Township Council met at 6:05 p.m. in the Council Chambers, Township of King Municipal Building, 2075 King Road, King City, with Mayor Pellegrini presiding. 1. CALL TO ORDER

Mayor Pellegrini called the meeting to order. A quorum was present. 2. INTRODUCTION OF ADDENDUM ITEMS The Clerk advised there was an administrative paginating correction made to the staff report for COW Item #2 and correspondence was received for COW Item #5. 3. APPROVAL OF AGENDA A motion was made by Councillor Eek, seconded by Councillor Schaefer and carried that the Agenda for the Council Meeting of May 25th, 2015 be adopted. 4. DECLARATIONS OF PECUNIARY INTEREST There were no declarations of pecuniary interest. 5. MAYOR’S COMMENTS Mayor Pellegrini highlighted the recently held and upcoming community events in the Township of King, being: the Nobleton Victoria Day Celebration and the 165th Schomberg Agricultural Fair. Mayor Pellegrini noted that newly elected Regional Chair Wayne Emmerson was in attendance at tonight’s meeting and welcomed him to King.

6. AGENDA ITEMS C.O.W. #1 Engineering and Public Works Department Report Number EPWB 2015-11 Re: Township of King Transportation Master Plan Eric Peissel, WSP Canada Inc., provided a slide presentation and reviewed the Township of King Transportation Master Plan (TMP). Mr. Peissel commented on the following: the need for a TMP; the Municipal Class EA Planning Process; existing road network, classification and issues; sightline and roadway geometry; current conditions; existing transportation; 2031 future conditions; GTA West corridor Environmental Assessment; Highway 427 extension; transportation issues; future improvements; village centre concepts and street typologies; proposed municipal/regional truck routes; York Region proposed road network improvements (10 Year Capital Plan); candidate roads segments for transfer to York Region; potential transit network connectivity; traffic calming; community engagement; and TMP implementation and cost. Mr. Peissel responded to questions. DEPUTATIONS (i) Dennis Mooney Mr. Mooney questioned where the vision is in the Plan and expressed concerns with; increased traffic; increase in GO traffic; growing infrastructure; how to handle the impacts from big businesses; future population growth; pedestrian and cycling lanes; increase in truck traffic; and need for an increase in Regional involvement. Mr. Mooney commented on the timing of the public information sessions and how the report doesn’t identify the Township’s future needs. Committee recommends that the deputation by Mr. Mooney be received. Committee provided the following comments for consideration: include a list of potential roads for future uploading to the Regional level; accurate mapping of sidewalks; cycling paths be made mandatory when considering road improvements on major roadways; clarification of types of roads; better clarification on traffic calming measures; line painting for parking during off peak hours on King Road; transit concerns; Metrolinx and future parking at the GO Station; how to deal with increased truck traffic; King’s need for a by-pass around Nobleton and King City; ensure the Plan clearly identifies to the Province and Regional Municipality of York, King’s vision for the future; and how other Plans (i.e. GTA East/West corridor) align with King’s vision. Committee considered Engineering and Public Works Department Report Number EPWB-2015-11 to present the final Transportation Master Plan for the Township of King. Committee recommends that comments submitted this evening be considered and as such, the Engineering and Public Works Department Report Number EPWB-2015-11 be Deferred to the June 8th, 2015 meeting.

Engineering and Public Works Department Report Number EPWB 2015-21 Re: Award of Consulting Services for Municipal Engineering Services Related to Roads and Structure Needs Report – RFP 2015-P11 Committee considered Engineering and Public Works Department Report Number EPWB 2015-21 to seek approval to award the contract for the consulting assignment for the Municipal Engineering Services Related to Roads and Structures Needs Report. Committee recommends that Engineering and Public Works Department Report Number EPWB 2015-21 be received, and the recommendations therein be approved, as follows:

a) That Chisholm Fleming & Associates (CFA), with a total bid in the amount of $59,995.00 (excluding H.S.T.) being the only bidder with respect to Requests for Proposal (RFP) 2015-P11, be awarded the Contract to undertake the Consulting assignment for Municipal Engineering Services Related to Roads and Structures Needs Report.

b) That a by-law be passed at the May 28th 2015 Council meeting authorizing

the Mayor and Clerk to execute an agreement between Chisholm Fleming & Associates (CFA) and the Township.

C.O.W. #3 Parks, Recreation and Culture Department Report Number PRC-2015-21 Re: Shared Use Agreement with York Region District School Board Committee considered Parks, Recreation and Culture Department Report Number PRC-2015-21 to authorize a partnership with the York Region District School Board to utilize their playing fields during the 2015 spring/summer seasons. Committee recommends that Parks, Recreation and Culture Department Report Number PRC-2015-21 be received, and the recommendations therein be approved, as follows:

a) Report PRC-2015-21 be received as information; b) That the Mayor and Clerk be authorized to execute the necessary

agreements with the York Region District School Board; c) That the necessary By-law be approved at the May 25, 2015 meeting of

Parks, Recreation and Culture Department Report Number PRC-2015-22 Re: Parks and Recreation Month

Committee considered Parks, Recreation and Culture Department Report Number PRC-2015-22 to provide an overview of departmental programs, events and services occurring during June 2015 – Parks and Recreation Month within the Township of King.

Committee recommends that Parks, Recreation and Culture Department Report Number PRC-2015-22 be received, and the recommendations therein be approved, as follows:

a) That Council report PRC-2015-22 be received as information. C.O.W. #5 Planning Department Report Number P-2015-21 Re: Application to Lift the Holding (H) Symbol, File No.: Z-2014-03 Application for Site Plan Development Approval, File No.: SPD-14-23 Plan 65M4163, Block 10 65 Dillane Drive, Schomberg Owner/Applicant: Tal Kang Committee considered Planning Department Report Number P-2015-21 to advise and make recommendations with respect to the removal of the ‘Holding’ (H) symbol restriction on the subject lot and to approve a development plan in accordance with the site plan control policies of the Schomberg Community Plan. Committee recommends that Planning Department Report Number P-2015-21 be received, and the correspondence from N. Malhotra, be received, and the recommendations therein be approved, as amended, as follows:

A) That Planning Report P-2015-21 be received. B) That Zoning By-law Amendment application file number Z-2014-03 to

remove the Holding (H) symbol and Site Plan application file number SPD-14-23, submitted by Tal Kang to permit the commercial development of the lands described as Block 10 on Plan 65M4163 located at the south east corner of Highway 27 and Dillane Drive BE APPROVED subject to the matters outlined in Recommendations ‘C’, ‘D’, ‘E’ and ‘F’;

C) That Council enact amending By-law No. 2015-55 to remove the Holding

(H) symbol from the zone for the subject lands, attached as Appendix 1; D) That prior to the execution of the Site Plan Development Agreement, the

Applicant shall address the following matters: i) Engineering review matters including the comments issued by R.J.

Burnside & Associates, dated April 17, 2015 and further recommendations and comments prepared by Township Engineering staff in an email dated May 12, 2015 be addressed to the satisfaction of the Director of Engineering, Public Works and Building;

ii) Revise the building elevation plans/signage plans to remove the back-

lighting component and further, identify that all proposed signage for the building shall be lit by overhead or below mounted lamps and not back lit sources;

iii) The Applicant shall submit engineered certified drawings for the

proposed retaining wall together with confirmation from the abutting property owner for consent to the proposed design;

iv) Region of York site plan matters, including comments issued by email

dated, May 7th, 2015, shall be addressed to the satisfaction of the Region, including any related conditions for inclusion in the Site Plan Development Agreement;

v) That a subsurface investigation be undertaken to identify any need for

dewatering and/or groundwater depressurization and where applicable, submit a detailed dewatering plan prepared by a qualified professional to the Region for approval prior to conducting site alterations or excavations;

vi) The submission of a final complete set of plans (site plan,

architectural/elevations, landscaping and engineering) as approved by the Director of Engineering, Public Works and Building in consultation with the Director of Planning and other applicable agencies for inclusion in the Site Plan Development Agreement.

E) That Prior to the issuance of a Building Permit, the Owner shall enter into a

Site Plan Development with the Township to be registered on title; together with a submission of a financial security to the Township of King to the satisfaction of the Director of Planning to ensure that the proposed works are carried out in accordance with the approved plans and that such deposit shall be held by the Township until such time the Owner has completed the various components of the development. The Site Plan Development Agreement shall include provisions addressing the following, together with the Township’s standard Site Plan Development Agreement:

i) That the Owner submit to the Township an Engineering Review fee in

the amount of 6% of the total estimated construction costs (external of building footprint), upon execution of the Site Plan Development Agreement;

ii) That the Owner submit the required fees for the purchase of a water

NEW BUSINESS C.O.W #6 Parks, Recreation and Culture Summer Program Re: One on One Programs for Youth with Special Needs Councillor Mortelliti asked that staff report back on how King can offer and support the financing/subsidizing of “one on one” summer camp programs for youth with special needs, and that the report includes municipal comparators, budgetary impacts and potential funding sources for such a subsidy. Motion Carried. 8. ADJOURNMENT A motion was made by Committee and carried that the Committee of the Whole Meeting of May 25th, 2015 be adjourned. The meeting adjourned at 8:22 p.m.

BY-LAW NUMBER 2015-59

A BY-LAW TO SET TAX RATES FOR THE YEAR 2015 AND TO PROVIDE FOR THE LEVY AND COLLECTION OF RATES OR LEVIES REQUIRED FOR THE TOWNSHIP OF KING FOR THE YEAR 2015

WHEREAS Section 312(2) of the Municipal Act, 2001 provides that a local municipality

shall each year pass a by-law levying a separate tax rate as specified in the by-law on the

assessment in each property class, in the local municipality rateable for local municipal

purposes.

AND WHEREAS Section 312 (6) of the said Act requires tax rates to be established to:

1) raise an amount equal to the general local municipal levy;

2) be in the same proportion to each other as the tax ratios established under

Section 308.

AND WHEREAS the 2015 tax levy for all purposes has been set at $63,420,808 in

which the Township portion is $23,569,547;

AND WHEREAS certain regulations require reductions in certain tax rates for certain

classes or subclasses of property;

AND WHEREAS Committee of the Whole report of the Regional Municipality of York

passed on the 23rd day of April, 2015 established tax ratios pursuant to Section 308(5) of

the Municipal Act, 2001 as shown on Schedule “A” to this by-law;

AND WHEREAS By-law Number 2015-25 of the Regional Municipality of York, passed

on the 23rd day of April, 2015, levied certain amounts against the Township and the tax

rates necessary to raise these amounts are included in the tax rates shown on Schedule “A”

to this By-law;

AND WHEREAS the Education Act, O. Reg. 400-98 as amended by O. Reg. 445/12

prescribes the education rates to be levied on the whole assessment in each property class,

these tax rates are included in the tax rates shown on Schedule “A” to this By-law;

NOW THEREFORE the Council of the Corporation of the Township of King HEREBY ENACTS AS FOLLOWS:

1. THAT for the year 2015 the tax rates as shown on Schedule “A” to this by-law

are hereby adopted to be applied against the whole of the assessment for real

property in each property class shown on Schedule “A” to this by-law.

2. THAT for payments in lieu of taxes due to the Township, the amount shall be

based on the assessment roll CVA and the tax rates for the year 2015 as

shown on Schedule “A” to this by-law.

3. THAT the Treasurer shall add to the collectors roll all or any municipal charges

for utility arrears, weed cutting, municipal ditch maintenance, Holland Marsh

Maintenance, Ansnorveldt Water Debenture Charges, King City Sewer

Debenture Charges, Nobleton Sewer Debenture Charges, Tile Drain Loans,

unpaid fees or charges, or any other charges which should be levied pursuant

to any statute or by-law against the respective property chargeable therewith

and the same shall be collected by the Treasurer in the same manner and at

the same time as all other taxes or levies.

4. THAT the 2015 interim tax levy shall be shown as a reduction of the taxes

levied hereunder.

5. THAT every owner shall be taxed according to the tax rates shown on Schedule

“A” to this by-law and the taxes so levied shall become due and payable in two

(2) equal installments. The installments shall be due and payable as follows:

First Installment – July 25, 2014 Second Installment - September 25, 2014

In the event that the above dates cannot be met due to circumstances beyond

the control of Township staff, the Treasurer is authorized to amend the

installment due dates accordingly.

6. THAT the Treasurer shall mail or cause to be mailed the notice specifying the

amount of taxes payable by any person liable for taxes addressed to them at

their place of residence, or business as shown on the latest assessment roll, or

other location as may be requested by the person from time to time.

7. THAT taxes are payable at the Township of King Municipal Offices, by mail or

at any participating chartered bank or financial institution in Canada.

8. THAT as provided in Section 345 of the Municipal Act, 2001, if the taxes or any

class or installment thereof so levied in accordance with this by-law remain

unpaid on the due date, a penalty of one and one quarter per cent (1.25%) of

the unpaid taxes may be levied on the first day of default and shall be levied on

the first day of the next calendar month following the due date and a further one

and one quarter per cent (1.25%) of the taxes remaining unpaid shall be levied

on the first day of each calendar month thereafter for so long as there are taxes

remaining unpaid, until December 31, 2015.

9. THAT as provided in Section 354(i) of the Municipal Act, 2001, if any taxes

levied pursuant to this by-law remain unpaid as of December 31, 2015, interest

at the rate of one and one quarter per cent (1.25%) of the taxes remaining

unpaid shall be levied on January 1, 2016 and the first day of each calendar

month thereafter for so long as the taxes remain unpaid.

THE CORPORATION OF THE TOWNSHIP OF KING

BY-LAW NUMBER – 2015 - 60 A BY-LAW TO AMEND ZONING BY-LAW NUMBER 74-53, AS AMENDED WHEREAS Zoning By-law Number 74-53, being a By-law to regulate the use of

land and the character, location and use of buildings and structures in the Township of

King, was passed on the 7th day of October, 1974;

AND WHEREAS it is deemed necessary to further amend By-law Number 74-53,

WHEREAS Zoning By-law Number 74-53, being a By-law to regulate the use of land

and the character, location and use of buildings and structures in the Township of King, was

amended, the matters herein set out are in conformity with the Official Plan of the Township of

King, as amended, which is approved and in force and at this time, and with Amendment No.

1970 to the Official Plan for the Township of King, known otherwise as the Oak Ridges Moraine

Conservation Plan conformity amendment, which is also approved and in force at this time;

AND WHEREAS authority is granted pursuant to Section 34 of the Planning Act, R.S.O.

1990, Chapter P.13, to the Council of the Corporation of the Township of King to exercise such

powers;

NOW THEREFORE the Council of the Corporation of the Township of King HEREBY ENACTS AS FOLLOWS: 1. THAT the lands subject to this By-law consist of Part Lot 31, Concession 4 (Part West

Half), Township of King, Regional Municipality of York as shown in thick bold outlining,

on Schedule "1" attached hereto, and that Schedule "1" forms part of this By-law.

"22.200 Exception re: Part Lot 31, Conc. 4, Part West Half, Township of King Notwithstanding the provisions of Sections 6.30(ii) and 22 of this By-law, the lands delineated as a “Rural General (RU1)” zone and shown as “Exception – Sections 6.30(ii)(116) and 22.200 on Schedule “A” of this By-law may be used for “Rural General (RU1)” purposes provided that: (i) the additional dwelling permitted as per Section 6.30(ii)(116) shall be

used for the residential accommodation of a person or persons and their family only if such person is employed on the lands as full-time farm help;

-2- By-law 2015-66 (ii) the Floor Area Maximum of the additional dwelling, as per clause (i) shall

be 300 square metres; and (iii) the additional dwelling, as per clause (i) shall not be permitted within the

Oak Ridges Moraine Feature Protection (ORMFP) zone as shown in cross-hatching on Schedule 1 attached hereto.

5. EXCEPT where specifically provided for herein, the use of the lands subject to this by-

law shall comply with all other provisions of Zoning By-law Number 74-53, as amended.

6. THAT this By-law shall come into force on the day it was passed where no notice of

appeal has been filed with the Township Clerk in accordance with the requirements and

within the time prescribed under Section 34(19) of the Planning Act.

THE CORPORATION OF THE TOWNSHIP OF KING BY-LAW NUMBER 2015-67

A BY-LAW TO AUTHORIZE THE MAYOR AND CLERK TO EXECUTE A CERTAIN SITE PLAN DEVELOPMENT AGREEMENT BETWEEN MARINA KHAJETOORIAN AND EDMOND KHAJETOORIAN AND THE CORPORATION OF THE TOWNSHIP OF KING

WHEREAS the Council of the Corporation of the Township of King deems it

advisable to enter into a Site Plan Development Agreement with the owner of Lot 14, Plan 162,

Township of King;

NOWTHEREFORE the Council of the Corporation of the Township of King HEREBY ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk are hereby authorized and directed to execute a certain Site

Plan Development Agreement dated June 8, 2015, between Marina Khajetoorian and

Edmond Khajetoorian and the Corporation of the Township of King, attached as Schedule

“A” hereto, for the development of the lands described as Lot 14, Plan 162, (Lot 22,

Concession 6) Township of King and as more particularly described on Schedule “B”

attached hereto.

A BY-LAW TO CONFIRM THE PROCEEDINGS OF COUNCIL AT ITS

MEETING HELD ON JUNE 8TH, 2015

The Council of the Corporation of the Township of King HEREBY ENACTS AS FOLLOWS: 1. The action of Council in respect of each motion, resolution and other action passed and

taken by the Council at its said meeting is, except where the prior approval of the

Ontario Municipal Board is required, hereby adopted, ratified and confirmed.

2. The Mayor and the proper officers of the Municipality are hereby authorized and directed

to do all things necessary to give effect to the said action or to obtain approvals where

required, and, except where otherwise provided, the Mayor and Clerk are hereby

directed to execute all documents necessary in that behalf, and the said Clerk is hereby

authorized and directed to affix the corporate seal of the Municipality to all such

documents.
