpose vehicle (SPV)."In the meeting, the commit-

tee has cleared the proposal relat-ed to debt transfer from Air Indiato SPV. Expression of Interestwould come out in January 2020,"a government official told ANI.

Civil Aviation Minister Hard-eep Singh Puri, Finance MinisterNirmala Sitharaman, CommerceMinister and Piyush Goyal at-tended the GoM meeting.

NATION ALLAHABAD: The Allahabad High Court on Tuesday asked the National Human Rights Commission (NHRC) to investigate the allegations of police brutality on students of Aligarh Muslim University during protests against the Citizenship (Amendment) Act. Hearing a Public Interest Litigation (PIL) filed by one Mohammed Aman Khan of Allahabad, a division bench of Chief Justice Govind Mathur and Justice Vivek Varma directed the Commission to complete the process of inquiry expeditiously within one month. While directing to list this PIL for further hearing on February 17, the bench also directed the NHRC to convey its findings and recommendations to the high court immediately after conclusion of the investigation. "Looking to the powers of the Human Rights Commission, at this stage, we are not inclined to constitute any Special Investigating Team (SIT) but to get the entire matter inquired by the National Human Rights Commission," the bench said.

Punjab Chief Minister CaptainAmarinder Singh on Tuesday ex-pressed deep concern over AkalTakht Acting Jathedar’s remarksthat Sikhs were not safe even in In-dia, and asked the Takht to putpressure on the Akalis to sever allties with the ruling alliance at theCentre, which had been unable toensure a sense of safety among theminorities in the country.

While he himself did not agreewith the Akal Takht Jathedar’s re-marks that Sikhs were not safe inIndia, the Chief Minister said that ifthe former did feel that way then heshould take up the matter with theShiromani Akali Dal (SAD) andask them to leave the BJP-led coali-tion government at the Centre, ofwhich they are a part.

Unlike Pakistan, India had al-ways taken pride in being a secularnation, with no discrimination onreligious grounds, said CaptainAmarinder, adding that any feelingamong the Sikh community thatthey were not secure here was amatter of grave concern. If Sikhswere feeling insecure in this coun-

try, as stated by the Acting Jathedarof Akal Takht, Giani HarpreetSingh, then it was the dispensationat the Centre which was to blame,he stressed.

Given that the Akalis claim tobe the custodians of the Sikh reli-gion, and the community, theyshould take a stand on the issue,and SAD chief Sukhbir Badalshould also ask his wife, HarsimratKaur Badal, to resign immediatelyas a Union Minister, the Chief Min-ister.

Man held in dhabaowner murder caseANIL THAKUR DHARAMSHALA: Under the policestation Fatehpur of district Kangra, inthe Khatiyad area adjacent to Punjab,the elderly man died in the lastevening in exchange for demandingmoney from the customer. Jai Ram Thakur thanks Union Govt forapproving Rs 284.94 Cr under NDRF

Chief Minister said thatCentral Government had providedRs 312 crore assistance to the StateGovernment last year againstreported loss of Rs 2099 crorewhich comes to around 17 percent.

Mr Thakur said that state hadreceived highest ever assistancefrom the Central Governmentunder NDRF during last twoconsecutive years for monsoon

losses.He said that State Government

had also received Centralassistance of Rs 64.49 crore forwinter losses during last year. CMsaid that Central Government wasproviding liberal assistance to the

State for carrying outdevelopmental works. He alsoapplauded the Principal SecretaryRevenue and DisasterManagement Team for putting upthe case earnestly for gettingCentral assistance.

Rs 21.40 cr spent in Hamirpurduring 2019-20 under MGNREGA

HAMIRPUR: A sum of Rs 21.4crore had been spent in thedistrict on various programmesunder MGNREGA, the much-ambitious programme, whichwas started to help the poorpeople, Deputy CommissionerHarikesh Meena said here onTuesday. While presiding over ameeting to review the Ruraldevelopment programmes in thedistrict, Mr Meena said thatduring the above-mentionedperiod, 7,89,931 man days weregenerated, as against 9,40,247

fixed for the year 2019-20,thereby achieving a target of 84per cent. Srinagar-Jammu highway closed,hundreds of vehicles stranded

SRINAGAR: Hundreds of vehicles, includingthose carrying passengers, are stranded on Tuesdayon the national highway due to closure of only allweather Srinagar-Jammu road, connecting Kash-mir valley with the rest of the country due to freshlandslides and snowfall. There was also freshsnowfall on the 434-km-long Srinagar-Leh nation-al highway, the only road connecting Union Terri-tory (UT) Ladakh with Kashmir valley, which re-mained closed for the past 28 days on Tuesday dueto accumulation of over five feet snow and slipperycondition. The historic 86-km-long Mughal road,connecting Shopian in south Kashmir with Rajouriand Poonch in Jammu region and Anantnag-Kisht-war road also remained closed for the past 28 days.Both the roads will now remain closed for wintermonths. Man stripped,thrashed for stealinggarlic at MP marketMANDSAUR (MP): A man wasstripped naked and thrashed forallegedly stealing a sack of garlic at awholesale market in MadhyaPradesh's Mandsaur city, police saidon Tuesday. The matter came to lightafter a purported video of the incidentsurfaced on local WhatsApp groups,an official said. Couple accuses doctorof keeping their baby asmortgage for notpaying billBAGHPAT: A couple has accused thata doctor in Usha Nursing Home herehas kept their baby as a mortgage fornot paying the hospital bills worth Rs40,000. Talking to ANI, Shikha, motherof the child, said: "In September 2018,I gave birth to a boy and after thedelivery, a bill of Rs 40,000 was givento us. We didn't have that muchmoney to settle the bills. "The doctorcame up with a solution and said thatwe can return the money, but they willkeep my child as a mortgage till wefully pay the amount," she added.Mohar Singh, child's father, said: "Wegradually paid Rs 30,000 and whenwe approached the doctor with therest of the money, he drove us awayand didn't give our child back."However, Additional Superintendent ofPolice (ACP) Anil Kumar Singh said:"During the inquiry, the doctor said thatthe couple sold their child inMuzaffarnagar and the couple isdenying it. Police bust illegalarms manufacturingunit in WB, 1 heldKOLKATA: A man was arrested afterpolice busted an illegal armsmanufacturing unit from the Port area ofthe city. According to the police'sstatement, the accused identified asAbdul Kayum alias Munna has beenarrested for his alleged involvement inthe illegal arms manufacturing unit. "Hewas engaged in making firearms usingmachines and materials inside a tile shedroom situated on the terrace of his rentedpremises," police said. Acting on a tip-off,a police team raided a single-storiedbuilding at Nadial in the city's Port areaand busted the arms manufacturing unit,seized the materials and arrestedMunna. During the raid, one finished 7mm pistol, one finished magazine, onesemi-finished magazine, one barrel,three drill machines, six vises machines,two hand-held visas, steel sheets, ironbars, hammers, hacksaw blades, ironspring coils were also seized, police said.Apart from Kayum, the landlord of thebuilding Mohammed Kalim, a resident ofBihar and others were also engaged inthe same job. But they could not betraced, they said. The Centre has warned itsemployees of "consequences" ifthey go on strike called on January8 by one of their associations toprotest against union government'spolicies including labour reforms,foreign direct investment (FDI)and privatisation, according to aPersonnel ministry order. TheCentral Trade Union, exceptBhartiya Mazdoor Sangh, andtheir affiliates in different sectors

are mobilising workers andemployees for their proposednationwide general strike onJanuary 8, to protest against someof the central government policiesand press for 12-point commondemands of the working classrelating to minimum wage andsocial security among others."Any employee going on strike inany form would face theconsequences which, besidesdeduction of wages, may alsoinclude appropriate disciplinaryaction," the order said. In a missive

issued to all central governmentdepartments, it said existinginstructions prohibit a governmentservant from participating in anyform of strike including masscasual leave etc. It said the right toform the association does notinclude any guaranteed right tostrike or protest. "There is nostatutory provision empoweringthe employees to go on strike," theministry said. The Supreme Courthas also agreed in severaljudgements that going on a strikeis a grave misconduct under the

rules and that misconduct by thegovernment employees is requiredto be dealt with in accordance withlaw, it said. "All officers are alsorequested not to sanction casualleave or any other kind of leave tothe officers and employees, ifapplied for, during the period ofproposed strike, and ensure thatwilling officers are allowedhindrance free entry into the officepremises," said the order, alsoissued to the Central IndustrialSecurity Force (CISF) asking it toensure strict vigil.

Court rejects Karti Chidambaram'sdischarge plea in tax evasion case

A special court here onTuesday dismissed adischarge petition filed byCongress MP KartiChidambaram and his wifeSrinidhi in connection with atax evasion case. When theplea came up, Special Courtfor MLAs and MPs judge DLingeshwaran found merit inthe evidence submitted by theprosecution and dismissed it.The judge then ordered theprosecution to go ahead withthe framing of charges andsought both the accused to bepresent in the court onJanuary 21. He also said

warrants would be issued ifboth failed to appear duringnext hearing. The matterrelates to the alleged non-disclosure of Rs 1.35 crorereceived by KartiChidambaram, son of formerunion minister PChidambaram, and his wifein cash for sale of land inMuttukadu near here. Thepetitioners submitted that the

transaction was completedand returns of income werefiled in 2015 when Karti wasnot a member of Parliament.

The deputy director ofincome tax Investigation,Chennai, had filed acomplaint on September 12,2018 against the petitionersbefore the Additional ChiefMetropolitan MagistrateCourt-II (EconomicOffences) for offences undersections 276c(1) and 277 ofthe I-T Act. The case waslater transferred to the specialcourt. During the hearing, theI-T department submitted thatKarti received Rs 6.38 crorein cash while his wife

received Rs 1.35 crore in cashfor the sale of land nearMuttukadu. It was allegedthat the Karti's mom NaliniChidambaram received thepayment in the form ofcheque while their son andhis wife received cash.During a joint searchconducted by officials fromthe IT department andEnforcement Directorate inconnection with the case ofAdvantage StrategicConsulting Pvt Ltd, onDecember 1, 2015, thedepartment found severalelectronic materials related tothe transaction of money,which was all seized.

The police aren’t known to show such solicitousness to-wards leftist students. But it’s the slogans that give the hood-lums away. “Naxals”, “tukde-tukde gang”, “desh ka gaddar”were some of the milder things said. These expressions aren’ta part of the Left’s vocabulary. A woman reporter of a top tel-evision channel could be seen asking those who surrounded herwhy they wanted her to shout “Bharat Mata ki Jai” and whatrelevance that nationalist cry had to the prevailing situation.

In the past six years, leading lights of the ruling party andthe government have sought to devise ways to dismantle JNUas it is today — a haven of study through seminars, sharp de-bates, and a consciously designed academic programme thatencourages the linking of all aspects of life with the curriculain a free manner. The spirit of constant questioning, and JNU’sadmissions policy that assiduously seeks students from all partsof the country and from the poorest classes, has made this uni-versity among the best in the world, but anathema to the ma-joritarian right-wing.

The powers-that-be appear to want to inculcate scholarshipthat is worshipful of the State and would pray at the altar of theputative greatness of our ancients. Nothing gets America asexcited as the prospectof going to war in a dis-

tant land. Largely insulated asthey are from the consequencesof their actions (war is a spec-tator sport, to be cheered onmuch like a televised footballmatch), it is with a horrifiedfascination that one watchesthem go through the same oldrituals once again, like trainedpriests at the bloodstained altarof the gods of war and greed.

Nothing is more pre-dictable than the tools and rhet-oric employed in that march towar either, and what we areseeing now in the Americanbody politic is a warped repeatof what we saw in 2003, withthe blind, bleating march to

war with Iraq; the same warthat led to the circumstancesthat eventually led to the assas-sination of Iranian Quds forcecommander QassimSoleimani. If history repeats it-self first as tragedy and then asfarce, then this is a farce beingrepeated so many times that anentire new word will have to beadmitted for the sheer shamefuldishonesty of it all.

The expectation that the judici-ary should use its role as aneutral arbiter not only to in-

terpret and apply the law but also todetermine the political course ofthe state is heightened when politi-cal institutions seem to be inca-pable of resolving serious crises.

In Pakistan, courts are often ex-pected to resolve fundamentalquestions concerning the identity ofthe state. Certain recent decisionsof the Supreme Court have beenperceived to mark a shift in the sta-tus quo. The Supreme Court’s deci-sion to take up the challenge to theextension of the Army Chief’stenure and then direct Parliament tolegislate on this issue was widelyviewed as an attempt to challengeexisting state power structures. Theconviction of a military dictator forhigh treason by a special court wastermed by a Dawn editorial to be a“seismic shift in Pakistan’s histo-ry”. The reactions to these deci-sions reveal how the judiciary is of-ten viewed as a driver of significantchange.

The judiciary, by the very na-ture of its role, is limited in its abil-ity to bring about political change.Unlike the executive branch, the ju-diciary does not have a monopolyover brute power and unlike thelegislature, its power is not derivedfrom the people. In a democracy,the power of the judiciary lies inthe legitimacy — the social, moraland legal credibility — of its deci-sions. To maintain this credibility,the judiciary must, more often thannot, be perceived to be neutralrather than political. In authoritari-an contexts, the power of the judi-ciary ultimately depends on the oli-

garchs that run the state, whichmeans that the judiciary must com-promise with the oligarchs for itsinstitutional survival. If we lookbeyond the rhetoric and sometimesoverarching personalities of indi-vidual judges in Pakistan, we seethat ultimately it is pragmatism,compromise with political realitiesand institutional preservation thathave guided the work of the judici-ary as an institution. We see this inthe absence of effective accounta-bility in our courts for enforced dis-appearances and the targeting ofcivilian political leadership in cor-ruption cases.

In a context where the suo motupowers of the Supreme Court areinvoked frequently, it is instructiveto observe which issues the highestcourt does not take up suo motu: forexample, constitutionality of thelaw on blasphemy, systemic sup-pression of media freedom andwidespread militarisation.

There have certainly been timeswhen the judiciary has hastened po-litical change in Pakistan, some-times by directly challenging brutepower. The resistance of the judici-ary to Gen. Pervez Musharraf’s

purge fuelled the movement to de-pose the military dictator. But eventhough the face of the dictatorshipwas removed, the judiciary was un-able to stem the erosion of funda-mental rights in subsequent years(by, for example, upholding the es-tablishment of military courts), andthe continued weakening of electedgovernments (through, for exam-ple, the disqualification of formerPrime Minister Nawaz Sharif). Thejudiciary could not stall the recentbacksliding of Pakistan towards au-thoritarianism. The truth is thatconstitution

al morality is not determined byjudicial decisions — nor should itbe. It is determined by politicalpower. Ultimately, the courts andthe judiciary cannot and should notbe expected to disrupt the statusquo in any sustainable way, unlessthere is continued political momen-tum and a broader movement for

change. Indian political theoristPratab Bhanu Mehta summed it upwhen cautioning against an overre-liance on courts to resolve the cur-rent moral and philosophical crisisfacing the Indian state: “[T]his di-rection is not going to be setthrough the nice formalisms of thelaw, or the contrived conventionswe can adhere to in normal times.The direction is going to be set bythe mob, by brute power, by mobil-isation.”

Let us not place the burden ofour political expectations on the ju-diciary. Not only is it unfair on oursuperior courts, it will also distractus from where the work really mustbe done: in our university campus-es, workplaces, factories, Parlia-ment and our streets. We shouldrely on courts only when we are do-ing a lot of work outside of them, inthose spaces where democracy real-ly happens.

Today its globalprofile is greatly helped by thegenerally humanist behaviourof Christian-dominant nationsin Europe and North America,who are standard bearers ofthe modern virtues of democ-racy, equality, liberty and therule of law. Nor is Zoroastri-anism a threat. It has no glob-al salience today even in its

home — Persia (modern Iran)— from where 1,000 yearsago the Parsis fled religiouspersecution by the conqueringMuslims. They are refugees inIndia, who are more national-istic than the original inhabi-tants, as is always the casewith “new” citizens.

In contrast, Islam does notrhyme with modernity. It pres-ents a strong, alternative sov-ereignty, backed by petro-dol-lars. It is increasingly more as-sertive globally. To be sure,moderate Islamic countrieslike Malaysia, Indonesia andBangladesh under SheikhHasina Wajed demonstratesome virtuous democratictrends. But these are not thestandard bearers of Islam.That honour goes to SunniSaudi Arabia, Egypt or Turkey

and Shia Iran, where there is astrong confluence between re-ligion and the State. None ofthese countries shine ifviewed through the modernlens of good governance,equality or liberty.

Allah has bestowed hisfollowers with vast quantitiesof black gold. Only a rampingup of a combination of nuclearand renewable power, as thepreferred energy source, candilute the fiscal heft of this giftand weaken the pull of resur-gent, global Islam. But this isunlikely any time before2040.

This means that Hindupolarisation will remain polit-ically attractive over the nearfuture. The Ram Mandir andRath Yatra political template,exploited by the BJP leaders

from a gentler time — Lal Kr-ishna Advani and Atal BehariVajpayee — is likely to in-crease in potency. This is thereal problem for NarendraModi. So attractive is the Hin-dutva path to political power,and so used are his followersto exercising dominant power,that it will be well nigh im-possible to get away from thecurrent high.

Expect a new populationcontrol law limiting all fami-lies to two children to followthe completion of a nationalpopulation register. This will,while appearing fair and even-handed, disproportionatelyimpact Muslims, who aremore fertile than Hindus.

Left-leaning, secular in-tellectuals explain that theirfertility has nothing to do withIslam; that Muslims are poor-er than Hindus and it is wellknown that for the poor, con-straining the family size is nota priority. This argument issalient. But a trope does notneed a reason behind it to be-come popular. It is enoughthat it seems true.

It is therefore certain thatNarendra Modi will go downin history as the Hindu leaderwho brought dignity andpride to a religion — which,like the white, blue collaredmasses of middle America —has felt neglected in its ownhome; ignored by its own,mostly Hindu, leaders; rele-gated to a residual status on

which all the burdens of so-cial compromise could besaddled. This ersatz “revival-ism” is Mr Modi’s claim to apage in history.

But how sustainable issuch religious revivalismwithout a cleansing of theembedded barriers to organicconsolidation? An excess ofrituals over substance hascreated a curious disconnectbetween the modern demandsof a scientific temperament,equality of opportunity,changing norms are andro-genising society and shapingglobal allegiances, whilecontradictions afflict tradi-tional roles and relationships— not least between men andwomen, the rulers and theruled, patrimony and dissentand the aged versus theyouth.

Coffee exports in2019 up marginally at3.50 lakh tonneNEW DELHI: Coffee exports fromIndia rose marginally to 3.50 lakhtonne in 2019 as compared to 3.48lakh tonne in the previous year,according to the Coffee Board. India isthe third-largest producer and exporterof coffee in Asia. Italy, Germany andRussia were the major exportdestinations for Indian coffee last year.India ships both Robusta and Arabicavarieties, besides instant coffee.Robusta coffee exports rose 4.10 percent to 1,86,360 tonne in 2019 from1,79,004 tonne in 2018, the Boarddata showed. Export of Arabica coffeehowever declined 10.75 per cent to47,341.82 tonne from 53,049 tonne in2018. The outbound shipment ofinstant coffee fell to 27,339 tonne in2019 from 29,146 tonne in theprevious year, the data showed. Of thetotal coffee exports, India exported72,267 tonne to Italy, 37,175 tonne toGermany and 28,573 tonne to Russialast year. Some of the major exportingcompanies include CCL ProductsIndia, Tata Coffee, NKG India Coffee,Allanasons Pvt Ltd, Olam Agro andCoffee Day Global Ltd. GM Breweries reports net profit down atRs 14 crore in Q3 FY20MUMBAI: GM Breweries said on Tuesday its total revenue from operationsduring the quarter ended December 2019 fell to Rs 429 crore compared toRs 449 crore in the year-ago period. Total income came in at Rs 430 croreagainst Rs 452 crore in Q3 FY19. The company's profit before tax (PBT)dropped to Rs 18.6 crore as against Rs 26 crore in the same period.Net profit or profit after tax for Q3 FY20 stood at Rs 13.9 crore. Thecompany had logged a profit of Rs 16.7 crore in the year-ago quarter.The fall was mainly on the back of an unprecedented rise in the cost ofcompany's main raw material -- rectified spirit. Earnings per share stood atRs 7.65 against Rs 9.14 last year.
